CIRCULAR
PROVIDING
INSTRUCTIONS FOR BANKING-SECTOR EMULATION, COMMENDATION AND REWARDING
Pursuant to the Law on Emulation and
Commendation dated November 26, 2003; the Law on Amendments and Supplements to
several articles of the Law on Emulation and Commendation dated June 14, 2005;
the Law on Amendments and Supplements to the Law on Emulation and Commendation
dated November 16, 2013;
Pursuant to the Government's Decree No.
91/2017/ND-CP dated July 31, 2017, specifying and guiding the implementation of
a number of articles of the Law on Emulation and Commendation;
Pursuant to the Government's Decree No.
16/2017/ND-CP dated February 17, 2017, defining the functions, tasks, powers
and organizational structure of the State Bank of Vietnam;
Upon the request of the Director of the
Department of Emulation and Commendation;
The Governor of the State Bank of Vietnam hereby
promulgates the Circular providing instructions for emulation, commendation and
rewarding activities in the banking sector.

Article 1. Scope
This Circular serves as a manual for emulation and
commendation in the banking sector, including the followings: Contestants in
emulation and commendation campaigns; organization of emulation campaigns;
emulative titles and emulative title standards; praising and rewarding forms
and standards; authority to issue commendation and rewarding decisions,
application and documentation requirements for receipt of commendation and
rewarding decisions; conferment of emulative titles, praising and rewarding
forms; emulation, commendation and rewarding funds; state management of
emulation, commendation and rewarding activities; Emulation, Commendation and
Rewarding Boards, and Innovation Board at all levels; rights and obligations of
winning persons and teams.
Article 2. Subjects of
application
Persons and teams controlled by the State Bank of
Vietnam (hereinafter referred to as SBV); credit institutions; foreign bank
branches; Deposit Insurance of Vietnam; standing affiliates of associations and
enterprises under the SBV’s management; other persons or teams making direct
and significant contribution to banking operations.
Article 3. Banking-sector
teams
1. SBV's teams
a) SBV-controlled units and standing authorities of
Party organizations or unions at the SBV’s headquarter are classified as large
teams;
b) Authorities, Departments or Administrations and
Offices under the Bank Supervision and Inspection Agency’s control;
Subdepartments or Sub-administrations are classified as basic teams;
c) Departments (divisions) and equivalent of either
team specified in point a and b of this clause are classified as small teams.

a) Commercial banks, Bank for Social Policies,
Cooperative Bank of Vietnam, Deposit Insurance of Vietnam, foreign bank
branches, financial institutions, financial leasing companies and microfinance
institutions (except subsidiaries of credit institutions) are classified as large
teams;
b) Departments (divisions), centers at head
offices, branches, subsidiaries and equivalents of teams specified in point a
of this clause (except microfinance institutions) are classified as basic
teams;
c) Departments (divisions), transaction offices and
equivalents of teams specified in point b of this clause are classified as
small teams.
3. Training teams
a) Banking Academy and Banking University of Ho Chi
Minh city are classified as large teams;
b) Departments, faculties, subject groups, training
centers and establishments, units of teams specified in point a of this clause
are classified as basic teams;
c) Departments (divisions), faculties, subject
groups and equivalents of teams specified in point b of this clause are
classified as small teams.
4. Teams at enterprises under the SBV’s management
a) National Banknote Printing Plant, National
Payment Corporation of Vietnam, Vietnam Asset Management Company and other
enterprises under the SBV's authority are classified as large teams;

c) Subgroups and equivalents of teams specified in
point b of this clause are classified as small teams.
5. Teams at standing entities of associations under
the SBV’s management
a) Standing entities of Banks Associations,
Association of People’s Credit Funds, Association of Financial Leasing Companies
and other associations under the SBV’s management are classified as large
teams;
b) Departments (divisions) and equivalents of teams
specified in point a of this clause are classified as small teams.
Article 4. Commendation and rewarding principles
Banking-sector commendation and rewarding
principles shall be subject to Article 3 in the Government’s Decree No.
91/2017/ND-CP dated July 31, 2017, elaborating on implementation of several
articles of the Law on Emulation, Commendation and Rewarding (hereinafter
referred to as Decree No. 91/2017/ND-CP) and the following regulations:
1. SBV’s Governor shall be authorized to confer a
merit certificate upon an individual or team, or nominate an individual or team
for a national award, only once a year, except in case of sudden or thematic
awards.
2. Commending and rewarding, or requesting
higher-level authorities to confer commendations or rewards upon, individuals
or teams that are waiting for decisions to take disciplinary action considered
by a competent authority, or is under investigation or inspection in case of
being suspected of any violation, or are expecting their complaints or
accusations to be verified, shall be pending.
3. Only credit institutions, branches of credit
institutions, foreign bank branches, individuals holding posts as managers or
chief executive officers of credit institutions, and Directors General
(Directors) of foreign bank branches, that maintain their bad debt ratios
within the limits decided by the SBV’s Governor on an annual basis.

