Quy chuẩn quốc gia về sản phẩm, hàng hóa vật liệu xây dựng áp dụng từ 01/01/2024

Đây là nội dung tại Thông tư 04/2023/TT-BXD ngày 30/6/2023 Quy chuẩn kỹ thuật quốc gia về sản phẩm, hàng hóa vật liệu xây dựng do Bộ trưởng Bộ Xây dựng ban hành.

Quy chuẩn quốc gia về sản phẩm, hàng hóa vật liệu xây dựng áp dụng từ 01/01/2024

Theo đó, quy định chung của Quy chuẩn kỹ thuật quốc gia về sản phẩm, hàng hóa vật liệu xây dựng ban hành kèm theo Thông tư 04/2023/TT-BXD như sau:

- Các sản phẩm, hàng hóa vật liệu xây dựng phải đảm bảo không gây mất an toàn trong quá trình vận chuyển, lưu giữ, bảo quản và sử dụng. Khi lưu thông trên thị trường, đối với sản phẩm, hàng hóa sản xuất trong nước phải có giấy chứng nhận hợp quy và thông báo tiếp nhận hồ sơ công bố hợp quy của cơ quan kiểm tra tại địa phương; đối với hàng hóa nhập khẩu phải có Giấy chứng nhận hợp quy.

- Các tổ chức, cá nhân sản xuất, nhập khẩu, kinh doanh, sử dụng sản phẩm phải kê khai đúng chủng loại sản phẩm, hàng hóa vật liệu xây dựng phù hợp với danh mục sản phẩm quy định tại Bảng 1, Phần 2 Quy chuẩn kỹ thuật quốc gia về sản phẩm, hàng hóa vật liệu xây dựng ban hành kèm theo Thông tư 04/2023/TT-BXD .

Trường hợp không rõ chủng loại sản phẩm, hàng hóa các tổ chức, cá nhân có liên quan phải phối hợp với Tổ chức chứng nhận hợp quy, Tổ chức thử nghiệm để thực hiện việc định danh loại sản phẩm.

- Các sản phẩm, hàng hóa vật liệu xây dựng sản xuất trong nước, nhập khẩu quy định tại Bảng 1, Phần 2 Quy chuẩn kỹ thuật quốc gia về sản phẩm, hàng hóa vật liệu xây dựng ban hành kèm theo Thông tư 04/2023/TT-BXD áp dụng biện pháp quản lý dựa trên kết quả chứng nhận của Tổ chức chứng nhận đã đăng ký hoặc được thừa nhận theo quy định của pháp luật.

- Dấu hợp quy được sử dụng trực tiếp trên sản phẩm, hàng hóa hoặc trên bao gói hoặc trên nhãn gắn trên sản phẩm, hàng hóa hoặc trong chứng chỉ chất lượng, tài liệu kỹ thuật của sản phẩm theo quy định về dấu hợp quy và sử dụng dấu hợp quy của Thông tư 28/2012/TT-BKHCN và Phụ lục IX ban hành kèm theo Thông tư 26/2019/TT-BKHCN .

BAN HÀNH QUY CHUẨN KỸ THUẬT QUỐC GIA VỀ SẢN PHẨM, HÀNG HÓA VẬT LIỆU XÂY DỰNG

Căn cứ Luật Tiêu chuẩn và quy chuẩn kỹ thuật ngày 29 tháng 6 năm 2006;

Căn cứ Nghị định số 127/2007/NĐ-CP ngày 01 tháng 8 năm 2007 của Chính phủ quy định chi tiết thi hành một số điều của Luật Tiêu chuẩn và Quy chuẩn kỹ thuật;

Căn cứ Nghị định số 78/2018/NĐ-CP ngày 16 tháng 5 năm 2018 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 127/2007/NĐ-CP ngày 01 tháng 8 năm 2007 của Chính phủ quy định chi tiết thi hành một số điều của Luật Tiêu chuẩn và Quy chuẩn kỹ thuật;

Căn cứ Nghị định số 52/2022/NĐ-CP ngày 08 tháng 8 năm 2022 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Xây dựng;

Theo đề nghị của Vụ trưởng Vụ Khoa học công nghệ và môi trường;

Bộ trưởng Bộ Xây dựng ban hành Thông tư ban hành Quy chuẩn kỹ thuật quốc gia về sản phẩm, hàng hóa vật liệu xây dựng.

Điều 1. Ban hành kèm theo Thông tư này Quy chuẩn kỹ thuật QCVN 16:2023/BXD Quy chuẩn kỹ thuật quốc gia về sản phẩm, hàng hóa vật liệu xây dựng.

Điều 2. Quy chuẩn kỹ thuật QCVN 16:2023/BXD có hiệu lực thi hành kể từ ngày 01 tháng 01 năm 2024.

Điều 3. Bãi bỏ Quy chuẩn kỹ thuật QCVN 16:2019/BXD Quy chuẩn kỹ thuật quốc gia về sản phẩm, hàng hóa vật liệu xây dựng ban hành kèm theo Thông tư số 19/2019/TT-BXD ngày 31 tháng 12 năm 2019 của Bộ trưởng Bộ Xây dựng.

Điều 4. Điều khoản chuyển tiếp

1. Đối với các tổ chức, cá nhân sản xuất, nhập khẩu hàng hóa vật liệu xây dựng đã được cấp Giấy chứng nhận hợp quy phù hợp Quy chuẩn kỹ thuật QCVN16:2019/BXD và Giấy chứng nhận còn hiệu lực thì được phép sử dụng Giấy chứng nhận hợp quy và dấu hợp quy cho đến khi hết hiệu lực của Giấy chứng nhận đó.

