Căn cứ Luật Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;
Căn cứ Nghị quyết số 17/NQ-TW ngày 18 tháng 3 năm 2002 Hội nghị lần thứ năm Ban Chấp hành Trung ương Đảng khoá IX về ''Đổi mới và nâng cao chất lượng hệ thống chính trị ở cơ sở xã, phường, thị trấn'';
Căn cứ Chỉ thị số 10-CT/TW ngày 28 tháng 3 năm 2002 của Ban Bí thư Trung ương Đảng tiếp tục đẩy mạnh việc xây dựng và thực hiện Quy chế dân chủ ở cơ sở;
Theo đề nghị của Bộ trưởng Bộ Nội vụ,

NGHỊ ĐỊNH:

Điều 1. Ban hành kèm theo Nghị định này bản Quy chế thực hiện dân chủ ở xã.

Điều 2. Quy chế ban hành kèm theo Nghị định này áp dụng đối với cả phường và thị trấn. Bộ trưởng Bộ Nội vụ ban hành văn bản hướng dẫn để áp dụng Quy chế thực hiện dân chủ ở xã đối với phường và thị trấn.

Điều 3. Nghị định này có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng Công báo và thay thế Nghị định số 29/1998/NĐ-CP ngày 11 tháng 5 năm 1998 của Chính phủ về việc ban hành Quy chế thực hiện dân chủ ở xã.

Điều 4. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ và Chủ tịch Uỷ ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Nghị định này.

QUY CHẾ

Chương 1:

NHỮNG QUY ĐỊNH CHUNG

Điều 1. Quy chế này quy định cụ thể những việc Hội đồng nhân dân và Uỷ ban nhân dân xã (sau đây gọi là chính quyền xã) phải thông tin kịp thời và công khai để dân biết; những việc dân bàn và quyết định trực tiếp; những việc dân tham gia ý kiến trước khi cơ quan nhà nước quyết định; những việc dân giám sát, kiểm tra và các hình thức thực hiện Quy chế dân chủ ở xã.

Điều 2. Quy chế thực hiện dân chủ ở xã nhằm phát huy quyền làm chủ, sức sáng tạo của nhân dân ở xã, động viên sức mạnh vật chất và tinh thần to lớn của nhân dân trong phát triển kinh tế - xã hội, cải thiện dân sinh, nâng cao dân trí, ổn định chính trị, tăng cường đoàn kết, xây dựng Đảng bộ, chính quyền và các đoàn thể ở xã trong sạch, vững mạnh; ngăn chặn và khắc phục tình trạng suy thoái, quan liêu, tham nhũng của một số cán bộ, đảng viên và các tệ nạn xã hội, góp phần thực hiện mục tiêu dân giàu, nước mạnh, xã hội công bằng, dân chủ, văn minh, theo định hướng xã hội chủ nghĩa.

Điều 3. Phát huy quyền làm chủ của nhân dân gắn liền với cơ chế ''Đảng lãnh đạo, Nhà nước quản lý, nhân dân làm chủ''; phát huy chế độ dân chủ đại diện, nâng cao chất lượng và hiệu lực hoạt động của chính quyền địa phương, thực hiện chế độ dân chủ trực tiếp ở cơ sở để nhân dân bàn bạc và trực tiếp quyết định những công việc quan trọng, thiết thực, gắn với quyền lợi và nghĩa vụ của nhân dân.

Điều 4. Dân chủ phải trong khuôn khổ của Hiến pháp và pháp luật; đi đôi với trật tự, kỷ cương; quyền đi đôi với nghĩa vụ; kiên quyết xử lý những hành vi lợi dụng dân chủ, vi phạm Hiến pháp, pháp luật, xâm phạm lợi ích của Nhà nước, lợi ích tập thể, quyền tự do, dân chủ và lợi ích hợp pháp của công dân.

Chương 2:

NHỮNG VIỆC CẦN THÔNG BÁO ĐỂ NHÂN DÂN BIẾT

Điều 5. Chính quyền xã có trách nhiệm thông tin kịp thời và công khai để nhân dân biết những công việc chính sau:

1. Chủ trương, chính sách, pháp luật của Nhà nước liên quan trực tiếp đến quyền và lợi ích của nhân dân trong xã, bao gồm:

a) Các nghị quyết của Hội đồng nhân dân, quyết định của ủy ban nhân dân xã và của cấp trên liên quan đến địa phương;

b) Các quy định của pháp luật về thủ tục hành chính, giải quyết các công việc liên quan đến dân;

c) Những quy định của Nhà nước và chính quyền địa phương về đối tượng, mức thu các loại thuế, phí, lệ phí và các nghĩa vụ khác đối với nhân dân theo quy định của pháp luật hiện hành;

2. Kế hoạch phát triển kinh tế - xã hội dài hạn và hàng năm của xã;

3. Quy hoạch, kế hoạch sử dụng đất đai;

4. Dự toán và quyết toán ngân sách xã hàng năm;

5. Dự toán, quyết toán thu chi các quỹ, chương trình, dự án, các khoản huy động nhân dân đóng góp xây dựng cơ sở hạ tầng, các công trình phúc lợi công cộng của xã, thôn, làng, ấp, bản, khóm (thôn, làng, ấp, bản, khóm sau đây gọi chung là thôn) và kết quả thực hiện;

6. Các chương trình, dự án do Nhà nước, các tổ chức và cá nhân đầu tư, tài trợ trực tiếp cho xã;

7. Chủ trương, kế hoạch vay vốn phát triển sản xuất, xoá đói, giảm nghèo;

8. Điều chỉnh địa giới hành chính xã và các đơn vị hành chính liên quan đến xã;

9. Kết quả thanh tra, kiểm tra, giải quyết các vụ việc tiêu cực, tham nhũng của cán bộ xã, thôn;

10. Công tác văn hóa, xã hội, phòng, chống tệ nạn xã hội, giữ gìn an ninh, trật tự, an toàn xã hội của xã;

11. Sơ kết, tổng kết hoạt động của Hội đồng nhân dân, ủy ban nhân dân xã;

12. Phương án dồn điền, đổi thửa phục vụ chuyển dịch cơ cấu kinh tế, phát triển nông nghiệp, kinh tế trang trại, hợp tác xã;

13. Bình xét các hộ nghèo được vay vốn phát triển sản xuất và xây dựng nhà tình thương; thực hiện chính sách đối với gia đình có công với cách mạng, gia đình liệt sĩ, thương binh, bệnh binh được tặng nhà tình nghĩa, sổ tiết kiệm, thẻ bảo hiểm y tế;

14. Kết quả lựa chọn, thứ tự ưu tiên và tổ chức thực hiện các công trình thuộc các chương trình, dự án của Nhà nước, của các tổ chức và cá nhân đầu tư, tài trợ trực tiếp cho xã.

