CIRCULAR
ON
DELEGATION OF POWERS AND DISTINCTION OF POWERS IN STATE MANAGEMENT OF LAND
Pursuant to the Law on Organization of the
Government 2025;
Pursuant to the 2025 Law on Organization of
Local Government 2025;
Pursuant to the Resolution No. 190/2025/QH15
dated February 19, 2025 of the National Assembly on settlement of some issues
related to restructuring of state apparatus;
Pursuant to Resolution No. 202/2025/QH15
dated June 12, 2025 of the National Assembly on the rearrangement of provincial
administrative divisions;
Pursuant to Government’s Decree No.
35/2025/ND-CP dated February 25, 2025 on the functions, tasks, powers and
organizational structure of the Ministry of Agriculture and Environment of
Vietnam;
Pursuant to Government’s Decree No.
151/2025/ND-CP dated June 12, 2025 on delegation of powers to two-tier local governments;

The Minister of Agriculture and Environment
issues a Circular on delegation and distinction of powers in state management
of land.
Chapter I
GENERAL
PROVISIONS
Article 1. Scope
This Circular provides for the delegation and
distinction of powers in state management of land, including:
1. Elaboration of the Government’s Decree No.
151/2025/ND-CP dated June 12, 2025 on delegation of powers to two-tier local
governments; delegation and distinction of powers in fields of land;
2. Amendments and supplements of some
provisions of legislative documents under the authority of the Minister of
Agriculture and Environment to implement the delegation and distinction of
powers in land.
Article 2. Regulated
entities
This Circular applies to central state
administrative authorities, local authorities, and relevant organizations and
individuals in the field of land.

AND SUPPLEMENTS TO SOME PROVISIONS OF CIRCULARS IN THE FIELD OF LAND
Article 3. Amendments
and supplements to certain provisions of Circular No. 08/2024/TT-BTNMT dated
July 31, 2024 of the Minister of Natural Resources and Environment on land
statistics, land inventory, and mapping of current land use status
1. Several points and clauses of Article 6 are
amended as follows:
a) Point a, Article 1 is amended as follows:
“a) Collect records, documents, maps, data
concerning land-related changes during the statistical year of communes,
records of boundaries of commune-level administrative divisions; commune-level
land inspection data of the previous period or land statistics conducted in the
previous year, and other relevant documents; receive the list of land changes
in the statistical year and the period of producing statistics specified in
Appendix IV enclosed herewith sent by Land Registration Offices;";
b) Clause 2 and point a Clause 2 are amended as
follows:
“2. Review, consolidate, update, and adjust
land changes in the statistical year:
a) Cases of changes in land type, land user,
entity assigned to manage land in the list of land changes in the statistical
year sent by Land Registration Offices; update information before and after the
changes of land parcels in the list of land changes in the statistical year and
the period of producing statistics specified in Appendix IV enclosed herewith
sent by Land Registration Offices;
Review, consolidate land changes in the
statistical year for cases of changing in land type, entity assigned to manage
land that have undergone procedures for land allocation, land lease, land
repurposing, land repossession in the statistical year for individuals and
communities into the list of land changes in the statistical year and the
period of producing statistics specified in Appendix IV enclosed herewith,
except for commune-level administrative divisions that already have land data
databases being managed and operated consistently at all levels.”.

In cases where mapping the current land use
status of an administrative division with a complex boundary shape makes it
difficult to depict the content when mapping at the scale as prescribed, such
as significantly different lengths and widths, the option to choose a larger or
smaller scale than the regulation above within the range from 1:2,000 to 1:100,000
is allowed.”.
3. Point d, Clause 3 of Article 17 is amended
as follows:
“d) Transportation category and relevant
objects: cadastral maps of communes shall include all types of transportation
routes, including local roads, main roads within residential areas, and trails
in mountainous and midland communes. Provincial-level cadastral maps should
show inter-communal roads and above. Cadastral maps for economic and social
regions and nationwide shall show provincial roads and above; for mountainous
areas, it should also include inter-communal roads;”
4. Clause 3 of Article 21 is amended as
follows:
“3. Inspection, acceptance of construction
works, production of land statistics and land inspection shall comply with
regulations of the Ministry of Agriculture and Environment, People's Committees
of provinces and cities on inspection, appraisal, and acceptance of
construction works and production in the field of land management.”.
5. Section 8, Part I of Appendix V is amended
as follows:
“8. Cadastral maps of communes and provinces
shall be made using the meridian axis of the province or city as prescribed in
Appendix 01 enclosed with Circular No. 26/2024/TT-BTNMT.".

