AMENDMENTS TO GOVERNMENT’S DECREE
NO.162/2013/ND-CP DATED NOVEMBER 12, 2013 PRESCRIBING PENALTIES FOR
ADMINISTRATIVE VIOLATIONS COMMITTED WITHIN TERRITORIAL WATERS, ISLANDS AND
CONTINENTAL SHELF OF THE SOCIALIST REPUBLIC OF VIETNAM, AS AMENDED BY DECREE
NO. 23/2017/ND-CP AND DECREE NO. 37/2022/ND-CP

The Government
promulgates a Decree providing amendments to the Government’s Decree
No.162/2013/ND-CP dated November 12, 2013 prescribing penalties for
administrative violations committed within territorial waters, islands and
continental shelf of the Socialist Republic of Vietnam, as amended by the
Decree No. 23/2017/ND-CP and the Decree No. 37/2022/ND-CP.
Article
1. Amendment of heading of Article 3, addition of clauses 1a and 1b following
clause 1 Article 3
1. Heading of Article 3 is amended as follows:
“Article 3. Penalties,
fines, power to impose fines, and penalty imposition rules”.
2. Clauses 1a and 1b are added following clause 1 as follows:
“1a. Primary penalties to
be imposed under this Decree include:
a) Warning;
b) Fine.
1b. Additional penalties
to be imposed under this Decree include:

operations for fixed periods;

2. Addition of clauses 6 and 7 following clause 5 Article 4
“6. Enforced return of
ship certifications/documents, practicing certificates, certificates of
competency, discharge books or passports which have been erased or altered to
issuing authorities or officers.
7. Enforced treatment of
exhibits which are hazardous waste”.

3. Amendment of clause 2, addition of clause 3 following clause 2 Article 8a
1. Clause 2 is amended as follows:
“2. Additional penalties:
Confiscate the exhibits and/or instrumentalities used for committing the
violation in point i clause 1 of this Article.”

Enforced payment of an amount equivalent to the value of the
exhibits/instrumentalities which have been sold, liquidated, hidden or
destroyed inconsistently with the law, if the violation in point i clause 1 of
this Article is committed.”.

4. Addition of point c following point b clause 9 Article 8b
“c) Enforced payment of an
amount equivalent to the value of the exhibits/instrumentalities which have
been sold, liquidated, hidden or destroyed inconsistently with the law, if any
of the violations in clause 5 of this Article is committed.”.

5. Amendment of clause 3, addition of clause 4 following clause 3 Article 15
1. Clause 3 is amended as follows:
“3. Additional penalties:
Confiscate the exhibits of administrative violations in points a and c clause 1
and clause 2 of this Article.”.
2. Clause 4 is added following clause 3 as follows:
“4. Remedial measures:
Enforced payment of an amount equivalent to the value of the
exhibits/instrumentalities which have been sold, liquidated, hidden or
destroyed inconsistently with the law, if any of the violations in points a and
c clause 1 and clause 2 of this Article is committed.”.

Suspend the master's certificate of competency for 01 - 06 months, if the
violation prescribed in clause 2 of this Article is committed;”.
2. Clause 8 is added following clause 7 as follows:
“8. Remedial measures:
Enforced return of ship certificates and documents to their issuing authorities
or officers, if the violation prescribed in clause 4 of this Article is
committed.”.

1. Clause 4 is amended as follows:
“4. Additional penalties:
Confiscate any forced certificates of competency, discharge books and
passports, if the violation prescribed in clause 3 of this Article is
committed.”.
2. Clause 5 is added following clause 4 as follows:
“5. Remedial measures:
Enforced return of erased or altered certificates of competency, discharge
books and passports to their issuing authorities or officers, if any of the
violations in clauses 2 and 3 of this Article is committed.”.

amount equivalent to the value of the exhibits/instrumentalities which have
been sold, liquidated, hidden or destroyed inconsistently with the law, if the
violation in point b clause 3 of this Article is committed.”.

“Article 28. Power to
impose penalties of Vietnam Coast Guard Forces
The title holders
specified in this Article shall have the power to impose penalties for the
administrative violations prescribed in Chapter II, except those committed by
foreigners as prescribed in points a, e and g clause 7 Article 8b of this
Decree. To be specific:
1. Police Officers on duty
of the Coast Guard Forces shall have the power to:
a) Issue warning;
b) Impose a fine up to VND
50.000.000;
c) Confiscate the
exhibits/instrumentalities whose value does not exceed twice the fine specified
in point b of this clause.
2. Coast Guard Team
Leaders shall have the power to:
a) Issue warning;
b) Impose a fine up to VND
100.000.000;

3. Heads of Coast Guard
Units or Coast Guard Stations shall have the power to:
a) Issue warning;

exhibits/instrumentalities whose value does not exceed twice the fine specified
in point b of this clause;
d) Impose the remedial
measures specified in points a, c and e clause 1 Article 28 of the Law on

of this Decree.
4. Captains of Coast Guard
Platoons shall have the power to:
a) Issue warning;
b) Impose a fine up to VND
300.000.000;
c) Confiscate the
exhibits/instrumentalities whose value does not exceed twice the fine specified
in point b of this clause;