Điều 6. Chính quyền xã có trách nhiệm phối hợp với Uỷ ban Mặt trận Tổ quốc Việt Nam, các thành viên của Mặt trận Tổ quốc Việt Nam cùng cấp và Trưởng thôn cung cấp các thông tin theo quy định tại Điều 5 của Quy chế này để nhân dân biết bằng các hình thức sau:

1. Niêm yết công khai văn bản tại trụ sở Uỷ ban nhân dân xã và các trung tâm dân cư, văn hóa;

2. Hệ thống truyền thanh của xã, thôn và các tổ chức văn hóa, thông tin, tuyên truyền cơ sở;

3. Tổ chức các cuộc tiếp xúc cử tri của đại biểu Hội đồng nhân dân xã;

4. Tại các kỳ họp của Hội đồng nhân dân xã, các cuộc họp của Uỷ ban nhân dân, Uỷ ban Mặt trận Tổ quốc Việt Nam, các thành viên của Mặt trận Tổ quốc Việt Nam cùng cấp và của cuộc họp của thôn;

5. Gửi văn bản tới hộ gia đình hoặc Trưởng thôn.

Chương 3:

NHỮNG VIỆC NHÂN DÂN BÀN VÀ QUYẾT ĐỊNH TRỰC TIẾP

Điều 7. Nhân dân ở xã, thôn bàn và quyết định trực tiếp những công việc sau:

1. Chủ trương và mức đóng góp xây dựng cơ sở hạ tầng và các công trình phúc lợi công cộng (điện, đường, trường học, trạm y tế, nghĩa trang, các công trình văn hóa, thể thao);

2. Xây dựng hương ước, quy ước làng văn hóa, nếp sống văn minh, giữ gìn an ninh trật tự, bài trừ các hủ tục, mê tín dị đoan, tệ nạn xã hội;

3. Các công việc trong nội bộ cộng đồng dân cư thôn, phù hợp với quy định của pháp luật hiện hành;

4. Thành lập Ban Giám sát các công trình xây dựng do dân đóng góp;

5. Tổ chức bảo vệ sản xuất, kinh doanh giữ gìn an ninh trật tự, an toàn giao thông, vệ sinh môi trường và các hoạt động khác trên địa bàn xã, thôn.

Điều 8. Ngoài những khoản đóng góp quy định tại khoản 1 Điều 7, những khoản đóng góp khác của nhân dân ủng hộ với mục đích tương trợ, nhân đạo, từ thiện ủy ban nhân dân xã phối hợp với Uỷ ban Mặt trận Tổ quốc Việt Nam, các thành viên của Mặt trận Tổ quốc Việt Nam cùng cấp tuyên truyền, vận động nhân dân theo nguyên tắc hoàn toàn tự nguyện, không được áp đặt, phân bổ, bình quân nhất loạt.

Điều 9. Phương thức thực hiện những việc nhân dân quyết định trực tiếp

1. Uỷ ban nhân dân xã xây dựng phương án, chương trình, kế hoạch; phối hợp với Uỷ ban Mặt trận Tổ quốc Việt Nam cùng cấp chỉ đạo, tổ chức nhân dân thảo luận, quyết định những công việc quy định tại Điều 7 của Quy chế này bằng một trong các hình thức sau:

a) Họp toàn thể nhân dân hoặc chủ hộ gia đình hay cử tri đại diện hộ gia đình ở từng thôn, thảo luận và biểu quyết công khai hoặc bỏ phiếu kín;

b) Phát phiếu lấy ý kiến các hộ gia đình.

Việc lấy ý kiến, biểu quyết công khai tại cuộc họp hoặc bỏ phiếu kín về từng vấn đề do nhân dân tự quyết định theo quy định tại Điều 7 của Quy chế này phải được lập biên bản để báo cáo Uỷ ban nhân dân xã về nội dung cuộc họp và kết quả những vấn đề đã biểu quyết.

2. Những nội dung quy định tại Điều 7 của Quy chế này phù hợp với quy định của pháp luật, đạt tỷ lệ trên 50% số người tham gia cuộc họp hoặc lấy ý kiến tán thành, thì ủy ban nhân dân xã ra quyết định công nhận.

3. Uỷ ban nhân dân xã phối hợp với Mặt trận Tổ quốc Việt Nam cùng cấp chỉ đạo Trưởng thôn và Trưởng Ban công tác Mặt trận tổ chức thực hiện những vấn đề do nhân dân tự quyết định đã được Uỷ ban nhân dân xã công nhận, có sự giám sát của Thanh tra nhân dân hoặc Ban Giám sát công trình, dự án do nhân dân bầu.

4. Nhân dân có trách nhiệm chấp hành và thực hiện nghiêm chỉnh các quyết định đã được trên 50% các hộ gia đình của xã hoặc của thôn nhất trí.

