ON AMENDMENTS TO SOME ARTICLES OF LEGISLATIVE
DOCUMENTS OF THE MINISTER OF SCIENCE AND TECHNOLOGY REGARDING STANDARDS,
METROLOGY AND QUALITY
Pursuant to the Law on Promulgation of Legislative
Documents No. 64/2025/QH15 amended by the Law No. 87/2025/QH15;
Pursuant to the Law on Standards and Technical
Regulations No. 68/2006/QH11 amended by the Law on Standards and Technical
Regulations No. 70/2025/QH15;
Pursuant to the Law on Product and Goods Quality No.
05/2007/QH12 amended by the Law on Product and Goods Quality No. 78/2025/QH15;

Article 1. Amendments to some
articles of Circular No. 22/2013/TT-BKHCN dated September 26, 2013 of the
Minister of Science and Technology on management of measurement in gold trading
and quality management of gold jewelry on the market
1. Amendments to clause 1, Article 4:
“1. The scale used for determining gold mass and gold
content in transactions between organizations and individuals shall satisfy the
following requirements:
a) The scale must have a measurement range and
accuracy suitable for the gold mass to be measured. The capacity of the scale
shall comply with the verification scale interval (e) prescribed in Table 1.

b) The scale must have been recognized and appointed
in accordance with laws on metrology. The inspection certificate (inspection
mark, inspection seal, or inspection certificate) must be unexpired.
2. Amendments to clause 3, Article 4:
“3. The mass of gold traded or tested must not be
smaller than the declared mass. The measurement error limit for the gold mass
shall comply with requirements prescribed in Table 2.

A golden bracelet weighs 86 g (m = 86 g) using a scale
with e = 1 mg. According to Table 2, 50 g < 86 g < 100 g.

The error limit (S) is:
c) For m > 6kg, the error limit (S) is calculated
by multiplying the measurement result by 0,0175% and rounded to the nearest
verification scale interval (e) of the scale.

Article 2. Amendments to point
b, section 3.4.2 of the National Technical Regulation QCVN 19:2019/BKHCN on LED
lighting products attached to Circular No. 08/2019/TT-BKHCN dated September 25,
2019 of the Minister of Science and Technology
“b. Testing for certification purposes shall be
conducted by a testing organization designated in accordance with Decree No.
132/2008/ND-CP dated December 31, 2008 of the Government elaborating some
articles of the Law on Product and Goods Quality amended by Decree No.
74/2018/ND-CP dated May 15, 2018 of the Government on amendments to some
articles of Decree No. 132/2008/ND-CP, Decree No. 154/2018/ND-CP; or be
recognized in accordance with Circular No. 27/2007/TT-BKHCN. The scope of
testing of the testing organization shall comply with requirements of this
Technical Regulation.”.
Article 2. Amendments to
section 4.4.3 of the National Technical Regulation QCVN 03:2019/BKHCN on safety
of toys attached to Circular No. 09/2019/TT-BKHCN dated September 30, 2019 of
the Minister of Science and Technology
“4.4.3. Testing for certification purposes shall be
conducted by a testing organization designated in accordance with Decree No.
132/2008/ND-CP dated December 31, 2008 of the Government elaborating some
articles of the Law on Product and Goods Quality amended by Decree No.
74/2018/ND-CP dated May 15, 2018 of the Government on amendments to some
articles of Decree No. 132/2008/ND-CP, Decree No. 154/2018/ND-CP; or be
recognized in accordance with Circular No. 27/2007/TT-BKHCN. The scope of
testing of the testing organization shall comply with requirements of this
Technical Regulation.”.

Minister of Science and Technology on Group 2 measuring instruments amended by
clause 2, Article 1 of Circular No. 07/2019/TT-BKHCN dated July 26, 2019 of the
Minister of Science and Technology on amendments to some articles of Circular
No. 23/2013/TT-BKHCN; and amended by Article 1 of Circular No. 03/2024/TT-BKHCN
dated April 15, 2024 of the Minister of Science and Technology

Article 5. Amendments to points
5.3, Article 5 of the National Technical Regulation 25:2025/BKHCN on electrical
equipment for household electrical installations and similar electrical systems
attached to Circular No. 01/2025/TT-BKHCN dated February 14, 2025 of the
Minister of Science and Technology
Article 6. Implementation
clause
1. This Circular comes into force from April 15, 2026.
2. Article 2 of this Circular ceases to be effective from June 01, 2026.
3. In cases where legislative documents cited in this Circular are
amended, supplemented or replaced by other legislative documents, the newer
documents shall prevail.
4. Chief of Office; President of the Commission for the Standards,
Metrology and Quality of Vietnam; heads of authorities and units affiliated to
the Ministry of Science and Technology; relevant organizations and individuals
are responsible for implementing this Circular./.
