VỀ PH­ƯƠNG PHÁP XÁC ĐỊNH TỶ LỆ NỘI ĐỊA HÓA ĐỐI VỚI ÔTÔ

Quyết định số 28/2004/QĐ-BKHCN ngày 01 tháng 10 năm 2004 của Bộ trưởng Bộ Khoa học và Công nghệ về phương pháp xác định tỷ lệ nội địa hóa đối với ôtô, có hiệu lực kể từ ngày 17 tháng 03 năm 2005, được sửa đổi, bổ sung bởi:

1. Quyết định số 05/2005/QĐ-BKHCN ngày 11 tháng 5 năm 2005 của Bộ trưởng Bộ Khoa học và Công nghệ về việc sửa đổi, bổ sung Quyết định số 28/2004/QĐ-BKHCN ngày 01/10/2004 về phương pháp xác định tỷ lệ nội địa hóa đối với ô tô, có hiệu lực kể từ ngày 10 tháng 06 năm 2005;

2. Thông tư số 05/2012/TT-BKHCN ngày 12 tháng 3 năm 2012 của Bộ trưởng Bộ Khoa học và Công nghệ về việc sửa đổi, bổ sung Điều 1 Quyết định số 05/2005/QĐ-BKHCN ngày 11 tháng 5 năm 2005 của Bộ trưởng Bộ Khoa học và Công nghệ về việc sửa đổi, bổ sung Quyết định số 28/2004/QĐ-BKHCN ngày 01 tháng 10 năm 2004 về phương pháp xác định tỷ lệ nội địa hóa đối với ô tô, có hiệu lực kể từ ngày 30 tháng 4 năm 2012.

Căn cứ Pháp lệnh Chất lượng hàng hóa năm 1999;

Căn cứ Nghị định số 54/2003/NĐ-CP ngày 19/5/2003 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Khoa học và Công nghệ, Nghị định số 28/2004/NĐ-CP ngày 16/01/2004 của Chính phủ sửa đổi, bổ sung một số điều Nghị định số 54/2003/NĐ-CP ngày 19/5/2003 của Chính phủ quy định chức năng, nhiệm vụ quyền hạn và cơ cấu tổ chức của Bộ Khoa học và Công nghệ;

Căn cứ Quyết định số 175/2002/QĐ-TTg ngày 03/12/2002 của Thủ tướng Chính phủ phê duyệt chiến l­ược phát triển ngành công nghiệp ôtô Việt Nam đến năm 2010, tầm nhìn đến năm 2020;

Căn cứ chỉ đạo của Thủ tướng Chính phủ tại Thông báo số 82/TB-VPCP ngày 16/6/2003, Công văn số 4659/VPCP-KG ngày 24/9/2003, Thông báo số 63/TB -VPCP ngày 02/4/2004 và Công văn số 2943/ VPCP-KG ngày 11/6/2004 của Văn phòng Chính phủ;

Theo đề nghị của Tổng cục truởng Tổng cục Tiêu chuẩn Đo 1ường Chất lượng và Vụ trưởng Vụ Pháp chế[1],

Điều 1. Quyết định này quy định ph­ương pháp xác định tỷ lệ nội địa hóa đối với ôtô, số điểm cụ thể của các loại linh kiện và trách nhiệm của các cơ quan có liên quan trong việc xác định tỷ lệ nội địa hóa đối với ôtô.

Điều 2. Giải thích từ ngữ

Trong Quyết định này, các từ ngữ dưới đây được hiểu như sau:

1. Linh kiện được hiểu là các chi tiết, cụm chi tiết, bộ phận để lắp ráp thành ôtô hoàn chỉnh.

2. Linh kiện nội địa hóa là linh kiện được sản xuất, chế tạo trong nước thay thế phần nhập khẩu.

3. Tỷ lệ nội địa hóa của ôtô là số điểm của linh kiện nội địa hóa so với tổng số điểm của ôtô hoàn chỉnh.

Điều 3. Tỷ lệ nội địa hóa được xác định đối với từng loại linh kiện cụ thể của ôtô được xác định theo điểm của loại linh kiện đó quy định tại các Phụ lục 1, 2, 3 và 4 ban hành kèm theo Quyết định này.