Chương 4:

NHỮNG VIỆC NHÂN DÂN BÀN, THAM GIA Ý KIẾN, CHÍNH QUYỀN XÃ QUYẾT ĐỊNH

Điều 10. Những việc chính quyền xã có trách nhiệm đưa ra nhân dân thảo luận hoặc tham gia ý kiến trước khi chính quyền xã quyết định (hoặc trình cấp có thẩm quyền quyết định) gồm có:

1. Dự thảo nghị quyết của Hội đồng nhân dân xã;

2. Dự thảo quy hoạch, kế hoạch phát triển kinh tế - xã hội dài hạn và hàng năm của xã, phương án chuyển đổi cơ cấu kinh tế, cơ cấu sản xuất và phương án phát triển ngành nghề;

3. Dự thảo quy hoạch, kế hoạch sử dụng đất đai ở địa phương và việc quản lý, sử dụng có hiệu quả quỹ đất công ích của xã;

4. Phương án quy hoạch khu dân cư; đề án định canh, định cư, vùng kinh tế mới; kế hoạch, dự án huy động và sử dụng các khoản đóng góp của nhân dân để đầu tư xây dựng cơ sở hạ tầng do xã quản lý;

5. Dự thảo đề án phân vạch, điều chỉnh địa giới hành chính xã, đề án chia tách, thành lập thôn;

6. Dự thảo kế hoạch triển khai các chương trình mục tiêu quốc gia trên địa bàn xã;

7. Chủ trương, phương án đền bù giải phóng mặt bằng, xây dựng hạ tầng cơ sở, tái định cư;

8. Giải quyết việc làm cho người lao động trên địa bàn xã;

9. Những công việc khác mà chính quyền xã thấy cần thiết.

Điều 11. Phương thức thực hiện những việc nhân dân bàn, tham gia ý kiến trước khi chính quyền xã quyết định (hoặc trình cấp có thẩm quyền quyết định)

1. Căn cứ nghị quyết của cấp ủy đảng, nghị quyết của Hội đồng nhân dân xã, Uỷ ban nhân dân xã dự thảo các văn bản, kế hoạch, phương án và phối hợp với Uỷ ban Mặt trận Tổ quốc Việt Nam và các thành viên Mặt trận Tổ quốc Việt Nam cùng cấp tổ chức lấy ý kiến nhân dân công khai bằng các hình thức:

a) Họp toàn thể nhân dân hoặc chủ hộ gia đình thảo luận;

b) Phát phiếu lấy ý kiến từng hộ gia đình;

c) Họp các tổ chức kinh tế để thảo luận;

d) Đặt hòm thư góp ý.

2. Ý kiến của nhân dân tại cuộc họp hoặc các ý kiến góp ý phải được tổng hợp báo cáo đầy đủ, khách quan để Uỷ ban nhân dân xã xem xét, trình Hội đồng nhân dân xã quyết định theo thẩm quyền hoặc trình cơ quan có thẩm quyền cấp trên xem xét, quyết định.

Chương 5:

NHỮNG VIỆC NHÂN DÂN GIÁM SÁT, KIỂM TRA

Điều 12. Những việc nhân dân ở xã giám sát, kiểm tra gồm có:

1. Hoạt động của chính quyền xã, các tổ chức chính trị - xã hội, tổ chức xã hội và tổ chức nghề nghiệp ở xã;

2. Kết quả thực hiện nghị quyết của Hội đồng nhân dân và quyết định, chỉ thị của Uỷ ban nhân dân xã;

3. Hoạt động và phẩm chất đạo đức của Chủ tịch Hội đồng nhân dân và Chủ tịch Uỷ ban nhân dân, hoạt động của đại biểu Hội đồng nhân dân xã, của cán bộ Uỷ ban nhân dân xã và cán bộ, công chức hoạt động tại địa phương;

4. Giải quyết khiếu nại, tố cáo của công dân tại địa phương;

5. Dự toán và quyết toán ngân sách xã;

6. Quá trình tổ chức thực hiện công trình, kết quả nghiệm thu và quyết toán công trình do nhân dân đóng góp xây dựng và các chương trình, dự án do Nhà nước, các tổ chức và cá nhân đầu tư, tài trợ trực tiếp cho xã;

7. Các công trình của cấp trên triển khai trên địa bàn xã có ảnh hưởng trực tiếp đến sản xuất, an ninh, trật tự, văn hoá - xã hội, vệ sinh môi trường và đời sống của nhân dân địa phương;

8. Quản lý và sử dụng đất đai tại xã;

9. Thu, chi các loại quỹ và lệ phí theo quy định của Nhà nước, các khoản đóng góp của nhân dân;

10. Kết quả thanh tra, kiểm tra, giải quyết các vụ việc tiêu cực, tham nhũng liên quan đến cán bộ xã;

11. Việc thực hiện chế độ, chính sách ưu đãi, chăm sóc, giúp đỡ thương binh, bệnh binh, gia đình liệt sĩ, những người và gia đình có công với nước, chính sách bảo hiểm xã hội, bảo trợ xã hội.

Điều 13. Phương thức thực hiện những việc dân giám sát, kiểm tra

Nhân dân trực tiếp giám sát hoạt động của cơ quan, tổ chức, cá nhân hoặc gián tiếp thông qua các tổ chức chính trị - xã hội, các tổ chức đại diện cho mình hoặc Ban Thanh tra nhân dân bằng các phương thức sau đây:

1. Tham gia trực tiếp (nếu được mời) hoặc thông qua các tổ chức đại diện cho mình trong các cuộc họp của chính quyền xã bàn về các vấn đề liên quan trực tiếp đến quyền và lợi ích của mình;

2. Tham gia ý kiến đánh giá báo cáo tổng kết công tác sáu tháng và hàng năm của chính quyền xã;

3. Góp ý kiến vào bản kiểm điểm công tác và tự phê bình của Chủ tịch Hội đồng nhân dân và Chủ tịch Uỷ ban nhân dân xã trong cuộc họp tổng kết công tác cuối năm;

4. Bỏ phiếu tín nhiệm đối với các chức vụ do Hội đồng nhân dân xã bầu;

5. Phát hiện những cơ quan, tổ chức, cá nhân xâm phạm quyền làm chủ của nhân dân và có dấu hiệu tham nhũng, lãng phí, sử dụng sai mục đích thu, chi ngân sách và các khoản đóng góp của nhân dân; thực hiện chương trình, dự án và sử dụng quản lý đất đai, đền bù giải phóng mặt bằng trái với những quy định của pháp luật và các hành vi vi phạm pháp luật khác; tố cáo, kiến nghị với chính quyền xã, cơ quan có thẩm quyền làm rõ, giải quyết và thông báo kết quả giải quyết.