5. Captains of Coast Guard
Squadrons; Heads of Reconnaissance Commissions, Heads of Task Force Commissions
for Drug Crime Prevention and Control under the control of Vietnam Coast Guard
shall have the power to:
a) Issue warning;
b) Impose a fine up to VND
500.000.000;
c) Suspend
licenses/practicing certificates or operations for fixed periods;
d) Confiscate the
exhibits/instrumentalities used for committing administrative violations;
dd) Impose the remedial
measures specified in points a, c, d, e and i clause 1 Article 28 of the Law on
Handling of Administrative Violations and clauses 2, 3, 4, 5, 6 and 7 Article 4
of this Decree.
6. Regional Coast Guard
Commanders, Director General of the Department of Operations and Legislation
under the control of Vietnam Coast Guard shall have the power to:
a) Issue warning;
b) Impose a fine up to VND
800.000.000;

The title holders
specified in this Article shall have the power to impose penalties for the
administrative violations prescribed in Chapter II, except those committed by

Decree, in the fields and areas under their management. To be specific:
1. On-duty soldiers of the
Border Guard Forces shall have the power to:
a) Issue warning;
b) Impose a fine up to VND

whose value does not exceed twice the fine specified in point b of this clause.
2. Station Heads or Team
Leaders in charge of managing soldiers of the Border Guard Forces shall have
the power to:

exhibits/instrumentalities whose value does not exceed twice the fine specified
in point b of this clause;

3. Leaders of Task Force
Teams for Drug and Crime Prevention and Control which are put under the control
of Task Force Commissions for Drug and Crime Prevention and Control shall have
the power to:
a) Issue warning;
b) Impose a fine up to VND
150.000.000;
c) Confiscate the
exhibits/instrumentalities whose value does not exceed twice the fine specified
in point b of this clause;
d) Impose the remedial
measures specified in points a, c and e clause 1 Article 28 of the Law on
Handling of Administrative Violations.
4. Heads of Border Guard
Posts, Captains of Naval Border Guard Flotillas, and Commanding Officers of
Border Guard Commands at port border checkpoints shall have the power to:
a) Issue warning;
b) Impose a fine up to VND
300.000.000;
c) Confiscate the
exhibits/instrumentalities whose value does not exceed twice the fine specified
in point b of this clause;

control of the Drug and Crime Prevention and Control Department affiliated to
the Border Guard High Command shall have the power to:
a) Issue warning;
b) Impose a fine up to VND

c) Suspend licenses/practicing
certificates or operations for fixed periods;
d) Confiscate the
exhibits/instrumentalities used for committing administrative violations;
dd) Impose the remedial
measures specified in Article 4 of this Decree.
6. Commanding Officers of
Border Guard Commands; Captains of Naval Border Guard Squadrons, and Director
General of the Drug and Crime Prevention and Control Department affiliated to
the Border Guard High Command shall have the power to:
a) Issue warning;
b) Impose a fine up to VND

1. Soldiers on duty of
People’s Public Security Forces shall have the power to:
a) Issue warning;
b) Impose a fine up to VND
100.000.000;
c) Confiscate the
exhibits/instrumentalities whose value does not exceed twice the fine specified
in point b of this clause.

divisions of the following authorities: the Economic Security Department, the
Investigation Police Department for Social Order Crimes, the Counter Narcotics
Police Department, the Traffic Police Department, the Fire and Rescue Police
Department, the Environment Crime Prevention and Fighting Police Department,
the Department of Cybersecurity and Hi-tech Crime Prevention and Control, the
Immigration Department, and Commanders of Mobile Police Regiments; Heads of
divisions affiliated to Provincial-level Police Departments, including:
Economic Security Divisions, Investigation Police Divisions for Social Order
Crimes, Police Divisions for Investigation into Corruption, Economy, Smuggling
and Environment-related Crimes, Counter Narcotics Police Divisions, Traffic
Police Divisions, Mobile Police Divisions, Fire and Rescue Police Divisions,
External Security Divisions, and Cybersecurity, and Hi-Tech Crime Prevention
and Control Divisions, shall have the power to:
a) Issue warning;
b) Impose a fine up to VND
800.000.000;

1.000.000.000;
c) Suspend
licenses/practicing certificates or operations for fixed periods;
d) Confiscate the
exhibits/instrumentalities used for committing administrative violations;
dd) Impose the expulsion
penalty;

(Directors) of the following authorities: the Economic Security Department, the
Investigation Police Department for Social Order Crimes, the Counter Narcotics
Police Department, the Police Department for Investigation into Corruption,
Economy and Smuggling-related Crimes, the Traffic Police Department, the Fire
and Rescue Police Department, the Environment Crime Prevention and Fighting
Police Department, and the Department of Cybersecurity and Hi-tech Crime
Prevention and Control, and the Mobile Police Commander, shall have the power
to:
a) Issue warning;
b) Impose a fine up to VND
1.000.000.000;
c) Suspend
licenses/practicing certificates or operations for fixed periods;

