CỦA CHÍNH PHỦ SỐ 55/2003/NĐ-CP NGÀY 28 THÁNG 5 NĂM 2003 QUY ĐỊNH CHỨC NĂNG, NHIỆM VỤ, QUYỀN HẠN VÀ CƠ CẤU TỔ CHỨC CỦA BỘ CÔNG NGHIỆP

Căn cứ Luật Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;
Căn cứ Nghị quyết số 02/2002/QH11 ngày 05 tháng 8 năm 2002 của Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XI, kỳ họp thứ nhất quy định danh sách các bộ và cơ quan ngang bộ của Chính phủ;
Căn cứ Nghị định số 86/2002/NĐ-CP ngày 05 tháng 11 năm 2002 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của bộ, cơ quan ngang bộ;
Theo đề nghị của Bộ trưởng Bộ Công nghiệp và Bộ trưởng Bộ Nội vụ,

NGHỊ ĐỊNH :

Điều 1. Vị trí và chức năng

Bộ Công nghiệp là cơ quan của Chính phủ, thực hiện chức năng quản lý nhà nước về công nghiệp, bao gồm: cơ khí, luyện kim, điện, năng lượng mới, năng lượng tái tạo, dầu khí, khai thác khoáng sản, hóa chất (bao gồm cả hóa dược), vật liệu nổ công nghiệp, công nghiệp tiêu dùng, công nghiệp thực phẩm và công nghiệp chế biến khác trong phạm vi cả nước; quản lý nhà nước các dịch vụ công và thực hiện đại diện chủ sở hữu phần vốn của Nhà nước tại doanh nghiệp có vốn nhà nước trong các ngành công nghiệp thuộc phạm vi quản lý của Bộ theo quy định của pháp luật.

Điều 2. Nhiệm vụ và quyền hạn

Bộ Công nghiệp thực hiện nhiệm vụ, quyền hạn theo quy định tại Nghị định số 86/2002/NĐ-CP ngày 05 tháng 11 năm 2002 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của bộ, cơ quan ngang bộ và những nhiệm vụ, quyền hạn cụ thể sau đây:

1. Trình Chính phủ, Thủ tướng Chính phủ các dự án luật, pháp lệnh và các dự thảo văn bản quy phạm pháp luật của Chính phủ, Thủ tướng Chính phủ về các ngành công nghiệp thuộc phạm vi quản lý của Bộ.

2. Trình Chính phủ, Thủ tướng Chính phủ chiến lược, quy hoạch phát triển tổng thể, quy hoạch vùng, lãnh thổ, quy hoạch ngành, kế hoạch dài hạn, năm năm và hàng năm về các ngành công nghiệp thuộc phạm vi quản lý của Bộ và các chương trình, dự án quan trọng của Bộ.

3. Ban hành các quyết định, chỉ thị, thông tư thuộc phạm vi quản lý nhà nước của Bộ.

4. Chỉ đạo, hướng dẫn, kiểm tra và chịu trách nhiệm thực hiện các văn bản quy phạm pháp luật, chiến lược, quy hoạch, kế hoạch đã được phê duyệt thuộc phạm vi quản lý của Bộ; thông tin, tuyên truyền, phổ biến, giáo dục pháp luật về công nghiệp.

5. Chủ trì thẩm định, thẩm định hoặc phê duyệt các dự án đầu tư trong các ngành công nghiệp thuộc phạm vi quản lý của Bộ theo quy định của pháp luật.

6. Quản lý, chỉ đạo, kiểm tra và chịu trách nhiệm việc tổ chức thực hiện về an toàn kỹ thuật công nghiệp, bao gồm: đăng ký, kiểm định an toàn các thiết bị áp lực, thiết bị nâng, an toàn điện, an toàn khai thác mỏ và dầu khí (trừ các thiết bị, phương tiện thăm dò và khai thác dầu khí trên biển), an toàn hóa chất, vật liệu nổ công nghiệp và môi trường công nghiệp theo quy định của pháp luật.

