CIRCULAR
REGULATIONS ON REGISTRATION AND INSPECTION OF INLAND
WATERCRAFTS
Circular No.
48/2015/TT-BGTVT dated September 22, 2015 of the Minister of Transport on
regulations on inspection and registration of inland watercrafts comes into
force from January 01, 2016. The Circular is amended according to the following
Circulars:
1. Circular No.
26/2020/TT-BGTVT dated October 16, 2020 of the Minister of Transport on
amendments to some Articles of Circulars on periodic report on registration and
inspection that comes into force from December 15, 2020;
2. Circular No.
16/2022/TT-BGTVT dated June 30, 2022 of the Minister of Transport on amendments
to some Articles of Circulars on registration and inspection that comes into
force from August 15, 2022;

Chapter I
GENERAL PROVISIONS
Article 1. Scope
1. This Circular
elaborates registration and inspection of inland watercrafts and organization
of registration and inspection of inland watercrafts.
2. This Circular fails
to apply to the following entities:
a) Inland watercrafts
used for defense and security purposes, fishing vessels;
b) Non-motorized
watercraft with a deadweight tonnage of 15 tonnes or a capacity of 12
passengers;
c) Motorized
watercraft with total main engine capacity of under 5 horse powers or a
capacity of under 5 passengers;

Article 2.
Regulated entities
This Circular applies
to organizations or individuals relevant to registration and inspection of
inland watercrafts.
Article 3.
Definitions
For the purposes of
this Circular, the terms below are construed as follows:
1. Industrial products
used for inland watercrafts (hereinafter referred to as “industrial products”)
include: materials, machinery and equipment used in construction, modification,
repair and installed in inland watercrafts.
2. Stamp indicating
approval for the technical safety and environmental safety of inland watercraft
(hereinafter referred to as "approval stamp") is a symbol of an
inland watercraft that has been certified by the registration agency for
achievement of standards of the quality of technical safety and environmental
safety.
3. Design
documentation includes: Design documentation on construction, modification,
repair and import for constructed, modified, repaired and imported watercrafts;
design and making of documentation for imported and constructed watercrafts
without the supervision of the registration agency; industrial product design;
representative sample design; design for conversion from seagoing vessels into
inland watercrafts.
4. Instructional
documents include: stability notification to the captain, shipboard oil
pollution emergency plan, shipboard pollution emergency plan due to the
carriage of hazardous liquids.
5. Duplication and
approval for representative samples means the duplication and approval for
design according to the representative sample design that is approved

REGISTRATION AND INSPECTION OF INLAND
WATERCRAFTS
Article 4. Contents
of registration and inspection of inland watercrafts
1. Approval for design
documentation and instructional documents of inland watercrafts.
2. Inspection of the
quality, technical safety and environmental safety (hereinafter referred to as
“inspection”), issuance of certificates of technical safety and environmental
safety of inland watercrafts for imported watercrafts.
3. Inspection and
issuance of certificates for industrial products used for watercrafts.
4. Inspection and
issuance of certificates of technical safety and environmental safety of inland
watercrafts for watercrafts in construction, modification and repair.
5. Inspection and
issuance of certificates of technical safety and environmental safety of inland
watercrafts for watercrafts in the process of operation.
6. Measurement of
determination of deadweight tonnage and capacity of the watercrafts.
7. Measurement of
determination of freeboard and load line of the watercrafts

Article 5. Basis
for assessment of the quality, technical safety and environmental safety of
watercrafts and industrial products
The registration and
inspection specified in Article 4 of this Circular shall comply with the
regulations, technical regulations and technical standards specified in
Appendix I of this Circular.
Article 6. Types of
inspection of inland watercrafts
1. Types of inspection
of inland watercrafts include:
a) Initial inspection:
inspection of constructed watercrafts, imported watercrafts and administrative
registration watercrafts for the first time;
b) Cyclical
inspection: periodic inspection; annual inspection; inspection in shipyard;
intermediate inspection;
c) Adhoc inspection
according to regulations in the system of rules, technical regulations and
technical standards specified in Appendix I of this Circular.
2. The contents and
time limit of types of inspection shall comply with regulations of the system
of rules, technical regulations and technical standards specified in Appendix I
of this Circular.
Article 7.
Principles for inspection and issuance of certificates of technical safety and
environmental safety of inland watercrafts

