DECREE
ON
ACTIVITIES RELATED TO CIVIL CRYPTOGRAPHY AND AMENDMENTS TO DECREE NO.
15/2020/ND-CP DATED FEBRUARY 3, 2020 OF THE GOVERNMENT ON PENALTIES FOR ADMINISTRATIVE
VIOLATIONS AGAINST REGULATIONS ON POSTAL SERVICES, TELECOMMUNICATIONS, RADIO
FREQUENCIES, INFORMATION TECHNOLOGY, AND ELECTRONIC TRANSACTIONS WHICH IS
AMENDED BY DECREE NO. 14/2022/ND-CP DATED JANUARY 27, 2022 OF THE GOVERNMENT

Violations No. 15/2012/QH13, which is amended by Law No. 54/2014/QH13, Law No.
18/2017/QH14, Law No. 67/2020/QH14, Law No. 11/2022/QH15, Law No. 56/2024/QH15
and Law No. 88/2025/QH15;

Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Decree elaborate some articles of the Law on
cyberinformation security on providing civil cryptography products and
services, and export or import of civil cryptography products and amends Decree
No. 15/2020/ND-CP dated February 3, 2020 of the Government on penalties for
administrative violations against regulations on postal services,
telecommunications, radio frequencies, information technology and electronic
transactions which is amended by Decree No. 14/2022/ND-CP dated January 27,
2022 of the Government.
Article 2. Regulated entities
1. Civil cryptography product and service
providers, importers and exporter of civil cryptography product; organizations
participating in assessment of conformity of civil cryptographic products and
other relevant organizations and individuals.
2. Organizations and individuals committing
administrative violations against regulations on trading in, using civil
cryptography; competent persons for making written records of and imposing
penalties on administrative violations against regulations on providing, using
civil cryptography, and relevant organizations and individuals.

PROVISION OF CIVIL

Attached to this Decree are the List of civil
cryptography products and services specified in Appendix I and List of civil
cryptography products exported and imported under license specified in Appendix
II.
Article 4. Application of the
List of civil cryptography products exported and imported under license
1. The List of civil cryptography products exported
and imported under license shall only apply to civil cryptography products that
have HS codes, product descriptions and cryptographic technical specifications
identical to the HS codes, product descriptions and cryptographic technical
specifications of the goods in such List.
2. In case there is a difference in determining the
HS codes in the List attached hereto and the List of Vietnam's export and
import goods, the determination of the HS codes shall comply with laws on customs.
Article 5. Requirements for
issuance of license to provide civil cryptography products, services
1. Enterprises are granted a License to provide
civil cryptographic products/services when they satisfy all requirements
specified in Clause 2 of Article 31 of the Law on cyberinformation security.2.
Licensing requirements as prescribed in Point a of Clause 2 of Article 31
of the Law on cyberinformation security are prescribed as follows: Enterprise
must have at least 02 technicians who possess a bachelor’s degree or higher
qualifications in electronics - telecommunications, information technology,
mathematics or information security; the managerial personnel that possess must
have a bachelor’s degree in one of the above disciplines or have a bachelor’s
degree in other discipline with a training certificate in information security.
3. The licensing requirements as stated in point dd
of clause 2 of Article 31 of the Law on cyberinformation security: The
enterprise must possess a customer and technical service system pertinent to
its business scope, target customers and product range and comply with form No.
04 of Appendix II attached hereto.
Article 5. Procedure for
issuance, amendment, re-issuance, and renewal of a license to provide civil
cryptography products and services