Điều 14. Trách nhiệm của các cơ quan, tổ chức và cá nhân đối với việc giám sát và kiểm tra của nhân dân

1. Uỷ ban nhân dân xã có trách nhiệm:

a) Mời đại diện Uỷ ban Mặt trận Tổ quốc Việt Nam và các thành viên của Mặt trận Tổ quốc cùng cấp, các đối tượng liên quan trực tiếp tham gia các cuộc họp của chính quyền xã bàn bạc về các vấn đề liên quan đến quyền và lợi ích trực tiếp của nhân dân địa phương;

b) Xem xét, giải quyết các kiến nghị của cơ quan, tổ chức, cá nhân theo thẩm quyền và thông báo kết quả giải quyết cho tổ chức, cá nhân có kiến nghị;

c) Trình cơ quan có thẩm quyền các vụ việc vượt quá thẩm quyền.

2. Chủ tịch Hội đồng nhân dân, Chủ tịch Uỷ ban nhân dân xã có trách nhiệm gửi cho Trưởng thôn bản kiểm điểm công tác và tự phê bình tại cuộc họp tổng kết hàng năm để Trưởng thôn tổ chức nhân dân đóng góp ý kiến.

3. Hàng năm, Mặt trận Tổ quốc xã tổ chức lấy phiếu tín nhiệm của các thành viên Mặt trận đối với các chức vụ chủ chốt do Hội đồng nhân dân xã bầu ra. Nếu tỷ lệ số phiếu tín nhiệm thấp dưới 50% số người tham gia thì Mặt trận Tổ quốc xã đề nghị Hội đồng nhân dân xã xem xét, miễn nhiệm.

4. Trưởng thôn phối hợp với Trưởng Ban công tác Mặt trận có trách nhiệm tổ chức cuộc họp thu thập ý kiến của nhân dân về các vấn đề do nhân dân tự quyết định; tổng hợp, báo cáo một cách chính xác, khách quan, trung thực ý kiến góp ý của nhân dân bằng văn bản gửi về chính quyền xã.

5. Nhân dân không được tụ tập đông người khiếu kiện vượt cấp, gây mất trận tự an ninh và chống đối người thi hành công vụ trong khi các kiến nghị đang được xem xét, giải quyết theo quy định của pháp luật.

Chương 6:

XÂY DỰNG CỘNG ĐỒNG DÂN CƯ THÔN

Điều 15. Thôn là nơi sinh sống của cộng đồng dân cư, là nơi thực hiện dân chủ một cách trực tiếp và rộng rãi để phát huy các hình thức hoạt động tự quản của cộng đồng dân cư và là nơi tổ chức cho nhân dân thực hiện chủ trương, đường lối của Đảng, chính sách, pháp luật của Nhà nước và nhiệm vụ cấp trên giao. ủy ban nhân dân xã có trách nhiệm chỉ đạo, hướng dẫn, hỗ trợ và giám sát, kiểm tra hoạt động của thôn.

Điều 16. Hội nghị nhân dân thôn được tổ chức 6 tháng một lần, trong trường hợp cần thiết có thể họp bất thường, gồm toàn thể cử tri hoặc chủ hộ hay cử tri đại diện hộ nhằm:

1. Thảo luận và quyết định các công việc của nội bộ cộng đồng dân cư về sản xuất, xây dựng cơ sở hạ tầng, giải quyết việc làm, xóa đói giảm nghèo, đoàn kết tương trợ giúp đỡ nhau trong sản xuất và đời sống, những vấn đề về văn hóa, xã hội, vệ sinh môi trường, an ninh, trật tự an toàn xã hội phù hợp pháp luật;

2. Bàn biện pháp thực hiện nghị quyết của Hội đồng nhân dân xã, các quyết định của ủy ban nhân dân xã, nghĩa vụ công dân và nhiệm vụ cấp trên giao;

3. Thảo luận, góp ý kiến về báo cáo kết quả công tác và tự phê bình, kiểm điểm của Trưởng thôn, Chủ tịch Hội đồng nhân dân và Chủ tịch Uỷ ban nhân dân xã;

4. Bầu, miễn nhiệm Trưởng thôn; xây dựng hương ước, quy ước; cử các ban, nhóm tự quản, ủy viên thanh tra nhân dân;

Nghị quyết của hội nghị có giá trị khi có ít nhất quá nửa số người dự họp tán thành và không trái với pháp luật.

Điều 17. Nhiệm vụ và quyền hạn của Trưởng thôn

1. Trưởng thôn là người do nhân dân trực tiếp bầu tại hội nghị nhân dân và được Chủ tịch Uỷ ban nhân dân xã xem xét, ra quyết định công nhận và chịu sự chỉ đạo quản lý của Uỷ ban nhân dân xã. Chủ tịch Uỷ ban nhân dân xã có quyền phê bình, cảnh cáo, tạm đình chỉ cho thôi chức khi Trưởng thôn không hoàn thành nhiệm vụ, vi phạm quyền làm chủ của nhân dân, tham nhũng, lãng phí; không phục tùng sự chỉ đạo, điều hành của Uỷ ban nhân dân xã; vi phạm pháp luật và các quy định của cấp trên.

