LAW
ON AMENDMENTS TO SOME ARTICLES OF 10 LAWS RELATED TO
SECURITY AND ORDER
Pursuant to the
Constitution of the Socialist Republic of Vietnam amended by the Resolution No.
203/2025/QH15;
The National Assembly
promulgates the Law on amendments to some articles of the Law on VIP Protection
No. 13/2017/QH14 (amended by the Law No. 40/2024/QH15); the Law on Entry, exit,
transit, and residence of foreigners in Vietnam No. 47/2014/QH13 (amended by
the Law No. 51/2019/QH14, the Law No. 23/2023/QH15 and the Law No.
103/2025/QH15); the Law on Entry and Exit of Vietnamese Citizens No. 49/2019/QH14
(amended by the Law No. 23/2023/QH15); the Law on Residence No. 68/2020/QH14
(amended by the Law No. 59/2024/QH15); the Law on Identification No.
26/2023/QH15; the Law on Forces participating in protection of security and
order at grassroots level No. 30/2023/QH15 (amended by the Law No.
51/2024/QH15); the Law on Road Traffic Order and Safety No. 36/2024/QH15; the
Law on Road No. 35/2024/QH15 (amended by the Law No. 112/2025/QH15); the Law on
Management and Use of Weapons, Explosive Materials and Support Instruments No.
42/2024/QH15; the Law on Fire and Rescue (amended by the Law No.
135/2025/QH15).

entitled to different protection regimes, he/she is only entitled to the
highest regime.

5. Forces, means and
protective measures for protected entities when the political security
situation, social order and safety become complicated.
6. The Minister of Public
Security shall elaborate protective measures prescribed in this Article.”.
3. Amendments to clause
3, Article 12:
“3. Guests of the General
Secretary of the Central Committee of the Communist Party of Vietnam; the
President of the Socialist Republic of Vietnam; the President of the National
Assembly; the Prime Minister; the Permanent Member of the Secretariat; or other
guests of the Chief of the National Assembly’s Committee on National Defense,
Security, and Foreign Affairs, or of the Minister of Foreign Affairs who are not
entities prescribed in clauses 1 and 2 of this Article are entitled to one or
more protection regimes prescribed in clause 1, Article 11 of this Law during
their visits or working trips in Vietnam based on diplomatic requirements,
international practices, the guest’s request and the actual situation.”.

5. Amendments to point
g2, clause 1, Article 20:
“g) In cases where the
laws of the host country, or the available human resources and equipment do not
satisfy the requirements for VIP protection, a decision shall be issued to hire
forces, means and technical equipment to protect the entities prescribed in
points a, b, c, d and d1, clause 1, Article 10 of this Law when traveling
abroad on official duty;”.
6. The phrase “quận”
(district) is replaced with the phrase “phường” (ward) in point dd, clause 3,
Article 10.
7. The phrase “Head of
the Commission for Foreign Affairs, Chief of the Committee on Foreign Affairs
of the National Assembly” is replaced with the phrase “Chief of the National
Assembly’s Committee on National Defense, Security, and Foreign Affairs” in
point d, clause 2, Article 10.
Article
2. Amendments to some articles of the Law on Entry, Exit, Transit and Residence
of Foreigners in Vietnam
1. Addition of Article 6a
after Article 6:
“Article 6a. Use of
information in the national database and specialized databases for resolution
of administrative procedures
If documents and
information included in the dossiers on administrative procedures related to
entry, exit, transit and residence of foreigners in Vietnam are existed in the
national database or specialized databases, and can be accessed and used by the
authority receiving and processing the procedures, the authority shall not
request the applicants to re-submit those documents or information.
2. Addition of clauses 22
and 23 after clause 21, Article 8:

3. Amendments to clause
6, Article 9:
“6. LS, ĐT1, ĐT2, UĐ1,
UĐ2 visas shall be valid for no more than 05 years.”.
4. Addition of point dd
after point d, clause 4, Article 10:
“dd) Foreigners
prescribed in clause 22, Article 8 of this Law must have documents proving that
they are workforce of high-quality digital technology industry as prescribed by
the Law on Digital Technology Industry or documents proving that they are
entitled to preferential treatment.”.
5. Addition of clause 6
after clause 5, Article 12:
“6. Foreigners who are
entitled to special preferential treatment for socio-economic development are
entitled to definite visas in accordance with regulations on national defense,
national security and order, social order as prescribed by the Government.”.
6. Amendments to clause
1, Article 16:
“1. Foreigners who are
not prescribed in clauses 1, 2, 3 and 4, Article 8 of this Law shall go through
an inviting or sponsoring entity to carry out procedures at the immigration
authority. The inviting or sponsoring entity shall submit a written visa
application to the immigration authority in person, by post, or online in cases
where the authority or organization satisfies requirements in clause 1, Article
16b of this Law, and individual satisfies requirements prescribed in point a,
clause 1, Article 16b of this Law.”.