2. Đối với các tổ chức đã được chỉ định chứng nhận hợp quy, thử nghiệm đối với các sản phẩm, hàng hóa vật liệu xây dựng theo Quy chuẩn kỹ thuật QCVN 16:2019/BXD thì được phép tiếp tục thực hiện chứng nhận hợp quy, thử nghiệm đối với các sản phẩm, hàng hóa vật liệu xây dựng có trong Quyết định chỉ định đồng thời có trong danh mục sản phẩm hàng hóa vật liệu xây dựng theo Quy chuẩn kỹ thuật QCVN 16:2023/BXD đến khi hết hạn hiệu lực của Quyết định chỉ định.

3. Trường hợp quyết định chỉ định hết thời hạn trong khoảng thời gian Quy chuẩn này ban hành nhưng chưa có hiệu lực thì được phép gia hạn hoạt động chứng nhận hợp quy, thử nghiệm đến ngày Quy chuẩn này có hiệu lực./.

PHẦN 1. QUY ĐỊNH CHUNG

1.1. Phạm vi điều chỉnh

1.1.1. Quy chuẩn này quy định về mức giới hạn của đặc tính kỹ thuật và yêu cầu quản lý các sản phẩm, hàng hóa vật liệu xây dựng nêu trong Bảng 1, Phần 2, thuộc nhóm 2 theo quy định tại Luật Chất lượng sản phẩm, hàng hóa (sau đây gọi là sản phẩm, hàng hóa vật liệu xây dựng) được sản xuất trong nước, nhập khẩu, kinh doanh, lưu thông trên thị trường và sử dụng vào các công trình xây dựng trên lãnh thổ Việt Nam.

1.1.2. Quy chuẩn này không áp dụng cho sản phẩm, hàng hóa vật liệu xây dựng nhập khẩu dưới dạng mẫu hàng để quảng cáo không có giá trị sử dụng; hàng mẫu để nghiên cứu; mẫu hàng để thử nghiệm; hàng hóa tạm nhập khẩu để trưng bày, giới thiệu tại hội chợ triển lãm; hàng hóa tạm nhập - tái xuất, không tiêu thụ và sử dụng tại Việt Nam; hàng hóa trao đổi của cư dân biên giới, quà biếu, tặng trong định mức thuế; hàng hóa quá cảnh, chuyển khẩu, trung chuyển; Hàng hóa phục vụ yêu cầu khẩn cấp theo chỉ đạo của Chính phủ và hàng chuyên dụng phục vụ mục đích quốc phòng, an ninh.

1.2. Đối tượng áp dụng

1.2.1. Các tổ chức, cá nhân sản xuất, nhập khẩu, kinh doanh, sử dụng sản phẩm, hàng hóa vật liệu xây dựng.

1.2.2. Các tổ chức thử nghiệm, tổ chức chứng nhận hợp quy thực hiện việc đánh giá, chứng nhận hợp quy sản phẩm, hàng hóa vật liệu xây dựng.

1.2.3. Các cơ quan quản lý nhà nước có liên quan về chất lượng sản phẩm, hàng hóa vật liệu xây dựng.

1.3. Giải thích từ ngữ

Trong Quy chuẩn này, các từ ngữ dưới đây được hiểu như sau:

1.3.1. Cơ quan kiểm tra nhà nước về chất lượng sản phẩm, hàng hóa vật liệu xây dựng là cơ quan được phân công, phân cấp thực hiện nhiệm vụ kiểm tra nhà nước về chất lượng sản phẩm, hàng hóa vật liệu xây dựng thuộc trách nhiệm quản lý của Bộ Xây dựng (sau đây viết tắt là cơ quan kiểm tra). Cơ quan kiểm tra tại địa phương là Sở Xây dựng.

1.3.2. Sản phẩm, hàng hóa vật liệu xây dựng nhóm 2 là sản phẩm, hàng hóa trong điều kiện vận chuyển, lưu giữ, bảo quản, sử dụng hợp lý và đúng mục đích vẫn tiềm ẩn khả năng gây hại cho người, động vật, thực vật, tài sản, môi trường.

1.3.3. Mã HS là mã số phân loại hàng hóa xuất nhập khẩu ghi trong Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam do Bộ Tài chính ban hành.

1.3.4. Lô sản phẩm là tập hợp một loại sản phẩm, hàng hóa vật liệu xây dựng có cùng thông số kỹ thuật và được sản xuất cùng một đợt trên cùng một dây chuyền công nghệ.

1.3.5. Lô hàng hóa là tập hợp một loại sản phẩm, hàng hóa vật liệu xây dựng được xác định về số lượng, có cùng nội dung ghi nhãn do một tổ chức, cá nhân sản xuất, nhập khẩu tại cùng một địa điểm được phân phối, tiêu thụ trên thị trường.

1.3.6. Mẫu điển hình của sản phẩm, hàng hóa vật liệu xây dựng là mẫu đại diện cho một kiểu, loại cụ thể của sản phẩm, hàng hóa được sản xuất theo cùng một dạng thiết kế, trong cùng một điều kiện về dây chuyền, công nghệ sản xuất và sử dụng cùng loại nguyên vật liệu.

1.3.7. Mẫu đại diện của lô sản phẩm, hàng hóa vật liệu xây dựng là mẫu được lấy theo tỷ lệ và ngẫu nhiên từ cùng một lô hàng hóa và đảm bảo tính đại diện cho toàn bộ lô hàng hóa, được dùng để đánh giá, chứng nhận hợp quy.

