CIRCULAR
PRESCRIBING
THE AUTHORITY TO REVOKE CERTIFICATES OF ELIGIBILITY FOR FOOD SAFETY FACILITIES
UNDER THE MANAGEMENT OF THE MINISTRY OF HEALTH
Pursuant to the Law on Food Safety No.
55/2010/QH12 dated June 17, 2010;
Pursuant to Decree No. 15/2018/ND-CP dated
February 2, 2018 of the Government on elaboration of a number of articles of
the Law on Food Safety;
Pursuant to Decree No. 155/2018/ND-CP dated
November 12, 2018 of the Government on amendments to regulations related to
business investment conditions under the state management of the Ministry of
Health;
Pursuant to Decree No. 95/2022/ND-CP dated
November 15, 2022 of the Government on functions, duties, powers, and
organizational structure of the Ministry of Health;
At the request of the Director of the Department
of Food Safety;
The Minister of Health hereby promulgates the
Circular prescribing the authority to revoke Certificates of eligibility for
food safety facilities under the management of the Ministry of Health.

1. Scope
This Circular prescribes the authority to revoke
Certificates of eligibility for food safety facilities under the management of
the Ministry of Health.
2. Regulated entities
This Circular applies to Vietnamese agencies, organizations,
and individuals, as well as foreign organizations and individuals engaged in
food production, business, or import activities in Vietnam; regulatory
agencies; and organizations or individuals involved in food safety activities
in Vietnam under the management of the Ministry of Health.
Article 2. Authority to revoke
Certificates of eligibility for food safety facilities
The authority that issues a Certificate of
eligibility for food safety facilities shall have the power to revoke such
Certificate.
Article 3. Grounds for
revocation of Certificates of eligibility for food safety facilities
1. The authority specified in Article 2 of this
Circular shall revoke a Certificate of eligibility for food safety facilities
when conducting inspection or examination, or upon the recommendation of an
inspection or examination agency using Form No. 01 issued together with this
Circular, upon discovering that the establishment fails to meet any of the
following conditions:
a) Failing to meet food safety assurance conditions
for food production, processing, or business suitable to each type of
production as prescribed in Articles 19, 20, 21, 22, 25, 26, 27, 28, 29, and 30
of the Law on Food Safety; Clause 2, Article 2 of Decree No. 155/2018/ND-CP
dated November 12, 2018 of the Government on amendments to regulations related
to business investment conditions under the state management of the Ministry of
Health; Article 28 of Decree No. 15/2018/ND-CP dated February 2, 2018 of the
Government on elaboration of a number of articles of the Law on Food Safety;
and other relevant legal provisions;

2. Within 5 working days from the date of receipt
of the application for revocation of the Certificate of eligibility for food
safety facilities from the inspection or examination agency, the authority
specified in Article 2 of this Circular shall issue a Decision on revocation of
the Certificate of eligibility for food safety facilities of the establishment,
using Form No. 02 enclosed with this Circular.
Article 4. Reference provisions
In case the legislative documents referred to in
this Circular are amended, supplemented, or replaced, the new documents shall
prevail.
Article 5. Entry into force
This Circular shall come into force as of February
15, 2024.
Article 6. Implementation
1. The Department of Food Safety shall take the
lead and coordinate with relevant units in disseminating, guiding, and organizing
the implementation of this Circular.
2. Departments of Health and Food Safety Management
Authorities of provinces and centrally-affiliated cities shall organize the
implementation.
During the implementation of this Circular, any
difficulties or problems should be reported to the Ministry of Health
(Department of Food Safety) for consideration and resolution.
