CIRCULAR
AMENDMENTS
TO SOME ARTICLES OF CIRCULARS ON QUARANTINE OF TERRESTRIAL ANIMALS AND ANIMAL
PRODUCTS
Pursuant to the Government’s Decree No.
105/2022/ND-CP dated December 22, 2022 on functions, tasks, powers and
organizational structure of the Ministry of Agriculture and Rural Development
of Vietnam;
Pursuant to the Law on Veterinary Medicine dated
June 19, 2015;
At the request of the Director of Department of
Animal Health;
The Minister of Agriculture and Rural
Development of Vietnam promulgates Circular on amendments to some Articles of
Circulars on quarantine of terrestrial animals and animal products.
Article 1. Amendments to
some Articles of the Circular No. 25/2016/TT-BNNPTNT dated June 30, 2016 of the
Minister of Agriculture and Rural Development on quarantine of terrestrial
animals and animal products (amended by the Circular No. 35/2018/TT-BNNPTNT
dated December 25, 2018, and the Circular No. 09/2022/TT-BNNPTNT dated August
19, 2022 of the Minister of Agriculture and Rural Development)
1. Clause 1 Article 9 shall be amended as
follows:

2. Point b Clause 5 Article 19 shall be amended
as follows:
“b) The validity period of the Certificate of
quarantine of imported animals and animal products is 60 days; the validity
period of the Certificate of quarantine of exported animals and animal products
is 180 days;".
3. Clause 1 Article 20 shall be amended as
follows:
“1. Animals that must be marked and issued with
codes:
a) Breeds (buffalo, cow, goat, sheep, deer,
horse, donkey, mule and pig) upon transport to another province;
b) Animals (buffalo, cow, goat, sheep, deer,
horse, donkey, mule and pig) upon export or import.”.
4. Clause 7 shall be added after Clause 6 of
Article 22 as follows:
“7. In case of import of livestock marked or
issued with ear tags, it is not required to comply with regulations in clauses
1, 2, 3, 4 and 5 of this Article. The animal quarantine authority at the
import checkpoint shall make a list of codes and numbers of livestock according
to regulations in Clause 6 of this Article (except for the case where the list
of codes and numbers is available and it is enclosed with the veterinary health
certificate given by a competent authority of the exporting country).".
5. Point c and Point d shall be added after
point b Clause 4 Article 23 as follows:

d) The goods owner shall be responsible for
legality and accuracy of the application for registration and declaration of
quarantine.”.
Article 2. Amendments
to, replacement and annulment of some phrases, appendices and forms of the
Circular No. 25/2016/TT-BNNPTNT dated June 30, 2016 of the Minister of
Agriculture and Rural Development on quarantine of terrestrial animals and
animal products (amended by the Circular No. 35/2018/TT-BNNPTNT dated December
25, 2018, and the Circular No. 09/2022/TT-BNNPTNT dated August 19, 2022 of the
Minister of Agriculture and Rural Development)
1. Clause 1a Article 1, Clause 2a Article 1 and
Article 9a shall be annulled.
2. The phrase “Trâu, bò, dê, cừu, hươu, nai,
ngựa, lừa, la khi vận chuyển ra khỏi địa bàn cấp tỉnh phải được đánh dấu bằng
cách bấm thẻ tai bằng nhựa cao su, thẻ tai được bấm ở mặt trong tai bên phải
của gia súc. Thẻ tai được quy định như sau:” (When the buffalo, cow, goat,
sheep, deer, horse, donkey and mule are transported to another province, they must
be marked with plastic ear tags. The ear tag is pressed on the inside of the
right ear of cattle. The ear tag is defined as follows) shall be replaced by
the phrase “Động vật giống (Trâu, bò, dê, cừu, hươu, nai, ngựa, lừa, la) khi
vận chuyển ra khỏi địa bàn cấp tỉnh phải được đánh dấu bằng cách bấm thẻ tai.
Thẻ tai được quy định như sau:” (Upon transport to another province, breeds
(buffalo, cow, goat, sheep, deer, horse, donkey and mule) shall be marked with
ear tags. The ear tag is defined as follows:) in Clause 1 Article 21.
3. The phrase “Lợn vận chuyển với mục đích để
nuôi làm giống, nuôi thương phẩm thực hiện theo một trong các biện pháp sau:”
(Regarding pigs transported to another province for breeding purposes or
commercial purposes, they shall be marked by one of the following measures)
shall be replaced by the phrase " Lợn giống khi vận chuyển được thực hiện
theo một trong các biện pháp sau” (Upon transport of breeding pigs, one of the
following measures shall be applied) in clause 2 Article 21.
4. The phrase “Số chứng minh nhân dân/Số Hộ
chiếu/Số định danh cá nhân” (ID Card No./Passport No./Personal Identification
No.) shall be replaced by the phrase “Số Hộ chiếu/Số định danh cá nhân”
(Passport No./Personal Identification No.) in Form No.1, Form No. 2, Form No.
3, Form No. 8, Form No. 9, Form No. 14a, Form No. 14b, No. Form 15a of Appendix
V.
5. Form No. 2 of Appendix V shall be amended as
follows:
a) The column “HS code (8-digit HS code
according to applicable regulations)” shall be added between the column “Type
of animals” and the column “Breeds” in Section I;
b) The column “HS code (8-digit HS code
according to applicable regulations)” shall be added between the column “Name
of goods" and the column “Packaging method” in Section II;