9. Director General
(Director) of the Immigration Department shall have the power to impose
penalties as prescribed in clause 8 of this Article, and are entitled to issue

1. Chief Representatives
of Maritime Administrations shall have the power to:
a) Issue warning;
b) Impose a fine up to VND
250.000.000;
c) Suspend licenses/practicing
certificates or operations for fixed periods;
d) Confiscate the
exhibits/instrumentalities whose value does not exceed twice the fine specified
in point b of this clause;

c) Confiscate the exhibits
whose value does not exceed twice the fine specified in point b of this clause.

impose penalties of Fisheries Surveillance Forces
The title holders
specified in this Article shall have the power to impose penalties for the
administrative violations prescribed in Article 7, Article 10, Article 11,
clause 1 Article 12, Article 15, Article 19, clause 1 Article 20, clause 1 and
point a clause 3 Article 21 hereof in the fields and areas under their
management. To be specific:
1. Fisheries surveillance
officials on duty shall have the power to:

of this Decree.
3. Directors of Regional
Fisheries Surveillance Sub-departments affiliated to the Fisheries and
Fisheries Surveillance Department; Directors of Sub-departments in charge of
fisheries and fisheries surveillance affiliated to provincial-level Departments
of Agriculture and Environment shall have the power to:
a) Issue warning;
b) Impose a fine up to VND
500.000.000;
c) Suspend licenses/practicing
certificates or operations for fixed periods;
d) Confiscate the
exhibits/instrumentalities used for committing administrative violations;
dd) Impose the remedial
measures specified in Article 4 of this Decree.
4. Director General of the
Fisheries and Fisheries Surveillance Department shall have the power to:
a) Issue warning;

20. Amendments to Article 32a
“Article 32a. Power to
impose penalties of Vietnam Maritime Inspectorate
The title holders
specified in this Article shall have the power to impose penalties for the
administrative violations directly related to the contents of the inspection,
and in the fields under their management as prescribed in Chapter II hereof
within the ambit of their assigned functions, tasks and powers. To be specific:
1. Inspectors of Vietnam
Maritime Inspectorate shall have the power to:
a) Issue warning;
b) Impose a fine up to VND

21. Amendments to Article 33
“Article 33. Power to
make records of administrative violations
1. The persons having the
power to impose administrative penalties of the authorities or forces specified
in Articles 28, 29, 29a, 30, 31, 31a, 31b, 32 and 32a hereof shall, during
their performance of official duties or tasks, have the power to make records
of the administrative violations in the fields and areas under their management.
2. On-duty soldiers of the
Coast Guard Forces shall the power to make records of the administrative
violations prescribed in this Decree.
3. On-duty soldiers of the
People’s Public Security Forces shall the power to make records of the
administrative violations in the fields and areas under their management.
4. Persons of the People’s
Armed Forces or the People’s Public Security Forces, and civil servants and
public employees working at the authorities specified in Articles 28, 29, 29a,
30, 31, 31a, 31b, 32 and 32a hereof shall, during their performance of official
duties or tasks, have the power to make records of the administrative
violations in the fields and areas under their management.”

Article 33c. Imposition
of penalties for administrative violations in this Decree which are also
governed by the Criminal Code
When considering a case
for the purpose of issuing a penalty imposition decision, if it is determined
that any of the violations prescribed in point b clause 2 Article 14, clause 2
Article 15, clause 3 Article 17, clause 7 and clause 8 Article 26, point e
clause 5 Article 26c and other violations prescribed in this Decree denotes
signs of a crime, the competent person who is handling the case shall transfer
the case file to the authority competent to conduct criminal proceedings for
initiating criminal prosecution as prescribed in clauses 1, 2 and 4 Article 62
of the Law on Handling of Administrative Violations.”.
Article
23. Abrogation and replacement of some phrases in Government’s Decree
No.162/2013/ND-CP dated November 12, 2013 prescribing penalties for
administrative violations committed within territorial waters, islands and
continental shelf of the Socialist Republic of Vietnam, as amended by Decree
No. 23/2017/ND-CP and Decree No. 37/2022/ND-CP
1. Clause 2 Article 27a of
this Decree is abrogated.
2. The phrase “Bộ Tài
nguyên và Môi trường” (“Ministry of Natural Resources and Environment”) is
replaced with the phrase “Bộ Nông nghiệp và Môi trường” (“Ministry of
Agriculture and Environment of Vietnam”) in Article 8b and Article 8c of this
Decree.
3. The phrase “hộ chiếu
thuyền viên” (“seafarer’s passport”) is replaced with the phrase “hộ chiếu”
(“passport”) in Article 17 of this Decree.
Article
24. Effect and responsibility for implementation
1. This Decree comes into
force from May 04, 2026.
2. Ministers, heads of
ministerial agencies, heads of Governmental agencies, Chairpersons of People’s
Committees of provinces or central-affiliated cities, and relevant authorities
and organizations shall be responsible for the implementation of this Decree.