Article 5. Amendments
and supplements to certain provisions of Circular No. 10/2024/TT-BTNMT dated
July 31, 2024 of the Ministry of Natural Resources and Environment
1. Point b, Clause 5 of Article 8 is amended as
follows: “b) Land use form shall be specified as follows:
- Private land use form is specified as: “Private
use”;
- Joint land use is specified as: “Joint use”;
- In case a parcel is under the joint land use
right of a wife and husband or a group of land users, it shall be specified as:
“Joint use of wife and husband (or Joint use of the group of Certificate
holders)”;
- In the case where a land parcel with an apartment
building or another construction work that the investor has sold the apartment,
construction work, or work item for the first time, the Certificate issued to
the owner of the apartment building, construction work, or work item shall be
specified as: “Use in common by owners of the apartment building (construction
work, or work item)”;
- In the case where a land parcel has an area
that is jointly used by multiple land users and areas separated used by each
land user, it shall be specified as: "... m2 for joint use; … m2 for
private use”;
- In the case where a land parcel has multiple
types of land that is jointly used by multiple land users or separately used by
each land user, it shall be specified as: “private use”, followed by the
type of land and private use area; and “joint use”, followed by the type
of land and joint use area. Example: “Private land use”; Residential land
120m2, perennial crop land 300m2; Joint use: Residential land 50m2, perennial
crop land 200m2”.”.

“a) Land parcel diagram shall be presented
based on the cadastral map or an excerpt from the cadastral map that has been
used to issue the Certificate. Content of the diagram shows the

which boundary markers of the district–level land use planning (before July 1,
2025) or commune-level land use planning or one of the planning of urban and

cadastral records.
The
adjustment and update of land-related databases shall be carried out as
follows:

Preparation
Prepare detailed
implementation plans; Prepare human resources, work locations; Prepare
materials, equipment, tools, and software to support the adjustment of
land-related databases when rearranging provincial- and commune-level
administrative divisions.
2.
Document
collection and assessment
a)
Collect land-related documents and data, including: cadastral records,
cadastral maps which have been adjusted after the rearrangement of
administrative divisions;
b)
Prepare a reference list of land parcels and land-attached assets for
land-related databases to be adjusted after the rearrangement of administrative
divisions.
3.
Adjustment
of land spatial data
a)
The base land spatial data shall be adjusted based on new administrative
boundaries approved by competent authorities. The layer of district-level administrative
boundary data and the district-level administrative area data which have been
built shall be transferred to storage for management and retrieval purposes;

parcel spatial data and land-attached asset spatial data shall have the information
about code of commune-level administrative division, map sheet number; land

sizes ranging from A4 to A0 depending on the scale of the land parcel and the
scale required to fully representing the land parcel within the boundary of the
cadastral map according to the established scale. The printed paper has a
weight of 120g/m2 or more, printed using map printers with a printing
resolution of at least 1200 x 600 dpi, high-quality ink, and suitable for the
technical requirements.”
2. Point c is added after point b, Clause 2 of
Article 23 as follows:
c) In cases where a cadastral map excerpt is
used for land registration or issuance of Certificates under the authority of
commune-level agencies, the cadastral map excerpt must be confirmed by the land
user, surveying unit, and commune-level land management agency.
3. Clause 5 of Article 23 is amended as
follows:
“5. Cadastral map and cadastral map excerpt
specified in Clauses 1, 2, and 3 of this Article shall be signed for confirmation
on paper and digital products. Digital products shall be signed for confirmation
in raster image data file format for cadastral maps and cadastral map excerpts;
and in *.pdf file format for land parcel registration form. Cadastral map
excerpt for land registration or issuance of Certificate under the authority of
commune-level agencies shall be signed for confirmation on paper or digital
products”.
4. Clause 3 is added after Clause 2 of Article
27 as follows:
“3. In case of the merger of administrative
divisions, cadastral maps and cadastral map excerpts created before the merger
shall be handled as follows:
a) Keep the longitudinal axis of the cadastral
map, cadastral map excerpt used before the merger without adjustment;
b) In case of the merger of commune-level
administrative divisions stipulated in point b, Clause 7, Article 17 of this
Circular, provincial-level land management agencies shall direct and organize
the adjustment of map sheet sequence for use after the rearrangement of
commune-level administrative divisions; and develop plans to adjust other
changes of the cadastral map due to changes in the name of administrative
divisions (if any).

documents according to Article 34 of this Circular, urban planning and zoning
planning according to Law on Urban and Rural Planning.

record the sequential number in the certificate issuance register in continuous
order, starting from No. 01 for the first certificate issued in accordance with
this Circular.
