Pursuant to Resolution No. 218/2025/QH15 of the
National Assembly on universalization of preschool education for children aged
3 to 5;
At request of the Minister of Education and
Training;
The Government promulgates Decree elaborating
Resolution No. 218/2025/QH15 dated June 26, 2025 of the National Assembly on
universalization of preschool education for children aged 3 to 5.
Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Decree elaborates Resolution No. 218/2025/QH15
dated June 26, 2025 of the National Assembly on universalization of preschool
education for children aged 3 to 5, including: regulations, policies,
standards, requirements, roadmap for implementing universalization of preschool
education for children aged 3 to 5, responsibilities of agencies and entities.
Article 2. Regulated entities
This Decree applies to children aged 3 to 5,
preschools, relevant organizations and individuals.

INVESTMENT IN
DEVELOPMENT OF SCHOOLS, CLASSES, FACILITIES, TEACHING EQUIPMENT, SUPPLIES, TOYS
Article 3. Investment policies
for development of schools, classes, facilities, teaching equipment, supplies,
toys
1. Strengthen resources provided by central
government budget and local government budget for investment in facilities.
Attract social resources for investment in facilities and development of
preschool education. Invest in preschool network in a manner that ensures adequate
establishments, facilities, teaching equipment, supplies, and toys for
universalization of preschool education for children aged 3 to 5. Improve
preschool standards in a manner that standardizes, modernizes, and satisfies
preschool education universalization demands for children aged 3 to 5.
2. Prioritize clean land fund, allow flexible land
repurposing to accommodate preschool construction; focus on site preparation
and allocation of clean land for preschool projects. Do not collect land levy;
reduce land levy and land use tax applicable to preschools. Do not collect
corporate income tax of public preschools and non-profit private preschools.
Prioritize unused headquarters of state authorities after re-arrangement
process for use as preschools; allow state-owned structures to be hired for use
as private preschools.
3. Prioritize investment using central and local
funding provided by programs and projects in order to ensure that 100% of
public preschools preschools affiliated to armed forces in communes with
extremely disadvantaged socio-economic situations, communes in disadvantaged
areas, ethnic minority regions, mountainous regions, borders, islands, shoals,
coastal areas, residential areas, administrative divisions with industrial
parks, industrial complexes, and export-processing zones are outfitted with
adequate number of schools, at least 1 classroom/preschool class, 100%
strengthened classrooms, adequate functional rooms, preschool libraries,
outdoor toys, indoor toys, teaching equipment, cater kitchens, toilets, and
clean water facilities as per the law.
Article 4. Policies on priority
development of preschool education in communes with extremely disadvantaged
socio-economic situations, communes in disadvantaged areas, ethnic minority
regions, mountainous regions, borders, islands, shoals, coastal areas,
residential areas, administrative divisions with industrial parks, industrial
complexes, and export-processing zones
1. Public preschools, preschools affiliated to
armed forces in zone III, zone II, zone I communes, communes with extremely
disadvantaged hamlets in ethnic minority regions and mountainous regions,
extremely disadvantaged communes in coastal areas and islands in accordance
with regulations of competent authorities where children aged 3 to 5 study,
have meals, and take naps (hereinafter referred to as “day-boarding children”)
shall be eligible for:
a) Financial support for procurement of paper,
comic books, crayons, pencils, toys, and other learning equipment and aids;
blankets, curtains, and personal consumables for day-boarding children aged 3
to 5 at a rate of 1.350.000 VND/child/school year.
b) Financial support for electricity and water
payments serving studying and daily activities of day-boarding children aged 3
to 5 at a rate of 5 KW of electricity/month/child and 1 m3 of
water/month/child which is determined by locally applicable electricity and
water prices and provided for at most 9 months/school year. In respect of areas
without electricity and water, financial support provided for schools in these
areas can be used for procurement of lighting equipment and clean water for
children.

d) Financial support provided by the state budget
for catering employees. Each instance of support shall be determined by number
of day-boarding children aged 3 to 5 and at least equal to 3.900.000 VND/1
month/45 children; an additional support instance shall be provided for 20
children or more in case they do not make up 45 children. Each preschool shall
be eligible for at most 5 instances of support above/month and at most 9
months/school year.
2. Independent preschools, preschools affiliated to
armed forces in areas with extremely disadvantaged socio-economic situations,
ethnic minority regions, mountainous regions, borders, islands, coastal areas,
residential areas, areas with private industrial parks, industrial complexes,
export-processing zones licensed for establishment by competent authorities as
per the law that cater for, care for, and provide education for children aged 3
to 5 shall be eligible for a one-time support for facility procurement,
including: equipment, toys, teaching equipment according to lists prescribed by
the Ministry of Education and Training and facility repair in order to
facilitate children catering, care, and education. Financial support shall
equal at least 50.000.000 VND/independent preschool.
Chapter III
HUMAN RESOURCE
DEVELOPMENT AND CHILD SUPPORT POLICIES
Article 5. Human resource development
policies
1. Ensure maximum number of preschool teachers
according to law-stipulated norms.
2. Ensure policies and benefits for managerial
cadres, teachers, employees in charge of universalization of preschool
education for children aged 3 to 5 in preschools.
3. Provide support for preschool teacher
recruitment

