CIRCULAR
PROMULGATING NATIONAL TECHNICAL
REGULATION ON HAZARDOUS WASTE THRESHOLDS
Pursuant
to the Law on Standards and Technical Regulations dated June 29, 2006 and the
Law on amendments to some Articles of the Law on Standards and Technical
Regulations dated June 14, 2025;
Pursuant
to the Law on Environmental Protection dated November 17, 2020;
Pursuant
to the Government’s Decree No. 08/2022/ND-CP dated January 10, 2022 on
elaboration of several Articles of the Law on Environmental Protection and the
Government’s Decree No. 05/2025/ND-CP dated January 06, 2025 on amendments to
certain Articles of the Government’s Decree No. 08/2022/ND-CP dated January 10,
2022 on elaboration of several Articles of the Law on Environmental Protection;
Pursuant
to the Government’s Decree No. 127/2007/ND-CP dated August 01, 2007 elaborating
some Articles of the Law Standards and Technical Regulations and Government’s
Decree No. 78/2018/ND-CP dated May 16, 2018 dated May 16, 2018 on amendments to

Article 1. Promulgated together with this
Circular is National technical regulation on hazardous waste thresholds (QCVN
07:2025/BNNMT).
Article 2. Effect
1. This
Circular comes into force from February 09, 2026.
2. The
following national technical regulations shall cease to have effect from the
effective date of this Circular, except for the case specified in Article 3 of
this Circular:
a) QCVN
07:2009/BTNMT - National technical regulation on hazardous waste thresholds
promulgated together with the Circular No. 25/2009/TT-BTNMT dated November 16,
2009 of the Minister of Natural Resources and Environment providing for
National technical regulations on environment (hereinafter referred to as “QCVN
07:2009/BTNMT”);
b) QCVN
50:2013/BTNMT - National technical regulation on hazardous thresholds for
sludges from water treatment process promulgated together with the Circular No.
32/2013/TT-BTNMT dated October 25, 2013 of the Minister of Natural Resources
and Environment providing for National technical regulations on environment
(hereinafter referred to as “QCVN 50:2013/BTNMT”).
Article 3. Transitional clauses
1.
Ongoing cases of waste identification and classification carried out in
accordance with law before the effective date of this Circular shall continue
to comply with corresponding national technical regulations: QCVN 07:2009/BTNMT
and QCVN 50:2013/BTNMT until the cases are completely resolved in accordance
with law.
2. Any
waste generator that has identified and classified waste as per law before the
effective date of this Circular is not required to re-identify waste, unless
there is any hazardous constituent with a more stringent hazardous waste
threshold than that specified under QCVN 07:2009/BTNMT, QCVN 50:2013/BTNMT or
there is any other change specified in Section 5.1.2 of QCVN 07:2025/BNNMT.

Ministries, ministerial agencies, People’s Committees at all levels,
Departments of Agriculture and Environment of provinces and central-affiliated
cities, organizations and organizations concerned are responsible for the
implementation of this Circular.
2.
Difficulties that arise during the implementation of this Circular should be
promptly reported to the Ministry of Agriculture and Environment for
consideration and resolution./.

1. GENERAL PROVISIONS
1.1. Scope
1.1.1.
This Regulation provides for hazardous waste thresholds for industrial waste
subject to control and other types of wastes for specific purposes.

1.2. Regulated entities
This
Regulation applies to state agencies; organizations and individuals involved in
waste identification and classification, and waste monitoring and analysis.
1.3. Definitions
For the
purposes of this Regulation, the terms below shall be construed as follows:
1.3.1. “NH”
means the abbreviation for hazardous waste on the List of hazardous wastes,
industrial wastes subject to control and normal industrial solid wastes
promulgated together with Circular No. 02/2022/TT-BTNMT dated January 10, 2022
of the Minister of Natural Resources and Environment elaborating a number of
Articles of the Law on Environmental Protection (hereinafter referred to as
“the Waste List”).
1.3.1. “KS”
means the abbreviation for industrial wastes subject to control on the Waste
List.
1.3.3. “hazardous
waste threshold” (also known as hazardous threshold of waste) means the
quantitative limit of the hazardous properties or hazardous constituents of a
waste, which serves as a basis for identifying, classifying and managing
hazardous waste.
1.3.4. “homogeneous
waste” means a waste whose composition and physico-chemical properties are
relatively uniform at every point in the mass of the waste.
1.3.5.
“waste mixture” means a mixture of at least two types of homogeneous wastes,
even in cases where it originates from intentional structure or constitution
(such as end-of-life vehicles and equipment). The homogeneous wastes
constituting waste mixtures are called waste constituents. Waste mixture in
which waste constituents are mixed so that their physico-chemical properties
are relatively uniform at every point in the mass of wastes is considered as a
homogeneous waste.