6. Form No. 3 of Appendix V shall be amended as
follows:
a) The clause “1a. HS code (8-digit HS code
according to applicable regulations)” shall be added after clause 1 Form No. 3
Appendix V;
b) Clause 22 shall be added after clause 21 Form
No. 3 as follows:
“22. Number and date of the bill of
lading/transport contract (if any):".
7. The following phrases in Form No. 3 of
Appendix V shall be annulled;

11. The column “HS code (8-digit HS code
according to applicable regulations)” shall be added between the column “Name
of goods” and the column “Quantity” in Form No. 17 and Form No. 18 Appendix V;
12. Form No. 19 Appendix V shall be amended as
follows:

14. The No. 20a and Form No. 20a in Appendix V
shall be annulled.
15. Clause 3 shall be added after clause 2
section I Appendix XI as follows:
“3. Taking testing samples for quarantine.
a) Regarding animals transported to another
province according to regulations in section I of Appendix XI enclosed with this
Circular: Combine 05 samples into a pooled sample for testing pathogens;
b) Sample-pooling principles: same type of
animals, same shipments, same facilities for breeding, collecting and trading
animals;
c) If it is not possible to combine samples for
testing according to the pooled samples, the testing of pathogens according to
single samples shall be conducted.
16. The phrase “Làm giống” (breeding) shall be

The sampling according to frequency shall be
applied to the total quantity of the imported shipments from January 1 to
December 31 in the same year. The sampling and testing of pathogens shall
comply with Vietnam's regulations, standards, technical regulations and
international regulations.”,
18. The phrase “Kiểm tra ADN loài nhai lại đối
với nguyên liệu thức ăn chăn nuôi, thủy sản/thức ăn thành phẩm có chứa sản phẩm