Điều 4. Tỷ lệ nội địa hóa được quy định cho các giai đoạn như sau:

1. Đối với ôtô phổ thông (t­ương ứng với ôtô khách, ôtô chở hàng quy định tại Tiêu chuẩn Việt Nam 7271:2003): đạt tỷ lệ nội địa hóa 40% vào năm 2005, 45% vào năm 2006, 50% vào năm 2007, 55% vào năm 2008 và đạt 60% vào năm 2010.

Đối với động cơ đạt tỷ lệ nội địa hóa 30% vào năm 2005, 50%vào năm 2006, 40% vào năm 2007, 45% vào năm 2008 và 50% vào năm 2010 và hộp số đạt 65% vào năm 2005, 70% vào năm 2006, 75% vào năm 2007, 80% vào năm 2008, 85% vào năm 2009 và 90% vào năm 2010.

2. Về các loại ôtô chuyên dùng (quy định tại Mục 3.3 của Tiêu chuẩn Việt Nam TCVN 7271:2008): đạt tỷ lệ nội địa hóa 40% vào năm 2005, 45% vào năm 2006, 50% vào năm 2007, 55% vào năm 2008 và đạt 60% vào năm 2010.

3. Về các loại ôtô cao cấp: các loại xe du lịch do các liên doanh sản xuất (tương ứng với ôtô con quy định tại Mục 3.1.1 của Tiêu chuẩn Việt Nam TCVN 7271: 2003) phải đạt tỷ lệ nội địa hóa 20 - 25% vào năm 2005, 30-35% vào năm 2007 và 40-45% vào năm 2010.

Xe buýt cao cấp đạt tỷ lệ nội địa hóa 20% vào năm 2005, 30% vào năm 2007 và 35 - 40% vào năm 2010.

Điều 5. Xác định tỷ lệ nội địa hóa

1. Doanh nghiệp tự kê khai, đăng ký tỷ lệ nội địa hóa theo các Phụ lục 1, 2, 3, và 4 ban hành kèm theo Quyết định này để Bộ Khoa học và Công nghệ xem xét và cấp giấy xác nhận.

Bộ Khoa học và Công nghệ thành lập Tổ công tác liên ngành để kiểm tra, xác định tỷ lệ nội địa hóa đối với linh kiện của ôtô.

2. Các linh kiện ôtô mua của các doanh nghiệp khác sản xuất trong nước cũng được tính tỷ lệ nội địa hóa như­ của doanh nghiệp tự sản xuất trong nước.

3. Các doanh nghiệp nhập khẩu bán thành phẩm các chi tiết, cụm chi tiết hoặc bộ phận để gia công một hoặc nhiều công đoạn được tính tỷ lệ nội địa hóa theo tỷ lệ giá trị gia tăng của chi tiết, cụm chi tiết hoặc bộ phận đó.

4.[2] Các linh kiện ô tô do doanh nghiệp trực tiếp nhập khẩu hoặc mua của các doanh nghiệp thương mại nhập khẩu thì không được tính là nội địa hóa.

a) Mức độ rời rạc của các linh kiện ôtô nhập khẩu được quy định như sau:

- Thân vỏ ô tô (đối với ôtô con (xe du lịch), ô tô khách cỡ nhỏ (xe minibus), ô tô khách (xe bus), ca bin (đối với ô tô tải): Rời tối thiểu thành 06 cụm chính, chưa sơn tĩnh điện, bao gồm: cụm nóc, cụm sàn, cụm sườn trái, cụm sườn phải, cụm trước, cụm sau và các mảng liên kết (nếu có).

- Khung ô tô: Đã liên kết với nhau và chưa sơn tĩnh điện. Đối với khung ô tô có chiều dài từ 3,7m trở lên, được phép sơn tĩnh điện trước khi nhập khẩu.

- Động cơ: Hoàn chỉnh và có thể lắp liền với bộ ly hợp và hộp số.

- Hệ thống truyền động: Đã hoặc chưa lắp cùng với hệ thống phanh.

- Hệ thống điện, đèn và tiện nghi: Hệ thống dây điện, bảng điện, đèn và tiện nghi của ô tô để rời khỏi thân vỏ, cabin ô tô.