1.3.8. Lưu thông hàng hóa là hoạt động trưng bày, khuyến mại, vận chuyển và lưu giữ hàng hóa trong quá trình mua bán hàng hóa, trừ trường hợp vận chuyển hàng hóa của tổ chức, cá nhân nhập khẩu hàng hóa từ cửa khẩu về kho lưu giữ.

1.4. Quy định chung

1.4.1. Các sản phẩm, hàng hóa vật liệu xây dựng phải đảm bảo không gây mất an toàn trong quá trình vận chuyển, lưu giữ, bảo quản và sử dụng. Khi lưu thông trên thị trường, đối với sản phẩm, hàng hóa sản xuất trong nước phải có giấy chứng nhận hợp quy và thông báo tiếp nhận hồ sơ công bố hợp quy của cơ quan kiểm tra tại địa phương; đối với hàng hóa nhập khẩu phải có Giấy chứng nhận hợp quy.

1.4.2. Các tổ chức, cá nhân sản xuất, nhập khẩu, kinh doanh, sử dụng sản phẩm phải kê khai đúng chủng loại sản phẩm, hàng hóa vật liệu xây dựng phù hợp với danh mục sản phẩm quy định tại Bảng 1, Phần 2 của Quy chuẩn này. Trường hợp không rõ chủng loại sản phẩm, hàng hóa các tổ chức, cá nhân có liên quan phải phối hợp với Tổ chức chứng nhận hợp quy, Tổ chức thử nghiệm để thực hiện việc định danh loại sản phẩm.

1.4.3. Các sản phẩm, hàng hóa vật liệu xây dựng sản xuất trong nước, nhập khẩu quy định tại Bảng 1, Phần 2 của Quy chuẩn này áp dụng biện pháp quản lý dựa trên kết quả chứng nhận của Tổ chức chứng nhận đã đăng ký hoặc được thừa nhận theo quy định của pháp luật.

1.4.4. Dấu hợp quy được sử dụng trực tiếp trên sản phẩm, hàng hóa hoặc trên bao gói hoặc trên nhãn gắn trên sản phẩm, hàng hóa hoặc trong chứng chỉ chất lượng, tài liệu kỹ thuật của sản phẩm theo quy định về dấu hợp quy và sử dụng dấu hợp quy của Thông tư số 28/2012/TT-BKHCN và Phụ lục IX ban hành kèm theo Thông tư số 26/2019/TT-BKHCN.

1.5. Tài liệu viện dẫn

Các tài liệu viện dẫn sau là cần thiết khi áp dụng quy chuẩn này. Đối với các tài liệu viện dẫn ghi năm công bố thì áp dụng phiên bản được nêu. Đối với các tài liệu viện dẫn không ghi năm công bố thì áp dụng phiên bản mới nhất, bao gồm cả các sửa đổi, bổ sung (nếu có). Trường hợp các tiêu chuẩn, quy chuẩn, văn bản được viện dẫn trong quy chuẩn này có sự thay đổi, bổ sung hoặc thay thế thì thực hiện theo quy định trong văn bản mới.

PHẦN 2. QUY ĐỊNH VỀ KỸ THUẬT

2.1. Không sử dụng nguyên liệu amiăng amfibôn (tên viết khác amfibole) cho chế tạo các sản phẩm vật liệu xây dựng. Nhóm amiăng amfibôn bị cấm sử dụng gồm 05 loại sau:

2.2. Các sản phẩm, hàng hóa vật liệu xây dựng phải được kiểm tra các chỉ tiêu kỹ thuật theo các phương pháp thử tương ứng và phải thỏa mãn mức yêu cầu quy định trong Bảng 1.

PHẦN 3. QUY ĐỊNH VỀ QUẢN LÝ

3.1. Quy định về chứng nhận hợp quy

3.1.1. Việc chứng nhận hợp quy cho các sản phẩm, hàng hóa vật liệu xây dựng ở Bảng 1 Phần 2 của Quy chuẩn này được thực hiện theo các phương thức đánh giá nêu tại khoản 3.1.2.

3.1.2. Các phương thức đánh giá chứng nhận hợp quy được quy định tại Thông tư số 28/2012/TT-BKHCN ngày 12/12/2012 của Bộ trưởng Bộ Khoa học và Công nghệ Quy định về Công bố hợp chuẩn, công bố hợp quy và phương thức đánh giá sự phù hợp với tiêu chuẩn, quy chuẩn (sau đây gọi tắt là Thông tư 28/2012/TT-BKHCN) và Thông tư số 02/2017/TT-BKHCN ngày 31/3/2017 của Bộ trưởng Bộ Khoa học và Công nghệ về sửa đổi bổ sung một số điều của Thông tư số 28/2012/TT-BKHCN (sau đây gọi tắt là Thông tư 02/2017/TT-BKHCN), cụ thể như sau:

- Phương thức 1: Thử nghiệm mẫu điển hình.

Hiệu lực của Giấy chứng nhận hợp quy không quá 01 năm. Giấy chứng nhận hợp quy chỉ có giá trị đối với kiểu, loại sản phẩm, hàng hóa được lấy mẫu thử nghiệm.

Hàng hóa vật liệu xây dựng nhập khẩu áp dụng phương thức này khi:

+ Cơ sở sản xuất tại nước ngoài đã được cấp chứng chỉ hệ thống quản lý chất lượng phù hợp tiêu chuẩn ISO 9001 đối với lĩnh vực sản xuất sản phẩm vật liệu xây dựng này và chứng chỉ đang còn hiệu lực

+ Giám sát thông qua việc thử nghiệm mẫu mỗi lần nhập khẩu.

