NGHỊ QUYẾT

VỀ CHƯƠNG TRÌNH XÂY DỰNG LUẬT, PHÁP LỆNH CỦA QUỐC HỘI NHIỆM KỲ KHÓA XII (2007-2011) VÀ NĂM 2008

QUỐC HỘI NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung một số điều theo Nghị quyết số 51/2001/QH10;
Căn cứ Luật tổ chức Quốc hội;
Căn cứ Luật ban hành văn bản quy phạm pháp luật;
Sau khi xem xét Tờ trình số 71/TTr-UBTVQH12 ngày 12 tháng 11 năm 2007 của Uỷ ban thường vụ Quốc hội về dự kiến Chương trình xây dựng luật, pháp lệnh của Quốc hội nhiệm kỳ khóa XII (2007-2011) và năm 2008 và ý kiến của các vị đại biểu Quốc hội;

QUYẾT NGHỊ:

Điều 1. Thông qua Chương trình xây dựng luật, pháp lệnh của Quốc hội nhiệm kỳ khóa XII gồm 128 dự án luật, pháp lệnh, trong đó có 93 dự án thuộc Chương trình chính thức (gồm 83 dự án luật, 10 dự án pháp lệnh) và 35 dự án luật thuộc Chương trình chuẩn bị (theo Danh mục số 1).

Điều 2. Thông qua Chương trình xây dựng luật, pháp lệnh năm 2008 gồm 54 dự án luật, pháp lệnh, trong đó có 44 dự án thuộc Chương trình chính thức (gồm 36 dự án luật, 08 dự án pháp lệnh) và 10 dự án luật thuộc Chương trình chuẩn bị (theo Danh mục số 2).

Điều 3. Giao Ủy ban thường vụ Quốc hội chỉ đạo việc triển khai thực hiện Chương trình xây dựng luật, pháp lệnh của Quốc hội nhiệm kỳ khóa XII, Chương trình xây dựng luật, pháp lệnh năm 2008; trình Quốc hội Chương trình xây dựng luật, pháp lệnh hằng năm tại kỳ họp cuối năm của năm trước. Trong trường hợp thật cần thiết, Ủy ban thường vụ Quốc hội có thể điều chỉnh, bổ sung Chương trình xây dựng luật, pháp lệnh và kịp thời báo cáo Quốc hội.

Điều 4. Để thực hiện có hiệu quả Chương trình xây dựng luật, pháp lệnh của Quốc hội nhiệm kỳ khóa XII và năm 2008, cần tập trung thực hiện các giải pháp sau đây:

1. Chính phủ, Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, các cơ quan khác, tổ chức có quyền trình dự án luật, pháp lệnh sớm thành lập hoặc củng cố Ban soạn thảo các dự án luật, pháp lệnh; đổi mới quy trình chuẩn bị, xem xét dự án luật, pháp lệnh, dành thời gian hợp lý để thảo luận về các dự án; giữ mối quan hệ thường xuyên với Ủy ban thường vụ Quốc hội, Hội đồng dân tộc và các Ủy ban của Quốc hội trong công tác xây dựng pháp luật;

2. Cơ quan soạn thảo, cơ quan, tổ chức trình dự án luật, pháp lệnh có kế hoạch bảo đảm thực hiện đúng quy trình, tiến độ và chất lượng chuẩn bị dự án; nghiêm túc thực hiện các quy định của pháp luật về thời hạn gửi dự án luật, pháp lệnh đến Chính phủ, cơ quan thẩm tra, Ủy ban thường vụ Quốc hội và Quốc hội;

3. Hội đồng dân tộc và các Ủy ban của Quốc hội chủ động phối hợp chặt chẽ với cơ quan soạn thảo, cơ quan, tổ chức trình dự án luật, pháp lệnh nhằm nâng cao chất lượng thẩm tra; các Đoàn đại biểu Quốc hội và các đại biểu Quốc hội dành thời gian thỏa đáng để nghiên cứu, tổ chức thảo luận, cho ý kiến hoàn thiện dự thảo luật, pháp lệnh;

4. Ủy ban thường vụ Quốc hội có biện pháp bảo đảm triển khai thực hiện Chương trình xây dựng luật, pháp lệnh; tập trung chỉ đạo việc chuẩn bị, chỉnh lý, hoàn thiện dự thảo luật, pháp lệnh; bảo đảm để các dự án trình thông qua được chuẩn bị kỹ cả về nội dung và kỹ thuật văn bản;

