DECISION
PROMULGATING THE LIST OF GOODS SUBJECT TO INSPECTION OF THEIR
ENERGY EFFICIENCY AND ENERGY LABELING UNDER MANAGEMENT OF MINISTRY OF INDUSTRY
AND TRADE
THE MINISTER OF INDUSTRY AND TRADE
Pursuant to the Law on
Quality of Products and Goods dated November 21, 2007;
Pursuant to the Law on
Economical and Efficient Use of Energy dated June 17, 2010;
Pursuant to the Law on
Foreign Trade Management dated June 12, 2017;
Pursuant to the
Government’s Decree No. 21/2011/ND-CP dated March 29, 2011 on elaboration and
measures for implementation of the Law on Economical and Efficient Use Of
Energy;
Pursuant to the
Government’s Decree No. 96/2022/ND-CP dated November 29, 2022 defining the
functions, tasks, powers and organizational structure of the Ministry of
Industry and Trade;

Pursuant to the
Government’s Decree No. 85/2019/ND-CP dated November 14, 2019 prescribing
handling of administrative procedures via National Single Window and ASEAN
Single Window and specialized inspection for exports and imports;
Pursuant to the Prime
Minister’s Decision No. 04/2017/QD-TTg dated March 09, 2017 prescribing the
List of equipment and appliances to which the mandatory energy labeling and
minimum energy efficiency standards are applied, and the roadmap to their
implementation;
Pursuant to the Prime Minister’s
Decision No. 14/2023/QD-TTg dated May 24, 2023 prescribing Lists of
low-efficiency equipment subject to elimination and low-efficiency generating
sets banned from development and application roadmaps;
Pursuant to the Prime
Minister’s Decision No. 36/2016/TT-BCT dated December 28, 2016 on energy
labeling for means and equipment using energy under management of the Ministry
of Industry and Trade;
Pursuant to the
Circular No. 31/2022/TT-BTC dated June 08, 2022 of the Ministry of Finance on
Vietnam’s Nomenclature of Exports and Imports;
Pursuant to the
Decision No. 1182/QD-BCT dated May 20, 2019 of the Minister of Industry and
Trade promulgating Lists of imports (with HS codes) subject to specialized
inspection under management of Ministry of Industry And Trade;
At the request of the
Director General of the Department of Energy Efficiency and Sustainable
Development.
HEREBY DECIDES:
Article
1. Promulgating the List of goods (with HS
codes) subject to inspection of their energy efficiency and energy labeling
under management of Ministry of Industry and Trade in the Appendix to this
Decision.

The Department of Energy
Efficiency and Sustainable Development is assigned to (i) Preside over and
cooperate with agencies and units concerned in reviewing, updating and
announcing the List of goods (with HS codes) subject to inspection of their
energy efficiency and energy labeling under management of Ministry of Industry
and Trade in accordance with state management requirements in each period; (ii)
Promptly provide guidelines and respond to difficulties (if any) that arise
from the specialized inspection of the list in the Appendix to this Decision.
Article
3. Implementation clause:
1. This Decision comes
into force from the day on which it is signed.
2. This Decision
supersedes Appendix III to the Decision No. 1182/QD-BCT dated May 20, 2019 of
the Minister of Industry and Trade promulgating Lists of imports (with HS
codes) subject to specialized inspection under management of Ministry of
Industry and Trade;
3. In the cases where any
of the legislative documents referred to in this Decision is amended or
replaced, the newest one shall apply.
Article
4. Chief of the Ministry Office, Director
General of Department of Science and Technology, Department of Energy
Efficiency and Sustainable Development, heads of units affiliated to the
Ministry of Industry and Trade, organizations and individuals concerned are
responsible for the implementation of Decision./.