b) A copy of the Enterprise Registration
Certificate or Investment Registration Certificate or equivalent;
c) Copies of diplomas/degrees or professional
certificates in information security and safety of the managerial personnel,
and technicians;
d) Technical plan including documents on technical
specifications, technical parameters of products; product standards and
technical regulations; service standards and quality; technical measures and
solutions; warranty and maintenance plans of products according to form No. 03
in Appendix III attached hereto;
dd) Business plan including scope, target
customers, scale and quantity of products, services, system serving customers,
and technical assurance according to form No. 04 in Appendix III attached hereto;
e) Cyberinformation security and safety plan during
management and provision of civil cryptographic products/services according to
form No. 05 in Appendix III attached hereto.
2. The application for amendments to the License to
provide civil cryptography products, services:
a) The application form for amendments to the
License using form No. 02 of Appendix III attached hereto;
b) A copy of the Enterprise Registration
Certificate or Investment Registration Certificate or equivalent;
c) The issued License to provide civil cryptography
products, services;

3. The application for re-issuance of the License
to provide civil cryptography products, services: The application form for
re-issuance of the License using form No. 02 of Appendix III attached hereto;
4. The application for renewal of the License to
provide civil cryptography products, services:
a) The application form for renewal of the License
using form No. 02 of Appendix III attached hereto;
b) Unexpired License to provide civil cryptography
products, services;
c) Business operation report of the enterprise for
the last 2 years.
5. For the documents at point b of Clause 1, points
b and c of Clause 2, and point b of Clause 4 of this Article, the Government
Cipher Committee shall retrieve data from the National Database without
requiring the enterprise to provide these documents.
6. Enterprises carrying out procedures for new
issuance, amendment, re-issuance, or renewal of the License to provide civil
cryptographic products/services shall submit an application in person, by post,
or via online public service system to the Government Cipher Committee,
phone/fax: 024-3232.3313, email: [email protected], National Public Service
Portal: https://dichvucong.gov.vn. Online application must be digitally signed
in accordance with the law on digital signatures.
7. Within 3 working days from the date of receipt
of the application, the Government Cipher Committee shall check the validity of
the application; if invalid, the enterprise shall be notified in writing about
the contents to be amended. Within 5 working days from receiving the
notification, the enterprise is responsible for completing the application. If,
after the amendments, the application still does not satisfy the requirements
or the completion deadline has already expired, within 3 working days, the
Government Cipher Committee shall notify the enterprise in writing of the
reasons for refusal to issue the license.
From the date of receiving an adequate application,
the Government Cipher Committee shall appraise and issue a new License to
provide civil cryptographic products and service within 20 days; re-issue the
license within 10 working days for cases of amendments or renewal; re-issue the
license within 4 working days if the license is lost or damaged. In case of
refusal, the Government Cipher Committee shall notify in writing and clearly
state the reasons. The License to provide civil cryptography products, services
shall comply with form No. 06 of Appendix III attached hereto;

1. The application for issuance of the license to
import/export civil cryptography products shall be made in 02 sets, including:
a) The application form for issuance of the License
to import/export civil cryptography products using form No. 07 of Appendix III
attached hereto;
b) A copy of the License to provide civil
cryptography products, services;
c) A copy of the certificate of conformity of the
civil cryptography products imported;
2. For the documents at point b and point c of
Clause 1, the Government Cipher Committee shall retrieve data from the National
Database without requiring the enterprise to provide these documents.
3. Enterprises carrying out procedures for issuance
of the License to import/export civil cryptographic products shall submit an
application in person, by post, or via online public service system to the
Government Cipher Committee at the address specified in Clause 6 of Article 6
hereof.
4. Within 01 working days from the date of receipt
of the application, the Government Cipher Committee shall check the validity of
the application; if invalid, the enterprise shall be informed in writing about
the contents to be amended. If, after the amendments, the application still
does not satisfy the requirements, the Government Cipher Committee shall notify
the enterprise in writing of the reasons for refusal to issue the license.
From the date of receiving an adequate application,
the Government Cipher Committee shall appraise and issue a License to
import/export civil cryptographic products within 07 working days. In case of
refusal, the Government Cipher Committee shall notify in writing and clearly
state the reason. The License to import/export civil cryptography products
shall comply with form No. 08 of Appendix III attached hereto;