- Thùng của ô tô tải: Sàn thùng xe, thành phải thùng xe, thành trái thùng xe, thành sau thùng xe và thành trước thùng của ô tô tải để rời chưa sơn và sàn thùng xe chưa được gắn với hệ thống khung phụ khi nhập khẩu.

b) Trường hợp mức độ rời rạc của linh kiện ô tô không đáp ứng quy định tại điểm a khoản này do công nghệ sản xuất ô tô và phụ tùng ô tô thay đổi hoặc do kết cấu ô tô và phụ tùng có tính mới, mức độ rời rạc của các linh kiện ô tô nhập khẩu phải được sự chấp thuận của Bộ Khoa học và Công nghệ.

c) Các Phụ lục 5, 6, 7, 8 ban hành kèm theo Quyết định này chỉ có tính chất minh họa, không dùng làm cơ sở để xác định mức độ rời rạc về mặt kết cấu của các linh kiện đối với ô tô các loại.

5. Doanh nghiệp có hành vi vi phạm hoặc gian lận trong việc kê khai tỷ lệ nội địa hóa sẽ bị xử lý theo quy định của pháp luật.

Điều 6[3]. Quyết định này thay thế Quyết định số 20/2003/QĐ-BKHCN ngày 31/7/2008 của Bộ trưởng Bộ Khoa học và Công nghệ về việc ban hành "Quy định phân loại sản xuất, lắp ráp ôtô", và có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng Công báo.

Điều 7. Tổng cục trưởng Tổng cục Tiêu chuẩn Đo lư­ờng Chất lượng, Vụ trưởng Vụ Đánh giá, Thẩm định và Giám định công nghệ, Vụ trưởng vụ Khoa học và Công nghệ các ngành kinh tế kỹ thuật, Vụ trưởng Vụ Pháp chế, Chánh Văn phòng và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Quyết định này./.

Căn cứ Quyết định số 175/2002/QĐ-TTg ngày 03/12/2002 của Thủ tướng Chính phủ phê duyệt chiến lược phát triển ngành công nghiệp ô tô Việt Nam đến năm 2010, tầm nhìn đến năm 2020;

Căn cứ chỉ đạo của Thủ tướng Chính phủ tại Thông báo số 82/TB-VPCP ngày 16/6/2003, Công văn số 4659/VPCP-KG ngày 24/9/2003, Thông báo số 63/TB-VPCP ngày 02/4/2004 và Công văn số 2943/VPCP-KG ngày 11/6/2004 của Văn phòng Chính phủ;

Thông tư số 05/2012/TT-BKHCN về việc sửa đổi, bổ sung Điều 1 Quyết định số 05/2005/QĐ-BKHCN ngày 11 tháng 5 năm 2005 của Bộ trưởng Bộ Khoa học và Công nghệ về việc sửa đổi, bổ sung Quyết định số 28/2004/QĐ-BKHCN ngày 01 tháng 10 năm 2004 về phương pháp xác định tỷ lệ nội địa hóa đối với ô tô có căn cứ ban hành như sau:

“Căn cứ Nghị định số 28/2008/NĐ-CP ngày 14 tháng 3 năm 2008 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Khoa học và Công nghệ;

Căn cứ Quyết định số 175/2002/QĐ-TTg ngày 03 tháng 12 năm 2002 của Thủ tướng Chính phủ phê duyệt Chiến lược phát triển ngành công nghiệp ô tô Việt Nam đến năm 2010, tầm nhìn đến năm 2020;

Căn cứ Quyết định số 177/2004/QĐ-TTg ngày 05 tháng 10 năm 2004 của Thủ tướng Chính phủ về việc phê duyệt Quy hoạch phát triển ngành công nghiệp ô tô Việt Nam đến năm 2010, tầm nhìn đến 2020;

Xét đề nghị của Tổng cục trưởng Tổng cục Tiêu chuẩn Đo lường Chất lượng;

