Pursuant to the Law on Government Organization No.
63/2025/QH15;
Pursuant to the Law on Foreign Trade Management
No. 05/2017/QH14;
Pursuant to the Law on Commerce No.
36/2005/QH11;
Pursuant to the Law on Investment No.
61/2020/QH14; the Law on amendment to the Law on Public Investment, the Law on
Investment in Public-Private Partnerships, the Law on Investment, the Law on
Housing, the Law on Bidding, the Law on Electricity, the Law on Enterprises,
the Law on Excise Tax, and the Law on Civil Judgment Enforcement No.
03/2022/QH15;

GENERAL PROVISIONS
Article 1. Scope
This Decree prescribes management of export, temporary
import for re-export, transfer via border checkpoints, intermediate transport,
transit of strategic goods.
Article 2. Regulated entities
This Decree applies to traders engaging in export,
temporary import for re-export, transfer via border checkpoints, intermediate
transport, transit of strategic goods; relevant agencies and organizations.
Article 3. Definitions
In this Decree, the definitions below have their
meaning attributed to them as follows:
1. Strategic goods are weapons of mass destructions
(WMDs), conventional weapons, and dual-use goods used for development,
production, or use of WMDs and conventional weapons.
2. Dual-use goods are goods that are commonly used
for civilian purposes but also can be used for development, production, or use
of WMDs, conventional weapons.

4. Weapons of mass destruction (WMDs) are weapons
described under Clause 1 Article 4 of Decree No. 81/2019/ND-CP of the
Government.
5. Designated organizations and individuals are
organizations, individuals described under Clause 15 Article 4 of Decree No.
81/2019/ND-CP of the Government.
6. Internal compliance program means a combination
of procedures developed by traders engaging in export, temporary import for
re-export, transfer via border checkpoints, intermediate transport, transit of
strategic goods for mandatory internal application within the traders in order
to ensure compliance with this Decree and other legislative documents related
to strategic trade control.
7. Technical and technological characteristics
refer to information depicting functionalities, capabilities, scope of
application, technical specifications, structure, design, and technical
dossiers pertaining to products or technology.
Chapter II
MANAGEMENT OF STRATEGIC
GOODS
Article 4. Management
principles of strategic goods
1. Strategic goods shall conform to this Decree and
applicable regulations of the law pertaining to foreign trade management,
commerce, field-specific laws, tax laws, customs laws, and other law
provisions.
2. Traders engaged in export, temporary import for
re-export, transfer via border checkpoints, intermediate transport, transit of
dual-use goods under Clause 3 Article 7 hereof shall be required to be in
possession of license (unless such activities serve national defense and
security).

4. When necessary for the purpose of implementing
international commitments or bilateral agreements, the Ministry of Industry and
Trade all decide on application of solutions for licensing export, temporary
import for re-export, transfer via border checkpoints, intermediate transport,
and transit of goods that are not specified under Clause 2 and Clause 3 of this
Article.
5. Traders engaging in export, temporary import for
re-export, transfer via border checkpoints, intermediate transport, and transit
of WMDs and conventional weapons shall conform to applicable legislative
documents on prevention and combat of proliferation of WMDs and regulations of
the law pertaining to management and use of weapons, explosive materials, and
combat gears.
Article 5. Regulations on
Internal compliance program
1. Traders engaging in export, temporary import for
re-export, transfer via border checkpoints, intermediate transport, and transit
of strategic goods are encouraged to develop and implement Internal compliance
program.
2. Internal compliance program consists of:
a) Commitment relating to responsibilities of
traders, enterprise owners, departments, and employees pertaining to strategic
trade control as per the law.
b) Procedures for reviewing end-users and use
purposes of the goods.
c) Procedures pertaining to methods in which
traders frequently stay up-to-date in terms of regulations of the law on
strategic trade control.
d) Procedures pertaining to internal training in
this field.