Article 8. Responsibilities for
managing the assessment of the conformity of the civil cryptography products
The Government Cipher Committee assisting the
Minister of National Defense in managing the assessment of the conformity of
the civil cryptography products shall have the following tasks:
1. Issuing Certificates of registration for
assessment of the conformity of the civil cryptography products.
2. Designating and managing the operation of
organizations assessing the conformity of the civil cryptography products.
3. Receiving declarations of conformity of civil cryptographic
products.
Article 9. Conditions and
procedures for registration of assessment of conformity, designation of
organizations to conduct the assessment, and declaration of conformity of civil
cryptographic products
1. Conditions and procedures for registration of
assessment of conformity, designation of organizations to conduct the
assessment, and declaration of conformity for civil cryptographic products
shall comply with the applicable laws on conditions, procedures, and dossiers
for registration for registration of assessment of conformity, designation of
organizations to conduct the assessment, and declaration of conformity of
products and goods.
2. Applications for registration of assessment of
conformity, designation of organizations to conduct the assessment, and
declaration of conformity for civil cryptographic products shall be submitted
in person, by post, or via online public service system to the Government
Cipher Committee at the address specified in Clause 6 of Article 6 hereof.

results of assessment of the conformity of civil cryptographic products

2. The Government Cipher Committee assisting the
Minister of National Defense in reviewing and deciding the unilateral
recognition of results of assessment of the conformity of civil cryptographic
products issued by international conformity assessment organizations or foreign
conformity assessment organizations to serve the state management of civil
cryptography.
Chapter IV
AMENDMENTS TO DECREE NO.
15/2020/ND-CP DATED FEBRUARY 3, 2020 OF THE GOVERNMENT ON PENALTIES FOR
ADMINISTRATIVE VIOLATIONS AGAINST REGULATIONS ON POSTAL SERVICES,
TELECOMMUNICATIONS, RADIO FREQUENCIES, INFORMATION TECHNOLOGY AND ELECTRONIC
TRANSACTIONS WHICH IS AMENDED BY DECREE NO. 14/2022/ND-CP DATED JANUARY 27,
2022 OF THE GOVERNMENT
Article 11. Amendments to
Decree No. 15/2020/ND-CP:
1. Amendments to some points and clauses of Article
3:
a) Amendment to point a of clause 2:
“a) The following license shall be suspended for a
fixed period of 01-24 months: Postal service license; telecommunications
license; license for establishment of telecommunications network; submarine
cable installation license; license to use radio frequencies; license for
trading in cyberinformation security products and services; license for
establishment of social network; license to provide G1 gaming services; license
to provide public digital signature authentication services; license to provide
civil cryptographic products/services; practicing license/certificate;".
b) Amendment to point b and clause 2:
“b) The exhibits and instrumentalities used for
committing administrative violations in postal services, telecommunications, radio
frequencies, IT, electronic transactions sectors, and cyberinformation security
shall be confiscated;”

n) Enforced re-export of imported cyberinformation
security products and civil cryptographic products imported;”;
d) Amendment to point q and clause 3:
“q) Proposed revocation of license due to the
commission of violation against the law.”
dd) Addition of points r, s, t, u after point q of
clause 3:
“r) Enforced report on the provision of civil
cryptographic products/services and summary of clients’ information;
import/export of civil cryptographic products;
s) Enforced establishment, storage and security of
clients’ information, type name, quantity and purpose of use of civil
cryptographic products/services;
t) Enforced declaration of the use of civil
cryptographic products not provided by licensed enterprises;
u) Enforced provision of information related to
encryption keys to competent state authorities.”.

