CIRCULAR
Providing detailed
regulations and guidance on certain Articles of the Law on Chemicals and Decree
No. 26/2026/ND-CP of the Government providing detailed regulations and guidance
on certain Articles of the Law on Chemicals regarding the management of
chemical-related operations and hazardous chemicals in products and goods
Pursuant to Law on
Chemicals No. 69/2025/QH15;
Pursuant to Decree No.
26/2026/ND-CP of the Government providing detailed regulations and guidance on
certain Articles of the Law on Chemicals regarding the management of
chemical-related activities and hazardous chemicals in products and goods;
Pursuant to Decree No.
40/2025/ND-CP of the Government on functions, tasks, powers and organizational
structure of the Ministry of Industry and Trade;
At the request of the
Director of Vietnam Chemicals Agency,
The Ministry of
Industry and Trade hereby promulgates a Circular providing detailed regulations
and guidance on certain Articles of the Law on Chemicals and Decree No.
26/2026/ND-CP of the Government providing detailed regulations and guidance on
certain Articles of the Law on Chemicals regarding the management of
chemical-related activities and hazardous chemicals in products and goods.

This Circular provides
detailed regulations and guidance on:
a) Delegation of
authority to carry out procedures for issuing, reissuing, and amending licences
for manufacturing and trading, licences for manufacturing and trading of group
1 or group 2 chemicals requiring special control; issuing, reissuing, amending,
and renewing licences for export and import of group 1 or group 2 chemicals
requiring special control;
b) Content and form of
a safety data sheet (SDS);
c) Logging of the
manufacture, import, use, and storage of chemicals under the state management
by the Ministry of Industry and Trade;
d) Forms, deadlines,
methods and procedures for creating slips, checking items and selling chemicals
requiring special control in the Chemical Industry Database;
dd) List of hazardous
chemicals in products and goods that must be publicly disclosed within the
management scope of the Ministry of Industry and Trade;
e) Forms used in
administrative procedures include: issuance, reissuance or amendment to the
licence to import prohibited chemicals; issuance, reissuance or amendment to
the licence to manufacture prohibited chemicals; plan for controlling and
preventing the loss of prohibited chemicals; logbook for monitoring the
manufacture, import, use, and storage of prohibited chemicals; issuance,
reissuance or amendment to the licence to manufacture and trade chemicals
requiring special control; issuance, reissuance, amendment and renewal of the
licence to export or import chemicals requiring special control; plan for
controlling and preventing the loss of chemicals requiring special control;
record of purchase and sale of chemicals requiring special control; issuance,
reissuance, and amendment of the Certificate of eligibility for conditional
manufacturing and trading of chemicals; issuance, reissuance or amendment of
the Certificate of eligibility for providing chemical storage services;
registration of new chemicals; declaration information and feedback on the
declaration of imported chemicals via the Vietnam National Single Window.

Industry Database;

2. This Circular
applies to:
This Circular applies
to domestic agencies, organizations and individuals and foreign organizations
and individuals performing chemical-related operations in the territory of
Vietnam.
Article 2.
Interpretation of terms
1. Group 1 chemicals
requiring special control include Group 1 chemicals specified in Appendix III
of Decree No. 24/2026/ND-CP.
2. Group 2 chemicals
requiring special control include Group 2 chemicals specified in Appendix III
of Decree No. 24/2026/ND-CP.
Article 3. Delegation
of authority to carry out administrative procedures on chemicals under the
management of the Ministry of Industry and Trade
1. The People's
Committee of the province where the organization or individual has its
headquarters shall:

b) Receive
applications, issue, reissue, amend or renew export or import licences for
chemicals requiring special control for organizations or individuals exporting
or importing group 2 chemicals requiring special control.
2. Vietnam Chemicals
agency shall
a) Receive
applications, appraise or assess the actual conditions for procedures related
to the issuance, reissuance and amendment to licences to manufacture prohibited
chemicals in the industrial field; receive and appraise applications for the
issuance, reissuance or amendment to licences to import prohibited chemicals
under the state management of the Ministry of Industry and Trade;
b) Receive
applications, organize appraisals, issue, reissue or amend licences to
manufacture, licences to trade, licences to manufacture and trade chemicals
requiring special control for organizations engaged in the manufacturing and
trading of Group 1 chemicals requiring special control, and organizations
engaged in the manufacturing and trading of both group 1 chemicals and group 2
chemicals;
c) Receive
applications, issue, reissue, amend or renew export or import licences for
group 1 chemicals requiring special control;
d) Receive
applications, organize appraisals, issue, reissue or amend Certificates of
eligibility for providing chemical storage services for storage facilities
required to develop a Chemical incident prevention and response plan
(accidental release plan) as appraised by the Ministry of Industry and Trade;
dd) Receive
applications, organize appraisals of new chemicals;
e) Receive declared
information on imported chemicals.
Article 4. Organization
of appraisals for issuing licences to manufacture, licences to trade, licences
to manufacture and trade group 2 chemicals requiring special control

