CIRCULAR
ON PROMULGATION
AND IMPLEMENTATION OF "NATIONAL TECHNICAL REGULATION ON SAFETY FOR
ELECTRICAL AND ELECTRONIC APPLIANCES"
Pursuant to the Law on Standards and
Technical Regulations dated June 29, 2006 and the Decree No.127/2007/ND-CP of
August 01, 2007 of the Government detailing the implementation of a number of
Articles of the Law on Standards and Technical Regulations;
Pursuant to the Decree No.28/2008/ND-CP of
March 14, 2008 of the Government defining the functions, tasks, powers and
organizational structure of the Ministry of Science and Technology;
At the proposal of the General Director of
the Directorate for Standards, Metrology & Quality;
Minister of Science and Technology defines:
Article 1. To issue together with this
Circular "National Technical Regulation on safety for electrical and
electronic appliances".
Article 2. This Circular takes effect 45
days after its signing date.

Article 4. From 01/01/2011, electrical
and electronic appliances from No.7 to No.13 specified in the Appendix of the
National Technical Regulation on safety for electrical and electronic
appliances are circulated on market only after they are certified Regulation
conformity, affixed with Regulation conformity mark and registered for quality
records in accordance with provisions.
Article 5. General Director of the
Directorate for Standards, Metrology and Quality, heads of the concerned
agencies, organizations and individuals shall implement this Circular.
In the course of implementation, if any problems
arise, agencies, organizations and individuals should promptly report to the
Ministry of Science and Technology for study, amendment and supplement./.

ELECTRICAL AND ELECTRONIC APPLIANCES
Preamble
QCVN 4: 2009/BKHCN is
compiled by the National Technical Regulation Compilation Board on safety for
electrical and electronic appliances, submitted for approval by the Directorate
for Standards, Metrology and Quality and is issued according to the Circular
No.21/2009/TT-BKHCN dated September 30, 2009 of the Minister of Science and
Technology.
NATIONAL TECHNICAL REGULATION
ON SAFETY FOR
ELECTRICAL AND ELECTRONIC APPLIANCES
1. GENERAL PROVISIONS
1.1. Scope of governing
This technical Regulation defines the
requirements for safety and the management requirements for electrical and
electronic appliances specified in the list in Appendix of this technical
Regulation. This list may be amended, supplemented, canceled by Decision of the
Minister of Science and Technology.

This technical Regulation shall apply to the
organizations, individuals (hereinafter referred to as the enterprises)
producing, importing, distributing and retailing the electrical and electronic
appliances specified in the Appendix of this technical Regulation, the state
management agencies and other concerned organizations and individuals.
1.3. Interpretation of terms
In this technical Regulation, the following
terms shall be construed as follows:
1.3.1. Electrical and electronic appliances
are the equipment connected directly or through a socket to low voltage power
supply, used in household, in trade and in the places with similar purposes of
use (not including the medical devices and telecommunication devices).
1.3.2. Low voltage power supply is the
voltage source from 50 V to 1000 V of AC and voltage from 75 V to 1500 V of DC.
2. SAFETY REQUIREMENTS
Electrical and electronic appliances specified
in the Appendix of the technical Regulation must be ensured safety in
accordance with the respective national standards (TCVN) as follows:
2.1 Electrical instantaneous water heater must
be consistent with the provisions of TCVN 5699-2-35:2007 (IEC 60335-2-35: 2005)
Household and similar electrical appliances. Safety. Part 2-35: Particular
requirements for fast water heater.
2.2 Electrical water heater and
storage water heaters must be consistent with the provisions of TCVN
5699-2-21:2007 (IEC 60335-2-21:2004) Household and similar electrical
appliances. Safety. Part 2-21: Particular requirements for storage water
heaters.