e) Procedures pertaining to notification
obligation.
Requirements of procedures under Internal
compliance program are provided for under Appendix II hereof.
3. Traders who have implemented Internal compliance
program for at least 2 years and have been confirmed by the Ministry of
Industry and Trade shall be eligible for export, temporary import for
re-export, transfer via border checkpoints, intermediate transport, transit
license the effective period of which shall conform to Clause 3 Article 8
hereof.
Article 6. Responsibilities of
traders
Traders engaging in export, temporary import for
re-export, transfer via border checkpoints, intermediate transport, transit of
strategic goods have the responsibility to:
1. Comply with regulations on management of export,
temporary import for re-export, transfer via border checkpoints, intermediate
transport, transit of strategic goods under this Decree and applicable regulations
on foreign trade management, commerce laws, field-specific laws, tax laws,
customs laws, and other law provisions.
2. Inform the Ministry of Industry and Trade and
the Ministry of National Defense upon discovering or suspecting that goods that
they trade may be used either directly or indirectly in production or use of
WMDs.
3. Inform the Ministry of Industry and Trade and
the Ministry of National Defense upon discovering or suspecting that recipients
or end-users of goods that they trade are under List of designated
organizations and individuals.
4. Store documents and information related to
strategic goods, work and provide documents, files at request of licensing
authorities, and relevant authorities when these authorities inspect compliance
with this Decree.

EXPORT, TEMPORARY IMPORT
FOR RE-EXPORT, TRANSFER VIA BORDER CHECKPOINTS, INTERMEDIATE TRANSPORT, AND
TRANSIT OF DUAL-USE GOODS
Article 7. List of dual-use
goods
1. List of dual-use goods for export, temporary
import for re-export, transfer via border checkpoints, intermediate transport,
and transit under license shall conform to Appendix I attached hereto.
2. Ministries shall, on the basis of management
demands, regulations on goods, and assignment under Appendix I hereof,
communicate with the Ministry of National Defense, the Ministry of Public
Security, the Ministry of Foreign Affairs, and the Ministry of Finance in
publishing detailed list of dual-use goods within governance jurisdiction of
relevant Ministry together with HS code, and technical, technological
specifications of the goods.
3. Only goods of which HS code, description,
technical and technological specifications match those under detailed list of
dual-use goods within governance jurisdiction of ministries under Clause 2 of
this Article are regulated by license under Clause 2 Article 4 hereof.
Article 8. Licensing dual-use
goods
1. Ministries within assignment under Appendix I
hereof (hereinafter referred to as “licensing authorities”) are responsible for
licensure of export, temporary import for re-export, transfer via border
checkpoints, intermediate transfer, and transit of dual-use goods in accordance
with Clause 2 Article 4 hereof.
2. The Ministry of Industry and Trade shall take
charge and cooperate with relevant ministries and ministerial agencies in
licensing export, temporary import for re-export, transfer via border
checkpoints, intermediate transfer, and transit of goods in accordance with
Clause 3 Article 4 hereof.
3. License for export, temporary import for
re-export, transfer via border checkpoints, intermediate transfer, and transit
of dual-use goods is divided into 2 categories:

b) General license.
4. General license shall be issued to traders which
have been verified by the Ministry of Industry and Trade to have completed
Internal compliance program in accordance with Clause 3 Article 5 hereof.
5. Effectiveness of the license
a) General license is effective for 12 months from
the date of signing and does not restrict the quantity of dual-use goods for
export, temporary import for re-export, transfer via border checkpoints,
intermediate transfer, and transit under the license during the effective
period thereof.
b) Individual license is effective for 3 months
from the date of signing.
Article 9. Application and
procedures for issuing license for import for re-export, transfer via border
checkpoints, intermediate transfer, and transit of dual-use goods
1. Depending on assignment under Appendix I hereof,
traders shall submit application for license for import for re-export, transfer
via border checkpoints, intermediate transfer, and transit of dual-use goods to
licensing authorities in person or via post or online. The application consists
of:
a) Application for license for import for
re-export, transfer via border checkpoints, intermediate transfer, and transit
of dual-use goods using form under Appendix III attached hereto (1 original
copies).
b) Written commitment of importers or end-users to prevent
the goods from being used for production of WMDs and provided for designated
organizations and individuals (1 original copy in English and 1 Vietnamese
translation, both copies are verified by the applicants).

