On September 17, 2026, the Government of Vietnam promulgated Decree No. 360/2026/ND-CP prescribing the conditions for investment in and operation of preschool education institutions, general education institutions, continuing education institutions, and other educational institutions within the national education system.
Article 9 of Decree No. 360/2026/ND-CP prescribes the conditions for permitting a preschool to conduct educational activities as follows:
(1) The preschool must have the minimum physical facilities, supplies, toys, learning materials, and teaching equipment required by the Ministry of Education and Training of Vietnam.
A people-founded or private preschool, including a preschool proposed by a foreign diplomatic mission or an intergovernmental international organization, must have a roadmap for ensuring that its minimum physical facilities satisfy the requirements of the Ministry of Education and Training of Vietnam in accordance with the school’s highest projected enrollment.
(2) The preschool must have a sufficient number of educational institution managers, teachers, educational support staff, and other employees who satisfy the requirements of their respective job positions so that the school can organize childcare, care, and education activities that meet the requirements of the preschool education program.
(3) The preschool must have sufficient financial resources to maintain and develop its educational activities:
- For a private preschool, the minimum investment is VND 30 million per child, excluding land-use costs. The minimum total investment capital shall be calculated based on the point at which the school reaches its highest projected enrollment. The investment capital plan must correspond to the projected enrollment for each stage.
Where a private preschool does not construct new physical facilities but leases or uses existing physical facilities for its operations, the minimum investment must equal at least 70% of the investment prescribed above;
- For a public or people-founded preschool, the competent managing authority or the local community shall ensure the financial resources necessary to organize childcare, care, and education activities that meet the requirements of the preschool education program.