- Phương thức 5: Thử nghiệm mẫu điển hình và đánh giá quá trình sản xuất; giám sát thông qua thử nghiệm mẫu lấy tại nơi sản xuất hoặc trên thị trường kết hợp với đánh giá quá trình sản xuất.

Hiệu lực của Giấy chứng nhận hợp quy không quá 3 năm và giám sát hàng năm thông qua việc thử nghiệm mẫu tại nơi sản xuất hoặc trên thị trường kết hợp với đánh giá quá trình sản xuất.

Phương thức này áp dụng đối với các loại sản phẩm được sản xuất bởi cơ sở sản xuất trong nước hoặc nước ngoài đã xây dựng và duy trì hệ thống quản lý chất lượng nhằm đảm bảo duy trì ổn định chất lượng sản phẩm, hàng hóa.

- Phương thức 7: Thử nghiệm, đánh giá lô sản phẩm, hàng hóa.

Hiệu lực của Giấy chứng nhận hợp quy chỉ có giá trị cho lô sản phẩm, hàng hóa vật liệu xây dựng sản xuất, nhập khẩu.

3.2. Quy định về công bố hợp quy

3.2.1. Các sản phẩm, hàng hóa vật liệu xây dựng sản xuất trong nước phải được công bố hợp quy tại Cơ quan kiểm tra tại địa phương nơi đăng ký kinh doanh dựa trên Kết quả chứng nhận của Tổ chức chứng nhận đã đăng ký hoặc thừa nhận theo quy định của pháp luật;

3.2.2. Hồ sơ, trình tự, thủ tục công bố hợp quy thực hiện theo quy định tại Điều 14, Điều 15 Thông tư số 28/2012/TT-BKHCN, được sửa đổi, bổ sung tại Thông tư số 02/2017/TT-BKHCN và Thông tư số 06/2020/TT-BKHCN (Áp dụng phiên bản mới nhất khi được thay thế, sửa đổi)

3.3. Quy định đối với hàng hóa vật liệu xây dựng nhập khẩu

3.3.1. Đối với hàng hóa vật liệu xây dựng nhập khẩu quy định tại Phần 2 của Quy chuẩn, người nhập khẩu phải thực hiện:

a) Đăng ký kiểm tra nhà nước về chất lượng hàng hóa nhập khẩu thực hiện tại Cơ quan kiểm tra tại địa phương nơi nhập khẩu sản phẩm, hàng hóa.

b) Khi đăng ký kiểm tra nhà nước, phải xác định tên Tổ chức chứng nhận hợp quy, tên Tổ chức thử nghiệm thực hiện việc thử nghiệm, đánh giá chứng nhận chất lượng hàng hóa nhập khẩu trên Bản đăng ký theo Mẫu số 01 -Nghị định số 74/2018/NĐ-CP ngày 15/5/2018 của Chính phủ, được sửa đổi, bổ sung theo khoản 9 Điều 4 của Nghị định số 154/2018/NĐ-CP ngày 9/11/2018 của Chính phủ. Cơ quan kiểm tra xác nhận người nhập khẩu đã đăng ký kiểm tra chất lượng hàng hóa nhập khẩu trên bản đăng ký.

c) Người nhập khẩu nộp bản đăng ký có xác nhận của Cơ quan kiểm tra cho Cơ quan hải quan để được phép thông quan hàng hóa;

d) Trong thời hạn 15 ngày làm việc (đối với nhóm sản phẩm xi măng, phụ gia cho xi măng, bê tông và vữa là 35 ngày làm việc) kể từ ngày thông quan hàng hóa, người nhập khẩu phải nộp bản sao y bản chính (có ký tên và đóng dấu của người nhập khẩu), Giấy chứng nhận hợp quy và kết quả kiểm tra chất lượng hàng hóa (được thực hiện bởi tổ chức chứng nhận hợp quy và tổ chức thử nghiệm đã có tên trong bản đăng ký nộp cho Cơ quan kiểm tra trước đó) phù hợp với Bảng 1 của quy chuẩn này cho Cơ quan kiểm tra.

đ)Trường hợp, hàng hóa đã được Tổ chức chứng nhận đánh giá tại nước xuất khẩu, trong thời hạn 03 ngày làm việc kể từ ngày thông quan, người nhập khẩu phải nộp bản sao y bản chính (có ký tên và đóng dấu của người nhập khẩu), Giấy chứng nhận hợp quy cho Cơ quan kiểm tra.

e) Trường hợp, người nhập khẩu thực hiện đăng ký kiểm tra chất lượng trên Cổng thông tin một cửa quốc gia thì thực hiện đăng ký kiểm tra và trả kết quả kiểm tra chất lượng thông qua Cổng thông tin một cửa quốc gia.

g) Người nhập khẩu hoàn toàn chịu trách nhiệm trước pháp luật về chất lượng hàng hóa do mình nhập khẩu.

3.3.2. Áp dụng biện pháp miễn giảm kiểm tra chất lượng hàng hóa vật liệu xây dựng nhập khẩu theo quy định tại khoản 3 Điều 1 Nghị định 74/2018/NĐ-CP và khoản 3 Điều 4 Nghị định 154/2018/NĐ-CP ngày 09/11/2018 của Chính phủ sửa đổi, bổ sung, bãi bỏ một số quy định về điều kiện đầu tư, kinh doanh trong lĩnh vực quản lý nhà nước của Bộ Khoa học và Công nghệ và một số quy định về kiểm tra chuyên ngành.