2.4 Kettle must be consistent with the
provisions of TCVN 5699-2-15:2007 (IEC 60335-2-15: 2005) Household and similar
electrical appliances - Safety - Part 2-15: Particular requirements for
appliances heating liquids.
2.5 Rice cooker must be consistent with the
provisions of TCVN 5699-2-15:2007 (IEC 60335-2-15: 2005) Household and similar
electrical appliances - Safety - Part 2-15: Particular requirements for
appliances for heating liquids.
2.6 Electric fans must be consistent with the
provisions of TCVN 5699-2-80:2007 (IEC 60335-2-80:2005) Household and similar
electrical appliances - Safety - Part 2-80: Particular requirements for
electric fans.
2.7 Electric irons must be consistent with the
provisions of TCVN 5699-2-3:2006 (IEC 60335-2-3: 2005) Household and similar
electrical appliances. Safety. Part 2-3: Particular requirements for electric
irons.
2.8 Microwave must be consistent with the
provisions of TCVN 5699-2-25:2007 (IEC 60335-2-25: 2005) Household and similar
electrical appliances. Safety. Part 2-25: Particular requirements for
microwave, combined microwave.
2.9 Electric grillers and roasters
(mobile type) must be consistent with the provisions of TCVN 5699-2-9:2004 (IEC
60335-2-9:2002, Adm.1: 2004) Household and similar electrical appliances.
Safety. Part 2-9: Particular requirements for grills, toaster and similar
mobile devices used for cooking.
2.10 PVC coated wires with rated voltage up to
and equal to 450/750V must be consistent with the provisions of the TCVN
6610-1:2007 (IEC 60227-1: 1998) Polyvinyl chloride insulated cables with rated
voltage up to and equal to 450/750V. Part 1: General requirements, TCVN
6610-3:2000 (IEC 60227-3: 1997) Polyvinyl chloride insulated cables with rated
voltage up to and equal to 450/750V. Part 3: unsheathed cable used for fixed
installation, TCVN 6610-4:2000 (IEC 60227-4: 1992, Adm.1: 1997) Polyvinyl
chloride insulated cables with rated voltage up to and equal to 450/750V. Part
4: sheathed cables for fixed installation, TCVN 6610-5:2007 (IEC 60227-5:2003)
Polyvinyl chloride insulated cables with rated voltage up to and equal to 450/750V.
Part 5: soft cable (wire).
2.11 Electrical immersion water heater must
be consistent with the provisions of TCVN 5699-2-74:2005 (IEC 60335-2-74:2002)
Household and similar electrical appliances. Safety. Part 2-74: Particular
requirements for electrical heating rod.
2.12 Tea or coffee maker must be consistent with
the provisions of TCVN 5699-2-15:2007 (IEC 60335-2-15:2005) Household and
similar electrical appliances. Safety. Part 2-15: Particular requirements for
appliances heating liquid.

3. REQUIREMENTS FOR MANAGEMENT
3.1. Conditions for circulation in the market
Electrical and electronic appliances being
circulated in the market must be labeled goods in accordance with the law
provisions on labeling of goods; must be certified regulation conformity,
bearing mark of regulation conformity (CR) according to the provisions of this
technical Regulation and subject to market inspection of quality inspection
agencies of products, goods (hereinafter referred to as inspection agencies).
3.2. Certification of regulation conformity for
electrical and electronic appliances
3.2.1 Electrical and electronic appliances must
be evaluated, certified regulation conformity by the mode 5 "typical
sample test and assessment of the process of manufacture, monitoring through
test of samples taken at the factory or on market combined with manufacturing
process assessment " defined in Appendix II of the "Regulation on
Certification of standard conformity, certification of regulation conformity
and Publication of standard conformity, Publication of regulation conformity
" issued together with the Decision No.24/2007/QD-BKHCN dated September
28, 2007 of the Minister of Science and Technology.
Certificate of regulation conformity upon
evaluated according to mode 5 is valid for not more than three (3) years.
3.2.2 Electrical and electronic appliances
imported according to the lot of goods which have not been evaluated
certification of regulation conformity according to the mode 5 specified in
Section 3.2.1 of this technical regulation must be assessed certification of
regulation conformity according to the mode 7 "test, assessment of lots of
products and goods" defined in Appendix II of the "Regulation on
Certification of standard conformity, certification of regulation conformity
and Publication of standard conformity, Publication of regulation
conformity" issued together with the Decision No.24/2007/QD-BKHCN dated
September 28, 2007 of the Minister of Science and Technology.
Certificate of regulation conformity upon
evaluated according to the mode 7 is valid only for each lot of imports.
3.3. Regulation conformity certification