1. A warning shall be imposed on the act of
submitting reports to the Government Cipher Committee on the provision of civil
cryptographic products/services and summarizing clients’ information less than
01 month late compared to the prescribed deadline.
2. A fine ranging from VND 20.000.000 to VND
30.000.000 shall be imposed on the following acts:
a) Failing to manage, preserve, and store documents
on technical solutions and technologies of civil cryptographic products in
accordance with laws on management, preservation, and storage of documents;
b) Failing to establish, store and keep
confidentiality of information about users, name, type, quantity, and purpose
of civil cryptographic products/services;
c) Failing to submit reports or submitting reports
to the Government Cipher Committee on provision, import/export of civil
cryptographic products products/services and summarizing client’s
information 01 month or more later than the prescribed deadline.
3. A fine ranging from VND 30,000,000 to VND
40,000,000 shall be imposed on the act of failing to carry out procedures to
amend the License to provide civil cryptographic products/services when
changing the name of the legal representative.
4. A fine ranging from VND 40.000.000 to VND
50.000.000 shall be imposed on the following acts:
a) Failing to maintain one of conditions for
issuance of the License to provide civil cryptographic products/services;
b) Failing to refuse provision of civil
cryptographic products/services when detecting organizations or individuals
violating laws on the use of such products/services or breaching contractual
commitments agreed upon regarding the use of civil cryptographic products/services
provided by the enterprise;

5. A fine ranging from VND 50.000.000 to VND
60.000.000 shall be imposed on the following acts:
a) Providing inaccurate information to obtain the
License to provide civil cryptographic products/services;
b) Providing civil cryptographic products/ services
inconsistent with the content recorded on the License;
c) Refusing to provide necessary information
related to cryptographic keys to competent state authorities upon request.
6. The following fines shall be imposed on act of
providing civil cryptographic products/services without a License to provide
such products/services as follows:
a) A fine ranging from VND 50.000.000 to VND
60.000.000 if the value of goods involved is under VND 50.000.000;
b) A fine ranging from VND 60.000.000 to VND
80.000.000 if the value of goods involved is from VND 50.000.000 to under VND 100.000.000;
c) A fine ranging from VND 80.000.000 to VND
100.000.000 if the value of goods involved is from VND 100.000.000 to under VND
150.000.000;
d) A fine ranging from VND 100.000.000 to VND
120.000.000 if the value of goods involved is from VND 150.000.000 to under VND
200.000.000;

e) A fine ranging from VND 140.000.000 to VND
160.000.000 if the value of goods involved is from VND 250.000.000 to under VND
300.000.000;
g) A fine ranging from VND 160.000.000 to VND
180.000.000 if the value of goods involved is VND 300,000,000 or more;
7. A fine ranging from VND 80.000.000 to VND
100.000.000 shall be imposed on the following acts:
a) Failing to cooperate or enable competent state
authorities' performance of professional measures upon their requests;
b) Failing to suspend or stop provision of
civil cryptographic products/services to ensure national defense, security, social
order, and safety when requested by competent state authorities.
8. A fine ranging from VND 80.000.000 to VND
100.000.000 shall be imposed on act of provision of civil cryptographic
products/services where the subjects and purposes of use cause harm to national
defense, security, social order, and safety.
9. Additional penalties:
The license to provide civil cryptographic
products/services shall be suspended for 03 – 06 months for violations
specified in Point b of Clause 4 of this Article;
b) The provision of civil cryptographic
products/services shall be suspended for 03 – 06 months for violations
specified in Clause 7 of this Article;

10. Remedial measures:
a) Enforced report on the provision of civil
cryptographic products/services and summary of clients’ information for act of
failing to submit reports specified in point c of clause 2 of this Article;
b) Enforced establishment, storage and security of
clients’ information, type name, quantity and purpose of use of civil
cryptographic products/services for violations specified in point b of clause 2
of this Article;
c) Enforced declaration of the use of civil
cryptographic products not provided by licensed enterprises for violations of
point c of clause 4 of this Article;
d) Enforced provision of information related to
cryptographic keys to competent state authorities for violations under point c
of Clause 5 of this Article;
Enforced return of benefits illegally obtained from
the commission of the violations specified in Point b of clause 4, points a and
b of clause 5, clause 6, point b of clause 7, clause 8 of this Article.
“Article 93b. Violations against regulations on
import/export of civil cryptography products
1. A warning shall be imposed on the act of
submitting reports to the Government Cipher Committee on the import/export of
civil cryptographic products less than 01 month late compared to the prescribed
deadline.
2. A fine ranging from VND 20.000.000 to VND
30.000.000 shall be imposed on the act of failing to submit reports or
submitting reports to the Government Cipher Committee on import/export of civil
cryptographic products 01 month or more later than the prescribed deadline.

