Accordingly, the National Data Exchange shall be managed and operated as follows:
(1) The National Data Exchange shall be developed, managed, operated, supervised, inspected, and evaluated by the National Data Center under the Ministry of Public Security of Vietnam. It shall provide data, data products and services, and a data transaction environment in accordance with Decree No. 314/2026/ND-CP.
(2) The National Data Exchange shall provide a data transaction environment and offer data and data products and services derived from the National Integrated Database, national databases, specialized databases, other databases managed by agencies of the CPV, state agencies, and the Vietnam Fatherland Front Committee, as well as data provided by other organizations and individuals.
(3) The National Data Center shall supervise, inspect, and evaluate the operations of the National Data Exchange and other data exchanges.
Its management, supervision, inspection, and evaluation functions must be separate from the direct operation and provision of data and data products and services on the National Data Exchange.
Inspections and evaluations of the National Data Exchange’s compliance with its operating conditions shall be conducted by an agency or unit functionally independent from the unit directly operating the National Data Exchange. Such inspections and evaluations may be conducted periodically, on an ad hoc basis, or at the request of a competent authority.
(4) The National Data Center shall assign an affiliated unit to operate the National Data Exchange service business and manage transaction data from other data exchanges connected to the National Data Exchange.
The National Data Center shall ensure the fulfillment of all relevant requirements regarding its organizational structure, professional personnel, technical infrastructure, technological systems, cybersecurity, data security, personal data protection, risk management, storage, supervision, transaction traceability, and other conditions necessary for the operation of the National Data Exchange under this Decree and other relevant laws. The organization operating the National Data Exchange service business shall not be required to obtain: a certificate of eligibility to provide data exchange services; a certificate of eligibility to trade in data intermediary, analytical, and aggregation products and services; a certificate of eligibility to provide data analysis and aggregation products and services.
(5) The organization operating the National Data Exchange service business shall provide services to organizations and individuals under service provision contracts, including: data intermediary, analysis, and aggregation services on the data exchange; purchase offer and sale offer services; services supporting the pricing of data and data products and services; auction services for data and data products and services; consultancy services for developing, managing, and operating data exchanges; other services prescribed by law.
(6) The National Data Exchange shall be organized, managed, and operated electronically at https://sandulieuquocgia.gov.vn.