a) In the case where
the organization conducts manufacture, trading or storage activities only in
the administrative division where its headquarters are located and does not
conduct manufacture, trading or storage activities in any other division:
The Provincial People's
Committee shall carry out the procedures for issuing the Licence in accordance
with the provisions specified in Clause 5, Article 13 of Decree No.
26/2026/ND-CP.
b) In the case where
the organization conducts manufacture, trading or storage activities in the
administrative division different from the division where its headquarters are
located:
Within 03 working days
from the date of receiving a complete and valid application, the Provincial
People’s Committee where the organization submitted their application is
responsible for sending a copy of the application for a licence to manufacture
and trade group 2 chemicals requiring special control to the People’s Committee
of the province where the organization’s chemical manufacturing and trading
facility is located to obtain their opinion.
Within 10 working days
from the date of receiving the copy of the application, the People's Committee
of the province where the chemical manufacturing and trading facility is
located shall be responsible for inspecting the actual conditions of chemical
manufacturing and trading facilities under its management and providing a
written confirmation of the compliance with the prescribed conditions.
The provincial People's
Committee where the organization submitted its application is responsible for
reviewing, evaluating the application, and issuing a Certificate of eligibility
to the organization within 03 working days from the date of receipt of the
written confirmation of the compliance with the prescribed conditions from the
People's Committee of the province where the chemical manufacturing and trading
facility is located, and simultaneously sending it to relevant units for
coordinated management. In case the licensing is rejected, the licensing
authority must provide explanation in writing.
2. In the case where an
organization that has already been granted a licence to manufacture and trade Group
2 chemicals requiring special control by the Provincial People's Committee
which is still valid intends to manufacture and trade Group 1 chemicals
requiring special control, the organization shall prepare and submit an
application for issuance of a new licence to Vietnam Chemicals Agency. Vietnam
Chemicals Agency shall carry out the procedures for issuing the Licence in
accordance with the provisions specified in Clause 5, Article 13 of Decree No.
26/2026/ND-CP.
3. After issuing the
licence, within 7 working days, the competent authority shall update the
Licence in the relevant database for coordinated monitoring and management.

Article 6. Forms used
in chemical management
1. The forms used in
the procedure for issuance, reissuance, and amendment to a licence to import
prohibited chemicals are prescribed in Appendix II enclosed herewith,

12. Forms of
declaration and response to the declaration of imported chemicals through
Vietnam National Single Window is stipulated in Appendix XIII enclosed
herewith, including:
a) Form No. 13a: Form
of declaration of imported chemicals through Vietnam National Single Window;
b) Form No. 13b: Form
of response to the declaration of imported chemicals through Vietnam National
Single Window;
13. Forms of
registration and notification of the enterprise’s successful registration in
the Chemical Industry Database are specified in Appendix XIV enclosed herewith.
Article 7. Principles
of chemical classification
Organizations and
individuals that manufacture or import chemicals are obliged to classify
chemicals in accordance with the guidelines in Appendix XV enclosed herewith or
in accordance with the classification principles of the Globally Harmonized
System of Classification and Labeling of Chemicals (GHS) from version 2 of 2007
onwards.
Article 8. Record of
purchase and sale of chemicals requiring special control
1. From January 1,
2026, within 10 days from the date of delivery, the organization trading
chemicals included in the list of chemicals requiring special control must
prepare a record of purchase and sale of chemicals requiring special control
using the form in Appendix IX enclosed herewith through the System for chemical
identification and origin tracking of chemicals requiring special control on
the electronic identification and authentication platform managed by the
Ministry of Public Security.
2. Vietnam Chemicals
Agency is responsible for ensuring the infrastructure to facilitate the entry
of information on the records of purchase and sale of chemicals requiring
special control in the Chemical Industry Database from the date the System for
chemical identification and origin tracking of chemicals requiring special
control is officially announced.