1.3.7.
“eluate/leaching concentration” means the concentration of a hazardous
constituent in the solution obtained after leaching when applying a leaching
method to prepare a sample.
1.3.8. “absolute
content” means the percentage (%) or parts per million (ppm) of a hazardous
constituent in a waste.
1.3.9. CAS
(Chemical Abstracts Service) Registry Number means a chemical registry
number assigned by the American Chemical Society.
2. TECHNICAL REGULATIONS ON
HAZARDOUS WASTE THRESHOLDS
2.1. General principles
2.1.1. A
waste with symbol KS on the list of hazardous wastes shall be identified
as a hazardous waste if falls into any of the following cases:
2.1.1.1.
It exhibits at least one hazardous property exceeding hazardous waste
thresholds (flash point, alkalinity, acidity) specified in Table 1 of this
Regulation.
2.1.1.2.
It contains at least one hazardous constituent exceeding hazardous waste
thresholds specified in Table 2 and Table 3 of this Regulation.
2.1.2. In
case a KS waste has been identified as a hazardous waste, it shall be
classified according to name and code of the hazardous waste containing one (or
group of) certain hazardous constituent(s).

3. DETERMINATION METHODS

3.2.
Other measurement, sampling, and testing methods (not referred to in Columns 2
and 3 of Appendix 1 of this Regulation), including: TCVN; national standard
methods of any of the G7 countries, the European Committee for Standardization
(CEN/EN), the member states of the European Union, or the International
Organization for Standardization (ISO) are accepted.
3.3.
Principles of hazardous waste sampling, analysis, identification and
classification:
In
addition to the specific provisions on sampling methods specified in the
determination methods set out in Appendix 1 of this Regulation, the hazardous
waste sampling, analysis, identification and classification must be carried out
in accordance with the following fundamental principles:
3.3.1.
For homogeneous solid wastes: take at least 03 random representative samples at
different positions in the waste block (taking into account the representative
distribution of particle or element sizes in the waste block) and use the mean
value of the analytical results to make a comparison with the hazardous waste
thresholds.
3.3.2. As
for liquid and sludge waste or mixture thereof: stir and mix well (if possible)
to achieve a relatively homogeneous composition before taking at least 03
random representative samples at different positions and use the mean value of
the analytical results to make a comparison with the hazardous waste
thresholds.
3.3.3.
For mixtures of solid wastes or mixtures of solid wastes and liquid or sludge
wastes: use appropriate mechanical measures at the maximum (cutting, slicing,
peeling, scraping, centrifuging, gravitating, aerating, etc., but not using
water or solvents to wash or separate them) to separate waste constituents and
take samples of each waste constituent in accordance with Section 3.3.1 or
3.3.2 of this Regulation; use the mean value of the analytical results for each
waste constituent to make a comparison with the hazardous waste thresholds.
Where waste constituents cannot be separated by mechanical measures, mix the
waste block evenly (if possible) and take at least 09 evenly distributed
samples by dividing the waste block into equal parts (one sample from each
part) and use the mean value of the analytical results to make a comparison
with the hazardous waste thresholds.
3.3.4.
For solid waste with adhesive impurities: take 03 random representative samples
at different positions of a base waste (homogeneous solid waste) with adhering
impurities and use the mean value of the analytical results to make a
comparison with the hazardous waste thresholds. If the base waste is a mixture
of wastes, the waste constituents must be separated for identification in accordance
with Section 3.3.3 of this Regulation.
3.3.5.
For the identification of whether a waste stream frequently generated from a
specific source is hazardous waste: take samples on at least 03 different days
at sampling times of such days (at the beginning, middle and end of a shift or
batch); take at least 03 random samples each day at different positions, then
mix all samples of each day into 01 sample for analysis and use the mean value
of the analytical results obtained in 03 days to make a comparison with the
hazardous waste thresholds.
3.4.
Principles of selecting hazardous properties and constituents for analysis:

3.4.1. For
hazardous properties: Based on the characteristics of the waste source and
waste type, flammability, alkalinity, acidity specified in Table 1 of this
Regulation shall be selected for analysis. If it is certain that
characteristics of the waste source and waste type cannot result in the waste
having flammable substances, alkalinity or acidity, then proceed to analyses
hazardous constituents.
3.4.2.
For hazardous constituents: it is not necessary to analyses all hazardous
constituents specified in Tables 2 and 3 of this Regulation.
Rely on
the type of production, business or service; production technology, waste
treatment technology; raw materials, materials, fuels, chemicals used and
characteristics of the waste source to select and analyze at least the typical
hazardous properties or constituents specified in Column 3 of Appendix 2 of
this Regulation and other possible hazardous properties or constituents
specified in Column 4 of Appendix 2 of this Regulation.
3.5. Some
practical cases commonly occurring in reality:
3.5.1.
For packaging waste: before taking and analyzing samples and analyzing for
hazardous identification and classification, the remaining constituents
contained in the packaging must be removed to the maximum extent possible by
appropriate mechanical measures (peeling, separating, scraping, etc. for solids
or sludge or gravitating, centrifuging, etc. for sludge or liquids but not
using water or chemicals to wash, separate or clean them), ensuring only
adhesive constituents remain (with an average thickness of less than 01 mm or
content of less than 01%). Sample and analyze separately the packaging material
(with adhesive constituents) and the separated constituent contained in the
packaging to determine whether such constituent is hazardous waste according to
Part 2 of this Regulation. If the separated constituent contained in the
package is hazardous waste, the entire packaging shall be identified as
hazardous waste without analyzing the packaging material. If the separated
constituent contained in the package is adhesive impurity only, it is not
necessary to remove it by mechanical measures but sample and analyze it
immediately.
3.5.2.
For end-of-life vehicles or equipment (e.g. transport vehicles, electrical or
electronic equipment, etc.): the sampling and analysis of each waste
constituent (any part or material constituting the vehicle or equipment, e.g.
engine oil) for determination and classification of hazardous waste must be
conducted.
3.5.3.
Waste oils, chemicals or solvents shall be only classified and coded as waste
containing organic halogens or having organic halogen components only if the
leaching concentration (except PCB expressed as absolute content) of at least
one organic halogen component exceeding the hazardous waste thresholds (as
specified in Table 2 or Table 3 of this Regulation).
4. MANAGEMENT REGULATIONS
4.1. Any
waste classified as NH or any mixture of waste containing at least one
waste constituent classified as NH on the Waste List shall not be
subject to sampling and analysis for comparison with the hazardous waste
thresholds but shall be immediately identified as hazardous waste or as a
hazardous waste mixture.

4.3. If a
waste stream frequently generated (relatively stable and repetitive) from a
specific source (such as sludge from a wastewater treatment system) has
hazardous properties or constituents that intermittently exceed (or fall below)
the hazardous waste thresholds at different sampling times, the entire waste
stream must be identified as hazardous waste, unless it is identified
separately for each individual batch of waste in that stream.
4.4. A
waste mixture that has at least one constituent being hazardous waste shall be
treated as hazardous waste (or hazardous waste mixture) and be managed in
accordance with the same regulations as those applicable to hazardous waste.
4.5. In
cases where a waste source has one or more hazardous properties or constituents
not specified in Table 1, Table 2, and Table 3 of this Regulation, the national
environmental protection standards of one of the G7 countries shall apply.
4.6. The
hazardous waste identification and classification prescribed in this Regulation
shall be carried out by way of monitoring and analysis of hazardous properties
and constituents of waste samples.
4.7. The
results of monitoring and analysis of the hazardous properties and constituents
of waste samples serve as the basis for waste generators to manage wastes in
accordance with regulations; as the basis for competent state agencies to
conduct review and take actions in accordance with the law.
4.8. The
monitoring and analysis of hazardous properties and constituents as prescribed
in this Regulation for the purpose of providing information and data to state
agencies must be carried out by an organization that has been granted a
Certificate of eligibility for provision of environmental monitoring services
in accordance with law. Monitoring and analysis of other hazardous properties
and constituents as prescribed in Section 4.5 of this Regulation shall be
carried out by an organization that has been granted a Certificate of registration
of testing services in accordance with the law.
4.9. The
determination of hazardous wastes for other types of waste for specific
purposes shall be carried out in the same manner as for industrial wastes
subject to control as prescribed in this Regulation. The selection of hazardous
properties and constituents for analysis regarding other types of wastes for
specific purposes shall be made according to the principles prescribed in
Section 3.4 of this Regulation or for each specific purpose.
5. RESPONSIBILITIES OF ORGANIZATIONS
AND INDIVIDUALS
5.1. Each

5.1.2.
Where there is any change to the production technology, waste treatment
technology, raw materials, materials, fuels, chemicals used, or any other
change which results in a change to the hazardous properties or constituents of
a waste, re-classify the waste as per regulations.
5.2.
Identify and classify wastes for management in accordance with regulations and
bear legal responsibility for the results of waste identification and
classification.
5.3.
Archive the analysis and identification results for a minimum period of 05
years.
5.4.
Organizations and individuals shall collect and analyze samples in order to
identify and classify waste according to Section 3 of this Regulation.
6. ORGANIZING IMPLEMENTATION
6.1.
Environmental protection authorities shall provide guidance on and inspect the
implementation of this Regulation.
6.2. If
any of the documents and regulations referred to in this Regulation is amended
or replaced, the newest one shall prevail./.