5. In order to meet the eligibility
standards for winning “Team of Excellence in Fulfilling Duties”, nominated
teams must be recognized as winners of “Team of Excellence at Work”.
6. Achievement duration recorded in the earlier
rewarding decision shall decide the next nomination time. If a rewarding
decision does not record the achievement duration, the next nomination time
shall vary depending on the date of issuance of the earlier rewarding decision.
Article 5. Banking-sector
innovations
1. Banking-sector innovations (hereinafter referred
to as innovation(s)) refers to new approaches or approaches to improving the
existing ones previously applied during the period of implementation of duties,
bringing about practical benefits (economic effectiveness or social welfares),
increasing operational efficiency, effectiveness and quality, including:
a) Managerial approach refers to a method that a
subject of management employs to conduct and govern work of a managed object in
order to attain work purposes;
b) Technological approach refers to a technical
method or means used for dealing with a specified duty;
c) Operational approach refers to the act of
counseling and proposing measures to perform duties with the aim of helping a
subject of management handle work in an effective manner;
d) Approach to application of scientific and
technological advances refers to a method, manner or measure in which a known
technical solution is applied to a bank’s practical operations.

b) An innovation rated effective and taking effect
in the banking sector (hereinafter referred to as sectoral-level innovation)
refers to a new approach or an approach improving the previous one which is
applied to create practical benefits in the banking sector.
c) An innovation rated effective and taking effect
at the grassroots level (hereinafter referred to as grassroots-level
innovation) refers to a new approach or an approach improving the previous one
which is applied to provide practical benefits for each bank’s business.
Chapter II
EMULATION AND EMULATIVE TITLES
Section 1. EMULATION AND HOSTING OF EMULATION
CAMPAIGNS
Article 6. Forms of hosting of
emulation campaigns
1. Regular emulation is a form of emulation
initiated based on assigned functions and duties of participating individuals
and teams for the purposes of stimulating them to well perform daily, monthly,
quarterly and annual duties assigned by their entities and units. Contestants
in regular emulations are individuals in a team, or teams in the same entity,
organization or unit or of entities and units having similar functions, duties
or characteristics of work.
A plan to host an emulation campaign must specify
its purposes, requirements, goals and targets, and must be carried out by
related entities and units, or by launching the campaign or signing emulative
undertakings between participating Clusters and Groups. By end of their term of
office, Heads of participating entities or units, and Heads of participating
Clusters or Groups, must convene sum-up meetings in which nominees for
emulative titles are recommended.
2. Thematic (or periodic) emulation is a form of
competition aimed at encouraging participating entities and units to prove
their good performance of key duties and other tasks that need their
concentration within a specific period of time, or held to stimulate them to
strive for fulfillment of their key, unscheduled or urgent duties. Participating
units may launch a thematic (or periodic) emulation campaign only if time,
purposes, requirements, targets, contents and manners of implementation of such
campaign are specified.