7. Thống nhất quản lý việc cấp, điều chỉnh, thu hồi, gia hạn giấy phép hoạt động điện lực, giấy phép sản xuất các sản phẩm thuốc lá điếu, giấy phép kinh doanh, sử dụng vật liệu nổ công nghiệp và các giấy phép khác theo quy định của pháp luật.

8. Về cơ khí và luyện kim:

a) Chủ trì, phối hợp với các bộ, ngành có liên quan trình Chính phủ, Thủ tướng Chính phủ ban hành hoặc ban hành theo thẩm quyền cơ chế, chính sách hỗ trợ phát triển ngành cơ khí, ngành luyện kim và phát triển các sản phẩm cơ khí, cơ khí - điện tử trọng điểm;

b) Chỉ đạo và kiểm tra việc tổ chức thực hiện chiến lược, quy hoạch, kế hoạch, chính sách phát triển ngành cơ khí, ngành luyện kim, phát triển các sản phẩm cơ khí, cơ khí - điện tử trọng điểm, các sản phẩm có hàm lượng công nghệ cao, kết hợp của kỹ thuật cơ khí, tự động hóa, điện tử công nghiệp;

c) Hướng dẫn, theo dõi, tổng hợp tình hình phát triển và thị trường tiêu thụ sản phẩm cơ khí, luyện kim.

9. Về điện, năng lượng mới, năng lượng tái tạo:

a) Trình Chính phủ, Thủ tướng Chính phủ ban hành quy định về bảo vệ hành lang an toàn lưới điện cao áp và các công trình điện lực; ban hành theo thẩm quyền tiêu chuẩn an toàn điện trong quản lý vận hành trang thiết bị điện, các quy trình, quy phạm, quản lý, vận hành và điều độ hệ thống điện;

b) Trình Thủ tướng Chính phủ phê duyệt giá bán điện cho các đối tượng tiêu dùng; hướng dẫn và kiểm tra thực hiện các tiêu chuẩn, định mức kinh tế - kỹ thuật, đơn giá dự toán xây dựng chuyên ngành điện;

c) Công bố danh mục các công trình điện lực sẽ xây dựng trong quy hoạch phát triển điện lực để kêu gọi đầu tư và quản lý việc thực hiện;

d) Phê duyệt quy hoạch phát triển điện lực của các tỉnh, thành phố trực thuộc Trung ương; theo dõi, tổng hợp việc tổ chức thực hiện và điều chỉnh khi cần thiết;

đ) Tổ chức, chỉ đạo, theo dõi việc thực hiện chính sách năng lượng quốc gia, phát triển điện nguyên tử, các dạng năng lượng mới, năng lượng tái tạo.

10. Về dầu khí:

a) Xây dựng, trình Chính phủ, Thủ tướng Chính phủ ban hành các chính sách khuyến khích tìm kiếm thăm dò và khai thác dầu khí;

b) Trình Thủ tướng Chính phủ quyết định lựa chọn nhà thầu và đối tác ký kết hợp đồng tìm kiếm, thăm dò, xây dựng, khai thác và các hoạt động dầu khí khác theo quy định của pháp luật;

c) Chủ trì trong việc thanh tra, kiểm tra, giám sát các hoạt động dầu khí;

d) Tổng hợp, theo dõi, báo cáo tình hình phát triển và kết quả tìm kiếm, thăm dò, khai thác, tiêu thụ dầu khí trong nước và xuất khẩu

đ) Quyết định các vấn đề khác thuộc thẩm quyền quản lý nhà nước về hoạt động dầu khí theo phân công của Chính phủ.

11. Về khai thác khoáng sản:

a) Chủ trì, phối hợp với các bộ, ngành có liên quan xây dựng, trình Thủ tướng Chính phủ phê duyệt quy hoạch, kế hoạch khai thác khoáng sản trên cơ sở trữ lượng khoáng sản đã được cấp có thẩm quyền phê duyệt; theo dõi, chỉ đạo, kiểm tra, tổng hợp, báo cáo về khai thác khoáng sản theo quy hoạch, kế hoạch đã được phê duyệt;

b) Hướng dẫn, kiểm tra, giám sát việc thực hiện các biện pháp bảo đảm an toàn và bảo vệ môi trường trong hoạt động khai thác khoáng sản theo quy định của pháp luật.