b) Policy contents
Preschool teachers under Point a Clause 3 of this
Article shall be eligible for support that is at least 1 year’s worth of statutory
pay rate (or equivalent amount in case of amendments to salary policy).
4. Provide support for entities engaging in
universalization of preschool education for children aged 3 to 5
a) Eligible entities
Principals, vice principals, teachers and employees
at public preschools engaging in universalization of preschool education for
children aged 3 to 5.
b) Policy contents
Entities under Point a Clause 4 of this Article
shall be eligible for support of 960.000 VND/month (the support is excluded from
calculation for payment and payout of social insurance).

Children aged 3 to 5 (excluding children of very
sparse ethnic minorities according to Decree No. 57/2017/ND-CP dated May 9,
2017 of the Government) residing in extremely disadvantaged communes, hamlets
and pursuing education at public preschools, preschools affiliated to people’s
armed forces at zone III, zone II, zone I communes, communes with extremely
disadvantaged hamlets in ethnic minority regions, mountainous regions,
extremely disadvantaged communes in coastal areas and islands according to
regulations of competent authorities;
Children aged 3 to 5 who lack sources of care
according to Clause 1 Article 5 of Decree No. 20/2021/ND-CP dated March 15,
2021 of the Government;
Children aged 3 to 5 living in poor households or
near-poor households according to multidimensional poverty and near-poverty
lines according to regulations of the Government;
Children aged 3 to 5 who are children of martyrs,
Hero of the People's Armed Forces, invalids, invalid policy beneficiaries,
diseased soldiers, other policy beneficiaries according to Ordinance on
benefits for people serving the war (if any);
Children aged 3 to 5 with disabilities who pursue
rehabilitation education.
b) Policy contents
Each eligible child according to Point a Clause 1
of this Article shall receive 360.000 VND per month for up to 9 months/school
year.

Children aged 3 to 5 who are pursuing education at
private preschools licensed for establishment and operation by competent
authorities and of whom parents or lawful caregivers are working in industrial
parks, industrial complexes, export-processing zones under employment
contracts.
b) Policy contents
Each eligible child according to Point a Clause 2
of this Article shall receive 150.000 VND per month for up to 9 months/school
year.
Article 7. Procedures, time
limit, and payment methods for child support policies
1. Procedures and time limit for reviewing
At the beginning of a school year, preschools shall
prepare and send lists of children aged 3 to 5 eligible for policies under
Clause 1 and Clause 2 Article 6 hereof to People’s Committees of communes,
wards, special regions affiliated to provinces (hereinafter referred to as
“commune-level People’s Committees”) or Departments of Education and Training
depending on education and training assignment for inspection and approval;
ensure that children aged 3 to 5 and benefiting from policies under Clause 1
and Clause 2 Article 6 hereof do not benefit from policies of the same type
under other legislative documents;
Within 7 working days from the date on which
commune-level People’s Committees or Departments of Education and Training
receive documents from preschools, commune-level People’s Committees or
Departments of Education and Training have the responsibility to review and
submit list of policy beneficiaries to provincial People’s Committees for
consideration, approval, and issuance of expenditure;
Within 10 working days from the date on which
provincial People's Committees receive requesting documents from commune-level
People’s Committees, provincial People’s Committees have the responsibility to
approve policy beneficiaries and inform commune-level People's Committees and
preschools about approval results;
Commune-level People’s Committees or Departments of
Education and Training shall, immediately upon receiving approval results of
provincial People’s Committees, inform preschools which will publicize lists of
policy beneficiaries (within 3 working days) and pay support.