Article 7. Registration for emulative titles and
signing of emulative undertakings
1. On an annual basis, large teams specified in Article
3 herein (hereinafter referred to as participating unit(s)) shall provide
opportunities for teams and individuals under these participating units'
control to make registration for participation in emulations and compile a list
of these teams and individuals by using the form No. 01 given herein and send
it to the SBV (via Department of Emulation, Commendation and Rewarding) by
February 28 at the latest. Microfinance institutions must send their
registrations for participation in emulative titles to SBV’s branches in
provinces or centrally-affiliated cities within their remit.
2. On an annual basis, Heads of emulative Clusters
or Groups must sign emulative undertakings between participating units under
their control, and send them to the SBV (via Department of Emulation,
Commendation and Rewarding) by February 28 at the latest. Emulative targets,
contents and approaches to organizing emulations must receive consent from
emulative Clusters or Groups before being put to use. Division into emulative
Clusters or Groups shall be subject to competent authority’s regulations.
Article 8. Responsibilities for hosting
emulation campaigns
1. SBV’s Governor shall lead, undertake and direct
banking-sector emulation campaigns. Department of Emulation, Commendation and
Rewarding shall give SBV’s Governor counsels on leading, undertaking, directing
and inspecting implementation of emulation campaigns under the Governor’s
authority.
2. Heads of participating units (i.e. Heads of
SBV-affiliated units; legal representatives of credit institutions, Deposit
Insurance of Vietnam, enterprises under the SBV’s management; Directors General
(Directors) of foreign bank branches; General Secretaries of Associations under
the SBV's authority) shall be responsible for leading emulations, undertaking
emulation campaigns and holding preliminary or final sum-up meetings over
emulation campaigns under their remit.
3. Heads of emulative Clusters or Groups shall be
responsible for leading emulations and supervising implementation of emulation
campaigns by participating units under the control of emulative Clusters or
Groups, and holding preliminary or final sum-up meetings over emulation
campaigns.
4. Executive Party Committees and associations at
all levels in the banking sector shall work closely with Heads of participating
units in charge of hosting and launching emulation campaigns.
5. Communications and press agencies in the banking
sector shall be responsible for disseminating emulation, commendation and
rewarding activities; correctly reflecting results of emulation campaigns,
commendation and rewarding activities; finding teams and individuals with
excellent achievements when participating in emulation campaigns and selecting
them as an example or introducing them to Emulation, Commendation and Rewarding
Boards at all levels so that they can consider issuing rewarding decisions;
fighting and criticizing illegal acts arising from emulation, commendation and
rewarding regulations in the banking sector.

Article 9. Emulative titles
1. Individual titles, including “Lao động tiên
tiến” (“Winner of Progressive Labor Title”), “Chiến sĩ thi đua cơ sở” (“Winner
of Grassroots-level Honourable Title”), “Chiến sĩ thi đua ngành Ngân hàng”
(“Winner of Banking-sector Honourable Title”), “Chiến sĩ thi đua toàn quốc”
(“Winner of National Honourable Title”).
2. Collective titles, including “Tập thể lao động
tiên tiến” (“Progressive Labor Team”), “Tập thể lao động xuất sắc” (“Excellent Labor
Team”), “Cờ thi đua của Ngân hàng Nhà nước” (“SBV’s Honourable Flag”), “Cờ thi
đua của Chính phủ” (“Government’s Honourable Flag”).
Article 10. “Winner of Progressive Labor Title”
1. This honourable title shall be annually
awarded to individuals meeting the following standards:
a) Performing assigned duties well and maintaining
high productivity and quality;
b) Duly complying with guidelines and policies of
the Party, legislative laws, regulations and statutes in the banking sector, of
participating units and localities; having a high sense of self-reliance,
autonomy, solidarity, support, and taking an active part in emulation
campaigns;
c) Demonstrating full commitment to studying
politics, culture, professional skills and practice;
d) Having good morals and healthy lifestyle.

3. If individuals risk their life to rescue people
and property, and are later injured to the extent that they have to receive
medical care and treatment, they shall be nominated for "Winner of
Progressive Labor Title".
4. If an individual is transferred to another work,
the receiving unit shall consider nominating him/her for the title of “Winner
of Progressive Labor Title”. If he/she has worked at the previous unit for at
least 6 months, such unit’s comments shall be required. If an individual is
seconded or dispatched to another entity or unit to work for a specified period
of time, the sending entity or unit shall be responsible for considering
issuing a decision to nominate him/her for the title of “Winner of Progressive
Labor Title” and the receiving entity or unit shall be responsible for giving
confirmation.
5. If an individual is sent to a short-term
domestic or overseas training course lasting for less than 1 year, duly
complying with regulations of training and educational institutions, his/her
training period shall be counted as his/her working period based on which
he/she will be entitled to nomination for the title of "Winner of
Progressive Labor Title". If an individual is sent to a domestic or
overseas training course lasting for at least 1 year, duly complying with
regulations of training and educational institutions, and attaining at least
the good training result, he/she shall be eligible to become a nominee for the
title "Winner of Progressive Labor Title".
6. None of nominations for the title of “Winner of
Progressive Labor Title” shall be applicable to individuals that have been
newly recruited for less than 10 months and receiving reprimand as a
disciplinary action.
Article 11. “Progressive Labor Team”
This honourable title shall be annually awarded to
teams meeting the following standards:
1. Fulfilling assigned duties and fully
implementing assigned plans.
2. Hosting regular, significant and effective
emulation campaigns.
3. Having more than 50% of individuals under their
control that have received the title of "Winner of Progressive Labor
Title" and none of individuals belonging to these teams that are subject
to at least warning as a disciplinary action which is the same as imposed on
public officials and servants; having none of individuals belonging to teams
that are disciplined in such forms as not-more-than-6-month extension of pay
raise, discharge from office, or dismissal, which are the same as those imposed
on employees.