2. Nhiệm vụ, trách nhiệm và quyền hạn của Trưởng thôn

a) Chủ trì, phối hợp với Ban công tác Mặt trận Tổ quốc và các đoàn thể ở thôn trong quá trình triển khai thực hiện các hoạt động bao gồm: triệu tập và chủ trì hội nghị thôn; tổ chức thực hiện các quyết định của thôn; tổ chức nhân dân thực hiện tốt Quy chế dân chủ; tổ chức xây dựng và thực hiện hương ước; bảo đảm đoàn kết, giữ gìn trật tự, an toàn trong thôn; tổ chức thực hiện nhiệm vụ do Uỷ ban nhân dân xã giao; tập hợp, phản ánh, đề nghị chính quyền xã giải quyết những nguyện vọng chính đáng của nhân dân; ký hợp đồng dịch vụ phục vụ sản xuất và xây dựng cơ sở hạ tầng trên cơ sở nghị quyết hội nghị nhân dân trong thôn;

b) Định kỳ sáu tháng và một năm báo cáo công tác tự phê bình, kiểm điểm trước hội nghị thôn. Hàng năm, Ban công tác Mặt trận Tổ quốc cùng với các thành viên của Mặt trận ở thôn tổ chức lấy phiếu tín nhiệm đối với Trưởng thôn. Nếu tỷ lệ phiếu tín nhiệm thấp dưới 50% số người tham gia bỏ phiếu thì đề nghị tổ chức hội nghị thôn xem xét miễn nhiệm và báo cáo lên Chủ tịch Uỷ ban nhân dân xã quyết định;

c) Được Uỷ ban nhân dân xã mời dự họp về các vấn đề liên quan. Hàng tháng báo cáo kết quả công tác với Uỷ ban nhân dân xã;

d) Được tham dự các lớp tập huấn, bồi dưỡng, được hưởng phụ cấp theo quy định của tỉnh, thành phố trực thuộc Trung ương.

Điều 18. Thôn xây dựng hương ước, quy ước về công việc thuộc nội bộ cộng đồng dân cư, kế thừa và phát huy thuần phong mỹ tục của cộng đồng, phù hợp với quy định của pháp luật hiện hành nhằm bài trừ hủ tục, mê tín dị đoan, tệ nạn xã hội, giữ gìn an ninh trật tự, an toàn giao thông, vệ sinh môi trường, xây dựng nông thôn mới giàu đẹp, văn minh.

Hương ước, quy ước được nhân dân ở thôn bàn bạc và thông qua tại Hội nghị nhân dân. Trưởng thôn gửi hương ước, quy ước đã được thông qua lên Uỷ ban nhân dân xã. Sau khi thống nhất với Chủ tịch Hội đồng nhân dân xã và Uỷ ban Mặt trận Tổ quốc cùng cấp, Chủ tịch Uỷ ban nhân dân xã có công văn đề nghị Chủ tịch Uỷ ban nhân dân cấp huyện phê duyệt hương ước, quy ước. Phòng Tư pháp, Phòng Văn hóa - Thông tin cấp huyện có trách nhiệm giúp Chủ tịch Uỷ ban nhân dân cấp huyện thẩm định hương ước, quy ước trước khi phê duyệt.

Điều 19. Thôn có thể thành lập các tổ: hòa giải, an ninh, bảo vệ sản xuất, kiến thiết. Các tổ chức này được thành lập hoặc giải thể theo yêu cầu thực tế của từng địa phương. Thành viên của các tổ chức này do nhân dân bầu. Hoạt động của các tổ chức nói trên do Trưởng thôn chủ trì, phối hợp với Ban công tác Mặt trận quản lý và chỉ đạo.

Chương 7:

ĐIỀU KHOẢN THI HÀNH

Điều 20. Các cấp, các ngành có trách nhiệm xây dựng chính quyền cơ sở trong sạch, vững mạnh, hiệu lực, hiệu quả, khắc phục biểu hiện quan liêu, thiếu trách nhiệm, mất dân chủ trong giải quyết các công việc; thường xuyên quan tâm xây dựng đội ngũ cán bộ ở cơ sở; có kế hoạch bồi dưỡng, đào tạo về trình độ văn hóa, chuyên môn nghiệp vụ, lý luận chính trị và phương pháp công tác, đáp ứng yêu cầu nhiệm vụ trong giai đoạn cách mạng mới.

Điều 21. Cán bộ, công chức chính quyền các cấp và nhân dân có nghĩa vụ chấp hành nghiêm chỉnh những quy định trong Quy chế này.

Điều 22. Chủ tịch Uỷ ban nhân dân các cấp có trách nhiệm chỉ đạo thực hiện Quy chế này. Sáu tháng, Chủ tịch Uỷ ban nhân dân cấp dưới báo cáo kết quả thực hiện với Chủ tịch Uỷ ban nhân dân cấp trên; hàng năm, Chủ tịch Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương báo cáo Chính phủ (thông qua Bộ Nội vụ) kết quả thực hiện Quy chế.

Điều 23. Bộ Nội vụ có trách nhiệm chỉ đạo, hướng dẫn, theo dõi thực hiện Quy chế này. Bộ Tài chính có trách nhiệm chỉ đạo, hướng dẫn các cơ quan chuyên môn cấp dưới kiểm tra tài chính và thu, chi ngân sách của xã, bồi dưỡng nghiệp vụ chuyên môn cho cán bộ tài chính xã. Thanh tra Nhà nước có trách nhiệm hướng dẫn công tác thanh tra, kiểm tra ở xã, bồi dưỡng, hướng dẫn nghiệp vụ cho Ban Thanh tra nhân dân xã. Bộ Tư pháp và Bộ Văn hóa - Thông tin có trách nhiệm hướng dẫn xây dựng các hương ước, quy ước thôn.

Điều 24. Đề nghị Uỷ ban Trung ương Mặt trận Tổ quốc Việt Nam, các thành viên Mặt trận Tổ quốc Việt Nam chỉ đạo, hướng dẫn, kiểm tra cấp dưới thực hiện tốt nhiệm vụ được quy định trong Quy chế này.

Điều 25. Trong quá trình thực hiện Quy chế, các tổ chức, cá nhân có thành tích sẽ được khen thưởng; các tổ chức, cá nhân vi phạm sẽ bị xử lý theo quy định của pháp luật hiện hành.

Những nơi không tổ chức triển khai thực hiện Quy chế hoặc triển khai hình thức, kém hiệu quả thì Chủ tịch Uỷ ban nhân dân xã phải chịu trách nhiệm và bị xử lý kỷ luật tùy theo mức độ sai phạm. Hình thức kỷ luật đối với Chủ tịch Uỷ ban nhân dân xã do Chủ tịch Uỷ ban nhân dân cấp huyện xem xét, quyết định.