“Article 16b.
Procedures for issuance of electronic visas (e-visas) at the request of
authorities and organizations
1. Authorities and
organizations prescribed in clause 2, Article 16 of this Law may request for
issuance of e-visas for foreigners when they satisfy the following
requirements:
a) Possess an electronic
identification account issued by a competent authority in accordance with laws
on electronic identification and authentication;
b) Possess an electronic
signature as prescribed by the Law on Electronic Transactions.
2. Authorities and
organizations prescribed in clause 1 of this Article shall use their electronic
identification accounts to access the National Public Service Portal or the
Website for issuance of visas to request for issuance of electronic visas for
foreigners; pay visa fees to the account prescribed on the National Public
Service Portal or the Website for issuance of visas after receiving the
electronic dossier code from the immigration authority.
3. The immigration
authority shall consider, process and respond to the authorities and
organizations via the National Public Service Portal or the Website for
issuance of visas within 03 working days from the receipt of complete
information and visa fees.
4. Authorities and
organizations shall access the National Public Service Portal or the Website
for issuance of visas, use the electronic dossier code to receive the response
from the immigration authority, and notify the foreigners accordingly.
5. Foreigners granted
electronic visas shall use the electronic dossier code notified by authorities
or organizations to print the electronic visa issuance result at the National
Public Service Portal or the Website for issuance of visas.”.

clause 1, Article 36:
“b) Foreigners
temporarily residing in Vietnam who are eligible for LV1, LV2, LS, ĐT1, ĐT2,
ĐT3, NN1, NN2, DH, PV1, LĐ1, LĐ2, TT, UĐ1 and UĐ2 visas.”.
10. Amendments to clause
2, Article 38:
“2. Temporary residence
cards with the codes ĐT1, UĐ1 and UĐ2 shall be valid for no more than 10
years.”.
11. Amendments to some
points and clauses of Article 43:
a) Amendments to point b,
clause 2:
“b) In case of loss of
permanent residence cards, holders shall declare information in the application
for re-issuance of permanent residence card;”;
b) Addition of clause 4
after clause 3:
“4. The Minister of
Public Security shall decide cases in which foreigners are permitted to carry
out procedures for issuance, replacement or re-issuance of permanent residence
cards at the immigration authority due to diplomatic, national defense or
security reasons.

“b) Vietnamese citizens
residing permanently in Vietnam may invite or sponsor their grandparents,
parents of their spouse; their foreign spouse, children, siblings who are
foreigners to visit Vietnam. Vietnamese citizens residing permanently in
Vietnam who are grandparents may invite or sponsor their grandchildren who are
foreigners to visit Vietnam;”.

3, Article 46:
“3. Promulgate
regulations on foreigners entering border economic zones, special
administrative-economic divisions and coastal economic zones who are exempt
from visas under clauses 3 and 3a, Article 12 of this Law and have the need to
travel to other locations within Vietnam; issuance of visas to foreigners who
do not yet have a commercial presence or partner in Vietnam entering Vietnam
under international treaties of which Vietnam is a member; methods for issuance
of temporary residence certificates for foreigners entering Vietnam; issuance
and use of electronic identification accounts for foreigners; foreigners
entering and exiting through the automated control gates.

People’s Committees shall direct specialized authorities to cooperate in
management of residence of foreigners in provinces as prescribed by this Law.”.

a) When there is a ground
to determine that a passport issued to a citizen contains incorrect
information, the authority issuing passports shall verify and request the
passport holder to return the passport for cancellation;
b) In cases where the
valid passport cannot be recovered, the authority issuing passports shall
cancel the validity of such passport in the National Immigration Database.
Article 31b. Cancel
the validity of passports of wanted persons
When there is a ground to
determine that the passport of a wanted person is still valid, the authority
issuing passports shall verify and cancel the validity of that passport. In
cases where the wanted person living overseas returns to Vietnam to surrender
or to participate in other criminal proceedings, the overseas representative
office of Vietnam shall issue a regular passport under simplified procedures
for that person.”.