Article 12. “Winner of Grassroots-level
Honourable Title”
1. This honourable title shall be annually awarded
to individuals meeting the following standards:
a) Satisfying standards of the title of “Winner of
Progressive Labor Title”;
b) Developing innovations aimed at increasing labor
productivity and efficiency which are recognized by their host units, or
completing scientific researches already tested and put to use at entities and
units.
2. Individuals receiving the title of "Winner
of Grassroots-level Honourable Title" account for not more than 15% of
total number of individuals receiving the title of “Winner of Progressive Labor
Title” of a unit.
Article 13. “Winner of
Banking-Sector Honourable Title” and “Winner of National Honourable Title”
1. The title of “Winner of Banking-sector
Honourable Title” shall be awarded to individuals meeting the following
standards:
a) Having achievements that are more outstanding
than those of individuals receiving the title of "Winner of
Grassroots-level Honourable Title" three times promptly before the date of
nomination for the title. Individuals with outstanding achievements are persons
awarded "Governor's Certificate of Merit", or commended or rewarded
by the Prime Minister or the President of Vietnam during the period of
consideration of conferment of "Winner of Banking-sector Honourable
Title";
b) Having innovations or scientific researches at the
sectoral level.

Article 14. “Excellent Labor Team”
1. This title shall be awarded annually to
outstanding teams that are selected out of teams receiving the title of
“Progressive Labor Team”, and are required to meet the following standards:
a) Being creative and overcoming difficulty to
perform duties well and duly implement obligations to the State;
b) Hosting regular, significant and effective
emulation campaigns;
c) Having one-hundred per cent of member
individuals fulfilling their assigned duties, including at least seventy
percent of member individuals awarded the title of “Winner of Progressive Labor
Title”;
d) Having member individuals awarded the title of
“Winner of Grassroots-level Honourable Title”.
2. A team shall be deemed excellently performing
assigned duties as provided in point a of clause 1 of this Article in the
following situations:
a) The team under the SBV’s control excellently has
performed the work plan within a nomination year and other duties assigned by
its supervisory entity; has given advice or opinions on formulation of SBV’s
regulations and policies; has duly complied with reporting and statistical
regulations;
b) The team under the control of a credit
institution, foreign bank branch and Deposit Insurance of Vietnam has
excellently fulfilled targets and plans of action within the nomination year;
has carried out internal inspection and control in a good manner; has duly
complied with policies, laws of the State and regulations or statutes of the
SBV;

d) The team under the control of an SBV-managed
enterprise has fully and excellently fulfilled assigned targets and plans; has
seriously complied with communication and reporting regimes prescribed in
regulations in force; has carried out internal inspection and control in a good
manner;
dd) The standing entity of an SBV-controlled
association has efficiently disseminated the Party’s policies, laws of the
State and regulations of the SBV; has submitted recommendations on formulation
of regulations and policies in the banking sector.
Article 15. “SBV’s
Honourable Flag” and “Government’s Honourable Flag”
1. The title of “SBV’s Honourable Flag” shall be
awarded annually to teams meeting the following standards:
a) The candidate team must have outstanding
achievements upon taking part in banking-sector emulation campaigns specific to
fields, zones, regions or systems; must excellently obtain assigned targets
within the nomination year; must be nominated or honored as a unit ranked
highest amongst others in an emulative banking Cluster or Group; must obtain
the title of “Excellent Labor Team” recognized by a competent authority;
b) The candidate team must develop and use new
factors and models so that other teams in the same emulative Cluster or Group
or the entire banking system learn them;
c) The candidate team must duly comply with
guidelines and policies of the Party, laws of the State, regulations of the
SBV, unit or locality; must unify its members, adopt practices of thrift,
prevent corruption, extravagance and other social evils.
2. The title of “Government’s Honourable Flag”
shall be annually awarded to:
a) Outstanding teams ranked at the first place
amongst teams meeting standards of the title "SBV's Honourable Flag"
may be nominated for such title through their participation in emulation
campaigns held on an annual basis. The number of teams eligible to become
nominees for the title of “Government’s Honourable Flag” shall not exceed 20%
of total number of teams meeting the standards of eligibility for winning the
title of "SBV's Honourable Flag";