Support for lunch and learning expenditure for day-boarding
children aged 3 to 5 under Clause 1 and Clause 2 Article 6 hereof shall be paid
twice per school year: the first payment occurs in December whereas the second
payment occurs in April. Preschools shall pay policy beneficiaries via transfer
or in-person.
Article 8. Procedures, time
limit, and payment methods for human resource development policies
1. Procedures for consideration
At the beginning of each school year, public
preschools shall review and send lists of new teachers recruited and individuals
engaging in universalization tasks eligible for support policies in accordance
with Clause 3, Clause 4, and Clause 5 hereof to commune-level People’s
Committees or Departments of Education and Training in accordance with approved
education and training decentralization;
Within 7 working days from the date on which
commune-level People’s Committees or Departments of Education and Training
receive documents from preschools, commune-level People’s Committees and
Departments of Education and Training have the responsibility to review and
submit list of policy beneficiaries to provincial People’s Committees for
consideration, approval, and issuance of expenditure;
Within 10 working days from the date on which
provincial People’s Committees receive written request of commune-level
People's Committees, provincial People’s Committees shall promulgate Decision
approving lists of teachers benefiting from policies, inform commune-level
People’s Committees or Departments of Industry and Trade and preschools about
approval results;
Preschools shall, immediately upon receiving
decision of competent authorities approving lists of policy beneficiaries,
publicly declare (within 3 working days) and incur payments.
2. Payment methods
Preschools shall pay support for recruiting
teachers and individuals engaging in education universalization after obtaining
approval from competent authorities.

1. Developing estimates
On an annual basis, in the period in which
preparation for state budget estimates is carried out, preschools shall, on the
basis of number of children aged 3 to 5, develop plans for recruiting teachers
and individuals engaging in universalization tasks eligible for policy benefits,
prepare and send expenditure estimates to Departments of Education and Training
or commune-level People’s Committees in accordance with education
decentralization for inspection and submission to competent authorities.
2. Allocating estimates
Provincial People’s Committees shall request peer
People’s Councils to allocate expenditure on policy payout for policy
beneficiaries in accordance with this Decree in education and training
expenditure estimates of local governments as per the law.
3. Managing and settling expenditure
a) Preschools provided with expenditure in order to
provide financial support for eligible entities in accordance with this Decree
have the responsibility to manage, use, and settle expenditure in a manner that
serves the right purposes and conforms to the Law on State Budget.
b) Settlement data regarding policy payout for
eligible entities under this Decree shall be consolidated in reports on
settlement of annual state budget expenditure of entities in accordance with
applicable regulations of the Law on State Budget and guiding documents.

for implementation of policies on universalization of preschool education for
children aged 3 to 5

b) Policies pertaining to development school
network conforming to public investment laws, national target programs for
education modernization and improvement shall be integrated in funding sources
of national target programs assigned by competent authorities in annual plans
of ministries, central departments, and local governments in accordance with
applicable management decentralization.
c) Funding sources of private sector involvement
and other legally mobilized funding sources.
2. Preparation of estimates, management, use, and
settlement of funding shall conform to the Law on State Budget, the Law on
Public Investment, and applicable regulations of the law.
Chapter IV
ROADMAP FOR STANDARD
FULFILLMENT, FULFIILLMENT CRITERIA, FACILITIES, TEACHING EQUIPMENT,
CONSUMABLES, TOYS, PROCEDURES FOR EXAMINING UNIVERSALIZATION OF PRESCHOOL
EDUCATION FOR CHILDREN AGED 3 TO 5
Article 11. Roadmap for
standard fulfillment
1. By 2028, at least 50% of all provinces and
central-affiliated cities fulfill standards of universalization of preschool
education for children aged 3 to 5.
2. By 2030, 100% of all provinces and
central-affiliated cities fulfill standards of universalization of preschool
education for children aged 3 to 5.

2. In case of children: Complete preschool
education program corresponding to their age.
3. In case of communes, wards, special regions
(hereinafter referred to as “commune level”)
a) At least 90% of children aged 3 to 5 are
encouraged to attend classes; at least 85% of children in communes extremely
disadvantaged socio-economic situations are encouraged to attend classes;
b) At least 85% of children aged 3 to 5 complete
preschool education program for children aged 3 to 5 at appropriate age; at
least 80% of children aged 3 to 5 in communes with extremely disadvantaged
socio-economic situations complete preschool education program for children
aged 3 to 5 at appropriate age.
4. In case of provinces and central-affiliated
cities (hereinafter referred to as “provincial level”): at least 90% of
communes are recognized for fulfillment of universalization of preschool education
for children aged 3 to 5; at least 85% of communes with extremely disadvantaged
socio-economic situations are recognized for fulfillment of universalization of
preschool education for children aged 3 to 5.
Article 13. Facilities,
teaching equipment, consumables, toys
Preschools where universalization of preschool
education for children aged 3 to 5 shall be required to be outfitted with
adequate facilities, teaching equipment, consumables, and toys as per the law
in order to arrange educational activities under preschool education program.
Article 14. Individuals
engaging in universalization
1. Teachers in charge of preschool classes for
children aged 3 to 5 at preschools.