Bộ trưởng Bộ Khoa học và Công nghệ ban hành Thông tư sửa đổi, bổ sung Điều 1 Quyết định số 05/2005/QĐ-BKHCN ngày 11 tháng 5 năm 2005 của Bộ trưởng Bộ Khoa học và Công nghệ về việc sửa đổi, bổ sung Quyết định số 28/2004/QĐ-BKHCN ngày 01 tháng 10 năm 2004 về phương pháp xác định tỷ lệ nội địa hóa đối với ô tô”

[2]  Khoản này được sửa đổi, bổ sung theo quy định tại Điều 1 của Quyết định số 05/2005/QĐ-BKHCN về việc sửa đổi, bổ sung Quyết định số 28/2004/QĐ-BKHCN ngày 01/10/2004 về phương pháp xác định tỷ lệ nội địa hóa đối với ô tô, có hiệu lực kể từ ngày 10 tháng 06 năm 2005.

Khoản này được sửa đổi, bổ sung theo quy định tại Điều 1 của Thông tư số 05/2012/TT-BKHCN về việc sửa đổi, bổ sung Điều 1 Quyết định số 05/2005/QĐ-BKHCN ngày 11 tháng 5 năm 2005 của Bộ trưởng Bộ Khoa học và Công nghệ về việc sửa đổi, bổ sung Quyết định số 28/2004/QĐ-BKHCN ngày 01 tháng 10 năm 2004 về phương pháp xác định tỷ lệ nội địa hóa đối với ô tô, có hiệu lực kể từ ngày 30 tháng 4 năm 2012.

[3] Điều 2 và Điều 3 của Quyết định số 05/2005/QĐ-BKHCN về việc sửa đổi, bổ sung Quyết định số 28/2004/QĐ-BKHCN ngày 01/10/2004 về phương pháp xác định tỷ lệ nội địa hóa đối với ô tô, có hiệu lực kể từ ngày 10 tháng 06 năm 2005 quy định như sau:

“Điều 2. Quyết định này có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng công báo.

Điều 3. Tổng cục trưởng Tổng cục Tiêu chuẩn Đo lường chất lượng, Vụ trưởng Vụ đánh giá, Thẩm định và Giám định công nghệ, Vụ trưởng Vụ Khoa học và Công nghệ các ngành kinh tế - kỹ thuật, Vụ trưởng Vụ Pháp chế, Chánh Văn phòng và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Quyết định này.”

Điều 2 và Điều 3 của Thông tư số 05/2012/TT-BKHCN về việc sửa đổi, bổ sung Điều 1 Quyết định số 05/2005/QĐ-BKHCN ngày 11 tháng 5 năm 2005 của Bộ trưởng Bộ Khoa học và Công nghệ về việc sửa đổi, bổ sung Quyết định số 28/2004/QĐ-BKHCN ngày 01 tháng 10 năm 2004 về phương pháp xác định tỷ lệ nội địa hóa đối với ô tô, có hiệu lực kể từ ngày 30 tháng 4 năm 2012 quy định như sau:

“Điều 2. Trách nhiệm tổ chức thực hiện

Tổng cục Tiêu chuẩn Đo lường Chất lượng có trách nhiệm hướng dẫn, tổ chức triển khai thực hiện Thông tư này.”

“Điều 3. Điều khoản thi hành

1. Thông tư này có hiệu lực kể từ ngày 30 tháng 4 năm 2012.

2. Tổng cục trưởng Tổng cục Tiêu chuẩn Đo lường Chất lượng, Vụ trưởng Vụ Đánh giá, Thẩm định và Giám định công nghệ, Vụ trưởng Vụ Pháp chế, Cục trưởng Cục Ứng dụng và Phát triển công nghệ, Chánh Văn phòng Bộ và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này./.”

DECISION

METHOD FOR DETERMINATION OF DOMESTIC CONTENT OF AUTOMOBILES

Decision No. 28/2004/QĐ-BKHCN dated October 01, 2004 of the Minister of Science and Technology on method for determination of domestic content of automobiles, effective since March 17, 2005, is amended by:

1. Decision No. 05/2005/QĐ-BKHCN dated May 11, 2005 on amendments to Decision No. 28/2004/QĐ-BKHCN, effective since June 10, 2005;

2. Circular No. 05/2012/TT-BKHCN dated March 12, 2012 of the Minister of Science and Technology on amendments to Article 1 of Decision No. 05/2005/QĐ-BKHCN, effective since April 30, 2012.