Chapter III
COMMENDATION AND REWARDING STANDARDS
Article 16. Commendation
and rewarding forms
1. Commendation and rewarding attributed to
meritorious service and achievement refers to an act of commending and
rewarding teams and individuals having excellent achievements or excellently
fulfilling their assigned duties, contributing to the homeland construction and
defence.
2. Thematic (or periodic) commendation and
rewarding refers to an act of commending and rewarding teams and individuals
creating excellent achievements after end of each emulation launched by the
President, Prime Minister, SBV's Governor, Heads of banking-sector entities and
units.
3. Sudden commendation and rewarding refers to an
act of commending, praising and rewarding teams and individuals creating
unusual achievements during their production, labor and fighting support
activities; making brave decisions to rescue people and public or State-owned
property (sudden achievement refers to any achievement created in the events
that are not anticipated or take place without conforming to plans or duties that
teams or individuals have to undertake).
4. Commendation and rewarding attributed to service
period refers to an act of commending and rewarding individuals who
participated in revolutions in the past, are holding office as leaders or managers
of State regulatory authorities, public service units, political or
socio-political organizations, and providing meritorious services and making
outstanding contributions to the revolutionary future of the Party and the
entire nation.
5. Commendation and rewarding attributed to
external or diplomatic relations refers to an act of commending and rewarding
teams or individuals that make contribution to the Motherland construction and
protection in the economic sector.
Article 17. Orders,
Medals, “Prime Minister’s Certificate of Merit”, State Honourable Titles, “Ho
Chi Minh Prize", "State Prize"

Article 18. “Governor’s
Certificate of Merit”
1. “Governor’s Certificate of Merit” shall be
awarded to individuals as examples of due compliance with guidelines of the
Party, policies and laws of the State and in the banking sector, meeting one of
the following standards:
a) Having at least two executive years' excellent
fulfillment of duties or attainment of excellent achievements qualified for
nominations in emulation campaigns launched by SBV’s Governor on an annual
basis. During the aforesaid period, there must be two grassroots-level innovations
recognized and applied effectively within their host entities;
b) Creating the large number of achievements,
having their influence over specific operations in the banking sector;
c) Having sudden excellent achievements.
d) Acquiring at least 25 and 20 years’ working
experience in the banking sector with regard to male and female, respectively,
proving their good performance of assigned duties during 5 successive years in
office preceding the retirement date, receiving none of punishment decisions
during their working period, having not yet been awarded "Governor's
Certificate of Merit" or other State-level commendation and rewarding
forms.
2. “Governor’s Certificate of Merit” shall be
awarded to teams as examples of due compliance with guidelines of the Party,
policies and laws of the State and in the banking sector, meeting one of the
following standards:
a) Proving at least two successive years’ excellent
performance of their assigned duties, being united teams, ensuring good
grassroots-level democracy practice, organizing emulation campaigns in a good
manner; taking good care of material and spiritual life of team members;
adhering to thrift practice; fully implementing laws and regulations;
b) Having excellent achievements qualified for the
nomination round in an emulation campaign;

3. “Governor’s Certificate of Merit” shall be
awarded to non-banking-sector teams and individuals having a lot of
achievements making direct and significant contributions to banking operations.
Article 19. Certificates of appreciation
Heads of participating units may confer
certificates of appreciation upon teams and individuals in accordance with
regulations laid down in Article 74 and 75 in the 2003 Law on Emulation,
Commendation and Rewarding (amended and supplemented).
Article 20. Commendation and rewarding
attributed to service period
Forms of grant or posthumous conferment of rewards
attributed to service period to individuals shall be subject to Article 41 and
42 in the Decree No. 91/2017/ND-CP.
Chapter IV
COMMEMORATIVE MEDALS
Article 21. Commemorative medal
1. “For the prosperous career of Vietnamese Bank”
Commemorative medal is a form of granting commendations and rewards by the
SBV’s Governor to recognize dedication of banking and non-banking individuals
that make various contributions to the developmental period of the banking
sector.