d) Report on export, temporary import for
re-export, transfer via border checkpoints, intermediate transfer, and transit
of dual-use goods under previous license using Form under Appendix IV attached
hereto (1 original copy) (except for application for general license).
dd) Decision of the Ministry of Industry and Trade
verifying implementation of Internal compliance program in accordance with
Clause 3 Article 5 hereof (only for application for general license).
2. Where application is inadequate, licensing
authorities shall inform the applicants in writing within 5 working days from
the date on which licensing authorities receive the application to revise the
application.
3. When necessary, licensing authorities shall
forward the application to relevant ministries for feedback within 5 working
days from the date on which licensing authorities receive the application.
Within 7 working days from the date on which
relevant ministries receive Official Dispatch requesting feedback from
licensing authorities, relevant ministries shall respond in writing.
4. Within 7 working days from the date on which
licensing authorities receive adequate application or written response of
relevant ministries, licensing authorities shall issue license to traders or
notice of rejection and reasons for rejection.
5. Regarding license amendment:
a) Applicants shall send application for license
amendments and relevant document proof to licensing authorities.
b) Where application is inadequate, licensing
authorities shall inform the applicants in writing (or online) within 5 working
days from the date on which licensing authorities receive the application to
revise the application.

6. Regarding re-issuance due to missing, lost,
damaged license
a) Applicants shall send application for license
re-issuance and relevant documents (if any) to licensing authorities.
b) Within 5 working days from the date on which
licensing authorities receive adequate application, licensing authorities shall
re-issue license or issue notice of rejection and reasons for rejection.
Article 10. Revocation of
license for import for re-export, transfer via border checkpoints, intermediate
transfer, and transit of dual-use goods
Licensing authorities shall promulgate documents on
revocation of license for import for re-export, transfer via border
checkpoints, intermediate transfer, and transit of dual-use goods where:
1. License holders are found to have falsely
declared information for the purpose of applying for license or failed to
adhere to their license.
2. Licensing authorities are informed by relevant
agencies and organizations about violations of license holders or transactions
thereof against regulations on prevention and combat of proliferation of WMDs,
relevant international agreements and treaties.
3. National security policies are amended or such
revocation is implemented in accordance with Resolutions of the United Nations
Security Council.
Article 11. Verification of
implementation of Internal compliance program

2. Application for verification of implementation of
Internal compliance program consists of:
a) Application for verification of implementation
of Internal compliance program using Form under Appendix V attached hereto (1
original copy).
b) Description of internal control system of
enterprises which depicts conformity to and implementation of Internal
compliance program under Article 10 hereof in the last 2 years (1 original copy
signed by person signing the application).
c) Reports on export, temporary import for
re-export, transfer via border checkpoints, intermediate transfer, and transit
of dual-use goods in the last 2 years using form under Appendix VI hereof (1
original copy signed by person signing the application).
Article 12. Procedures for
verifying implementation of Internal compliance program
1. Where application is inadequate, the Ministry of
Industry and Trade shall inform the applicants in writing (or online) within 5
working days from the date on which the Ministry of Industry and Trade receives
the application to revise the application.
2. Within 7 working days from the date on which the
Ministry of Industry and Trade receives adequate application, the Ministry of
Industry and Trade shall take charge and cooperate with relevant ministries
according to assignment under Appendix I hereof in conducting physical
inspection of manufacturing, business establishments of traders.
3. Within 7 working days from the date on which
physical inspection is concluded, the Ministry of Industry and Trade shall promulgate
decision verifying implementation of Internal compliance program or respond to
the applicant in writing regarding rejection and reasons for rejection.
4. Decision on verification of implementation of
Internal compliance program is effective for 5 years.

1. Where information on traders that have been
verified for implementation of Internal compliance program changes, the traders
must submit application for amendment using form under Appendix VII and
relevant document proof in person or via post or online to the Ministry of
Industry and Trade within 7 working days from the date on which the change
occurs.
2. Where application is inadequate, the Ministry of
Industry and Trade shall inform the applicants in writing (or online) within 5
working days from the date on which the Ministry of Industry and Trade receives
the application to revise the application.
3. Within 7 working days from the date on which the
Ministry of Industry and Trade receives adequate application, the Ministry of
Industry and Trade shall promulgate decision on amendments or issue notice of
rejection and reasons for rejection.
Article 14. Revocation of
Decision on verification of implementation of Internal compliance program
The Ministry of Industry and Trade shall promulgate
Decision on revocation of Decision on verification of implementation of
Internal compliance program where:
1. Traders provide incorrect information in their
application.
2. Traders fail to satisfy requirements pertaining
to Internal compliance program under Article 5 hereof.
3. Traders have their dual-use goods license
revoked in accordance with Article 10 hereof.
4. Traders are dissolved or declared bankrupt by
the court.