Chemicals banned for
use in the industry and trade sector include prohibited chemicals prescribed in
the Investment Law, except in cases where competent authorities grant
permission.
Article 10. Digital
transformation in state management of chemicals
1. The Chemical
Industry Database includes the following data:
a) Data on chemicals,
chemical-related activities, the chemical industry, and hazardous chemicals in
products and goods;
b) Data on the National
chemical list and the Foreign chemical list recognized by the competent
regulatory authorities of the Socialist Republic of Vietnam;
c) Data on the
implementation of chemical-related administrative procedures.
d) Data provided
annually by organizations and individuals;
dd) Data on the content
of a record of purchase and sale of chemicals requiring special control.
2. The information
shall be shared on the relevant database using the information form prescribed
in Appendix XVI enclosed herewith.

4. Information on
chemical types and intended uses of chemicals requiring special control is
published on the Chemical Industry Database in accordance with the form in
Appendix XVIII enclosed herewith.
5. Vietnam Chemicals
Agency is responsible for developing, operating, maintaining, updating,
upgrading and enhancing a comprehensive and modern database, ensuring
information security and cybersecurity, with the capability to connect with the
Ministry of Industry and Trade's public service portals and other relevant
databases; developing mechanisms for sharing and using information from the
Chemical Industry Database; leading the development of the function of
disclosing information on hazardous chemical content in products and goods;
leading the development of the function of disclosing the chemical types and
intended uses of chemicals requiring special control based on the Chemical
Industry Database.
6. Vietnam E-commerce
and Digital Economy Agency (iDEA) shall take charge and cooperate with Vietnam
Chemicals Agency in developing functions of issuing, reissuing, amending and
revoking Certificates and Licences (for certificates of conditional
manufacturing and trading of chemicals, licences to manufacture, trade, export
and import chemicals requiring special control, and certificates of eligibility
for providing chemical storage services) through the Ministry of Industry and
Trade's public service portal, as well as to share and synchronize data with
the Chemical Industry Database.
Article 11. Hazardous
chemicals in products and goods without technical regulations
1. The list of
hazardous chemicals in products and goods requiring information disclosure in
the industry is issued in Appendix XIX enclosed herewith.
2. Vietnam Chemicals
Agency shall receive feedback on the list specified in clause 1 of this
Article, review and assess the necessity and propose to the Minister of
Industry and Trade to update and supplement the list of hazardous chemicals
requiring information disclosure under the management of the Ministry of
Industry and Trade.
Article 12. Effect
1. This Circular comes
into force from January 17, 2026.
2. Circular No.
32/2017/TT-BCT and Circular No. 17/2022/TT-BCT shall be invalid from the day on
which this Circular comes into force.

4. Any difficulties
arising during the implementation of this Circular should be reported to the
Ministry of Industry and Trade (via Vietnam Chemicals Agency) for prompt

The Licence shall be kept at the headquarters and presented upon request by
competent authorities.

The Licence must not be transferred, leased, lent, or pledged.
4.
The licensing authority (1) shall be notified in the event of any changes to
the conditions of the licensed entity (business registration, taxpayer
identification number (TIN), location, scale, etc.).
5.
The licensing authority (1) shall be notified upon termination of
manufacturing activities or in cases the Licence is lost or damaged.
6.
The sale of prohibited chemicals is not permitted.
7.
Manufacture shall be carried out strictly within the approved scale and the
substances shall be used solely for the intended purpose.
7.
The Licence shall be returned to the licensing authority upon its expiry.

for Classification of explosives
Chemicals, which are not classified as an
unstable explosive, are assigned to one of the following six divisions
depending on the type of hazard they present:
1. Division 1.1: Substances, mixtures which
have a mass explosion hazard. A mass explosion is one which affects almost the
entire quantity present virtually instantaneously.
2. Division 1.2: Substances, mixtures which
have a projection hazard but not a mass explosion hazard.
3. Division 1.3: Substances, mixtures which
have a fire hazard and either a minor blast hazard or a minor projection hazard
or both, but not a mass explosion hazard: (i) combustion of which gives rise to
considerable radiant heat; or (ii) which burn one after another, producing
minor blast or projection effects or both.

