Pursuant to the Law on Geology and Minerals
dated November 29, 2024;
Pursuant to the Government’s Decree No.
35/2025/ND-CP dated February 25, 2025 defining the functions, tasks, powers and
organizational structure of the Ministry of Agriculture and Environment;
At the request of the Chief of the Office of the
Ministry of Agriculture and Environment;
The Minister of Culture, Sports and Tourism
hereby promulgates a Circular providing for periods of retention of records and
documents in fields of agriculture and environment.
Article 1. Scope, regulated
entities
1. This Circular provides for periods of retention
of records and documents in fields of agriculture and environment specified
under clause 5 Article 15 of the Law on Archives.
2. This Circular applies to units owned by and
affiliated to the Ministry of Agriculture and Environment, Departments of
Agriculture and Environment of provinces and central-affiliated cities,
agencies, organizations and individuals involved in the implementation of
regulations on periods of retention of records and documents in fields of
agriculture and environment (hereinafter referred to as “agencies and
organizations”).
Article 2. Application of
regulations of periods of record and document retention
1. The period of
record and document retention means a period of time necessary for the
retention of records and documents created during operation of agencies and
organizations.

3. For records and
documents which are created before the effective date of this Circular and the
retention periods of which have been specified under other legislative
documents, such legislative documents shall continue to prevail.
If the retention periods have not been specified,
agencies and organizations shall rely on the Law on Archives and corresponding
groups of records and documents specified in this Circular to determine the
retention periods.
Article 3. Groups and periods
of retention of records and documents in fields of agriculture and environment
1. Groups of
records and documents in fields of agriculture and environment consist of:
Group 1. General records and documents.
Group 2. Records and documents on crop production
and plant protection.
Group 3. Records and documents on animal husbandry
and veterinary medicine.
Group 4. Records and documents on fisheries and
fisheries surveillance.
Group 5. Records and documents on forestry and
forest rangers.

2. Groups of
records and documents in fields of agriculture and environment are elaborated
in the Appendix to this Circular.
Article 4. Effect
1. This Circular
comes into force from July 01, 2025.
2. This Circular
repeals Article 13 of the Technical Regulations and Techno-Economic Norms for
the collection, storage, preservation and provision of information and data on
natural resources and environment promulgated together with Circular No.
03/2022/TT-BTNMT dated February 28, 2022 of the Minister of Natural Resources
and Environment.
Article 5. Organizing
implementation
1. Chief of the
Ministry Office, heads of agencies and organizations specified in Article 1
shall organize the implementation of this Circular.