Article 15. Responsibilities
of traders engaging in export, temporary import for re-export, transfer via
border checkpoints, intermediate transport, and transit of dual-use goods
In addition to compliance with Article 6 hereof,
traders licensed to conduct export, temporary import for re-export, transfer
via border checkpoints, intermediate transport, and transit of dual-use goods
are required to:
1. Assume responsibility for accuracy and
trustworthiness of application for dual-use goods license and all documents
submitted to licensing authorities.
2. Work with and provide licensing authorities and
relevant agencies with documents, files at their request when they conduct
inspection for compliance with this Decree.
3. Store documents and files related to licensed
goods for at least 5 years and present to competent authorities at their
request.
4. File reports on export, temporary import for
re-export, transfer via border checkpoints, intermediate transport, and transit
of dual-use goods using form under Appendix VI attached hereto to the Ministry
of Industry and Trade before January 30 each year in person or via post or
online (if applicable).
Chapter IV
ORGANIZING
IMPLEMENTATION
Article 16. Responsibilities
of ministries and ministerial agencies

1. Ministry of Industry and Trade has the
responsibility to:
a) take charge and cooperate with relevant
ministries and ministerial agencies in developing list of dual-use goods within
their jurisdiction; arrange licensure for dual-use goods within their
jurisdiction and inform customs authorities about the licensure for joint
management.
b) take charge and cooperate with ministries and
ministerial agencies in monitoring implementation of Internal compliance
program of traders; inform licensing authorities about traders verified for
implementation of Internal compliance program in accordance with Article 11
hereof.
c) take charge and cooperate with ministries and
ministerial agencies in communicating, guiding enterprises, organizations, and
individuals to understand and comply with regulations strategic trade control.
d) monitor and extract information pertaining to
trade control relating to dual-use goods within jurisdiction of the Ministry of
Industry and Trade.
2. The Ministry of Science and Technology, the
Ministry of Health, and the Ministry of Construction have the responsibility
to:
a) take charge and cooperate with relevant
ministries and ministerial agencies in developing list of dual-use goods within
their jurisdiction; arrange licensure for dual-use goods within their
jurisdiction and inform the Ministry of Industry and Trade, customs authorities
about the licensure for joint management.
b) monitor and extract information pertaining to
trade control relating to dual-use goods within their jurisdiction.
3. The Ministry of Finance has the responsibility
to:

b) direct Department of Vietnam Customs to control
export, temporary import for re-export, transfer via border checkpoints,
intermediate transport, and transit of strategic goods at border.
c) direct Department of Vietnam Customs to
cooperate with ministries and central departments in communicating, training
customs officials to identify and verify goods under strategic trade control.
d) direct Department of Vietnam Customs to
cooperate with foreign customs authorities in implementation of international
agreements and treaties pertaining to strategic trade control.
4. State Bank of Vietnam has the responsibility to
Direct credit institutions to promulgate procedures
for controlling instruments in international payment in a manner compliant with
this Decree and legislative documents related to prevention and combat of
proliferation of WMDs.
5. Ministry of Foreign Affairs has the
responsibility to:
a) receive information related to strategic goods
via diplomatic channels then transfer to and cooperate with licensing
authorities, domestic agencies in handling within their powers.
b) promote international cooperation in accordance
with the Decree.
6. Ministry of National Defense has the
responsibility to:

Article 17. Organizing
implementation
1. On the basis of this Decree, ministries and
ministerial agencies shall publicize list of dual-use goods within their
jurisdiction in order to provide guidelines on implementation of this Decree.
2. Within 6 months from the date on which this
Decree enters into force, licensing authorities under this Decree have the
responsibility to cooperate with the Ministry of Finance in licensing via
National Single-window Portal.
3. The Ministry of Industry and Trade shall take
charge and cooperate with ministries and ministerial agencies in inspecting
compliance with this Decree.
Article 18. Entry into force
1. This Decree comes into force from October 10,
2025.
2. Ministers, heads of ministerial agencies, heads
of Governmental agencies, Chairpersons of People's Committees of provinces and
central-affiliated cities, and relevant organizations, individuals shall be
responsible for the implementation of this Decree.