Article 22. Standards of
eligibility for nomination for Commemorative medal
1. With regard to banking officers
a) Commemorative medals shall be awarded to
individuals performing their duties well and acquiring full 20 years’ and 15
years’ experience in working in the banking sector with regard to male and
female officers, respectively;
b) Banking officers who are, of course, awarded or
posthumously awarded commemorative medals include the followings: banking
officers who have been recognized as duty martyrs; officers joining the
Preparatory Committee for establishment of National Bank of Vietnam; banking
officers on active service at the battlefield B from 1968 and earlier; banking
officers winning titles such as "Golden Star Order", "Ho Chi
Minh Order”, “Independence Order” of all ranks, “Labor Hero” and comrades who
are holding office as Leaders of the State Bank;
c) Banking officers preferred to win commemorative
medals include the followings: banking officers on duty in the banking sector
from May 6, 1951 to May 7, 1954 and working for 10 successive years; if banking
officers were in active service at battlefields B, C and K in the Resistance
War against America taking place before April 30, 1975, their service period
shall be multiplied by the coefficient 2 (this means that one year will become
2 years) during the process of consideration of commendations or rewards; if
officers were previously working in the banking sector and then sent to serve
in the army, voluntary youth teams, or sent to take training courses or
transferred to work in other industries but, after that, reinstated to work in
banks, such service period shall be defined as the period of continuous working
in the banking sector during the process of consideration of commendations and
rewards.
2. With regard to non-banking individuals
Non-banking individuals may be considered as
winners of commemorative medals if they meet one of the following standards:
a) Proving provision of meritorious services through
their leadership and direction of contribution to the construction and
development of the banking industry of Vietnam;
b) Having innovations, initiatives or scientific
research findings that are useful for operations of the banking industry of
Vietnam;

d) Making direct and significant material
contributions to the development of the banking industry of Vietnam.
3. Foreign nationals have worked at Vietnamese
banks for at least 10 years and have performed their assigned duties well.
4. Below are individuals ineligible to win
commemorative medals:
a) Those who are subject to disciplinary action
imposed in the form of dismissal from work;
b) Those who are subject to criminal prosecution
procedures by judicial authorities, or are involved in crimes but awaiting
decisions from jurisdictional authorities;
c) Those who have been or are being imprisoned
(whether or not sentenced to probation), or serve their non-custodial community

1. SBV’s Governor shall be vested with authority to
confer:
a) The title of "Winner of Progressive Labor
Title" and “Winner of Grassroots-level Honourable Title” upon comrades
participating in the SBV’s Governing Board;
b) The title of “Winner of Banking-sector
Honourable Title”;
c) The title of “SBV’s Honourable Flag”;
c) Certificates of merit upon teams and
individuals;
dd) The title of “Excellent Labor Team”;
e) Commemorative medals upon individuals.
2. Directors of SBV’s branches at cities,
provinces, heads of SBV’s public service affiliates shall be accorded authority
to decide to confer the title of “Progressive Labor Team” upon teams; the title
of "Winner of Progressive Labor Title", "Winner of
Grassroots-level Honourable Title" upon individuals under their jurisdiction,

3. Inspector General of the Banking Inspection and

5. SBV’s Governor may authorize Heads of:
a) Departments, Administrations, Authorities, units
or standing entities of Party organizations and associations at SBV's
headquarter to decide to confer the title of "Progressive Labor Team"
upon teams; the title of "Winner of Progressive Labor Title" and
"Winner of Grassroots-level Honourable Title" upon individuals under
their jurisdiction.
b) SBV’s branches in cities or provinces and Bank
Supervision and Inspection Agency to decide to confer the title of “Excellent
Labor Team” upon small teams under their jurisdiction;
c) Governance Department, Issue and Vault
Department and Information Technology Department to decide to confer the title
of “Excellent Labor Team” upon small teams under the control of Subdepartments;
d) Credit institutions (except microfinance
institutions), foreign bank branches and Deposit Insurance of Vietnam to confer
the title of "Excellent Labor Team" upon nominated units.
dd) Participating units specified in point a of
clause 2, 3, 4 and 5 of Article 3 herein to decide to confer the title of
“Excellent Labor Team” upon teams under their control;
e) SBV’s branches in cities or provinces to decide

Article 24. Authority to
recognize innovations
1. Banking-sector Innovation Board shall be
authorized to evaluate efficiency and influence of innovations at the banking
sector or national level. Based on the evaluation result obtained from the Board,
the SBV’s Governor may authorize the Head of the Emulation, Commendation and
Rewarding Department to decide to recognize these innovations.