5. Division 1.5: Substances and mixtures which
have a mass explosion hazard but are so insensitive that there is very little
probability of initiation or of transition from burning to detonation under normal
conditions.

no likelihood of initiation or propagation of an explosion.

Series 3(c) (Sub-section 13.6.1 of the UN Recommendations on the Transport of

to allocate the correct Division.
Notes:
Unstable explosives are those which are
thermally unstable and/or too sensitive for normal handling, transport and use.
Special precautions are necessary. This comprises substances and mixtures which
are manufactured with a view to producing an explosive or pyrotechnic effect:
- Explosive substances or mixtures in packaged
form may be classified under divisions 1.1 to 1.6 and, for some regulatory
purposes, are further subdivided into compatibility groups A to S to
distinguish technical requirements (see UN Recommendations on the Transport of
Dangerous Goods, Model Regulations, Chapter 2.1);
- Some explosive substances and mixtures are
wetted with water or alcohols, diluted with other substances to suppress or
reduce their explosives properties. Desensitized explosives may be treated
differently from explosive substances and mixtures for some regulatory purposes
(e.g. transport);
- For classification tests on solid substances
or mixtures, the tests should be performed on the substance or mixture as
presented. E.g. the chemicals should be tested again if they are supplied or
transported in the other form. <0}

3. CRITERIA FOR CLASSIFICATION OF flammable aerosols
Aerosols shall be considered for classification
as flammable of they contain any composition classified as flammable according
to the GHS criteria, such as: flammable liquids (see part VI); flammable gases
(see part VII); flammable solids (see Part VIII). Aerosols shall be classified
as Category 1 or Category 2 if they contain more than 1% components (by mass)
which are classified as flammable according to the GHS criteria. Aerosols that
do not meet the criteria for Category 1 or Category 2 shall be classified as
Category 3.
Notes: Flammable components do not cover pyrophoric,
self-heating or water-reactive substances because such components are never
used as aerosol contents.

7. Classification criteria for flammable solids
Powdered, granular or pasty substances or
mixtures shall be classified as readily combustible solids when the time of
burning of one or more of the test runs, performed in accordance with the test
method described in the Manual of Tests and Criteria, Part III, subsection
33.2.1, is less than 45 s or the rate of burning is more than 2,2 mm/s.
- Metal powders shall be classified as
flammable solids when they can be ignited and the reaction spreads over the
whole length of the sample (100 mm) in 10 min or less.
- A flammable solid is classified in one of the
two categories for this class using method N1 as described in subsection 33.2.1
of the Manual of Tests and Criteria, according to the following table:

1. Any self-reactive substance or mixture
should be considered for classification in this class unless:

possessing explosive properties and which, as packaged, neither detonates nor

which, in laboratory testing, neither detonates in the cavitated state nor
deflagrates at all and shows low or no effect when heated under confinement as
well as low or no explosive power, provided that it is thermally stable
(self-accelerating decomposition temperature is 60 °C to 75°C for a 50 kg
package), and, for liquid mixtures, a diluent having a boiling point greater
than or equal to 150°C is used for desensitization will be defined as
selfreactive substance TYPE G.
If the mixture is not thermally stable or a
diluent having a boiling point less than 150°C is used for desensitization, the
mixture shall be defined as self-reactive substance TYPE F.

a) Inhalation cut-off values in the table are
based on 4 hour testing exposures. Conversion of existing inhalation toxicity
data which has been generated according to 1 hour exposures should be by
dividing by a factor of 2 for gases and vapours and 4 for dusts and mists;
b) It is recognized that saturated vapour
concentration may be used as an additional element by some regulatory systems
to provide for specific health and safety protection;
c) For some substances the test atmosphere will
not just be a vapour but will consist of a mixture of liquid and vapour phases.
For other substances the test atmosphere may consist of a vapour which is near
the gaseous phase. In these latter cases, classification should be based on

defined are defined in relation to acute inhalation toxicity testing under the
OECD Test Guidelines;
d) The values for dusts and mists should be
reviewed to adapt to OECD Test Guidelines with respect to technical limitation
in generating, maintaining and measuring dust and mist concentrations in

e) Criteria for Category 5 are intended to
enable the identification of substances which are of relatively low acute
toxicity hazard but which under certain circumstances may present a danger to
vulnerable populations. These substances are anticipated to have an oral or
dermal LD50 in the range of 2000-5000 mg/kg bodyweight and
equivalent doses for inhalation. The specific criteria for Category 5 are:

2. Classification
criteria for skin corrosion/irritation
2.1. Skin corrosion
Skin corrosion substances should be classified
in the only category in Table 5 following the results of an animal test. A substance
is corrosive to skin when it produces destruction of skin tissue, namely,
visible necrosis through the epidermis and into the dermis, in at least one of
the 3 tested animal after exposure for at least 4 hours. Corrosive reactions
are typified by ulcers, bleeding, bloody scabs. By the end of observation at 14
days, by discolouration due to blanching of the skin, complete areas of
alopecia, and scars. Histopathology should be considered to evaluate
questionable lesions.
Depending on each specific case, this category
may be further divided into sub-categories as follows: (Category 1, see Table 5):
sub-category 1A, where corrosive responses are noted following up to 3 minutes
exposure and up to 1 hour observation; sub-category 1B, where corrosive responses
are described following exposure greater than 3 minutes and up to 1 hour and
observations up to 14 days; and sub-category 1C, where corrosive responses
occur after exposures greater than 1 hour and up to 4 hours and observations up
to 14 days.

- Irreversible skin lesions serve as a
criterion for evaluating irritant responses. When inflammation persists to the
end of the observation period in 2 or more tested animals, taking into consideration
alopecia (limited area), hyperkeratosis, hyperplasia and scaling, then a
substance should be considered to be an irritant.
Animal irritant responses within a test can be
variable, as they are with corrosion. A separate irritant criterion accommodates
cases when there is a significant irritant response but less than the mean
score criterion for a positive test. For example, a test chemical might be
designated as an irritant if at least 1 of 3 tested animals shows a very
elevated mean score throughout the study, including lesions persisting at the
end of an observation period of normally 14 days. However, it should be
ascertained that the responses are the result of chemical exposure.

given in Table 6.

potential for humans; the placing of a substance is largely based on animal
evidence.
Based on strength of evidence together with
additional considerations, such evidence may be derived from human studies
that establish a causal relationship between human exposure to a substance
and the development of cancer (known human carcinogen). Alternatively,
evidence may be derived from animal experiments for which there is sufficient
evidence to demonstrate animal carcinogenicity (presumed human carcinogen).
In addition, on a case by case basis,
scientific judgement may warrant a decision of presumed human carcinogenicity
derived from studies showing limited evidence of carcinogenicity in humans
together with limited evidence of carcinogenicity in experimental animals.

TOXICITY
Reproductive toxicants are allocated to one of
two categories as follows: Effects on sexual function and fertility, and on
development, are considered.
In addition, effects on lactation are allocated
to a separate hazard category.

raises doubt about the relevance of the effect for humans, classification in
Category 2 may be more appropriate.
Category 2: Suspected human reproductive toxicant
(Presumed to cause adverse effects on sexual function or on development)
This category includes substances for which
there is some evidence from humans or experimental animals, possibly
supplemented with other information, of an adverse effect on sexual function
and fertility, or on development, in the absence of other toxic effects, or
if occurring together with other toxic effects the adverse effect on
reproduction is considered not to be a secondary non-specific consequence of
the other toxic effects, and where the evidence is not sufficiently
convincing to place the substance in Category 1.

Effects on or via lactation
Effects on or via lactation are currently
considered as a single category. It is appreciated that for many substances
there is no information on the potential to cause adverse effects on the
offspring via lactation. However, substances which are absorbed by women and
have been shown to interfere with lactation, or which may be present
(including metabolites) in breast milk in amounts sufficient to cause concern
for the health of a breastfed child, should be classified to indicate this
property hazardous to breastfed babies. This classification can be assigned
on the basis of:
- absorption, metabolism, distribution and
excretion studies that would indicate the likelihood the substance would be
present in potentially toxic levels in breast milk; and/or
- results of one or two generation studies in

criteria for hazards to the aquatic environment
Classification system consists of 3 acute
classification categories and 4 chronic classification categories (see Table 36
and Table 37). The acute and chronic classification categories are applied
independently. The criteria for classification of a substance in Acute 1 to 3
are defined on the basis of the acute toxicity data only (EC50 or LC50). The
criteria for classification of a substance into Chronic toxicity are defined on