Pursuant to Ordinance on Goods quality 1999;

Pursuant to the Government's Decree No. 54/2003/NĐ-CP dated May 19, 2003 defining functions, tasks, entitlements and organizational structure of the Ministry of Science and Technology; the Government's Decree No. 28/2004/NĐ-CP dated January 16, 2004 on amendments of Decree No 54/2003/NĐ-CP;

Pursuant to the Prime Minister’s Decision No. 175/2002/QĐ-TTg dated December 03, 2002 approving the strategy for development of Vietnam’s automobile industry by 2010 and the orientation towards 2020;

At the request of Director of Directorate for Standards, Metrology and Quality and Director of the Legal Department,

Article 1. This Decision provides for determination of domestic contents of automobiles, grades of components and responsibilities of relevant agencies for determination of domestic contents of automobiles.

Article 2. Definitions

For the purpose of this Decision, the terms below are construed as follows:

1. Component means a component, a group of components that form a complete automobile.

2. Domesticized component means a component that is manufactured domestically to substitute imported ones.

3. Domestic content of an automobile means the total grade of domestic components on a scale from 1 - 100.

Article 3. Domestic content of each type of components depends on its grade specified in Appendix 1 through 4 enclosed herewith.

Article 4. Target domestic contents of each stage:

For engines: 30% by 2005, 50% by 2006, 40% by 2007, 45% by 2008 and 50% by 2010; For gearboxes: 65% by 2005, 70% by 2006, 75% by 2007, 80% by 2008, 85% by 2009 and 90% by 2010.

2. For special-purpose automobiles (specified in 3.3 of TCVN 7271:2008): 40% by 2005, 45% by 2006, 50% by 2007, 55% by 2008 and 60% by 2010.

3. For high-grade tourist automobiles manufactured by joint ventures (specified in 3.1.1 of TCVN 7271: 2003): 20-25% by 2005, 30-35% by 2007 and 40-45% by 2010.

For high-grade buses: 20% by 2005, 30% by 2007 and 35-40% by 2010.

Article 5. Determination of domestic content

1. The Ministry of Science and Technology shall consider issuing certificates of domestic contents declared and registered by enterprises according to Appendix 1 through 4 enclosed herewith.

The Ministry of Science and Technology shall establish interdisciplinary inspectorates to inspect domestic contents of automobiles.

2. Auto parts purchased by a manufacturer from another domestic manufacturer shall be graded similarly to those manufactured by the former itself.

3. Imported semi-finished components for further processing shall be graded according to their added value.

a) Fragmentation of imported auto parts:

- Body and chassis (of sedans, minibuses, buses and truck cabins): 6 main assemblies, not powder coated: roof assembly, floor assembly, left body assembly, right body assembly, front body assembly, rear body assembly and connectors (if any).

- Chassis: connected and not powder coated. A chassis of at least 3.7 m in length may be powder coated before import.

- Engine: complete and may be assembled with the clutch and gearbox.

- Transmission system: assembled or not assembled with the braking system.

- Electrical system, lighting and utilities: the electrical wire system, dashboard, lights and utilities are not assembled with the body or cabin.

- Trunk: The floor, right panel, left panel, rear panel and front panel are not assembled, not painted; the floor is not assembled with the secondary chassis when imported.

b) In case of failure to meet any of the requirements in (a) because of changes in manufacturing technology and auto parts, or because of new properties in the structure of the vehicle or parts thereof, the fragmentation of imported auto parts are subject to approval by the Ministry of Science and Technology.

c) Appendices 5 through 8 enclosed herewith are for illustration purpose only and are not the basis for determination of fragmentation of auto parts.

Article 6. This Decision replaces Decision No. 20/2003/QĐ-BKHCN dated July 31, 2008 of the Minister of Science and Technology and comes into force after 15 days from the day on which it is published on Official Gazette.

Article 7. Director of the Directorate for Standards, Metrology, and Quality, Director of Technology Assessment Department, Director of Science and Technology Departments of technological authorities, Directors of the Legal Department, Chief of Office, relevant organizations and individuals are responsible for the implementation of this Decision./.
