PERSONAL DATA PROTECTION AGREEMENT
(To THƯ VIỆN PHÁP LUẬT's collection, storage and use of personal information provided by members serving customer care and support during the use of THƯ VIỆN PHÁP LUẬT's services)
You are agreeing to THƯ VIỆN PHÁP LUẬT's collection, storage and use of the personal information you provide in accordance with Decree No. 13/2023/NĐ-CP for the purpose of customer care and support during the use of THƯ VIỆN PHÁP LUẬT's services with the following contents:
1. Personal information being collected stored and used
You expressly understand, confirm and agree that THƯ VIỆN PHÁP LUẬT is allowed to collect, store and use the information that you have provided and will provide for us during the process of membership registration and communication with employees of THƯ VIỆN PHÁP LUẬT, where:
General personal information of a member includes: full name, phone number, email address, gender, mailing address, workplace, taxpayer identification number, browsing history on THUVIENPHAPLUAT.VN. This information is necessary for us to issue invoices and records during the process of using our paid services; making phone calls, sending emails, and supporting members during the use of THƯ VIỆN PHÁP LUẬT's services.
Moreover, we are also entitled to collect and use other information and legal questions provided by members for the purposes of providing legal assistance for members.
2. Purposes of collection, storage and use of personal information provided by members
You agree and confirm that your personal information mentioned in Article 1 of this document can be collected, stored and used for the following purposes:
- Member authentication (to remove fake accounts)
- Contacting members to introduce products and services; supporting members during use (by phone, email, etc.)
- Receiving and responding to your enquiries regarding services and legal issues.
- Issuing invoices and records as prescribed by law.
- Other purposes prescribed by law.
3. Organizations and individuals permitted to collect, manage and use personal information provided by members
You agree that the personal information you provide can be collected, managed and used by (i) THƯ VIỆN PHÁP LUẬT and (ii) other organizations and individuals that have cooperation/association with THƯ VIỆN PHÁP LUẬT (such as post offices, banks, lawyers authorized by you, etc.) in using this information for supporting members during the process of purchase, payment, and use of services of THƯ VIỆN PHÁP LUẬT.
4. Methods for collection, storage and use of personal information provided by members
You agree that your personal information can be collected, stored and used by any methods that are adopted and/or applied by THƯ VIỆN PHÁP LUẬT and may vary over time, including but not limited to, collection, recording, confirmation, storage, revision, combination, access, extraction, restoration, encryption, decryption, duplication, sharing, transmission, provision, transfer using cyberspace, electronic devices or other means of transferring personal information within Vietnam or abroad, deletion, destruction and other relevant activities.
5. Beginning and ending time of collection, storage and use of personal information provided by members
THƯ VIỆN PHÁP LUẬT will start to collect, store and use your personal information as soon as you register, provide or share it with THƯ VIỆN PHÁP LUẬT until:
- THƯ VIỆN PHÁP LUẬT receives a written request for termination of collection, storage and use of such personal information from a competent authority; or
- You withdraw your consent in writing as prescribed by law. However, in this case, THƯ VIỆN PHÁP LUẬT is still entitled to store necessary information of such member for execution of contracts signed by the parties; for provision of information upon requests of state agencies (e.g. during invoice inspection by tax authorities, etc.)
The withdrawal of the your consent in this case does not affect the legality of the collection, storage, and use of personal information previously provided by you for THƯ VIỆN PHÁP LUẬT.
6. Rights and obligations of members
- You are entitled to provide, access, revise, delete their personal information; withdraw their consent to the collection, storage, use of their personal information by THƯ VIỆN PHÁP LUẬT; restrict or object to the collection, storage, use of their personal information, unless otherwise prescribed by law.
- You have the responsibility to fully and accurately provide their personal information at the request of THƯ VIỆN PHÁP LUẬT in order to facilitate the customer care process.
- You have other rights and obligations prescribed by law.
7. Other commitment regarding collection, storage and use of personal information provided by members
THƯ VIỆN PHÁP LUẬT will protect the your personal information in accordance with the law of Vietnam; fully comply with the Regulation on Protection of Personal Data, contracts, agreements and other documents signed with you.
THƯ VIỆN PHÁP LUẬT will collect, store and use your personal information only for the specific, unequivocal and lawful purposes stated in the Regulation on Protection of Personal Data and in accordance with the law of Vietnam.
During the process of collection, storage and use of your personal information, THƯ VIỆN PHÁP LUẬT and relevant parties will apply necessary technical and security measures within our capacity to protect your personal information.
However, you must understand the fact that no system or security measure is perfectly safe, and that there are always potential risks to online transactions, cyberspace and any methods for personal information collection, storage and use, including but not limited to, data leaks, breaches, or cyberattack. If all appropriate measures within the capacity of THƯ VIỆN PHÁP LUẬT and relevant parties have been taken, THƯ VIỆN PHÁP LUẬT and relevant parties do not have any liability for the members and their relevant parties (if any).
8. Effect
This Agreement is an integral part of the documents, contracts that have been concluded and/or confirmed between you and THƯ VIỆN PHÁP LUẬT.