4. A fine ranging from VND 40.000.000 to VND
50.000.000 shall be imposed on the act of failing to import/export civil
cryptographic products inconsistent with the content recorded on the License.
5. A fine ranging from VND 50.000.000 to VND
60.000.000 shall be imposed on the following acts:
a) Providing inaccurate information to obtain the
License to import/export civil cryptographic products;
b) Failing to cooperate or enable competent
authorities' performance of professional measures upon their requests.
6. A fine ranging from VND 60.000.000 to VND
80.000.000 shall be imposed on the act of importing/exporting civil
cryptographic products without a License.
7. A fine ranging from VND 80.000.000 to VND
100.000.000 shall be imposed on the following acts:
a) Failing to suspend or stop the import/export of
civil cryptographic products to ensure national defense, security, social
order, and safety when requested by competent state authorities.
b) Importing/Exporting civil cryptographic products
whose subjects and purposes of use cause harm to national defense, security,
social order and safety.

9. Remedial measures:
a) Enforced report on the import/export of civil
cryptographic products for act of failing to submit reports specified in clause
2 of this Article;
b) Enforced return of benefits illegally obtained
from the commission of the violations specified in clause 4, point a of clause
5, clause 6, clause 7 of this Article;
c) Enforced re-export of civil cryptographic
products for violations specified in clause 4, point a of clause 5, clause 6 of
this Article.”.
3. Amendment to Article 114:
“Article 114. Power to impose penalties of
Inspectors
1. Inspectors of Ministries and ministerial
agencies assigned to conduct inspections within their state management scope of
Ministries and ministerial agencies have the power to:
a) Issue warnings;
b) Impose a fine of up to VND 20.000.000 on an
administrative violation in telecommunications, radio frequencies, information
technology, or cyberinformation security or a fine of up to VND 8.000.000 on an
administrative violation in postal service or electronic transaction;

2. Heads of inspection teams of the following
agencies: Department of Radiation and Nuclear Safety, Vietnam Maritime
Administration, Civil Aviation Authority of Vietnam, Provincial Police
authorities; Heads of inspection teams at military region level, Hanoi Capital
Command assigned to conduct inspections within the state management of
Ministries, competent ministerial agencies have the power to:
a) Issue warnings;
b) Impose a fine of up to VND 100.000.000 on an
administrative violation in telecommunications, radio frequencies, information
technology, or cyberinformation security or a fine of up to VND 40.000.000 on
an administrative violation in postal service or electronic transaction;
c) Confiscate the exhibits and means of
administrative violations;
d) Apply remedial measures as prescribed in Clause
1 of Article 28 of the Law on Handling of Administrative Violations.
3. The Chief Inspectors of the Department of
Radiation and Nuclear Safety; Vietnam Maritime and Waterway Administration,
Civil Aviation Authority of Vietnam; Heads of inspection teams at military
region level; Hanoi Capital Command; State Bank's regional branches; Provincial
Police authorities assigned to conduct inspections within the state management
of Ministries, competent ministerial agencies have the power to:
a) Issue warnings;
b) Impose a fine of up to VND 160.000.000 on an
administrative violation in telecommunications, radio frequencies, information
technology, or cyberinformation security or a fine of up to VND 64.000.000 on
an administrative violation in postal service or electronic transaction;
c) Revoke practicing licenses/certificates, or
suspend operations for a fixed term;

