This Decree provides for the management of export, temporary import for re-export, transshipment, transit, and cross-border transit of strategic trade goods.
This Decree applies to traders and agencies/organizations involved in the export, temporary import for re-export, transshipment, transit, or cross-border transit of strategic trade goods.
- Strategic trade goods include:
+ Weapons of mass destruction
+ Conventional weapons
+ Dual-use goods
+ Goods that may be designed, produced, or used for military purposes.
Principles of managing strategic trade goods:
- Strategic trade goods must comply with current foreign trade management, commerce, sectoral regulation, taxation, and customs laws.
- Traders engaged in activities related to dual-use goods must obtain a license, except where such activities serve national defense or security purposes.
- In cases where there is reasonable suspicion that goods may be used for producing or using weapons of mass destruction, or the end-user of the goods is included in the list of designated entities, the trader must obtain a license when conducting export, temporary import for re-export, transshipment, transit, or cross-border transit of the goods, including cases where such goods are not included in the list of dual-use goods.
- Where necessary, to implement international commitments or bilateral agreements, the Ministry of Industry and Trade of Vietnam shall decide to apply licensing requirements for the export, temporary import for re-export, transshipment, or cross-border transit of goods not covered by the above cases.
- Traders engaged in the export, temporary import for re-export, transshipment, transit, or cross-border transit of weapons of mass destruction or conventional weapons must comply with the current law on the prevention and combat against the proliferation of weapons of mass destruction and the law on the management and use of weapons, explosives, and combat gear.