PROMULGATING THE REGULATION ON THE EXERCISE OF DEMOCRACY IN COMMUNES

THE GOVERNMENT

Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to Resolution No. 17/NQ-TW of March 18, 2002 of the fifth plenum of the IXth Party Central Committee on renewing and raising the quality of the political system in communes, wards and district townships;
Pursuant to Directive No. 10-CT/TW of March 28, 2002 of the Party Central Committee's Secretariat on continuing to boost the formulation and realization of the Regulation on grassroots democracy;
At the proposal of the Minister of the Interior,

DECREES:

Article 1.- To issue together with this Decree the Regulation on the exercise of democracy in communes.

Article 2.- The Regulation issued together with this Decision shall also apply to wards and district townships. The Minister of the Interior shall issue documents to guide the application of the Regulation on the exercise of democracy in communes to wards and district townships.

Article 3.- This Decree takes effect 15 days after its publication in the Official Gazette and replaces the Government's Decree No. 29/1998/ND-CP of May 11, 1998 promulgating the Regulation on the exercise of democracy in communes.

REGULATION

ON THE EXERCISE OF DEMOCRACY IN COMMUNES
(Issued together with the Government's Decree No. 79/2003/ND-CP of July 7, 2003)

Chapter I

GENERAL PROVISIONS

Article 1.- This Regulation specifies works to be promptly informed and publicized by the commune People's Councils and People's Committees (hereinafter called the commune administrations) to people; works to be directly discussed and decided by people; works to be commented by people before being decided by State agencies; works to be supervised and inspected by people; and forms of implementing the Regulation on the exercise of democracy in communes.

Article 3.- The promotion of the people's right to mastery must be closely linked to the mechanism of "the Party's leadership, the State's management and the people's mastery," bringing into full play the representative democracy regime, raising the working quality and efficacy of the local administrations, implementing the direct democracy regime at the grassroots for the people to discuss and directly decide on important and practical issues closely related to their interests and obligations.

Article 4.- Democracy must lie within the framework of the Constitution and laws, going hand in hand with order and discipline; rights must be in parallel with obligations; any acts of abusing democracy, violating the Constitution and laws and infringing upon the interests of the State and collectives as well as the rights to freedom and democracy and legitimate interests of citizens shall be resolutely handled.

Chapter II

WORKS TO BE INFORMED TO PEOPLE

Article 5.- The commune administrations shall have to promptly inform and publicize the following major works to people:

1. The State's undertakings, policies and laws directly related to the rights and interests of the commune people, including:

a/ Resolutions of the commune People's Councils, decisions of the commune People's Committees and those of superior authorities relating to the localities;

b/ The provisions of law on administrative procedures and settlement of affairs concerning people;

c/ The State's and local administrations' regulations on payers and collection levels of assorted taxes, charges and fees, as well as other obligations of people as prescribed by current laws;

3. The land use plannings and plans;

4. The annual estimates and settlements of the commune budgets;

5. The estimates and settlement of revenues and expenditures of funds, programs, projects and contributions mobilized from the people for the construction of infrastructure and public welfare projects of communes, villages and hamlets (hereinafter villages and hamlets shall be referred collectively to as villages) as well as their implementation results;

6. The programs and projects directly invested in, or donated to, communes by the State, organizations or individuals;

7. Undertakings and plans on capital borrowing for production development, hunger elimination and poverty alleviation;

8. The adjustment of administrative boundaries of communes and administrative units related to communes;

9. The results of the inspection, examination and settlement of negative or corrupt cases involving commune and/or village officials;

10. The social and cultural activities, the prevention and combat of social evils, the maintenance of security, social order and safety in communes;

11. The preliminary and final reviews of activities of the commune People's Councils and People's Committees;

13. The consideration and selection of poor households entitled to borrow capital for production development and construction of gratitude houses; the realization of policies towards families with meritorious services to the revolution, fallen heroes' families, war invalids and diseased soldiers who are presented with gratitude houses, savings books and health insurance cards;

14. The results of selection, priority order and organization of implementation of works under the programs and projects directly invested in, or donated to, communes by the State, organizations and/or individuals.

Article 6.- The commune administrations shall have to coordinate with the Vietnam Fatherland Front Committees, Vietnam Fatherland Front's member organizations of the same level and the village chiefs in supplying the information prescribed in Article 5 of this Regulation to the people in the following forms:

1. Publicly posting up written documents at the head-offices of the commune People's Committees, residential quarters and cultural centers;

2. Through the public-addressing radio system of communes and villages as well as grassroots cultural, information and propaganda organizations;

3. Organizing meetings between voters and deputies of the commune People's Councils.

4. At the meeting sessions of the commune People's Councils, meetings of the People's Committees, Vietnam Fatherland Front Committees and Vietnam Fatherland Front's member organizations of the same level, and village meetings;

5. Sending documents to households or village chiefs.

Chapter III

Article 7.- The people in communes and villages shall discuss and directly decide on the following works:

1. Undertakings on, and levels of, contributions for the construction of infrastructure and public-welfare facilities (electricity supply, roads, schools, health stations, cemeteries, cultural and sport facilities);

2. The elaboration of village codes or conventions of cultured villages, building of a civilized lifestyle, maintenance of security and order, abolishment of bad practices, superstition and social evils;

3. Internal affairs of the village population communities, suitable to the current law provisions;

4. The establishment of boards for supervision of construction works built with the people's contributions;

5. The organization of the protection of production and business, maintenance of security, order, social safety and environmental sanitation as well as other activities in communes and villages.

Article 8.- Apart from the contributions prescribed in Clause 1 of Article 7, the commune People's Committees may coordinate with the Vietnam Fatherland Front Committees and Vietnam Fatherland Front's member organizations of the same level in propagating and mobilizing people to make other contributions for mutual assistance, humanitarian or charity purposes on the principle of absolute voluntariness without imposing compulsory or arbitrary contributions on everyone.