The designation of organization certifying
regulation conformity for electrical and electronic appliances shall comply
with the provisions of the Circular No.09/2009/TT-BKHCN dated April 08, 2009 of
the Minister of Science and Technology guiding request, order, procedures to
designate the conformity assessment organizations.
3.4. Use of regulation conformity mark
Regulation conformity mark and the use of
regulation conformity mark must comply with Clause 2, Article 4 of the
"Regulation on Certification of standard conformity, certification of
regulation conformity and Publication of standard conformity, Publication of
regulation conformity" issued together with the Decision
No.24/2007/QD-BKHCN dated September 28, 2007 of the Minister of Science and
Technology.
3.5. Registration
3.5.1. After enterprises producing the
electrical and electronic appliances are certified regulation conformity, they
shall register the written publication of regulation conformity at the Branch
for Standards, Metrology and Quality where the enterprises made their business
registration according to the provisions in the Decision No.24/2007/QD-BKHCN
dated September 28, 2007 of the Minister of Science and Technology.
3.5.2. After the enterprises importing the
electrical and electronic appliances are certified regulation conformity, they
shall register for quality inspection at the inspection agencies as prescribed
in the Circular No.17/2009/TT-BKHCN dated June 18, 2009 of the Minister of
Science and Technology guiding the order and procedures for quality inspection
of imported goods.
3.5.3. Registration dossier comprises:
The written registration for publication of
regulation conformity (for electrical and electronic appliances produced
domestically) under the form prescribed in the Decision No.24/2007/QD-BKHCN
dated September 28, 2007 of the Minister of Science and Technology; or the
written registration for quality inspection (for imported electrical and
electronic appliances) under the form prescribed in the Circular
No.17/2009/TT-BKHCN dated June 18, 2009 of the Minister of Science and Technology;
A product description (name, features, utility,
basic specifications, list or bills of main materials, components ...);

A manual;
A copy of the certificate of regulation
conformity;
Notification of changes related to the design,
materials, manufacturing technology (if any) compared with the registered
dossier.
3.5.4. The enterprises must keep registration
dossier specified in item 3.5.3 for at least ten (10) years from the date that
the final products are shipped or imported.
3.5.5. Regulation conformity certification
organizations must keep records on the certification for at least six (6) years
from the date of expiry of the certificate.
4. RESPONSIBILITIES OF THE ORGANIZATIONS AND
INDIVIDUALS
4.1. Inspection agency's responsibility
The inspection agency is responsible under the
provisions of Chapter IV, the Law on Quality of products, goods and other
relevant regulations.

4.3. Responsibilities of the enterprises
The enterprises producing, importing,
distributing and retailing the electrical and electronic appliances must ensure
the quality according to the relevant provisions of the Law on Quality of
product and goods.
The producing, importing enterprises must ensure
the safety according to the requirements specified in Section 2, to implement
the provisions of Section 3 of this Technical Regulation.
5. IMPLEMENTATION ORGANIZATION
5.1. Directorate for Standards, Metrology and
Quality are responsible for guiding and inspecting the implementation of this
Technical Regulation.
5.2. In case the standards, documents quoted in
this Technical Regulations are changed, supplemented or replaced, it shall
comply with the provisions in the new documents.
5.3. In case Vietnam has signed bilateral or
multilateral agreements, it shall comply with the provisions of such
agreements./.
