CIRCULAR
PROMULGATING LISTS OF IMPORTS AND EXPORTS IN THE PRINTING
AND PUBLISHING INDUSTRIES
The
Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of
Information and Communications promulgating lists of imports and exports in the
printing and publishing industries, which has been effective since February 12,
2019, is amended by:
The
Circular No. 18/2023/TT-BTTTT dated November 30, 2023 of the Minister of
Information and Communications on repeal of some legislative
documents promulgated and jointly promulgated by the Minister of Information
and Communications, which has been effective since November 30, 2023.
The
Circular No. 11/2024/TT-BTTTT dated September 23, 2024 of the Minister of
Information and Communications on amendments to some Articles of Circular
No. 03/2015/TT-BTTTT dated March 06, 2015 of the Minister of
Information and Communications on elaboration and guidance on some articles and
clauses of Government’s Decree No. 60/2014/ND-CP dated June 19, 2014
on printing, Circular No. 05/2016/TT-BTTTT dated March 01, 2016 of the
Minister of Information and Communications on management and use of
international standard book number, Circular
No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of
Information and Communications on list of imports and exports of printing and
publishing industries and Circular No. 09/2013/TT-BTTTT dated April
08, 2013 of the Minister of Information and Communications on issuance of list
of software, hardware, and electronic products (amended by Circular
No. 20/2021/TT-BTTTT dated December 03, 2021 of the Minister of
Information and Communications), which has been effective since November 07,
2024.

Distribution,
The
Minister of Information and Communications hereby promulgates a Circular on
lists of imports and exports in the printing and publishing industries. [1]
Article
1. Lists of imports and exports in the printing and publishing industries[2]
This Circular provides for list of imports of the printing
industry and list of imports and exports of the publishing industry serving
management of import, export, investment, application of tax and incentive
policies and other activities related to products and goods:[3]

b) Only
imports with 08-digit HS codes listed and described as printing equipment in
the list of imports of the printing industry specified at point a of this
clause must apply import declaration procedures prescribed in clause 6 Article
1 of the Government's Decree No. 72/2022/ND-CP .
In case
of modification of regulations on HS codes, the new regulations on HS codes
corresponding to printing equipment listed and described in the list of imports
of the printing industry specified in point a of this clause shall prevail.”
2. [6] List of commodities classified by HS codes and
methods for management of imports and exports of the publishing industry in the
Appendix 02 enclosed with this Circular.
Article 2.
Implementation clause[7]
1. This
Circular comes into force from February 12, 2019 and supersedes the following
Circulars:
a)
Circular No. 16/2015/TT-BTTTT dated June 17, 2015 of the Minister of
Information and Communications;
b)
Circular No. 41/2016/TT-BTTTT dated December 26, 2016 of the Minister of
Information and Communications.
2. The
Chief of Office, Director of Authority of Publication, Printing and
Distribution, heads of affiliates of the Ministry of Information and
Communications; authorities, organizations and individuals participating in or
related to import and export of commodities in the printing and publishing
industries are responsible for the implementation of this Circular.

2.
Procedures and applications for confirmation of registration of import of
publications for business purpose regarding commodities on the List in Section
I.1 shall comply with Article 39 of the Law on Publishing and Circular
No. 01/2020/TT-BTTTT dated February 07, 2020 of the Minister of
Information and Communications (amended by the Circular No. 23/2023/TT-BTTTT
dated December 31, 2023 of the Minister of Information and Communications[10].
3.
Procedures and applications for issuance of import license to publications
imported for non-business purpose regarding commodities on the List in Section
I.1 shall comply with Article 41 of the Law on Publishing and Circular No.
01/2020/TT-BTTTT dated February 07, 2020 of the Minister of Information and
Communications (amended by the Circular No. 23/2023/TT-BTTTT dated December 31,
2023 of the Minister of Information and Communications[11].
4.
Regarding the commodities on the List in Section I.1, which are not required to
obtain the import license as prescribed in Clauses 1 and 2 Article 42 of the
Law on Publishing, management methods specified in this Circular shall not be
adopted.
5. The
import of commodities on the List in Section I.1, which contain contents in
breach of regulations laid down in Clause 1 Article 10 of the Law on Publishing
shall be prohibited in any form.
II.
Exports
1. The
commodities on the List in Section I.1 which have been published and sold
legally in Vietnam are allowed to be exported abroad as prescribed in Article
43 of the Law on Publishing and are not required to obtain the export license
issued by the Ministry of Information and Communications.
2. The
export of commodities on the List in Section I.1, which contain contents in
breach of regulations laid down in Clause 1 Article 10 of the Law on Publishing
shall be prohibited in any form./.

[7] Articles 3 and 4 of
the Circular No. 18/2023/TT-BTTTT dated November 30, 2023 of the Minister of
Information and Communications on repeal of some legislative documents
promulgated and jointly promulgated by the Minister of Information and
Communications, which has been effective since December 30, 2023, stipulate

08, 2013 of the Minister of Information and Communications on issuance of list
of software, hardware, and electronic products (amended by Circular
No. 20/2021/TT-BTTTT dated December 03, 2021 of the Minister of
Information and Communications), which has been effective since November 07,
2024, stipulates that:

2. If
any dossier submitted to serve the declaration of import of printing equipment
and non-commercial publications, and registration for import of commercial
publications is submitted to a competent authority for processing before the
effective date of this Circular, but the deadline for processing such dossier
falls on at least the effective date or after the effective date of this
Circular, relevant regulations of this Circular shall not apply.
Difficulties
that arise during the implementation of this Circular should be reported to the
Ministry of Information and Communications (via the Publication, Printing and
Distribution Authority) for consideration and resolution./.”
[8] This Appendix is
repealed by clause 4 Article 2 of the Circular No. 18/2023/TT-BTTTT dated
November 30, 2023 of the Minister of Information and Communications on repeal
of some legislative documents promulgated and jointly promulgated by the
Minister of Information and Communications, which has been effective since
December 30, 2023.