Article 9.- Modes of implementing works directly decided by people

1. The commune People's Committees shall formulate plans and programs; coordinate with the Vietnam Fatherland Front Committees of the same level in directing and organizing the discussion of, and decision on, works defined in Article 7 of this Regulation by the people in one of the following forms:

b/ Distributing poll cards to households to collect their opinions.

The gathering of opinions, open voting at the meeting or secret ballot on each matter shall be decided by the people according to the provisions in Article 7 of this Regulation and must be recorded in writing for reporting to the commune People's Committees on the contents of the meetings and the conclusions on voted issues.

2. The commune People's Committees shall issue decisions to recognize the contents specified in Article 7 of this Regulation which are compliant with law provisions and voted for by over 50% of those participating in the meetings or those asked for their opinions.

3. The commune People's Committees shall coordinate with Vietnam Fatherland Front of the same level in directing village chiefs and heads of the Front's working boards to organize the implementation of affairs decided by the people and recognized by the commune People's Committees, with the supervision by the people's inspectorates or the supervision boards for works and projects, which are elected by the people.

4. The people shall have to observe and strictly implement decisions unanimously approved by over 50% of households in communes or villages.

Chapter IV

WORKS TO BE DISCUSSED OR COMMENTED BY PEOPLE AND DECIDED BY THE COMMUNE ADMINISTRATIONS

Article 10.- Works which the commune administrations must put up for discussion or comment by people before making decisions thereon (or before submitting to competent authorities for decision) include:

1. Draft resolutions of the commune People's Councils;

3. Draft plannings and plans on the use of land in localities as well as the management and efficient use of public land funds of the communes;

4. Plannings on residential quarters; schemes on sedentarization and new economic zones; plans and projects on the mobilization and use of people's contributions for the investment in construction of communally-run infrastructures;

5. Draft schemes on demarcation and adjustment of the administrative boundaries of communes, schemes on splitting and establishment of villages;

6. Draft plans on the implementation of national target programs in the communes;

7. Undertakings and plans on compensation for ground clearance, infrastructure construction and resettlement;

8. Employment for laborers in the communes;

9. Other affairs which the commune administrations deem necessary.

Article 11.- Modes of implementing works discussed and commented by people before being decided by the commune administrations (or being submitted to competent authorities for decision)

1. Based on resolutions of the commune Party Committees and resolutions of the commune People's Councils, the commune People's Committees shall draft documents and plans and coordinate with the Vietnam Fatherland Front Committees and Vietnam Fatherland Front's member organizations of the same level in organizing the collection of public opinions in the following forms:

b/ Distributing comment-gathering cards to each household;

c/ Organizing meetings of economic organizations for discussion;

d/ Placing letter-boxes for public comments.

2. The opinions of people at the meetings or their written comments must be summed up and reported fully and objectively for the commune People's Committees to consider and submit them to the commune People's Councils for decision according to their competence or submission to superior competent authorities for consideration and decision.

Chapter V

WORKS TO BE SUPERVISED AND INSPECTED BY PEOPLE

Article 12.- Works to be supervised and inspected by people in communes include:

1. Activities of the commune administrations, socio-political organizations, social organizations and professional organizations in the communes;

2. The results of the implementation of resolutions of the commune People's Councils and decisions as well as directives of the commune People's Committees;

4. The settlement of local citizens' complaints and denunciations;

5. The estimates and final settlement of commune budgets;

6. The process of organizing the construction, results of pre-acceptance tests and final settlement of projects built with people's contributions and projects directly invested in, or donated to, the communes by the State, organizations and/or individuals;

7. The projects implemented by superior authorities in the communes with direct impacts on the production, security, order, socio-cultural affairs, environmental sanitation and life of local people;

8. The management and use of land in the communes;

9. The collection and spending of various funds and fees according to the State regulations as well as various contributions of the people;

10. The results of the examination, inspection and handling of negative and corrupt cases involving commune officials;

11. The implementation of the regimes and policies on preferential treatment, care and assistance for war invalids, diseased soldiers, fallen heroes' families and people and families with meritorious services to the country, social insurance and social relief policies.

Article 13.- Modes of implementing works to be supervised and inspected by people

1. Attending personally (if being invited) or through their representative organizations the commune administrations' meetings on matters directly related to their rights and interests;

2. Contributing opinions on the evaluation of the biannual and annual reports on the activities of the commune administrations;

3. Giving comments on the work reports and self-criticisms of the chairmen of the commune People's Councils and the presidents of the commune People's Committees at the year-end final review meetings.

4. Participating in the vote of confidence for posts elected by the commune People's Councils;

5. Detecting agencies, organizations and individuals that infringe upon the people's right to mastery and show signs of corruption or wastefulness, using budget revenues and expenditures and people's contributions for wrong purposes, realizing programs and projects, using and managing land, making compensation for ground clearance in contravention of law provisions, or committing other acts of law violation; lodging denunciations and petitions to the commune administrations and competent agencies for clarification and settlement thereof then announcement of the settlement results.

Article 14.- Responsibilities of agencies, organizations and individuals for the people's supervision and inspection

1. The commune People's Committees have the responsibility:

a/ To invite representatives of the Vietnam Fatherland Front Committees, Fatherland Fronts member organizations of the same level and directly related subjects to attend the commune administration's meetings on matters related to the rights and interests of local people;

b/ To consider and settle proposals of agencies, organizations and individuals according to their competence and notify the settlement results to the proposers;

2. The chairmen of the commune People's Councils and the presidents of the commune People's Committees shall have to send to the village chiefs their reports on work performance and their self-criticisms at the annual review meetings for the village chiefs to organize the collection of people's opinions thereon.

3. Annually, the commune Fatherland Front Committees shall organize the vote of confidence among the Front's member organizations for key positions elected by the commune People's Councils. If the proportion of votes of confidence represents less than 50% of the participants, the commune Fatherland Front Committees shall propose the commune People's Councils to consider and remove such position holders.

4. The village chiefs shall coordinate with the heads of the Front's working boards in organizing meetings to gather people's opinions on issues to be decided by the people; sum up and accurately, objectively and truthfully report the people's opinions in writing to the commune administrations.