2. In any area where
the watercrafts are constructed, modified and repaired, the competent
registration agency shall inspect and issue certificate of technical safety and
environmental safety of inland watercrafts under their competence.
3. If administrative
registration procedures for an inland watercraft have been completed when
carrying out cyclical inspection and adhoc inspection, the watercraft shall be
inspected and issued with certificate of technical safety and environmental
safety of inland watercrafts by any the competent registration agency that has
authority to manage the area where the watercraft is anchored.
4. The registration
agency shall inspect and issue certificates of technical safety and environmental
safety for inland watercrafts in accordance within their capacity and
competence in the assigned area.
Chapter III
PROCEDURES FOR APPROVAL FOR DESIGN
DOCUMENTATION, INSTRUCTIONAL DOCUMENTS; INSPECTION, ISSUANCE OF CERTIFICATE OF
TECHNICAL SAFETY AND ENVIRONMENTAL SAFETY OF INLAND WATERCRAFTS; INSPECTION,
ISSUANCE OF CERTIFICATE OF QUALITY AND TECHNICAL SAFETY OF INDUSTRIAL PRODUCTS
“Article 8.
Application for design documentation approval and instructional documents:[2]
1. With regard to approval for design for construction,
modification, repair, a design documentation includes:
a) A written request
for design documentation approval made according to form in Appendix II
enclosed herewith (original copy or electronic form);
b) Spreadsheet,
drawings, explanations and technical documents (if any) as prescribed in
technical regulations and standards for the watercrafts (3 original copies if
submitted in person, by post or other manners or electronic copy that is valid
if submitted via online public service system); If the design documentation is
prepared by a foreign design unit or the owner is a foreigner or the watercraft
is constructed in Vietnam for export, explanations and spreadsheet must be
prepared in Vietnamese, or in English and accompanied with their Vietnamese
translations, but drawings may be prepared in either Vietnamese or English;

2. With regard to approval for representative sample
design, a design documentation includes:
a) A written request
for approval for representative sample for inland watercraft made according to
form in Appendix III enclosed herewith; (original copy or electronic form);
b) Spreadsheet,
drawings, explanations as prescribed in technical regulations and standards for
the watercrafts (3 original copies if submitted in person, by post or other
manners or electronic copy that is valid if submitted via online public service
system);
3. a) With regard to duplication and approval of
representative sample, the documentation shall include a written request for
approval for use of representative sample of an inland watercraft made
according to form in Appendix IV enclosed herewith (original copy or electronic
form);
4. With regard to approval for design of an imported
watercraft, a design documentation includes:
a) A written request
for design documentation approval made according to form in Appendix II
enclosed herewith (original copy or electronic form);
b) Spreadsheet,
drawings, explanation and technical documents (if any) as prescribed in
technical regulations and standards for the watercraft and any technical
documents issued to the watercraft by foreign organizations (3 original copies
if submitted in person, by post or other manners or electronic copy that is
valid if submitted via online public service system); explanations and
spreadsheet must be prepared in Vietnamese, or in English and accompanied with
their Vietnamese translations, but drawings may be prepared in either
Vietnamese or English;
c) Documents that
determine the watercraft’s age (certified true copy or electronic copy that is
valid)
d) Customs declaration
for import of the importer (if the watercraft has been imported to Vietnam)
(certified true copy or electronic copy that is valid)

a) If the industrial
product is produced or manufactured domestically, the documentation includes: a
written request for design documentation approval made according to form
in Appendix II enclosed herewith (original copy or electronic form);
spreadsheet, drawings, explanation and technical documents (if any) as
prescribed in technical regulations and standards for the industrial product (3
original copies if submitted in person, by post or other manners or electronic
copy that is valid if submitted via online public service system).
b) If the industrial
product is imported, the design documentation includes: a written request for
design documentation approval made according to form in Appendix II
enclosed herewith (original copy or electronic form); spreadsheet, drawings,
explanation and technical documents (if any) issued to the industrial product
by foreign organizations as prescribed in technical regulations and standards
for the industrial product (3 original copies if submitted in person, by post
or other manners or electronic copy that is valid if submitted via online
public service system). Explanations and spreadsheet must be prepared in
Vietnamese, or in English and accompanied with their Vietnamese translations,
but drawings may be prepared in either Vietnamese or English; and the customs
declaration for import.
6. With regard to approval for design for conversion of a
seagoing vessel into an inland watercraft, a design documentation includes:
a) A written request
for design documentation approval made according to form in Appendix II
enclosed herewith (original copy or electronic form);
b) Spreadsheet,
drawings, notes and technical documents (if any) as prescribed in technical
regulations and standards for the watercraft (3 original copies if submitted in
person, by post or other manners or electronic copy that is valid if submitted
via online public service system)
7. With regard to approval for instructional documents, an
application includes:
a) A written request
for approval of instructional documents made according to form in Appendix II
enclosed herewith (original copy or electronic form);
b) Instructional
documents (3 original copies if submitted in person, by post or other manners
or electronic copy that is valid if submitted via online public service system)
Article 9. Order of
approval for design and instructional documents