Đơn vị nhập khẩu khi có nhu cầu miễn giảm kiểm tra, lập 01 bộ hồ sơ đề nghị miễn kiểm tra theo quy định tại khoản 3 Điều 4 Nghị định 154/2018/NĐ-CP gửi về Cơ quan kiểm tra tại địa phương để xem xét, xác nhận miễn giảm.

Trong thời gian được miễn giảm kiểm tra chất lượng hàng hóa nhập khẩu: đơn vị nhập khẩu thực hiện theo quy định tại Điều 7, Thông tư số 06/2020/TT-BKHCN ngày 10/12/2020.

3.4. Quy định về xử lý hồ sơ nhập khẩu và chất lượng hàng hóa vật liệu xây dựng nhập khẩu không phù hợp quy chuẩn kỹ thuật: thực hiện theo khoản 3 Điều 6, Điều 9 Thông tư số 06/2020/TT-BKHCN ngày 10/12/2020.

3.5. Phương pháp lấy mẫu, quy cách và số lượng mẫu để thử nghiệm đánh giá

3.5.1. Phương pháp lấy mẫu điển hình, mẫu đại diện tuân theo các quy định nêu trong tiêu chuẩn quốc gia hiện hành về phương pháp lấy mẫu và chuẩn bị mẫu thử đối với sản phẩm tương ứng.

3.5.2. Quy cách và số lượng mẫu điển hình, mẫu đại diện cho mỗi lô sản phẩm, hàng hóa tuân theo quy định trong Bảng 1, Phần 2 tương ứng với từng loại sản phẩm.

3.5.3. Đối với hàng hóa vật liệu xây dựng nhập khẩu với số lượng ít không đủ để lấy mẫu thử nghiệm theo quy định hoặc chi phí thử nghiệm được xác định thông qua 03 báo giá của tổ chức thử nghiệm cho thấy lớn hơn so với giá trị của lô hàng nhập khẩu; Đồng thời người nhập khẩu cần chứng minh hàng hóa không sử dụng, lưu thông và đưa vào công trình xây dựng thì áp dụng theo điều 1.1.2 của Quy chuẩn này.

Đối với hàng hóa vật liệu xây dựng nhập khẩu không đúng quy cách quy định tại Phần 2, người nhập khẩu có trách nhiệm phối hợp với tổ chức chứng nhận làm việc với đơn vị sản xuất và xuất khẩu tại nước ngoài để gửi mẫu đảm bảo tính đại diện cho lô hàng hóa nhập khẩu phục vụ cho công tác chứng nhận chất lượng theo quy định, số lượng mẫu phải đủ cho công tác thử nghiệm và lưu mẫu.

3.6. Quy định về bao gói, ghi nhãn, vận chuyển và bảo quản

Các sản phẩm, hàng hóa vật liệu xây dựng phải ghi nhãn theo quy định tại Nghị định số 43/2017/NĐ-CP ngày 14 tháng 4 năm 2017 của Chính phủ về nhãn hàng hóa và Nghị định số 111/2021/NĐ-CP ngày 09 tháng 12 năm 2021 của Chính phủ sửa đổi, bổ sung một số điều Nghị định số 43/2017/NĐ-CP ngày 14 tháng 4 năm 2017 của Chính phủ về nhãn hàng hóa, Thông tư số 18/2022/TT-BKHCN của Bộ KH&CN quy định chi tiết một số nội dung bắt buộc thể hiện trên nhãn hàng hóa của một số nhóm hàng hóa bằng phương thức điện tử.

Thực hiện quy định về bao gói (với sản phẩm đóng bao, kiện, thùng), vận chuyển và bảo quản được nêu trong tiêu chuẩn đối với sản phẩm, hàng hóa đó.

PHẦN 4. HOẠT ĐỘNG ĐĂNG KÝ/ THỪA NHẬN ĐỐI VỚI TỔ CHỨC CHỨNG NHẬN HỢP QUY, TỔ CHỨC THỬ NGHIỆM

4.1. Các tổ chức chứng nhận, tổ chức thử nghiệm có năng lực đáp ứng yêu cầu về thử nghiệm, chứng nhận đối với sản phẩm, hàng hóa vật liệu xây dựng phù hợp với quy định tại QCVN 16:2023/BXD, lập hồ sơ đăng ký theo quy định tại Nghị định số 107/2016/NĐ-CP, Nghị định số 154/2018/NĐ-CP nộp về Bộ Xây dựng để xem xét cấp Giấy chứng nhận đăng ký hoạt động chứng nhận; Giấy chứng nhận đăng ký hoạt động thử nghiệm.

4.2. Bộ Xây dựng xem xét, thừa nhận các Tổ chức chứng nhận, Tổ chức thử nghiệm tại nước ngoài thực hiện công tác chứng nhận, thử nghiệm các sản phẩm, hàng hóa vật liệu xây dựng tại Bảng 1 theo quy định của Pháp luật khi Thỏa thuận thừa nhận lẫn nhau được ký kết.