3. Cadres affiliated to Departments of Education
and Training tasked with monitoring and managing universalization of preschool
education on a full-time or part-time basis.
4. Commune-level cadres and civil servants tasked
by commune-level People’s Committees to monitor, examine, inventory,
consolidate data, and encourage local children at appropriate age to attend
classes.
5. Commune-level People’s Committees shall assign
personnel to supervise universalization of preschool education for children
aged 3 to 5 in their jurisdiction.
Article 15. Entitlement to
inspection of standard fulfillment
1. Provincial People’s Committees shall examine and
issue decisions recognizing fulfillment of standards of preschool education
universalization for children aged 3 to 5 in commune level.
2. The Ministry of Education and Training shall
examine and issue decisions recognizing fulfillment of standards of preschool
education universalization for children aged 3 to 5 in provincial level.
Article 16. Application for
recognition of standard fulfillment for commune
1. Documents on universalization of preschool
education for children aged 3 to 5, including:
a)Data extracted from national population database;

preschool education program appropriate to their age.
2. Application for recognition of standard
fulfillment for commune consists of:
a) Written application submitted by commune-level
People’s Committee;
b) Reports on implementation and results of
universalization of preschool education for children aged 3 to 5 together with
statistics spreadsheets;
c) Record of self-inspection of preschool education
universalization for children aged 3 to 5.
Article 17. Application for
recognition of standard fulfillment for province
1. Application submitted by provincial People’s
Committee.
2. Reports on implementation and results of universalization
of preschool education for children aged 3 to 5 together with statistics
spreadsheets.
3. Records of inspection of preschool education
universalization for children aged 3 to 5 in commune level.

5. Documents and procedures under Article 15,
Article 16, and Article 17 hereof shall conform to Decree No. 20/2014/ND-CP
dated March 24, 2014 of the Government amended by Decree No. 142/2025/ND-CP
dated June 12, 2025 (Clause 1 Article 17) of the Government.
Article 18. Scope of
inspection for and recognition of standard fulfillment
1. Inspect universalization documents and
physically inspect implementation of preschool education universalization for
children aged 3 to 5.
2. Promulgate decision recognizing fulfillment of
preschool education universalization for children aged 3 to 5 for communes or
provinces where standards under this Decree are met.
Article 19. Procedures for
inspecting standard fulfillment
1. Commune-level government shall inspect and
submit application to provincial government for recognition of fulfillment of
standards of preschool education universalization for children aged 3 to 5.
2. Provincial government shall recognize
commune-level government’s fulfillment of standards of preschool education
universalization for children aged 3 to 5 and apply to the Ministry of
Education and Training for recognition of the provincial government’s
fulfillment of standards of preschool education universalization for children
aged 3 to 5.
3. The Ministry of Education and Training shall
inspect and recognize provincial government’s fulfillment of standards of
preschool education universalization for children aged 3 to 5.

Article 20. The Ministry of
Education and Training
1. Takes charge, cooperates with ministries,
central departments, and local governments in developing plans, coordinating implementation
of universalization of preschool education for children aged 3 to 5.
2. Develops and requests competent authorities to
promulgate or promulgates within their discretion policies, regulations of the
law pertaining to universalization of preschool education for children aged 3
to 5.
3. Coordinates and guides local government to
develop preschool network, invest in facilities, teaching equipment,
consumables, toys; implements policies relating to children and teams in a
manner that satisfies requirements for universalization of preschool education
for children aged 3 to 5.
4. Directs, encourages provinces and
central-affiliated cities to train, recruit adequate number of preschool
teachers for the purpose of universalizing preschool education for children
aged 3 to 5.
5. Takes charge and cooperates with the Ministry of
Finance in developing, requesting competent authorities to allocate budget for
implementation of policies under this Decree.
6. Arranges examination, provide guidelines for support,
training, and advanced training pertaining to universalization of preschool
education from 3 years of age to 5 years of age; examines and recognizes
provincial government’s fulfillment of standards of preschool education for
children aged 3 to 5.
7. Develops and improves database for inspection
,examination, evaluation and recognition of universalization of preschool
education for children aged 3 to 5.
8. Assumes responsibility to the Government for
implementation of Resolution No. 218/2025/QH15 dated June 26, 2025 of the
National Assembly and this Decree; advises the Government on development of
periodic assessment, conclusive reports on implementation of Resolution and
reports to the National Assembly.

