CIRCULAR
On certain measures
for implementation of the Law on Chemicals and Decree No. 25/2026/ND-CP of the
Government providing detailed regulations and measures for organization of and
guidance on certain Articles of the Law on Chemicals on development of chemical
industry and chemical safety and security
Pursuant to Law on Chemicals No.
69/2025/QH15;
Pursuant to Decree No.
40/2025/ND-CP of the Government on functions, tasks, powers and organizational
structure of the Ministry of Industry and Trade amended by Decree No.
109/2025/ND-CP and Decree No. 193/2025/ND-CP;
Pursuant to Decree No.
25/2026/ND-CP of the Government providing detailed regulations and measures for
organization of and guidance on certain Articles of the Law on Chemicals on
development of chemical industry and chemical safety and security;
At the request of the Director
of Vietnam Chemicals Agency;
The Minister of Industry and
Trade hereby promulgates a Circular on certain measures for implementation of
the Law on Chemicals and Decree No. 25/2026/ND-CP of the Government providing
detailed regulations and measures for organization of and guidance on certain
Articles of the Law on Chemicals on development of chemical industry and
chemical safety and security.

certificate of eligibility for chemical industry consulting

Article 2.
Regulated entities
This Circular applies to agencies,
organizations and individuals performing chemical-related activities in the
territory of the Socialist Republic of Vietnam.

Entering numbers of certificates and forms used in the issuance, reissuance,
amendment or revocation of certificates of eligibility for chemical industry
consulting

a) The number of the newly issued
certificate shall be recorded according to the personal identification number
(PIN) for citizens of the Socialist Republic of Vietnam or according to the
number of the work permit or the number of the certificate of exemption from
work permit in Vietnam for foreigners;
b) The number of the amended
certificate shall be recorded according to the structure: (number of newly
issued certificate).XX, in which XX represents the sequential number of
amendments;
c) The number of the reissued
certificate shall be recorded according to the number of the certificate issued
in the most recent previous instance.
2. The forms used for issuance,
reissuance, amendment and revocation of a certificate of eligibility for
chemical industry consulting are prescribed in Appendix I enclosed herewith,
including:
a) Form No. 01a: Form of a written
request for issuance, reissuance or amendment to the certificate of eligibility
for chemical industry consulting.
b) Form No. 01b: Form of the
certificate of employment (COE);
c) Form No. 01c: Form of the
confirmation of completed works made by the lawful representative of the
project developer;
d) Form No. 01d: Form of the
decision to revoke the certificate of eligibility for chemical industry
consulting.

2. Forms used in the assessment and
approval of a chemical release plan are prescribed in Appendix III enclosed
herewith, including:
a) Form No. 03a: Form of the
written request for assessment of the accidental release plan;
b) Form No. 03b: Form of the record
and notification of results of the assessment of the accidental release plan;
c) Form No. 03c: Form of the
comments on the accidental release plan made by members of the appraisal
council;
d) Form No. 03d: Form of the report
on the results of compliance with requirements of the appraisal council;
dd) Form No. 03dd: Form of the
record and report on the inspection results of the appraisal council;
e) Form No. 03e: Form of the
certification stamp affixed to the cover of the approved accidental release
plan.
3. Vietnam Chemicals Agency shall
assess and approve to civil-related accidental release plans for entities
specified in point a clause 2 Article 33 of Decree No. 25/2026/ND-CP.

a) Time and location of the drill;
b) Drill scenarios or simulation
exercises;
c) Procedure for responding to a
simulation exercise;

and forces directly participating in the drill, vehicle and equipment serving
the drill.
2. Procedures for organizing a
chemical incident response drill shall be carried out as follows:
a) Developing an overall scenario
for the drill, including the contents stipulated in Clause 1 of this Article;
b) After developing a scenario for
the drill, the organization or individual involved in the drill shall develop
specific practical exercises for forces participating in the drill according to
the overall scenario that has been developed;
c) Organizing exercises and joint
exercises for the forces participating in the drill when necessary;
d) Organizing the drill according
to the overall scenario that has been developed;

e) Preparing a report on the
organization of the drill;
g) Implementing the procedures for
updating the drill record in the Chemical Industry Database and maintaining the
drill record for a minimum of 3 years from the date of completion of the drill.
3. A chemical incident response
drill record shall include:
a) An overall scenario for the
chemical incident response drill;
b) A list of forces and vehicles
involved in the drill;
c) A report on the organization of
the chemical incident response drill made using Form No. 04 in Appendix IV
enclosed herewith.
Article 6.
Effect
1. This Circular comes into force
from January 17, 2026.
2. Any difficulties arising during
the implementation of this Circular should be reported to the Ministry of
Industry and Trade (via Vietnam Chemicals Agency) for prompt consideration,
amendment, supplementation or guidance./.

A. Guidelines for presenting a plan or measure
1. Presentation techniques
a) Paper size
The accidental release plan or
measure shall be presented on the A4 paper (210 mm x 297 mm).
b) Presentation style
The plan or measure shall be in
portrait orientation on A4-sized paper.
c) Margins
- Top: 20 - 25 mm;

d) Fonts
- Character set: Unicode, font:

- Normal spacing (Before: 6pt;

2. Presentation of the Plan or
Measure
- The Plan or Measure shall be
brief, clear, coherent and neat without any erasures and without overusing
abbreviations or common English words. Long phrases or phrases that
rarely appear in the Plan or Measure must not be abbreviated. There shall be
interpretation of terms in cases where there are terms or abbreviations in the
Plan or Measure;
- Subsections shall be numbered
automatically. Each number shall consist of 1 to 4 digitals. Any section
with subsections shall include at least 2 of them. E.g. The subsection 2.1.1
shall be followed by subsection 2.1.2 or more;

- The Plan or Measure shall be
bound in a blue hard cover with gold embossed lettering (after revisions have
been made according to the comments from the Appraisal council). Name of
the unit and the year in which the Plan or Measure is made shall be printed on
the back (spine);
- Cover page/title page: Similar to
the front cover, printed on regular paper, with the signature of the project
developer's representative and their full name and seal;
- Table of contents: Using
automatic “Table of Contents” function in Microsoft Word;
- List of forms;
- The map of the area where the
manufacturing facility is located: color-printed on an A3 sheet;
- The map of the location where
chemicals are planned to be stored in the premise of the manufacturing facility
and the storing condition (underground, semi-underground or on the
ground): color-printed on an A3 sheet;
- The equipment placement site plan
and technology line plan, the amount of hazardous chemicals from the main
manufacturing equipment and the intermediate containing equipment:
printed on A3 sheets;
- Appendices (if any): shall be
printed on separate pages. The word “Appendix” and their ordinal numbers
(in case of multiple appendices) shall be centered on a separate line with
normal font, size 14, bold. The title (name) of the appendix shall be centered,
capitalized, bold, size 13 to 14.

1. Forecasting risky locations
A List of risky locations including
locations of main equipment for manufacturing hazardous chemicals, devices or
areas designated for the storage of hazardous chemicals along with the
manufacture and storage conditions, and the expected number of workers present
in the areas.
2. Forecasting scenarios
Forecasting typical incident
scenarios that may occur at the identified risky locations, estimating the
subsequent consequences, the scope of impact, and the degree of effect on
people and the surrounding environment if the incident is not controlled or
prevented, and classifying the incident (the determination of consequences must