5. The people must not rally in large numbers, make petitions to authorities of levels higher than the prescribed ones, cause disorder and insecurity and resist persons on duty while their petitions are being considered and settled according to law provisions.

Chapter VI

BUILDING VILLAGE POPULATION COMMUNITIES

Article 15.- Villages are living places of the population communities where democracy is exercised in a direct and broad manner so as to promote forms of self-managed activities of the population communities and where people are organized to realize the Party's undertakings and lines, the State's policies and laws as well as tasks assigned by superior authorities. The commune People's Committees shall have to direct, guide, support, supervise and inspect activities of villages.

Article 16.- Village meetings shall be organized once every six months or extraordinarily in necessary cases, with the participation of all voters, household heads or voters representing households, aiming:

1. To discuss and decide on internal affairs of the population communities regarding production, infrastructure construction, employment, hunger elimination and poverty alleviation, solidarity and mutual assistance in production and daily-life activities, as well as matters related to culture, social affairs, environmental sanitation, social order and safety in accordance with law provisions;

3. To discuss and give comments on the reports on work performance and self-criticisms of the village chiefs, the chairmen of the commune People's Councils and the presidents of the commune People's Committees;

4. To elect and dismiss the village chiefs; elaborate village codes or conventions; appoint people to various boards, self-management groups or people's inspectors;

Resolutions of the meetings shall be valid only when they are approved by at least more than half of the participants and not contrary to law provisions.

Article 17.- Tasks and powers of the village chiefs

1. The village chiefs shall be directly elected by the people at village meetings, considered and recognized by the presidents of the commune People's Committees in their decisions and subject to the direction and management by the People's Committees. The presidents of the commune People's Committees may criticize, caution, temporarily suspend or dismiss the village chiefs when the latter fail to fulfill their tasks, infringe upon the people's right to mastery or commit corrupt or wasteful acts; fail to obey the direction and administration of the commune People's Committees; violate laws and/or other regulations of superior authorities.

2. Tasks, responsibilities and powers of the village chiefs

a/ To assume the prime responsibility and coordinate with the Fatherland Front's working boards and mass organizations in the villages in carrying out such activities as: convening and chairing village meetings; organizing the implementation of decisions of the villages; organizing the people to well implement the Regulation on democracy; organizing the elaboration and realization of the village codes or conventions; maintaining unity, order and safety in the villages; organizing the performance of tasks assigned by the commune People's Committees; gathering and reporting on the people's legitimate aspirations and requesting the commune administrations to deal with them; signing service contracts for the production and infrastructure construction on the basis of the village meetings' resolutions;

b/ To make biannual and annual reports on their work performance and self-criticisms and present them before the village meetings. Annually, the Fatherland Front's working boards shall, together with the Front's member organizations in the villages, organize the vote of confidence on the village chiefs. If the number of votes of confidence represents less than 50% of the participants in the voting, they shall request the organization of the village meetings to consider and dismiss the village chiefs and report such to the presidents of the commune People's Committees for decision;

c/ To be invited by the commune People's Committees to attend meetings on related issues. To make monthly reports on work performance to the commune People's Committees;

Article 18.- Villages shall elaborate codes or conventions on internal affairs of the population communities, inheriting and promoting the community's fine customs and practices in accordance with current law provisions so as to abolish bad customs, superstition and social evils, maintain security and order, traffic safety and environmental sanitation and build a new, prosperous and civilized countryside.

Village codes or conventions shall be discussed and adopted by the village people at the village meetings. The village chiefs shall send the adopted codes or conventions to the commune People's Committees. After reaching agreement with the chairmen of the commune People's Councils and the Fatherland Front Committees of the same level, the presidents of the commune People's Committees shall send official dispatches requesting the presidents of the district-level People's Committees to approve these codes or conventions. The district-level Justice and Culture-Information Sections shall have to assist the presidents of the district-level People's Committees in appraising the village codes or conventions before approval.

Article 19.- Villages may establish conciliation teams, security teams, production protection teams and construction teams. These organizations shall be set up or dissolved according to the practical requirements of each locality. Members of these organizations shall be elected by the people and their operation shall be managed and directed by the village chiefs in coordination with the Fatherland Front's working boards.

Chapter VII

IMPLEMENTATION PROVISIONS

Article 20.- All levels and branches shall have to build the grassroots administrations into clean, strong, effective and efficient ones, overcoming manifestations of red tape, irresponsibility or lack of democracy in the handling of works; to pay constant attention to the building of the contingent of grassroots officials; to work out plans on training and fostering in general education, professional knowledge and skills, political theory and working methods, thus meeting the requirements of tasks in the new revolutionary period.

Article 21.- Officials and employees of the administrations at various levels and people shall be obliged to strictly abide by the provisions of this Regulation.

Article 22.- The presidents of the People's Committees at various levels shall have to direct the implementation of this Regulation. Biannually, the presidents of subordinate People's Committees shall report on the implementation results to the presidents of the superior People's Committees; annually, the presidents of the provincial/municipal People's Committees shall report on the results of implementation of this Regulation to the Government (through the Ministry of the Interior).

Article 23.- The Ministry of the Interior shall have to direct, guide and monitor the implementation of this Regulation. The Ministry of Finance shall have to direct and guide its subordinate professional agencies to inspect the commune's finance as well as budget revenues and expenditures and provide professional fostering for financial staff in communes. The State Inspectorate shall have to provide guidance on the work of examination and inspection in communes, and professional fostering and guidance to the commune people's inspection boards. The Ministry of Justice and the Ministry of Culture and Information shall have to guide the elaboration of village codes or conventions.

Article 25.- In the course of implementing this Regulation, organizations and individuals that record achievements shall be rewarded and/or commended; organizations and individuals that violate this Regulation shall be handled according to the current law provisions.

For localities which fail to implement this Regulation, or do implement this Regulation but in a formalistic and inefficient manner, the presidents of the commune People's Committees shall be held responsible therefor and disciplined depending on the seriousness of their violations. The forms of discipline applicable to the presidents of the commune People's Committees shall be considered and decided by the presidents of the district-level People's Committees.