(It is required to carry out ruminant DNA inspection of feed ingredients/finished
foods that contain animal products from countries at risk of bovine spongiform
encephalopathy or whenever requested;)” in point c clause 2 section II Appendix
XII shall be replaced by the phrase “Căn cứ tình hình bệnh Bò điên của nước
xuất khẩu, theo các Nghị quyết của Tổ chức Thú y Thế giới (WOAH/OIE) về công
nhận tình trạng dịch bệnh của nước xuất khẩu, Cục Thú y hướng dẫn việc kiểm
tra, xét nghiệm chỉ tiêu ADN loài nhai lại đối với bột nguyên liệu có nguồn gốc
từ động vật để sản xuất thức ăn cho động vật;” (According to the situation of
bovine spongiform encephalopathy of the exporting country and Resolutions of
WOAH/OIE on recognition of the epidemic situation of exporting countries, the
Department of Animal Health shall give guidance on inspection and testing of
ruminant DNA parameters of the material powder derived from animals for
production of animal feeds;)”.
19. The Appendix XIV “PROCEDURES FOR INSPECTION
AND SAMPLING OF SHIPMENTS OF TERRESTRIAL ANIMAL PRODUCTS FOR QUARANTINE” shall
be added after the Appendix XIII enclosed with this Circular.
Article 3.
Implementation provision
1. This Circular comes into force as of May 16,
2024.
2. With regard to applications for registration
and declaration of quarantine, inspection and certification of quality of
imported animal and aquaculture feeds derived from animals and applications for
relief or exemption from state inspection of quality of imported animal and
aquaculture feeds derived from animals submitted before the effective date of
this Circular, regulations of law at the time of submission of such
applications shall be applied.
3. Certification documents on relief or
exemption from state inspection of quality of imported animal and aquaculture
feeds derived from animals certified by the Department of Animal Health before
the effective date of this Circular shall remain valid until their prescribed
expiry dates.
Any difficulty or problem that arises during the
implementation of this Circular should be reported to the Ministry of Agriculture
and Rural Development (via the Department of Animal Health) for consideration
and decision.

XIV: PROCEDURES FOR TESTING AND SAMPLING SHIPMENT OF TERRESTRIAL ANIMAL
PRODUCTS FOR QUARANTINE
(Issued together with Circular No. 04/2024/TT-BNNPTNT dated
April 01, 2024 of the Minister of Agriculture and Rural Development of Vietnam)
I. GENERAL PART
1. Definition of terms
- Packaging unit: means an independent package in
the form of a bag, box, pack, bottle, etc. Each shipment has a specific number
of packaging units.
- Sample: means a representative part of a shipment.
- Sampling: means technical actions that are taken
on the basis of application of technical conditions, principles and procedures
according to regulations for collection of representative samples which show
status of a shipment.

- Pooled sample (bulk sample): consists of single
samples of a shipment which are gathered and mixed together so that
representative characteristics of the shipment can be obtained.
- Analytical sample (testing sample): means a part
of a pooled sample, used to assess the quality of a specified shipment.
- Storage sample: means a sample taken from a pooled
sample. If sample pooling is not available, single samples shall be stored.
- Representative sample: means a part of the products from
the bulk sample or certain packaging units taken from the bulk sample.
2. General principles
- Before sampling, documents related to a shipment must be
inspected; the current status of products must be checked. If applicable
requirements are met, samples will be taken.
- In order for samples to accurately reflect the common status of
the shipment, it is required to ensure the unity of the shipment.
- Samples shall be taken in a scientific, quick and convenient
manner; the sampling process must be public and transparent; it is required to
make sure the locations are selected randomly in order to ensure the
representativeness of the samples
- In case it is not possible to collect samples at the border checkpoint,
animal products shall be transferred to the animal quarantine authority or the
enterprise’s warehouse for sampling.

1. Preparation
- Before sampling, the inspection and sampling time shall be
agreed upon with the goods owner or the representative.
- Relevant documents, forms, tools and equipment shall be prepared
for sampling and appropriate preservation of samples
2. On-site inspection
2.1. Inspect the satisfaction of veterinary hygiene conditions applicable
to transport vehicles, containers and seals.
2.2. Inspect shipment: storage conditions, packaging
specifications, product appearance, product types and labels, and detailed
information on the shipment that must be consistent with accompanying
documents.
Regarding each item, at least 5 randomly selected locations or
packaging units at different locations of the shipment shall be inspected. In
case the shipment contains different items, it is required to inspect and take
samples of a maximum of 03 items with the largest quantity/weight.
If the shipment is divided into multiple containers or carriages,
the sampling person randomly selects and conducts inspection of 02 to 04
containers or carriages (not applicable to shipments subject to DNA
examination). In case of uncertainty, the entire shipment can be inspected.
Result processing: inspect the actual status of products and take
samples for quarantine, if applicable requirements are met, or otherwise handle
products as prescribed.