dd) Apply remedial measures as prescribed in Clause
1 of Article 28 of the Law on Handling of Administrative Violations.
4. Chief Inspectors of Ministries and ministerial
agencies; Heads of inspection teams of Ministries or ministerial agencies
assigned to conduct inspections within the state management scope of Ministries
and ministerial agencies; Heads of agencies performing state management duties
by sector or field have the power to:
a) Issue warnings;
b) Impose a fine at a maximum level on an
administrative violation in telecommunications, radio frequencies, information
technology, cyberinformation security, postal service or electronic
transaction;
c) Revoke practicing licenses/certificates, or
suspend operations for a fixed term;
d) Confiscate the exhibits and means of
administrative violations;
dd) Apply remedial measures as prescribed in Clause
1 of Article 28 of the Law on Handling of Administrative Violations.”.
4. Addition of Articles 114a after Article 114:
“Article 114a. Power to impose penalties on
administrative violations of the Cipher Inspectorate and the Head of the
Government Cipher Committee

a) Issue warnings;
b) Impose a fine of up to VND 20.000.000 on an
administrative violation related to civil cryptography in cyberinformation
security;
c) Confiscate the exhibits and means of
administrative violations that are worth less than 02 times the fine specified
in Point b of this Clause.
2. Heads of inspection teams of the Government
Cipher Committee have the power to:
a) Issue warnings;
b) Impose a fine of up to VND 100.000.000 on an
administrative violation related to civil cryptography in cyberinformation
security;
c) Confiscate the exhibits and means of
administrative violations;
d) Apply remedial measures as prescribed in Clause
1 of Article 28 of the Law on Handling of Administrative Violations.
3. Chief Inspector of the Cipher Inspectorate has
the power to:

b) Impose a fine of up to VND 160.000.000 on an administrative
violation related to civil cryptography in cyberinformation security;
c) Revoke licenses or suspend operations for a
fixed term;
d) Confiscate the exhibits and means of
administrative violations;
dd) Apply remedial measures as prescribed in Clause
1 of Article 28 of the Law on Handling of Administrative Violations.
4. Heads of the Government Cipher Committee have
the power to:
a) Issue warnings;
b) Impose a fine up to the maximum level on an
administrative violation related to civil cryptography in cyberinformation
security;
c) Revoke licenses or suspend operations for a
fixed term;
d) Confiscate the exhibits and means of
administrative violations;

“Article 115. Power to impose penalties of
Presidents of People’s Committees at all levels
1. Presidents of communal-level People’s Committees
shall have the power to:

control has the power to:

Clause 1 of Article 110; Clauses 1, 2, and 3 of Article 111; Clauses 1 and 2 of
Article 112; and Article 113 of this Decree according to the authority
prescribed in Article 116 hereof and their jurisdiction.
The Head of the Immigration Division of the
Provincial Police authorities, Directors of provincial police authorities, and
Directors of the Immigration Department shall have the power to impose
administrative penalties and the power to make decision on imposition of
expulsion penalty specified herein.
3. Authorized persons of the Border guard forces
shall have the power to impose administrative penalties and apply remedial
measures for violations prescribed herein, except violations specified in
Clause 8 of Article 14; Clauses 2 and 3 of Article 19; Clause 2 of Article 51;
Clauses 2 and 4 of Article 64; Article 67; Clauses 2 and 3 of Article 68;
Clauses 2 and 3 of Article 69; Clauses 2 and 3 of Article 70; Clause 3 of
Article 77; and Article 80, according to the authority prescribed in Article
117 hereof within their management and jurisdiction.
4. Authorized persons of the border guard forces
shall have the power to impose administrative penalties and apply remedial
measures for violations prescribed herein, except violations specified in
Clause 8 of Article 14; Clauses 2 and 3 of Article 19; Clause 2 of Article 51;
Clauses 2 and 4 of Article 64; Article 67; Clauses 2 and 3 of Article 68;
Clauses 2 and 3 of Article 69; Clauses 2 and 3 of Article 70; Clause 3 of
Article 77; and Article 80, according to the authority prescribed in Article
118 hereof and their jurisdiction.