2. The Vietnam
Register or its authorized registration agency shall receive and inspect the
application. In case of inadequate application as prescribed, the Vietnam
Register or its authorized registration agency shall instruct to complete
within 01 working day (submission in person) or within 02 working days
(submission by post or other manners). In case of adequate application, the
Vietnam Register or its authorized registration agency shall set the time to
provide the results
3. From the date of
receipt of the application according to regulations, within 20 working days for
the design of watercrafts constructed with new materials, new function or
watercrafts that operate in coastal inland waterway transport routes, from
shore to island, between islands; watercrafts that carry liquefied gas,
dangerous chemicals, oil tankers with a flash point of 60°C or less, with a
deadweight tonnage of 500 tonnes or over; high-speed passenger vessels; air
cushion vessels; floating restaurants, floating hotels, accommodation vessels,
passenger vessels with a capacity of 100 passengers or over or within 5 working
days for designs other than those mentioned above and instructional documents,
the Vietnam Register or its authorized registration agency shall complete the
approval for design documentation and instructional documents. If the design
documentation and instructional documents meet requirements, the Vietnam
Register or its authorized registration agency shall issue a certificate of
approval for design according to the form specified in the Circular No.
15/2013/TT-BGTVT dated July 26, 2013 of the Minister of Transport on form of
certificate and number of inspection of technical safety and environmental
safety for seagoing vessels, inland watercrafts and industrial products used
for inland watercrafts (hereinafter referred to as “Circular No. 15/2013/TT-BGTVT”
), issue a notification of approval for instructional documents/design
documentation according to the form specified in Appendix VI of this Circular.
If the design documentation and instructional documents fail to meet
requirements, the Vietnam Register or its authorized registration agency shall
notify in writing the organization or individual to remedy the shortcomings.
4. In case of design
documentation that has overcome shortcomings according to notification of the
Vietnam Register or its authorized registration agency, from the date of
receipt of the design documentation, within 02 working days, the Vietnam
Register or its authorized registration agency shall complete the approval for
design documentation. If the design documentation meets requirements, the
certificate of approval for design documentation shall be issued as prescribed
in Clause 3 of this Article. If the design documentation fails to meet
requirements, the Vietnam Register or its authorized registration agency shall
notify in writing the organization or individual for correction.
5. “5[4]. The applicant
for approval for design documentation/ instructional documents shall pay fees
and charges as prescribed and receive the results at Vietnam Register or its
authorized registration agency in person, by post, online public service system
or other manners;
Article 10.
Procedures for inspection and issuance of certificates of technical safety and
environmental safety of inland watercrafts
1. The organizations
and individuals shall submit an application in person or by post or other
manners to the registration agency, the application include: A written request
for inspection made according to the form specified in Appendix V of this
Circular (except for documentation submitted in person or by phone call),
technical documents of the watercrafts. The technical document of watercraft is
regulated as follows:
a) In case of
inspection and issuance of certificate of technical safety and environmental
safety for constructed, modified, repaired or closed watercraft without the
supervision of the registration agency, the original copy of design
documentation that has been approved shall be submitted.
b) In case of
inspection and issuance of certificate of technical safety and environmental
safety for watercraft that is in the process of operation, the original copy of
the certificate of technical safety and environmental safety of inland
watercraft which has been issued shall be submitted in case of inspection of
watercraft.
c) In case of
inspection and issuance of certificate of technical safety and environmental
safety for seagoing vessel converted into inland watercraft, the original copy
of the design documentation of conversion from seagoing vessel into inland
watercraft that is approved and certificate of deregistration of Vietnamese
ships.