3.1. Quantity and weight of samples:
3.1.1. The quantity of samples required for pathogen testing shall
comply with regulations in Section IV and Section V, Appendix XII attached to
this Circular.
3.1.2. The quantity of samples required for DNA examination and
the collection of samples are regulated as follows:
- From 01 to 05 containers: collect 01 sample
- From 06 to 10 containers: collect 02 samples
- 01 more sample shall be inspected for every 01 - 05 additional
containers after the first 10 containers.
In case the shipment is stored in a cargo hold or coach: collect
01 sample if the quantity is ≤ 200 tonne, 02 samples if the quantity is from
200 to 500 tonne; 03 samples if the quantity is over 500 tonne.
3.1.3. Weight of analytical sample or storage sample: The minimum weight
of samples must be adequate for analysis according to regulations and the
laboratory's analysis method. In case where samples must be sent to multiple
laboratories, additional samples shall be taken accordingly. The weight of the
representative sample or increment sample (in case the increment sample
is equivalent to the representative sample) is from 500 - 1000g (excluding
bones).

a) With regard to a packaged shipment
- Regarding a shipment packaged in the form of a bag, bale, box,
barrel, etc.: the increment sample is taken from at least 01 packaging
unit but not more than 05 packaging units through a random selection of
products from the selected packages. In case of small packaging units,
additional samples must be taken in order to ensure sufficient testing weight
according to the testing methodology.
- Regarding liquid and viscous products: single samples are taken
in at least 03 locations at different depths within the packaging unit.
b) With regard to a bulk shipment (contained in carriages,
containers, cargo holds, etc.): increment samples shall be taken in at
least 03 different locations of the shipment.
3.2.2. Preparation of bulked sample
Pool all increment samples taken in order to form a bulk
sample that represents the shipment.
3.2.3. Preparation of representative sample
a) Regarding liquid and viscous products: thoroughly mix the bulk
sample and withdraw a portion to create a representative sample;
b) Products in forms of fibers, pieces and small pellets may be
sampled randomly;

d) Pre-packaged products: packages can be thoroughly mixed before
random selection of products;
dd) The weight of representative samples shall be sufficient to
analyze indicators and store samples.
3.2.4. Preparation of analytical samples
The representative sample will be divided into 2 corresponding
parts. One part is the analytical sample and the other is the storage sample with
the same quantity/weight The weight of samples taken shall be sufficient to
test indicators and store samples according to the testing method In case it is
necessary to send samples to multiple laboratories, the analytical sample can
be subdivided for separate analysis. If only small sample weight is required
for testing, after representative samples are taken, the unused samples shall
be returned to the goods owner.
3.2.5. Labeling, packaging, sealing, preserving and transporting samples
a) Samples shall be packaged, sealed and labeled in order to
ensure confidentiality and avoid confusion;
b) Samples shall be preserved under conditions suitable for each
type of products in their original state.
3.2.6. Sampling record
A sampling record shall be made immediately after sampling
according to Form No. 06, Appendix V issued with this Circular with the
participation of the witness. The goods owner and relevant parties shall sign
the record.

3.2.7 Transport and delivery of samples
a) Samples shall be transported to the laboratory as quickly as
possible by a vehicle in a manner that does not affect the quality of samples;
b) Samples sent to the laboratory shall be coded. Sample
containers sent to the laboratory shall be sealed and protected from the
influence of sunlight and temperature so as to avoid adverse impacts on the
quality of samples.
3.2.8. Storage and destruction of samples
Samples are stored for 30 days under conditions appropriate to
each type of products. The weight of stored sample is consistent with the
testing method.
At the end of the storage period, the stored sample must be
destroyed in accordance with regulations of law.
3.2.9. Returning unused animal products after sampling
Unused samples (not those used for testing) shall be returned
after obtainment of satisfactory test results. The form of record of returning
unused samples is promulgated together with this Appendix XIV.
- In case it is not possible to take samples on site, single
samples shall be sent to a location where there are adequate conditions for
sampling. In this case, a record of returning unused samples to the goods owner
shall be made after sampling.