PHẦN 5. TRÁCH NHIỆM CỦA CÁC TỔ CHỨC VÀ CÁ NHÂN LIÊN QUAN ĐẾN HOẠT ĐỘNG CHỨNG NHẬN HỢP QUY VÀ CÔNG BỐ HỢP QUY

5.1. Cơ quan chuyên môn của Bộ Xây dựng có trách nhiệm:

5.1.1. Hướng dẫn hoạt động chứng nhận hợp quy.

5.1.2. Tổ chức xây dựng, soát xét, sửa đổi, bổ sung Quy chuẩn kỹ thuật quốc gia về sản phẩm, hàng hóa vật liệu xây dựng.

5.1.3. Kiểm tra, theo dõi, tổng hợp tình hình hoạt động của các Tổ chức chứng nhận, Tổ chức thử nghiệm đã đăng ký hoạt động và thừa nhận; đề xuất cấp, đình chỉ và thu hồi Giấy chứng nhận đăng ký hoạt động đối với các Tổ chức chứng nhận, Tổ chức thử nghiệm đăng ký theo Nghị định số 107/2016/NĐ-CP và công bố trên trang thông tin của Bộ Xây dựng;

5.1.4. Theo dõi, tổng hợp, kiểm tra (định kỳ hoặc đột xuất) tình hình hoạt động công bố hợp quy, việc xác nhận miễn giảm kiểm tra chất lượng sản phẩm, hàng hóa vật liệu xây dựng của các Cơ quan kiểm tra tại địa phương.

5.2. Cơ quan kiểm tra tại địa phương có trách nhiệm:

5.2.1. Tiếp nhận hồ sơ công bố hợp quy của tổ chức, cá nhân đối với sản phẩm, hàng hóa vật liệu xây dựng sản xuất; Tiếp nhận, xử lý hồ sơ đăng ký kiểm tra nhà nước đối với hàng hóa nhập khẩu.

5.2.2. Tiếp nhận Hồ sơ miễn giảm kiểm tra chất lượng hàng hóa nhập khẩu của các tổ chức, cá nhân và có văn bản xác nhận hoặc từ chối miễn giảm kiểm tra hoặc có văn bản thông báo dừng áp dụng chế độ miễn giảm kiểm tra theo quy định tại khoản 3 điều 4 Nghị định số 154/2018/NĐ-CP.

5.2.3. Quản lý, kiểm tra các hoạt động chứng nhận hợp quy, công bố hợp quy đối với sản phẩm, hàng hóa vật liệu xây dựng trên địa bàn. Phối hợp với các cơ quan kiểm tra địa phương tại các cửa khẩu để kiểm tra việc thực hiện công tác đăng ký kiểm tra nhà nước và sự phù hợp chất lượng đối với hàng hóa nhập khẩu.

5.2.4. Tổng hợp tình hình hoạt động chứng nhận hợp quy, công bố hợp quy, kết quả kiểm tra nhà nước đối với hàng hóa nhập khẩu, tình hình miễn giảm kiểm tra hàng hóa và gửi báo cáo về Bộ Xây dựng trước ngày 25 tháng 12 hàng năm hoặc đột xuất theo yêu cầu của Bộ Xây dựng.

5.3. Tổ chức chứng nhận hợp quy và Tổ chức thử nghiệm có trách nhiệm:

5.3.1. Định kỳ trước ngày 20 tháng 12 hàng năm hoặc đột xuất theo yêu cầu, gửi báo cáo bằng văn bản về kết quả hoạt động chứng nhận hợp quy, hoạt động thử nghiệm về Cơ quan kiểm tra tại địa phương và Bộ Xây dựng.

5.3.2. Khi có thay đổi năng lực hoạt động chứng nhận hợp quy, hoạt động thử nghiệm so với hồ sơ đã đăng ký, trong thời hạn 15 ngày kể từ ngày có sự thay đổi phải thông báo cho Bộ Xây dựng.

5.3.3. Thực hiện các quyền và nghĩa vụ khác theo quy định của pháp luật

5.4. Các tổ chức, cá nhân sản xuất và nhập khẩu sản phẩm, hàng hóa vật liệu xây dựng có trách nhiệm:

Tuân thủ các quy định của Pháp luật và đảm bảo chất lượng sản phẩm, hàng hóa đáp ứng các quy định của Quy chuẩn trước khi lưu thông và đưa vào công trình xây dựng.

Thực hiện các quyền và nghĩa vụ khác theo quy định của pháp luật.

Ghi chú:

CIRCULAR

PROMULGATING NATIONAL TECHNICAL REGULATIONS ON PRODUCTS AND GOODS OF BUILDING MATERIALS

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 on elaboration of some Articles of the Law on Standards and Technical Regulations;

Pursuant to the Government's Decree No. 78/2018/ND-CP on amendments to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 on elaboration of some Articles of the Law on Standards and Technical Regulations;

Pursuant to the Government's Decree No. 52/2022/ND-CP dated August 08, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Construction;

At the request of the Director General of the Department of Science Technology and Environment;

The Minister of Construction hereby promulgates a Circular promulgating National technical regulations on products and goods of building materials.

Article 2. QCVN 16:2023/BXD comes into force from January 01, 2024.

Article 3. QCVN 16:2019/BXD National technical regulations on products and goods of building materials QCVN 16:2017/BXD promulgated together with the Circular No. 19/2019/TT-BXD dated December 31, 2019 of the Minister of Construction is superseded.

Article 4. Grandfather clauses

1. Where a manufacturer or importer of goods of building materials has been issued with a certificate of conformity in compliance with QCVN 16:2019/BXD and it remains effective, they may use the certificate of conformity and respective conformity mark until the expiry of the certificate.

2. Any body which has been designated to certify conformity and test products and goods of building materials in accordance with QCVN 16:2019/BXD may continue to certify conformity and test products and goods of building materials included in the designation decision and the list of products and goods of building materials under QCVN 16:2023/BXD under QCVN 16:2023/BXD until the expiry of the designation decision.