3. The registration
agency shall conduct inspection. Within 01 working day for inspection of
watercrafts which is less than 70 km far from the registration agency’s
headquarter, or within 02 (two) working days inspection of watercrafts which is
70 km or over far from the registration agency’s headquarter, or inspection of
watercrafts which is conducted at seas or islands, from the time for completion
of inspection in the site, if the result of inspection indicates that the
watercraft is conformable with relevant technical regulations and standards,
the registration agency shall issue certificate of technical safety and
environmental safety of inland watercrafts according to the form specified in
the Circular No. 15/2013/TT-BGTVT and append the as-built stamp on as-built
design documentation for construction, modification or repair of any of the
watercrafts specified in Clauses 1, 2, 3 Appendix IX enclosed herewith. If the
result of inspection indicates that the ship is not conformable with relevant
technical regulations and standards, a written notification shall be sent to
the applicant.
4. The applicant for
inspection of watercrafts shall pay fees and charges as prescribed and may
receive the results at the registration agency in person, by post or other
manners;
Article 11.
Procedures for inspection and issuance of certificates of technical safety and
environmental safety of imported watercrafts
1. The organizations
and individuals shall submit an application in person or by post or other
manners to the Vietnam Register, the application include: A written request for
inspection made according to the form specified in Appendix V of this Circular
(except for application submitted in person or by phone call), technical
documents of the imported watercrafts. The technical document of imported
watercraft is regulated as follows:
a) If the imported
watercraft has been inspected and issued with a certificate of registration and
inspection by a foreign registration agency accredited by Vietnam Register,
when it is imported into Vietnam, the design documentation which has been
approved by the foreign registration agency (an original copy and a copy for
the purpose of comparison), the original copy of registration and inspection
document issued to the watercraft by the foreign registration agency and technical
documents of the watercraft shall be submitted. The documents that determine
the watercraft’s age and copies of import documents certified by the importer,
including the commercial invoice, or other documents with equivalent validity
and customs declaration for import shall be also presented;
b) If the imported
watercraft has been inspected and issued with a certificate by a foreign
registration agency that is not yet accredited by Vietnam Register or the
imported watercraft has not been inspected, the original copy of design
documentation which have been approved shall be submitted.
2. The Vietnam
Register shall receive the application. In case of inadequate application as
prescribed, the Vietnam Register shall instruct to complete within 01 working
day (submission in person) or within 02 working days (submission by post or
other manners). In case of adequate application, the Vietnam Register shall set
the time and location for inspection
3. Vietnam Register
shall directly conduct, or authorizes a registration agency to conduct the
inspection as follows:
a) With regard to the
watercraft prescribed in Point a Clause 1 of this Article, the inspection is
conducted to verify the actual technical status of the watercraft compared with
its approved design documentation and registration and inspection document
issued to the watercraft;

