CIRCULAR
PROMULGATION OF AMENDMENT 1:2018 QCVN 9:2012/BKHCN NATIONAL
TECHNICAL REGULATION ON ELECTROMAGNETIC COMPATIBILITY FOR HOUSEHOLD AND SIMILAR
ELECTRICAL AND ELECTRONIC EQUIPMENT
Pursuant to the Law on
Standards and Technical Regulations dated June 29, 2006;
Pursuant to the
Government's Decree No. 127/2007/ND-CP dated August 01, 2007 elaborating some
Articles of the Law on Technical Regulations and Standards;
Pursuant to the
Government's Decree No. 95/2017/ND-CP dated June 16, 2017 defining the
functions, tasks, powers and organizational structure of the Ministry of
Science and Technology;
At the request of the
Director General of the Directorate for Standards, Metrology and Quality and
the Department of Legal Affairs;
The Minister of
Science and Technology hereby promulgates Amendment 1:2018 QCVN 9:2012/BKHCN
National technical regulation on electromagnetic compatibility for household
and similar electrical and electronic equipment.
Article
1. Amendment 1:2018 QCVN 9:2012/BKHCN National technical
regulation on electromagnetic compatibility for household and similar
electrical and electronic equipment (hereinafter referred to as “the
Regulation”) is promulgated together with this Circular.

1. As of September 01,
2019, hairdryers shall comply with the requirements laid down in this
Regulation before being circulated on the market;
2. As of July 01, 2020,
liquidizers, fruit processors, meat grinders and egg beaters shall comply with
the requirements laid down in this Regulation before being circulated on the
market;
3. As of July 01, 2021,
microwave ovens (including combination microwave ovens) and electric stoves
(including electromagnetic stoves) shall comply with the requirements laid down
in this Regulation before being circulated on the market;
Article
3. Producers, traders and importers of household electrical
and electronic equipment are encouraged to apply this Regulation and declare
conformity before the compulsory dates of application of this Regulation
specified in Article 2 hereof.
Article
4. Implementation
1. This Circular comes
into force from September 01, 2018.
2. The producers, traders
and importers of electrical and electronic equipment specified in this Article
2 hereof shall satisfy the technical requirements laid down to apply the
provisions of Amendment 1:2018 QCVN 9:2012/BKHCN from the effective date of
this Circular before the compulsory dates of application specified in Article 2
hereof.
3. The electrical and
electronic equipment produced, traded or imported before the compulsory dates
of application specified in Article 2 hereof may be circulated on the market
but not exceeding 06 (six) months from the compulsory dates of application
specified in Article 2 hereof.
4. The Director General
of the Directorate for Standards, Metrology and Quality shall provide guidance
on and organize the implementation of this Circular.

6. Ministries,
ministerial agencies, Governmental agencies, People’s Committees of provinces
and central-affiliated cities and relevant organizations and individuals are
responsible for the implementation of this Circular./.

Amendment 1:2018 QCVN
9:2012/BKHCN is prepared by the Board drafting amendment of National technical
regulation on electromagnetic compatibility for electrical and electronic
equipment, submitted by the Directorate for Standards, Metrology and Quality
for approval and promulgated together with the Circular No. 07/2018/TT-BKHCN
dated June 06, 2018 of the Minister of Science and Technology.

2.1.4. Microwave ovens
(including combination microwave ovens) – According to TCVN 6988:2006 (CISPR
11:2004) Industrial, scientific and medical (ISM) radio-frequency equipment.
Electromagnetic disturbance characteristics. Limits and methods of measurement.
2.1.5. Electric stoves
(including electromagnetic stoves) – According to CISPR 14-1:2016
Electromagnetic compatibility - Requirements for household appliances, electric
tools and similar apparatus - Part 1: Emission.
3.
MANAGEMENT REQUIREMENTS
3.1. Sections 3.1, 3.2
and 3.3 are amended as follows:
“3.1. Conditions for
circulation on the market
When circulated on the market,
electrical and electronic equipment domestically produced, traded and imported
must be labeled in accordance with regulations of law on goods labels; have
their conformity declared, bear the conformity (CR) marking and be subject to
inspection by authorities inspecting quality of products and goods.
3.2. EMC Declaration
of conformity
3.2.1. The declaration of
conformity shall be based on the certification result given by a certification
body that has registered its certification services according to regulations of
the Decree No. 107/2016/ND-CP or accredited according to regulations of the
Circular No. 27/2007/TT-BKHCN.

b) Tests serving
certification purpose shall be conducted by testing bodies that have registered
their testing services according to regulations of the Decree No.
107/2016/ND-CP or accredited according to regulations of the Circular No.
27/2007/TT-BKHCN. Scope of services offered by these testing bodies shall
encompass the requirements provided for in this Regulation.
c) A certificate of
conformity shall be valid for no more than 3 years.
3.2.3. Use of conformity
marking
The conformity marking
must be used in compliance with Clause 2 Article 4 of “Regulations on
certification of standard conformity, certification of technical-regulation
conformity, declaration of standard conformity and declaration of
technical-regulation conformity” promulgated together with the Circular No.
28/2012/TT-BKHCN.
3.3. Procedures and
documents for registration of declarations of conformity
Procedures and documents
for registration of declaration of conformity of electrical and electronic
equipment domestically manufactured and imported are provided for in Circular
No. 28/2012/TT-BKHCN and Circular No. 02/2017/TT-BKHCN.
4.

Enterprises manufacturing
and importing electrical and electronic equipment must satisfy the technical
requirements concerning electromagnetic interference limits specified in
Article 2 and the management requirements specified in Article 3 hereof.
Every enterprise shall
present evidence upon request or inspection according to regulations applicable
to goods circulated on the market.
During the effective
period of the certificate of conformity, the enterprise whose electrical and
electronic equipment have had their conformity certified must promptly notify
the conformity certification body in writing of changes of EMC-related parts of
such electrical and electronic equipment.
The enterprise must
archive documents for at least 6 years from the date on which the final product
of the type whose conformity has been declared is released (for domestically
produced electrical and electronic equipment) or imported (for imported
electrical and electronic equipment).
4.2. Responsibilities
of conformity certification bodies
Conformity certification
bodies must fulfill the obligations set out in the Decree No. 107/2016/ND-CP.
Conformity certification
bodies must receive and respond to enterprises' notifications of changes of
products and goods related to EMC.
Conformity certification
bodies must archive documents concerning conformity certification for at least
6 years from the expiry date of the certificate of conformity.