3. If the designation decision expires after this Regulation is promulgated but before it officially takes effect, an extension may be granted provided that it does not go beyond the effective date of this Circular./.

1.1.2. This document shall not apply to products, goods of building materials imported in the form of samples for advertising purpose only that have no use value; samples serving research; samples for testing; temporarily imported goods for displaying at a trade fair or exhibition; goods which are temporarily imported for re-export, and not consumed and used in Vietnam; goods exchanged between residents of bordering areas, gifts or donations within the duty-free allowance; goods in transit, merchanting trade or transshipment; goods serving emergency demands according to the Government’s directives and goods serving national defense or security purposes.

1.2. Regulated entities

1.2.1. Manufacturers, importers, traders and users of products, goods of building materials.

1.2.2. Testing bodies and certification bodies that assess and grant certificates of conformity to products, goods of building materials.

1.2.3. Relevant regulatory bodies responsible for quality of products, goods of building materials.

1.3. Definitions

For the purposes of this Regulation, the terms below shall be construed as follows:

1.3.1. “regulatory inspecting authority for quality of products, goods of building materials” refers to an authority assigned or decentralized to perform state inspection of quality of products, goods of building materials under management of the Ministry of Construction (hereinafter referred to as “inspecting authority”). The local inspecting authority is the Department of Construction.

1.3.2. “category 2 products, goods of building materials” refers to the products or goods which are transported, stored, preserved and used reasonably and for their intended purposes but still potentially cause harm to humans, animals, plants, assets and environment.

1.3.4. “batch” combines one type of products or goods of building materials having similar specifications and produced at once through one production line.

1.3.5. “lot” combines one type of products or goods of building materials, in a defined quantity, which have similar label content, are produced or imported by one manufacturer or importer at one location and are distributed and sold on the market.

1.3.6. “representative sample of products or goods of building materials” refers to a sample representing a specific type of product or good manufactured in similar design, under similar condition regarding production line and technology and with similar type of material.

1.3.7. “representative sample of batch and lot” refers to the sample that is taken in a certain ratio and randomly from the same lot in a manner that the representative nature for entire lot is ensured, and used for conformity assessment and certification.

1.3.8. “circulation of goods” involves displaying, promoting, transporting or storing goods in the process of goods sale and purchase, except the transport of goods by importers from a checkpoint to a storehouse.

1.4. General

1.4.1. Products, goods of building materials must be transported, stored and used in a manner that does not represent any safety hazard. Upon circulated on the market, domestically manufactured products and goods must have the certificate of conformity and notification of receipt of application for declaration of conformity declaration issued by the local inspecting authority; imports must have the certificate of conformity.

1.4.2. Manufacturers, importers, traders and users of products must accurately declare types of products, goods of building materials in accordance with product list in Table 1 Part 2 of this Regulation. Otherwise, it is required to cooperate with a conformity certification body or testing body to identify the products.

1.4.3. Domestically manufactured and imported products and goods of building materials specified in Table 1 Part 2 of this Regulation shall be subject to management measures according to the certification result given by the certification body registered or recognized as prescribed by law.

PART 3. REGULATORY REQUIREMENTS

3.1. Conformity certification

3.1.1. Conformity of products and goods of building materials in Table 1 Part 2 of this Regulation shall be certified using the assessment methods mentioned in 3.1.2.

3.1.2. Conformity assessment methods are set out in the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology on declaration of standard conformity and technical-regulation conformity and methods for conformity assessment (hereinafter referred to as “the Circular No. 28/2012/TT-BKHCN”) and the Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Minister of Science and Technology on amendments to some Articles of the Circular No. 28/2012/TT-BKHCN (hereinafter referred to as “the Circular No. 02/2017/TT-BKHCN”). To be specific:

- Method 1: Representative sample testing

The certificate of conformity shall be valid for no more than 01 year. It shall be only valid for the types of product and goods whose samples are taken for tests.

This method shall apply to imported products and goods of building materials when:

+ The foreign manufacturer has been issued with the certificate of quality management quality in conformity with ISO 9001 which covers the manufacturing of products of building materials and that certificate remains effective.

+ The supervision is carried out by testing samples upon each import.

The certificate of conformity shall be valid for no more than 03 years and annual supervision shall be carried out testing samples at the manufacturing location or on the market in association with assessment of the manufacturing process.

This method shall apply to the products manufactured by domestic or foreign manufacturers which have established and maintained a quality management system in order to stably maintain quality of products and goods.

- Method 7: Testing and assessing batches and lots.

The certificate of conformity shall be only valid for shipments of manufactured and imported products and goods of building materials.

3.2. Conformity declaration

3.2.1. Conformity of domestically manufactured and imported products and goods of building materials shall be declared at the inspecting authority of the local area where business is registered according to the certification result given by the certification body registered or recognized as prescribed by law;

3.2.2. Applications and procedures for conformity declaration are specified in Articles 14 and 15 of the Circular No. 28/2012/TT-BKHCN amended by the Circular No. 02/2017/TT-BKHCN and Circular No. 06/2020/TT-BKHCN (the newest version shall prevail when replaced or amended)

3.3. Regulations applicable to imported products and goods of building materials

3.3.1. Regarding imported goods of building materials specified in Part 2 of this Regulation, the importer shall:

b) When applying for state inspection, it is required to specify names of the conformity certification body and testing body carrying out testing and assessment of quality of imported goods in the Application form according to the Form No. 01 of the Government's Decree No. 74/2018/ND-CP dated May 15, 2018 amended by clause 9 Article 4 of the Government's Decree No. 154/2018/ND-CP dated November 9, 2018. The inspecting authority shall confirm in the application form that the importer has applied for inspection of quality of imported goods.