12. Về hóa chất và vật liệu nổ công nghiệp:

a) Chủ trì, phối hợp với các bộ, ngành có liên quan xây dựng, trình Chính phủ, Thủ tướng Chính phủ ban hành hoặc ban hành theo thẩm quyền chính sách hỗ trợ phát triển công nghiệp hóa chất, vật liệu nổ công nghiệp;

b) Theo dõi, chỉ đạo, hướng dẫn, kiểm tra, tổng hợp tình hình phát triển công nghiệp hóa chất;

c) Công bố danh mục các loại vật liệu nổ công nghiệp được sử dụng; kiểm tra, theo dõi việc thực hiện các quy định về sản xuất, nhập khẩu, cung ứng, sử dụng vật liệu nổ công nghiệp.

13. Về công nghiệp tiêu dùng, thực phẩm và chế biến khác:

a) Chủ trì, phối hợp với các bộ, ngành có liên quan xây dựng, trình Thủ tướng Chính phủ phê duyệt quy hoạch, kế hoạch phát triển các ngành công nghiệp tiêu dùng, thực phẩm và chế biến khác; chỉ đạo, hướng dẫn, kiểm tra việc thực hiện sau khi được phê duyệt;

b) Quản lý các ngành: dệt - may, da - giầy, giấy, sành sứ, thủy tinh, nhựa, rượu, bia, nước giải khát, bánh kẹo, sữa, dầu thực vật, thuốc lá, chế biến bột và tinh bột;

c) Theo dõi, tổng hợp, báo cáo tình hình phát triển và việc thực hiện các tiêu chuẩn chất lượng sản phẩm, an toàn vệ sinh, môi trường lao động trong công nghiệp tiêu dùng, thực phẩm, chế biến khác trong phạm vi cả nước theo quy định của pháp luật.

14. Về phát triển công nghiệp địa phương:

a) Trình Chính phủ, Thủ tướng Chính phủ ban hành hoặc ban hành theo thẩm quyền cơ chế, chính sách phát triển công nghiệp địa phương;

b) Phê duyệt hoặc thông qua và tổng hợp quy hoạch, kế hoạch dài hạn, năm năm về phát triển công nghiệp của tỉnh, thành phố trực thuộc Trung ương; hướng dẫn, theo dõi, kiểm tra việc tổ chức thực hiện theo quy định của pháp luật;

c) Theo dõi, tổng hợp, báo cáo định kỳ tình hình phát triển công nghiệp địa phương và kết quả các hoạt động khuyến công.

15. Về quản lý công nghiệp trong khu công nghiệp, khu chế xuất:

Chỉ đạo phát triển các ngành công nghiệp trong các khu công nghiệp, khu chế xuất theo chiến lược, quy hoạch, kế hoạch phát triển công nghiệp vùng và lãnh thổ đã được phê duyệt.

16. Thực hiện hợp tác quốc tế trong các ngành công nghiệp thuộc phạm vi quản lý của Bộ theo quy định của pháp luật.

17. Tổ chức và chỉ đạo thực hiện kế hoạch nghiên cứu khoa học, ứng dụng tiến bộ khoa học kỹ thuật, công nghệ trong các ngành công nghiệp thuộc phạm vi quản lý của Bộ.

18. Quyết định các chủ trương, biện pháp cụ thể và chỉ đạo việc thực hiện cơ chế hoạt động của các tổ chức dịch vụ công trong các ngành công nghiệp thuộc phạm vi quản lý của Bộ theo quy định của pháp luật; quản lý và chỉ đạo hoạt động đối với các tổ chức sự nghiệp thuộc Bộ.

19. Thực hiện nhiệm vụ, quyền hạn cụ thể thuộc quyền đại diện chủ sở hữu phần vốn của Nhà nước tại doanh nghiệp có vốn nhà nước trong các ngành công nghiệp thuộc phạm vi quản lý của Bộ, kể cả Tổng công ty Dầu khí Việt Nam và Tổng công ty Điện tử và Tin học Việt Nam theo quy định của pháp luật.

20. Quản lý nhà nước đối với các hoạt động của hội và tổ chức phi Chính phủ trong các ngành công nghiệp thuộc phạm vi quản lý của Bộ theo quy định của pháp luật.

21. Thanh tra, kiểm tra, giải quyết khiếu nại, tố cáo, chống tham nhũng, tiêu cực và xử lý vi phạm pháp luật theo quy định của pháp luật.

22. Quyết định và chỉ đạo thực hiện chương trình cải cách hành chính của Bộ theo mục tiêu và nội dung chương trình cải cách hành chính nhà nước đã được Thủ tướng Chính phủ phê duyệt.

23. Quản lý tổ chức bộ máy, biên chế; chỉ đạo thực hiện chế độ tiền lương và các chính sách, chế độ đãi ngộ, khen thưởng, kỷ luật đối với cán bộ, công chức, viên chức nhà nước thuộc phạm vi quản lý của Bộ; đào tạo, bồi dưỡng, xây dựng đội ngũ cán bộ, công chức, viên chức nhà nước thuộc thẩm quyền; quy định chức danh, tiêu chuẩn cấp bậc kỹ thuật, nghiệp vụ trong các ngành công nghiệp thuộc phạm vi quản lý của Bộ.

24. Quản lý tài chính, tài sản được giao và tổ chức thực hiện ngân sách được phân bổ theo quy định của pháp luật.

Điều 3. Cơ cấu tổ chức của Bộ

a) Các tổ chức giúp Bộ trưởng thực hiện chức năng quản lý nhà nước:

1. Vụ Cơ khí, Luyện kim và Hóa chất;

2. Vụ Năng lượng và Dầu khí;

3. Vụ Công nghiệp tiêu dùng và thực phẩm;

4. Vụ Kế hoạch;

5. Vụ Tài chính - Kế toán;

6. Vụ Khoa học, Công nghệ;

7. Vụ Hợp tác quốc tế;

8. Vụ Pháp chế;

9. Vụ Tổ chức cán bộ;

10. Cục Công nghiệp địa phương;

11. Cục Kỹ thuật an toàn công nghiệp;

12. Thanh tra;

13. Văn phòng.

b) Các tổ chức sự nghiệp thuộc Bộ:

1. Viện Nghiên cứu chiến lược, chính sách công nghiệp;

2. Viện Nghiên cứu Cơ khí;

3. Viện Nghiên cứu Mỏ và Luyện kim;

4. Viện Nghiên cứu Điện tử - Tin học - Tự động hóa;

5. Viện Công nghiệp thực phẩm;

6. Viện Nghiên cứu Dầu thực vật - Tinh dầu - Hương liệu - Mỹ phẩm;

7. Trung tâm Tin học;

8. Báo Công nghiệp Việt Nam;

9. Tạp chí Công nghiệp.

Bộ trưởng Bộ Công nghiệp chủ trì, phối hợp với Bộ trưởng Bộ Nội vụ xây dựng phương án sắp xếp các viện nghiên cứu, các trường cao đẳng, trung học chuyên nghiệp, đào tạo nghề và các tổ chức sự nghiệp khác hiện có trình Thủ tướng Chính phủ quyết định.

Điều 4. Hiệu lực thi hành

Nghị định này có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng Công báo, thay thế Nghị định số 74/CP ngày 01 tháng 11 năm 1995 của Chính phủ về chức năng, nhiệm vụ, quyền hạn và tổ chức bộ máy của Bộ Công nghiệp, Quyết định số 378/TTg ngày 04 tháng 6 năm 1997 của Thủ tướng Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và tổ chức bộ máy Cục Kiểm tra, giám sát kỹ thuật an toàn công nghiệp và các quy định trước đây trái với Nghị định này.

Điều 5. Trách nhiệm thi hành

Bộ trưởng Bộ Công nghiệp, các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ và Chủ tịch ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Nghị định này.