4. Within 01 working
day for inspection of watercrafts which is less than 70 km far from the
registration agency’s headquarter, or within 02 (two) working days inspection
of watercrafts which is 70 km or over far from the registration agency’s
headquarter, or inspection of watercrafts which is conducted at seas or
islands, from the time for completion of inspection in the site, if the result
of inspection indicates that the watercraft is conformable with relevant
technical regulations and standards, the Vietnam Register or its authorized
registration agency shall issue certificate of technical safety and
environmental safety of inland watercrafts according to the form specified in
the Circular No. 15/2013/TT-BGTVT. If the result of inspection indicates that
the ship is not conformable with relevant technical regulations and standards,
a written notification shall be sent to the applicant.
5. The applicant for
inspection of imported watercrafts shall pay fees and charges as prescribed and
may receive the results at the Vietnam Register or its authorized registration
agency in person, by post or other manners;
Article 12.
Procedures for inspection and issuance of certificate to industrial products
used for watercrafts
1. The applicant shall
submit an application in person, or by post or any other manners to Vietnam
Register or its authorized registration agency The organizations and
individuals shall submit an application in person or by post or other manners
to the registration agency, the application includes: A written request for
inspection made according to the form specified in Appendix V of this Circular
(except for application submitted in person or by phone call), technical
documents of the industrial products. The technical document of industrial product
is regulated as follows:
a) If the industrial
product is made according to the method of job production or batch production
in Vietnam, the original copy of design documentation which has been approved
shall be submitted;
b) If the industrial
product imported into Vietnam has been registered and inspected by a foreign
registration agency accredited by Vietnam Register, the copy of registration
and inspection document issued to the industrial product by the foreign registration
agency (accompanied by its original copy for the purpose of comparison) and
relevant technical documents (if any); the copy of import document certified by
the importer, including the commercial invoice, or other documents of
equivalent validity, and customs declaration for import shall be submitted;
c) If the industrial
product imported into Vietnam has been inspected by a foreign registration
agency that is not yet accredited by Vietnam Register or it has not been
inspected, the original copy of design documentation which has been approved
shall be submitted.
2. The Vietnam
Register or its authorized registration agency shall receive the application.
In case of inadequate application according to regulations, the Vietnam
Register or its authorized registration agency shall instruct to complete
within 01 working day (submission in person) or within 02 working days
(submission by post or other manners). In case of adequate application, the
Vietnam Register or its authorized registration agency shall set the time and
location to provide the results
3. Vietnam Register or
its authorized registration agency shall conduct the inspection. With regard to
the industrial product prescribed in Point a and Point c Clause 1 of this
Article, within a working day for inspection of the industrial product which is
less than 70 km far from the headquarter, or within 02 working days for
inspection of the industrial product which is 70 km or over far from the
headquarter, or which is conducted at seas or islands, if the result of
inspection indicates that the industrial product is conformable with relevant
technical regulations and standards, Vietnam Register, or its authorized
registration agency shall issue certificate of industrial product used for
inland watercrafts according to the form specified in Circular No.
15/2013/TT-BGTVT. If the result of inspection indicates that the industrial
product is not conformable with relevant technical regulations and standards, a
written notification shall be sent to the applicant.

Article 13.
Registration and inspection documents, approval stamp and control code issued
to inland watercrafts
1. An inland
watercraft which has been inspected and certified to satisfy relevant technical
regulations and standards shall be issued with the following documents:
a) Certificate of
technical safety and environmental safety issued to inland watercrafts;
b) Records and reports
on technical inspection.
2. In addition to the
documents in Clause 1 of this Article, the watercraft is also issued with the
followings:
a) Inspection book of
the lift crane installed on the watercraft;
b) Certificate of
moulded volume of the watercraft, if requested by the owner;
c) Certificates of
industrial products used for the inland watercraft.
3. The approval stamp
which is made according to the form in Appendix VII enclosed herewith shall be
issued together with the certificate of technical safety and environmental
safety issued to the inland watercraft. The approval stamp shall be stuck on
the watercraft as follows:

b) If the watercraft
has cabin or sleeping room without the glass wall in its front: The approval
stamp will be stuck on the outer side and to the upper right corner of the
front wall of cabin or sleeping room (with a view from aft to fore) or at a
noticeable position;
c) If the watercraft
other than the ones prescribed in Point a, b of this Clause has the hatch side
coaming: The approval stamp will be stuck on the outer side and to the upper
right corner of the hatch side coaming towards the bow (under the stiffener at
the coaming angle) or at a noticeable position;
d) Other types of
watercrafts: The approval stamp will be stuck at a noticeable position which is
protected from hitting and the impact of weather.
4. Control code
a) If the result of
inspection indicates that the watercraft satisfies all relevant technical regulations
and standards, a control code will be carved or stuck on the watercraft. This
control code is used for controlling every watercraft and the number of
watercrafts registered nationwide;
b) The control code
includes alphabetical and numerical parts The alphabetical part includes two
capital letters: VR – for the watercrafts prescribed in Clause 1, 2, 3 of
Appendix IX enclosed herewith, or VS – for the watercrafts prescribed in Clause
4 of Appendix IX enclosed herewith. The numerical part includes 8 (eight)
digits of which two first digits are 2 (two) last digits of the watercraft’s
year of construction and followed by six digits which are managed and granted
by Vietnam Register directly to registration agencies. The control code will be
stored in the database on management of registration and inspection of inland
watercraft during the process of the operation of watercrafts;
c) When receiving the
notification of 6 (six) digits granted by Vietnam Register, the registration
agencies shall give a confirmation to Vietnam Register. The registration
agencies shall use control codes in ascending numerical order. Each
registration agency shall prepare and send monthly report on its use of control
codes and estimated control codes in the following month to Vietnam Register.
5. The size and
position of control code shall comply with regulations of Appendix VIII
enclosed herewith.