5. Tiếp tục củng cố bộ máy giúp việc về công tác xây dựng pháp luật của Chính phủ, các bộ, Ủy ban thường vụ Quốc hội, Hội đồng dân tộc, các Ủy ban của Quốc hội đủ mạnh để hoàn thành tốt các nhiệm vụ được giao; có kế hoạch thu hút các luật gia, chuyên gia, nhà khoa học vào quá trình soạn thảo, thẩm tra, chỉnh lý, hoàn thiện dự thảo luật, pháp lệnh.

Nghị quyết này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XII, kỳ họp thứ 2 thông qua ngày 21 tháng 11 năm 2007.

RESOLUTION

ON THE NATIONAL ASSEMBLYS LAW- AND ORDINANCE-MAKING PROGRAMS FOR THE XIIth TENURE (2007-2011) AND FOR 2008

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and Supplemented under Resolution No. 51/2001/QH10;
Pursuant to the Law on Organization of the National Assembly;
Pursuant to the Law on Promulgation of Legal Documents;
After examining the National Assembly Standing Committees Report No. 71/TTr-UBTVQH12 of November 12, 2007, on the National Assembly S tentative law- and ordinance-making programs for the XIIth tenure (2007-2011) and for 2008, and considering opinions of National Assembly deputies,

RESOLVES:

Article 1. To adopt the National Assemblys law-and ordinance-making program for the XIIth tenure with 128 bills and draft ordinances, including 93 drafts under the official program (83 bills and 10 draft ordinances) and 35 bills under the preparatory program (sec List 1 for details).

Article 2. To adopt the law- and ordinance-making program for 2008 with 54 bills and draft ordinances, including 44 drafts under the official program 36 bills and 8 draft ordinances) and 10 bills under the preparatory program (sec List 2 for details).

Article 3. To assign the National Assembly Standing Committee to direct the implementation of the National Assemblys law- and ordinance-making program for the XIIth tenure and the law-and ordinance-making program for 2008; and submit to the National Assembly the annual law-and ordinance-making program of a year at the year-end session of the preceding year. When necessary, the National Assembly Standing Committee may adjust or supplement law- and ordinance-making programs and report thereon in time to the National Assembly.

In order to effectively implement the National Assemblys law- and ordinance-making programs for the XIIth tenure and for 2008, the following solutions should be implemented:

1. The Government, the Supreme Peoples Court, the Supreme Peoples Procuracy, other agencies and organizations that may submit bills and draft ordinances shall set up soon or consolidate committees for drafting laws and ordinances; renew the processes of preparing and examining bills and draft ordinances in order to arrange appropriate time for discussing drafts; and keep regular contact with the National Assembly Standing Committee, the Nationalities Council and National Assembly Committees in lawmaking work;

2. Law- and ordinance-drafting agencies and bill- and draft ordinance-submitting agencies and organizations shall draw up plans for ensuring compliance with the process, progress and quality of preparation of drafts; and strictly implement legal provisions on the time limit for sending bills and draft ordinances to the Government, verifying agencies, the National Assembly Standing Committee and the National Assembly:

The Nationalities Council and National Assembly Committees shall take the initiative in closely coordinating with law- and ordinance-drafting agencies and bill- and draft ordinance-submitting agencies and organizations in improving the quality of verification work; delegations of National Assembly deputies and National Assembly deputies shall spend appropriate time on studying, discussing and commenting on bills and draft ordinances for their finalization;

4. The National Assembly Standing Committee shall take measures to ensure the implementation of law- and ordinance-making programs; concentrate efforts on directing the preparation, adjustment and finalization of bills and draft ordinances; and ensure that drafts submitted for passage are well prepared substantially and technically;

5. To continue consolidating legislative work-assisting bodies of the Government, ministries, the National Assembly Standing Committee, the Nationalities Council and National Assembly Committees to be strong enough for well fulfilling their assigned tasks; to draw up plans for attracting lawyers, specialists and scientists in drafting, verifying, adjusting and finalizing bills and draft ordinances.

This Resolution was adopted on November 21, 2007, by the XIIth National Assembly of the Socialist Republic of Vietnam at its second session.