DECREE

DEFINING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INDUSTRY

THE GOVERNMENT

Pursuant to the Law on Organization of the Government of December 25, 2001;
Pursuant to Resolution No. 02/2002/QH11 of August 5, 2002 of the first session of the XIth National Assembly of the Socialist Republic of Vietnam promulgating the list of the ministries and ministerial-level agencies of the Government;
Pursuant to the Government’s Decree No. 86/2002/ND-CP of November 5, 2002 defining the functions, tasks, powers and organizational structures of the ministries and ministerial-level agencies;
At the proposals of the Minister of Industry and the Minister of the Interior,

DECREES:

Article 1.- Position and functions

The Ministry of Industry is a governmental agency which performs the function of State management over industries, including: mechanical engineering, metallurgy, electricity, new energy, re-generated energy, petroleum, mineral exploitation, chemicals (including pharmaceutical chemicals), industrial explosive materials, consumer goods production, food industry and other processing industries nationwide; performs the State management over public services and acts as the representative of the owner of State capital portions at State-invested enterprises in the industries under its management according to the provisions of law.

Article 2.- Tasks and powers

1. To submit to the Government and the Prime Minister bills, draft ordinances and draft legal documents of the Government and the Prime Minister on industries under its management.

2. To submit to the Government and/or the Prime Minister strategies, general development planning, regional and territorial plannings, branch plannings, long-term, five-year and annual plans on industries under its management as well as its important programs and projects.

3. To promulgate decisions, directives and circulars within the scope of its State management.

4. To direct, guide and inspect the implementation of and implement already approved legal documents, strategies, plannings and plans under its management; to carry out the information on, propagation, dissemination and education of the legislation on industry;

5. To assume the prime responsibility for the evaluation of, evaluate or approve, investment projects of various industries under its management according to the provisions of law.

6. To manage, direct, inspect and bear responsibility for organizing the implementation of regulations on industrial technical safety, including: registration and safety testing of compression equipment, lifting equipment, electric safety, mining and petroleum exploitation safety (except for offshore petroleum exploration and exploitation equipment and means), safety of chemicals, industrial explosive materials and industrial environment according to the provisions of law.

7. To unify the management of the granting, readjustment, withdrawal and extension of electricity operation permits, permits for production of cigarettes, permits for trading in and use of industrial explosive materials and other permits according to the provisions of law.

8. Regarding the mechanical engineering and metallurgy:

a/ To assume the prime responsibility and coordinate with the concerned ministries and branches in submitting to the Government and the Prime Minister for promulgation, or promulgate according to its own competence mechanisms and policies to support the development of the mechanical engineering and metallurgical industries as well as the development of key mechanical and electro-mechanical products;

c/ To guide, monitor and sum up the situation of development and outlets of mechanical and metallurgical products.

9. Regarding the electricity, new energy and re-generated energy:

a/ To propose to the Government and/or the Prime Minister for promulgation regulations on protection of safety corridor of the high-tension electricity grids and electricity works; to promulgate according to its competence the electric safety standards applicable to the management of operation of electric facilities and equipment, as well as procedures and processes for management, operation and regulation of electric systems;

b/ To submit to the Prime Minister for approval prices of electricity sold to different consumers; to guide and inspect the observance of techno-economic standards and norms, as well as projected unit prices for specialized electricity construction;

c/ To announce the list of electricity projects to be constructed under the electricity development planning in order to call for investment and manage the execution thereof;

d/ To approve the electricity development plannings of the provinces and centrally-run cities; to monitor and sum up the organization of implementation and readjustment thereof when necessary;

e/ To organize, direct and monitor the implementation of the national energy policy, the development of atomic-powered electricity generation, new energy types, regenerated energy.

10. Regarding petroleum:

a/ To formulate and propose to the Government and/or the Prime Minister for promulgation policies on promotion of the petroleum prospection, exploration and exploitation;

c/ To assume the prime responsibility for inspecting, examining and supervising petroleum activities;

d/ To sum up, monitor and report the development situation and result of the petroleum prospection, exploration, exploitation, domestic consumption and export;

e/ To decide on other matters under its competence for State management over petroleum activities as assigned by the Government.

11. Regarding the mineral exploitation:

a/ To assume the prime responsibility for and coordinate with the concerned ministries and branches in elaborating and submitting to the Prime Minister for approval planning and plans on mineral exploitation on the basis of estimated mineral reserves already approved by the competent authorities; to monitor, direct, inspect, sum up and report on mineral exploitation under the already approved planning and plans;

b/ To guide, inspect and supervise the application of measures to ensure safety and protect the environment in mining activities according to the provisions of law.

12. Regarding chemicals and industrial explosive materials:

a/ To assume the prime responsibility for and coordinate with the concerned ministries and branches in formulating and submitting to the Government and/or the Prime Minister for promulgation or promulgate according to its competence policies on supporting the development of chemical and industrial explosive materials industries;

b/ To monitor, direct, guide, inspect and sum up the development situation of the chemical industry;

13. Regarding the consumer goods, food and other processing industries:

a/ To assume the prime responsibility for and coordinate with the concerned ministries and branches in drawing up and submitting to the Prime Minister for approval planning and plans on development of consumer goods, food and other processing industries; to direct, guide and inspect the implementation thereof after they are approved;

b/ To manage textile - garment, leather - footwear, paper, porcelain, ceramic, glass, plastics, alcohol, beer, beverage, confectionery, milk, vegetable oil, tobacco, flour and starch processing industries;

c/ To monitor, sum up and report on the development situation and the observance of the standards on product quality, safety and hygiene as well as working environment in the consumer goods, food and other processing industries throughout the country according to the provisions of law.

14. Regarding the development of local industries:

a/ To submit to the Government and/or the Prime Minister for promulgation or promulgate according to its competence mechanisms and policies on development of local industries;

b/ To approve or adopt and synthesize long-term and five-year industrial development planning and plans of the provinces and centrally-run cities; to guide, monitor and inspect the organization of the implementation thereof according to the provisions of law;

c/ To monitor, sum up and periodically report on the development situation of local industries and the results of industrial promotion activities.

15. Regarding the industrial management in industrial parks and export processing zones:

16. To undertake international cooperation in various industries under its management according to the provisions of law.

17. To organize and direct the implementation of the plans on scientific research and/or application of scientific and technological advances to the industries under its management.

18. To decide on specific undertakings and measures, and direct the implementation of operation mechanism of public service-providing organizations in the industries under its management according to the provisions of law; to manage and direct operations of the non-business organizations attached to it.

19. To perform specific tasks and exercise specific powers of the representative of the owner of the State capital at State-invested enterprises in the industries under its management, including Vietnam Oil and Gas Corporation and Vietnam Electronics and Informatics Corporation according to the provisions of law.

20. To perform the State management over activities of associations and non-governmental organizations in various industries under its management according to the provisions of law.

21. To inspect, examine and settle complaints and denunciations against corruption and negative phenomena, and handle law violations according to the provisions of law.

22. To decide on and direct the implementation of its administrative reform program according to the objectives and contents of the State administrative reform program already approved by the Prime Minister.

23. To manage its organizational apparatus and payrolls; to direct the implementation of the salary regime and the policies and regimes of preferential treatment, commendation and disciplining of officials, public servants and State employees under its management; to train, foster and build up the contingent of officials, public servants and State employees according to its competence; to prescribe office titles as well as technical and professional criteria and grades in the industries under its management according to the provisions of law.

24. To manage finance and assets assigned to it and organize the implementation of its allocated budget according to the provisions of law.

The Minister of Industry shall assume the prime responsibility for and coordinate with the Minister of the Interior in devising plans for reorganization of the existing research institutes, colleges, intermediate vocational schools, job-training schools and other non-business organizations, and submitting them to the Prime Minister for decision.

Article 4.- Implementation effect

This Decree takes effect 15 days after its publication in the Official Gazette and replaces the Government’s Decree No. 74/CP of November 1, 1995 on the functions, tasks, powers and organizational structure of the Ministry of Industry, the Prime Minister’s Decision No. 378/TTg of June 4, 1997 defining the functions, tasks, powers and organizational structure of the Department for Inspection and Supervision of Industrial Techniques and Safety, and the previous stipulations contrary to this Decree.

Article 5.- Implementation responsibility

The Minister of Industry, the ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People’s Committees of the provinces and centrally-run cities shall have to implement this Decree.