c) The importer shall submit the application form having the inspecting authority’s confirmation to the customs authority to be granted customs clearance;

d) Within 15 working days (35 working days for cement, cement, concrete and mortar admixtures) from the date of customs clearance, the importer shall submit a copy of the original application form (bearing the importer’s name and seal), certificate of conformity and result of inspection of goods quality (carried out by the conformity certification body and testing body specified in the application form previously submitted to the inspecting authority) in conformity with Table 1 of this Regulation to the inspecting authority.

dd) If the goods have been assessed by the certification body in the exporting country, within 03 working days from the date of customs clearance, the importer shall submit a copy of the original application form (bearing the importer’s name and seal) and certificate of conformity to the inspecting authority.

e) If the importer applies for quality inspection through the National Single Window Portal, apply for quality inspection and return inspection result through the National Single Window Portal.

g) The importer shall be totally responsible to the law for the quality of goods they import.

3.3.2. Reduction or exemption of inspection of quality of imported goods of building materials shall be applied according to clause 3 Article 1 of the Government's Decree No. 74/2018/ND-CP and clause 3 Article 4 of the Government’s Decree No. 154/2018/ND-CP dated November 09, 2018 amending, supplementing and repealing certain regulations on investment and business conditions in sectors under the management of the Ministry of Science and Technology and certain regulations on specialized inspections.

Any importer that has the need for reduction or exemption of inspection shall prepare an application as prescribed in clause 3 Article 4 of the Decree No. 154/2018/ND-CP and submit it to the local inspection authority for consideration and confirmation.

Throughout the duration of such reduction or exemption, the importer shall comply with the regulations enshrined in Article 7 of the Circular No. 06/2020/TT-BKHCN dated December 10, 2020.

3.5. Sampling methods, specifications and quantity of samples for testing and assessment

3.5.1. Methods for collecting representative samples shall comply with the provisions set out in prevailing national technical regulations on sampling methods and preparation of test samples applicable to corresponding products.

3.5.2. Specifications and quantity of representative samples of each lot of products or goods shall comply with the regulations set out in Table 1 Part 2 corresponding to each type of product.

3.5.3. Where goods of building materials imported in small quantity resulting in not being adequate for collecting samples as per regulations or the testing costs determined via 03 quotations of the testing body are greater than value of imported shipments; the importer has the need to prove that goods are not used, circulated and put into any construction work, Article 1.1.2 of this Regulation shall be complied.

For imported goods of building materials failing to meet the specifications specified in Part 2, the importer shall cooperate with the certification body in working with the manufacturer and exporter in the foreign country to send samples representing the shipment of imported goods to service the quality certification as prescribed; the quantity of samples shall be sufficient for testing and sample storage.

3.6. Packaging, labeling, transport and preservation

Products and goods of building materials shall be labelled as prescribed in the Government's Decree No. 43/2017/ND-CP dated April 14, 2017 on goods labels and Government's Decree No. 111/2021/ND-CP dated December 09, 2021 on amendments to some Articles of the Government's Decree No. 43/2017/ND-CP dated April 14, 2017 on goods labels and Circular No. 18/2022/TT-BKHCN of the Ministry of Science and Technology elaborating to mandatory information of labels of several goods categories to be displayed on electronic media.

Regulations on packaging (for products bagged, packaged or boxed), transport and preservation specified in the standard applied to such products shall be complied with.

PART 4. REGISTRATION BY/RECOGNITION OF CONFORMITY CERTIFICATION BODIES AND TESTING BODIES

4.2. The Ministry of Construction shall consider recognizing certification bodies and testing bodies in foreign countries that certify and test products and goods of building materials in Table 1 as prescribed by law when the mutual recognition agreement is signed.

PART 5. RESPONSIBILITIES OF RELEVANT ORGANIZATIONS AND INDIVIDUALS INVOLVED IN CONFORMITY CERTIFICATION AND DECLARATION

5.1. Specialized agency of the Ministry of Construction has the responsibility to:

5.1.1. Provide guidelines for conformity certification.

5.1.2. Organize the formulation, review and amendment of National technical regulation on products, goods of building materials.

5.1.3. Inspect, supervise and review activities of registered and recognized certification bodies and testing bodies; propose the issuance, invalidation and revocation of the certificate of registration of certification bodies and testing bodies according to the Decree No. 107/2016/ND-CP and publish such on the website of the Ministry of Construction;

5.1.4. Supervise, review and inspect (on a periodic or ad hoc basis) the declaration of conformity and certification of reduction or exemption of quality inspection of products and goods of building materials by local inspecting authorities.

5.2. Local inspecting authorities have the responsibility to:

5.2.1. Receive applications for conformity declaration of organizations and individuals for products and goods of building materials; receive and processing applications for state inspection of imported goods.

5.2.3. Manage and inspect certification and declaration of conformity of products and goods of building materials in the locality. Cooperate with local inspecting authorities at border checkpoints to inspect the registration of state inspection of quality and conformity with quality requirements for imports.

5.2.4. Submit a consolidated report on certification and declaration of conformity, results of state inspection of imports, and reduction and exemption of goods inspection to the Ministry of Construction before December 25 every year or at the request of the Ministry of Construction.

5.3. Conformity certification bodies and testing bodies have the responsibility to:

5.3.2. If the registered competence in conformity certification or testing is changed, the change shall be notified to the Ministry of Construction within 15 days from the date of change.

5.4. Manufacturers and importers of products, goods of building materials have the responsibility to:
