The operator of an e-commerce platform shall disclose the rights and obligations of the parties and ensure compliance with the Law on E-Commerce, Decree No. 248/2026/ND-CP and relevant laws. Such rights and obligations shall include at least the following:
- Rights and obligations of the operator of an e-commerce platform
+ Promulgate, disclose, and organize the implementation of the operating conditions and transaction conditions;
+ Develop and disclose service standards and procedures for participating in activities on the platform;
+ Collect service charges in accordance with the disclosed pricing policy;
+ Provide buyers, before they place orders, with full or summarized information on the applicable forms of promotion;
+ Ensure the safe and stable operation of the platform;
+ Prescribe cases in which sellers’ or buyers’ accounts may be suspended, terminated, or restricted;
+ Apply necessary measures to ensure the security of information relating to users’ trade secrets and consumers’ personal information;
+ Receive and resolve users’ requests, feedback, and complaints;
+ Monitor and prevent violations of the law, and cooperate with and provide information and data at the request of competent state authorities.
- Rights and obligations of sellers
+ Register, maintain, suspend, or terminate the sale of goods or provision of services; and determine the goods, services, selling prices, and promotional policies in accordance with the law and agreements with the platform operator;
+ Use the platform’s technical infrastructure and support tools; access data directly related to their business activities; receive payments in full and on time; and have their requests, feedback, and complaints resolved in accordance with the principles of openness and transparency;
+ Provide accurate and complete information; ensure the quality of goods and services; fully discharge obligations relating to delivery, warranty, exchange, return, and refund; and refrain from using the platform to conduct business in sectors or trades banned from business investment, trade in counterfeit goods or goods infringing intellectual property rights, or commit other violations of the law;
+ Fulfill financial obligations to the State; protect buyers’ data and consumers’ information; and cooperate with the platform operator and competent state authorities in addressing violations of the law.
- Rights and obligations of buyers
+ Have their consumer rights and interests protected and be provided with complete and accurate information about goods, services, and sellers;
+ Select goods, services, payment methods, and delivery methods; have their personal data protected; and have their feedback, requests, and complaints resolved in accordance with regulations;
+ Provide necessary and accurate information and make payments in full and on time;
+ Comply with the law and the platform’s operating conditions and transaction conditions, and refrain from using the platform to commit violations of the law.
Vietnam’s Decree No. 248/2026/ND-CP comes into force as of July 1, 2026, except for the provision requiring operators of e-commerce platforms to conduct electronic identity verification of sellers and persons livestreaming sales, which applies from January 1, 2027.