Article 14.
Agencies that perform inspection and registration of inland watercrafts
1. The Vietnam
Registry shall organize the implementation of the contents of inspection and
registration specified in Article 4 of this Circular; organize the unified
system of inspection and registration units nationwide; carry out the
registration and inspection specified in Clauses 1, 2, 3, Article 4 of this
Circular.
2. Registration
agencies affiliated to Vietnam Register and those affiliated to Departments of
Transport (hereinafter referred to as “registration agencies”) which have been
certified and ranked shall perform the contents of inspection and registration
prescribed in Clause 4, 5, 6, 7 and 8 Article 4 hereof and other contents of
inspection and registration authorized by Vietnam Register in conformity with
their competence after receipt of certification and notification as prescribed.
3. Registration
agencies shall be ranked I, II or III according to their competence as
prescribed in Appendix X enclosed herewith and perform contents of inspection
registration as follows:
a) Rank-III
registration agencies shall take charge of inspection and registration of the
watercrafts prescribed in Clause 4 Appendix IX enclosed herewith.
b) Rank-II
registration agencies shall take charge of registration and inspection of the
watercrafts prescribed in Clause 1, 2, 3 and 4 Appendix IX enclosed herewith
(except for cargo ships with deadweight tonnage of 2000 tonnes or above, oil
tankers with a flash point exceeding 60°C and a deadweight tonnage of 1000
tonnes or above, oil tankers with a flash point not exceeding 60°C and a
deadweight tonnage of 500 tonnes or above, cargo ships of VR-SB class and a deadweight
tonnage of 500 tonnes or above, passenger ships of VR-SB class and capacity of
50 passengers or above, hovercrafts, ships that carry hazardous chemicals and
ships that carry liquefied gas).
c) Rank-I registration
agencies shall take charge of registration and inspection of all types of
inland watercrafts.
Article 15.
Responsibilities of Vietnam Register
1. Formulate or amend
technical regulations/standards of the quality, technical safety and
environmental safety of inland watercrafts and submit them to competent
authorities for promulgation; formulate and promulgate regulations on
registration and inspection for application of such technical
regulations/standards.

3. Develop, manage and
provide guidance on unified use database on registration and inspection of

database on inland watercrafts of registration agencies
4. Provide training in
registration and inspection.
5. Make certification
and notification of competence of registration agencies according to the
provisions in Appendix X; publish ranks of registration agencies on its
website.
6. Publish the list of
registration agencies authorized by Vietnam Register to perform registration
and inspection of inland watercrafts on its website.
7. Inspect and
supervise the performance of contents of inspection and registration by
registration agencies Handle or request competent authorities to handle
violations committed by individuals and registration agencies as prescribed.
8. Stipulate records
and reports on technical inspection issued to inland watercrafts.
9. Print, manage and
deliver written records and publications used in inspection and registration of
inland watercrafts
10. Submit reports on
the result of inspection and registration of inland waterway ships as
prescribed.
11. Collect fees and
charges in accordance with current regulations.

1. Inspect and
supervise operations and handle violations committed by individuals and
registration agencies under their management. Cooperate with Vietnam Register
in inspection of the performance of registration and inspection of registration
agencies under their management.
2. Direct their
functional agencies to:
a) Cooperate with
local governments in dissemination, mobilization, inspection and handling of
cases of failure to comply with regulations on registration and inspection of
inland watercrafts;
b) Cooperate with
registration agencies affiliated to Vietnam Register in performance of
inspection and registration of watercrafts in cases prescribed in Clause 2
Article 17 hereof.
Article 17.
Responsibilities of registration agencies
1. Registration
agencies affiliated to Departments of Transport shall perform contents of
inspection and registration for the watercrafts prescribed in Clause 4 of
Appendix IX under management of such Departments and the watercrafts prescribed
in Clause 3 of Appendix IX enclosed herewith if they meet competence
requirements and receive certification and notification from Vietnam Register.
2. Registration
agencies affiliated to Vietnam Register shall perform contents of inspection and
registration for the watercrafts prescribed in Clause 1, 2 and 3 of Appendix IX
enclosed herewith. Registration agencies affiliated to Vietnam Register shall
perform contents of inspection and registration assigned to registration
agencies affiliated to provincial Departments of Transport at the request of
Departments of Transport.
3. Registration
agencies shall satisfy requirements for competence corresponding rank I, II or
III prescribed in Appendix X enclosed herewith, and such satisfaction must be
certified and notified.
4. Registration
agencies shall arrange adequate personnel to perform contents of inspection and
registration in assigned areas specified in Appendix X and Appendix XI enclosed
herewith; assign people who perform registration and inspection (hereinafter
referred to as “surveyors”) to carry out inspections according to the
qualification and competence specified in their certificates of surveyors.