“2. The national database
on exit and entry of Vietnamese citizens shall be developed to connect with
databases on population, identification, nationality and other databases in accordance
with standards on database structure; technical standards and regulations on
information technology to ensure continuous, stable, smooth, safe and secure
operations.
For documents and
information included in applications for administrative procedures related to
exit and entry of Vietnamese citizens that already exist in the databases, if
the authority receiving and processing the procedures can access and use those
documents and information, citizens are not required to re-submit such
documents or information.
12. Amendments to clause
2, Article 46:
“2. Take charge and
cooperate with the Ministry of Public Security in regulating the issuance,
extension, revocation and cancellation of diplomatic passports, service passports,
diplomatic notes for visas that are carried out by consular missions of
Ministry of Foreign Affairs, Vietnam representative offices located overseas or
authorities authorized by Ministry of Foreign Affairs; cooperate with the
Ministry of Public Security in providing procedures for issuance, revocation
and cancellation of regular passports at Vietnam representative offices located
overseas.".

residence registration of citizens including police authorities of communes,
wards and special zones (hereinafter referred to as “commune-level police
authorities”).”.

who comes to live with their spouse; a person from 6 years old coming to live
with his/her parent(s) or guardian; or a parent coming to live with his/her
child; a person lacking legal capacity, or a person with difficulties in
cognition or self-control coming to live with his/her guardian;
b) The citizen is an old
person coming to live with their biological sibling or grandchild; or a person

with their parent or guardian, the Declaration of change to residence
information may not include permission for permanent residence registration
from the household head and owner of lawful place of residence or authorized

“2. Before leaving place
of residence, persons prescribed in points a and b, clause 1 of this Article
shall obtain approval of the competent authority supervising, managing or
educating such persons. Citizens shall declare temporary absence with the
registration authority of the place where they reside via the National Public
Service Portal or VNeID.
The registration
authority shall receive the temporary absence declaration, notify declared
information and communicate with the competent authority supervising, managing
and educating the applicants. Within 01 working day from the receipt of the
temporary absence declaration, the registration authority shall issue the
temporary absence declaration form for citizens. In complex cases, the
processing time may be longer but shall not exceed 02 working days.
3. Persons prescribed in
points c and d, clause 1 of this Article may declare via phones, electronic means
or other methods as prescribed by the Minister of Public Security. If the
persons prescribed in point d, clause 1 of this Article are minors, their
parent or guardian shall make the declaration.”.

a) The supervision system
for road traffic order and safety is a system that collects signals, data,
audio and images regarding the journey of road vehicles, traffic conditions and
relevant data. The system is built and installed on road traffic routes in
accordance with national technical regulations on supervision of road traffic
order and safety. The system shall also detect violations of laws on road
traffic order and safety, and other violations;
b) The construction,
management, operation and use of the supervision system for road order and
safety shall comply with procedures to ensure continuous operation and maintain
connectivity with the Traffic Command Center;
c) Data collected from
the supervision system for road traffic order and safety shall be managed in
accordance with the laws, requirements regarding protection of personal data,
legitimate rights and interests of individuals and organizations; be used for

violations, and serving state management.
2. The system for management
of data of vehicle tracking devices, in-cabin driver cameras and in-cabin
passenger cameras shall record, archive and transmit information and data
regarding journeys of road vehicles, driver footages and passenger footages to
serve road traffic order and safety, handling of violations and state
management of road transport. The system shall be managed, operated and used by
the traffic police. It is connected and shared with the road management
authority and relevant authorities.
3. The system of professional
equipment for motor vehicle load inspection shall be equipped for the traffic
police for inspection, discovery and handling of violations regarding road
vehicle load.
4. The Minister of Public
Security shall promulgate national technical regulations on the supervision
system for road traffic order and safety, and national technical regulations on
the system for management of data of vehicle tracking devices, in-cabin driver
cameras and in-cabin passenger cameras; regulations on construction, management,
operation and use of the supervision system for road traffic order and safety,
smart devices for commanding and controlling road traffic; regulations on
management, operation and use of the system for management of data of vehicle
tracking devices, in-cabin driver cameras and in-cabin passenger cameras;
regulations on equipment, installation, management, operation and use of the
system of professional equipment for motor vehicle load inspection.”.

People’s Committees are responsible for managing:

national highways crossing special cities; national highways where
authorization is given; national highway segments whose detour has been built
appropriate to road network planning; national highway segments that are no

using specialized roads on which public transportation is implemented are
responsible for providing information about load limits and dimensional limits
of specialized roads to specialized authority affiliated to province-level
People’s Committees for declaration;
d) Owners of road structure
constructions are responsible for providing information about load limits and
dimensional limits to authorities prescribed in points a, b and c of this
clause.”.

shall establish a destruction council and formulate a destruction plan. The
Council shall be composed of a Chair who is the destroying authority’s

11. Implementation clause
1. This Law comes into
force from July 01, 2026, except for clause 2 of this Article.
