Under the new Resolution of the Government of Vietnam, what are the dossier, procedures, and authority for issuing growing area codes and packing facility codes?
On July 31, 2026, the Government of Vietnam promulgated Resolution No. 36/2026/NQ-CP on the simplification of administrative procedures concerning growing area codes and packing facility codes.
Pursuant to Article 4 of Resolution No. 36/2026/NQ-CP the dossier, procedures, and authority for issuing growing area codes and packing facility codes from July 31, 2026, are prescribed as follows:
- Dossier for issuance of a growing area code or packing facility code
+ An application for issuance of a growing area code, made using the form in Appendix I enclosed with Resolution No. 36/2026/NQ-CP;
+ An application for issuance of a packing facility code, made using the form in Appendix II enclosed with Resolution No. 36/2026/NQ-CP.
- Procedures for issuing growing area codes and packing facility codes
+ Organizations and individuals shall submit applications for issuance of growing area codes or packing facility codes to the commune-level People’s Committee of the local area where the growing area or packing facility is located through the National Public Service Portal.
+ Where an organization or individual does not register to export to a market requiring such a code, within 3 working days from receipt of the dossier, the President of the commune-level People’s Committee shall issue a notice of issuance of the growing area code or packing facility code using the form in Appendix III or Appendix IV enclosed with Resolution No. 36/2026/NQ-CP If the code is not issued, a written response specifying the reasons must be provided.
+ Where an organization or individual registers to export to a market requiring such a code, within 10 working days from receipt of the dossier, the President of the commune-level People’s Committee shall organize an inspection and issue a notice of issuance of the growing area code or packing facility code using the form in Appendix III or Appendix IV enclosed with Resolution No. 36/2026/NQ-CP The code shall be approved immediately where the importing country permits the competent Vietnamese authority to approve it independently. If the code is not issued, a written response specifying the reasons must be provided.
Where a growing area code or packing facility code is subject to approval by the importing country, the provincial focal-point specialized agency shall compile and send the list of codes to the Ministry of Agriculture and Environment of Vietnam within 3 working days from the date on which the relevant notice of issuance is issued. Within 3 working days from receipt of the list, the Ministry of Agriculture and Environment of Vietnam shall compile and submit it to the importing country for consideration and approval. Where the importing country imposes a different time limit for submitting the list, its requirement shall apply.
The inspection shall cover the information declared in the dossier and compliance with the importing country’s technical requirements. The inspection record shall be made using the form in Appendix VI for a growing area or Appendix VII for a packing facility enclosed with Resolution No. 36/2026/NQ-CP.
+ Where a growing area or packing facility that has already been issued a code wishes to register an additional export market, the organization or individual shall submit an application using the form in Appendix I or Appendix II enclosed with Resolution No. 36/2026/NQ-CP The procedures specified in Points a and c Clause 2 Article 4 of Resolution No. 36/2026/NQ-CP shall apply, while the code stated in the notice of issuance or reissuance of the growing area code or packing facility code shall remain unchanged.
+ Where information concerning the name of the organization or individual representing the growing area code or packing facility code changes, or where a change results from the adjustment of administrative boundaries, the organization or individual shall submit an application for reissuance using the form in Appendix V enclosed with Resolution No. 36/2026/NQ-CP Within 2 working days from receipt of the application for reissuance, the commune-level People’s Committee shall review the archived dossier and notify the organization or individual using the form in Appendix III or Appendix IV enclosed with Resolution No. 36/2026/NQ-CP If the code is not reissued, a written response specifying the reasons must be provided.
- Where the National Public Service Portal encounters a technical problem that prevents the online receipt and processing of dossiers, or where an organization or individual is unable to submit a dossier online, the commune-level People’s Committee shall accept a paper dossier submitted in person or by post. The code shall be issued in accordance with Clauses 1 and 2 Article 4 of Resolution No. 36/2026/NQ-CP The relevant information must be updated on the National Public Service Portal immediately after the Portal resumes normal operation.