Cooperates with the Ministry of Education and
Training, People’s Committees of all levels, and preschools in reviewing,
amending, and providing data from national population database in order to
determine and encourage children aged 3 to 5 subject to universalization of
preschool education (additional information required includes: information
fields on national population database and identification information of:
eligible children residing in extremely disadvantaged communes, hamlets and
pursuing education at public preschools at zone III, zone II, zone I communes,
communes with extremely disadvantaged hamlets in ethnic minority regions and
mountainous regions, extremely disadvantaged communes in coastal areas and
islands; children who are social protection beneficiaries; children living in
poor households or near-poor households; children of policy beneficiaries
according to Ordinance on benefits for people serving the war; children of
employees and staff working at industrial parks, industrial complexes,
export-processing zones; children with disabilities, children with disabilities
pursuing rehabilitation education).
Article 22. The Ministry of
National Defense
Advises competent authorities about promulgation of
policies, plans, and programs, assurance and strengthened investment in
facilities, teaching equipment, consumables, toys, human resources for caring
and educating children aged 3 to 5 at preschools under management of the
Ministry of National Defense in order to satisfy universalization demands.
Cooperates with the Ministry of Education and
Training, People’s Committees of all levels, preschools in administrative
divisions where preschools of the Ministry of National Defense are located in
successfully implementing universalization of preschool education for children
aged 3 to 5 as per the law.
Article 23. The Ministry of
Home Affairs
Cooperates with the Ministry of Education and
Training in presenting policies pertaining to salaries, wages, bonus, attraction,
recruitment, and employment of managerial cadres, teachers, employees working
in preschool education as per the law.
Article 24. The Ministry of
Finance
Takes charge and cooperates with the Ministry of
Education and Training, relevant ministries, and central departments in
requesting competent authorities to allocate funding for policies under this
Decree in accordance with state budget laws and public investment laws.
Article 25. Ministries,
ministerial agencies, Central Committee of Viet Nam Fatherland Front, relevant
agencies and organizations

Article 26. Provincial
People’s Committees
1. Promulgate documents, policies, plans, roadmaps
for coordinating implementation, implementing universalization of preschool
education for children aged 3 to 5 of provinces and cities in order to meet
target. Integrate objectives and tasks relating to universalization of
preschool education for children aged 3 to 5 in documents of the Communist
Party, annual and periodic local socio-economic developments. Promote private
sector involvement in education, enable, support, and encourage domestic and
foreign individuals, enterprises, and organizations to invest in and develop
preschool education. Prioritize development of preschool education in communes
with extremely disadvantaged socio-economic situations, communes in
disadvantaged areas, ethnic minority regions, mountainous regions, borders,
islands, shoals, coastal areas, residential areas, administrative divisions
with industrial parks, industrial complexes, and export-processing zones.
2. Prepare planning, invest, build adequate
schools, classes, facilities, teaching equipment for universalization of
preschool education for children aged 3 to 5. Develop, maintain, upgrade, and
operate database on universalization of preschool education for children aged 3
to 5 of provinces and cities connected to system of the Ministry of Education
and Training.
3. Develop plans for training, advanced training,
registering training, attracting, recruiting, and assigning adequate number of
preschool teachers in accordance with the norms for universalization of
preschool education for children aged 3 to 5.
4. Fully implement policies relating to preschools,
children aged 3 to 5, managerial cadres, teachers, and employees working in
preschool education, and beneficiaries of policies under this Decree.
5. Provide funding for adequate implementation of
policies under this Decree; balance financial resources for local
implementation of policies in provinces and cities in accordance with the Law
on State Budget, the Law on Public Investment, and guiding documents. In
respect of provinces and central-affiliated cities of which budget balance is
higher than policy payout under this Decree, provincial People’s Committees
shall request peer People’s Councils to decide.
6. Examine and recognize communes that fulfill
standards of preschool education universalization for children aged 3 to 5.
Provide guidelines on implementation of policies in provinces and cities as per
the law.
Article 27. Commune-level
People’s Committees
1. Develop plans and arrange implementation of
universalization of preschool education for children aged 3 to 5 in their
communes.

Article 28. Preschools and
children’s families
Preschools have the responsibility to arrange
universalization of preschool education for children aged 3 to 5 within their
functions, tasks, and powers as per the law.
Families have the responsibility to enable children
aged 3 to 5 to attend schools, classes, receive care and education at
preschools in order to fulfill standards of preschool education universalization
for children aged 3 to 5.
Article 29. Entry into force
and responsibilities for implementation
1. This Decree comes into force from the date of
signing.
2. The Minister of Education and Training shall
arrange implementation of tasks and policies hereunder.
3. Ministers, figureheads of ministerial agencies,
figureheads of Governmental agencies, Chairpersons of provincial People's
Committees, and relevant organizations, individuals shall be responsible for
the implementation of this Decree.