6. Heads of
registration agencies and surveyors who directly carry out inspections shall
take responsibility for inspection results.
7. Declare order,
procedures, process, fees, charges and time of inspection.
8[5]. Comply with
regulations on storage, report the result of registration and inspection
according to the following contents.
a)
Name of the report: Technical supervision of inland watercrafts;
b) Content of the
requirement for report: Report the number of inspection of watercrafts
according to the type of watercrafts;
c) Agency that
performs report: Registration agency;
d) Agency that
receives report: Vietnam Registry;
dd) Manners of sending
and receiving report: the report shall be presented in the form of paper
document or electronic document; sent in person or by post or by online or
other manners according to regulations;
e) Time limit for
submission of report: Before the 28th of every month;

h) Time for collection
of the data on report: From the 26th of the month before the
reporting period to the 25th of the month of the reporting period;
i) Report data form:
according to Appendix XII issued with this Circular.
9. Comply with
professional direction and instructions given by Vietnam Register about
inspection and issuance of certificate of technical safety and environmental
safety for inland watercrafts.
10. Comply the
inspection and supervision of performance of registration and inspection by
competent authorities.
11. Manage and
supervise performance of inspection and registration by their officials,
surveyors and employees; regularly provide training courses in professional
ethics to their officials, surveyors and employees; take actions to prevent
violations against regulations on registration and inspection of inland
watercrafts
12. Collect fees and
charges in accordance with current regulations.
13. In case of receipt
of the written request for ad hoc inspection from a competent authority, the
registration agency shall carry out inspection and give written inspection
results according to contents, time and location of the requested inspection.
14. Revoke certificate
of technical safety and environmental safety and approval stamp issued to the
inland watercraft when it is in distress and thus fails to meet technical
requirements; revoke certificate of technical safety and environmental safety
in case of issuance of new documents on inspection and registration in case of
performance of the next inspection.
Article 18.
Responsibilities of owners, design, construction, modification and repair
facilities, industrial product manufacturing facilities and testing facilities
that serve performance of inspection and registration

2. Return certificate
and approval stamp upon notification of revocation given by the registration
agency or upon receipt of new certificate and approval stamp (in case of loss
of certificate and approval stamp).
3. Pay fees and
charges in accordance with current regulations.
Chapter V
IMPLEMENTATION PROVISIONS[6]
Article 19: Entry
into force
1. This Circular comes
into force as of January 01, 2016.
2. Regulation on
registration and inspection of inland watercrafts issued together with Decision
No. 25/2004/QD-BGTVT dated November 25, 2004, Circular No. 34/2011/TT-BGTVT
dated April 26, 2011 of the Minister of Transport on amendments to a number of
articles of the Regulation on registration and inspection of inland watercrafts
issued together with Decision No. 25/2004/QD-BGTVT dated November 25, 2004 and
standards, responsibilities and duties of the inspector of inland watercrafts
issued together with Decision No. 2687/2000/QD-BGTVT dated September 14, 2000
of the Minister of Transport shall be annulled.
Article 20.
Transitional clauses
1. The registration
agency that are operating before the effective date of this Circular shall
continue to perform their duties in accordance with the regulations on
registration and inspection of inland watercrafts issued together with Decision
No. 25/2004/QD-BGTVT dated November 25, 2004 till assessment and confirmation
of capacity

Article 21.
Responsibilities for implementation
Chief of the Ministry
Office, Chief Inspector of Ministries, Directors of Departments, Director of
the Vietnam Register, Directors of Departments of Transport of provinces, Heads
of relevant authorities, organizations and individuals shall be responsible for
the implementation of this Circular./.