6. Authorized persons of the Inspectorates shall
have the power to impose administrative penalties and apply remedial measures
for violations prescribed herein, except violations specified in Clause 8 of
Article 14; Clauses 2 and 3 of Article 19; Clause 3 of Article 77; and Article
80, according to the authority prescribed in Article 114 hereof and their
jurisdiction.
7. Authorized persons of Market Surveillance forces
shall have the power to impose administrative penalties and apply remedial
measures for violations prescribed herein, except violations specified in
Clause 8 of Article 14; Clauses 2 and 3 of Article 19; Clause 3 of Article 77;
and Article 80, according to the authority prescribed in Article 119 hereof and
their jurisdiction.
8. Cooperation among agencies when imposing
penalties on administrative violations against regulations on postal services,
telecommunications, radio frequency, information technology, cyberinformation
security, and electronic transactions shall comply with regulations in Article
52 of the Law on Handling Administrative Violations.
Article 121. Power to issue offence notices
The positions mentioned in Articles 114, 114a, 115,
116, 117, 118, 119 and 119a hereof, civil servants, public employees, people in
the People's Army, People's Police, people responsible for cipher activities
who are performing official duties, tasks and powers assigned in postal
services, telecommunications, radio frequencies, information technology,
cyberinformation security and electronic transactions shall have the right to
issue offence notices for administrative violations as prescribed.".

IMPLEMENTATION CLAUSES
Article 12. Effect
1. This Decree comes into force from September 09,

Article 13. Transitional
clauses
1. Providers of civil cryptographic products and
services that have unexpired license granted in accordance with Decree No.
58/2016/ND-CP dated July 1, 2016 of the Government elaborating regulations on
provision of civil cryptographic products /services and the import/export of
civil cryptographic products; Decree No. 53/2018/ND-CP dated April 16, 2018 of
the Government amending Decree No. 58/2016/ND-CP and Decree No. 32/2023/ND-CP
dated June 9, 2023 of the Government amending Decree No. 53/2018/ND-CP do not
have to re-apply for a License to provide civil cryptography products/services.
Within 30 days before the license expires, the enterprise must apply for a new
license in accordance herewith.
2. Licenses to import/export civil cryptographic
products that have been granted to enterprises before the effective date of
this Decree and such products' names match the description of the goods in the
Vietnam’s Nomenclature of exports and imports shall continue to be used in
carrying out customs procedures according to the time limit stated on the
Licenses. The Customs authority shall rely on the Vietnam’s Nomenclature of
exports and imports, the issued license for export and import of civil
cryptographic products and the actual status of exports and imports to
determine the HS code and carry out customs clearance procedures as prescribed.
3. The applications for issuance, amendment,
re-issuance, and renewal that have been accepted by the Government Cipher
Committee at the time the Decree No. 58/2016/ND-CP dated July 1, 2016 of the
Government elaborating regulations on provision of civil cryptographic
products/services and the import/export of civil cryptographic products; Decree
No. 53/2018/ND-CP dated April 16, 2018 of the Government amending Decree No.
58/2016/ND-CP and Decree No. 32/2023/ND-CP dated June 9, 2023 of the Government
amending Decree No. 53/2018/ND-CP are still in effect but have not been
processed shall continue to be processed in accordance with the regulations of
such Decrees.
4. Applications for issuance, amendment,
re-issuance, and renewal accepted by the Government Cipher Committee from the
effective date of this Decree shall apply the regulations prescribed herein.
Article 14. Responsibility for
implementation
Ministers, heads of ministerial agencies, heads of
government-affiliated agencies, Presidents of People's Committees of provinces
and centrally affiliated cities and relevant organizations and individuals are
responsible for implementing this Decree./.