Article 25. Award ceremony
1. The ceremony of award of Orders, Medals, State
Honourable Titles, “Ho Chi Minh Prize”, “State Prize”, “Government’s Honourable
Flag”, “Winner of National Honourable Title” and “Prime Minister’s Certificate
of Merit” shall be subject to regulations laid down in the Government’s Decree
No. 145/2013/ND-CP dated October 29, 2013, regulating organization of
ceremonial days; ceremonies of award and welcoming of emulative commendations,
rewards and titles; protocols for external relation, welcoming and reception of
foreign guests.
2. With respect to Orders, Medals, State Honourable
Titles, “Ho Chi Minh Prize”, “State Prize” and “Winner of National Honourable
Title”, upon receipt of notices from the Department of Emulation, Commendation
and rewarding, Heads of participating units shall draw up plans to hold ceremonies
to celebrate receipt of these awards and submit them to the SBV’s Governor (via
Department of Emulation, Commendation and Rewarding). After receipt of
directives from the SBV’s Governor, the Department of Emulation, Commendation
and Rewarding shall be responsible for cooperating with participating units to
organize meetings to publicize and confer awards.
3. With respect to the title of “Government’s
Honourable Flag” and “Prime Minister’s Certificate of Merit”, after being
notified in written by the Department of Emulation, Commendation and Rewarding,
Heads of units shall, on their own initiative, draw up plans and organize
meetings to award these titles to teams and individuals under the control of
nominated units. Before doing so, these organizer units shall have to inform
the Department of Emulation, Commendation and Rewarding for its supervision.
4. Before organizing ceremonies to announce and
grant commendations or rewards at the state level to teams and individuals at
the SBV’s headquarter, the Department of Emulation, Commendation and Rewarding
shall have to consult with the SBV’s Governor and submit the organization plan
to seek his/her approval decision.
5. As for emulative titles and awards under the
Governor’s jurisdiction, he/she may authorize Heads of units to organize
ceremonies to announce and award titles to nominated teams and individuals.
Heads of units in collaboration with the Department
of Emulation, Commendation and Rewarding shall submit the plan to announce and
grant the title of “Governor’s Certificate of Merit” and Commemorative Medals
to non-banking teams and individuals to the SBV’s Governor to seek his/her
approval decision.
6. As being deemed as the occasion of honoring
people with good work and progressive examples, ceremonies on announcement and
conferment of emulative titles and awards must be held in a formal, effective,
economical, unboastful, non-formalistic and extravagant manner. Each ceremony
must be held in combination with other activities for less time and cost
consumption purposes.
Section 2. COMMENDATION AND REWARDING PROCEDURES

1. Heads of banking-sector units shall be
responsible for rewarding or requesting higher-level authorities to honour
public officials, servants and employees and other workers falling within their
remit. If an emulation campaign is led and launched by a competent authority,
then that authority may consider rewarding or request a higher-level authority
to reward teams or individuals making excellent achievements.
2. Banking-sector units shall submit application
documents directly at the SBV’s single-window division or by post, or by
filling in application forms online, to the SVB (via Department of Emulation,
Commendation and Rewarding).
After receipt of these documents, Department of
Emulation, Commendation and Rewarding shall be responsible for checking
legitimacy of submitted documents, verifying achievements and submitting their
request for competent authority’s decision within duration of 20 working days
(such duration will be 30 working days if information required for
consideration of commendations and rewards needs to be collected). If such
application documents are not legitimate, they must inform or return them to
applicant units within 5 working days from receipt thereof; requesting units
must prepare completed application documents for re-submission to Department of
Emulation, Commendation and Rewarding within 05 working days from receipt
thereof. As for commendations and rewards attributed to meritorious services
and attained achievements, if praiseworthy achievements qualified for
consideration of state-level commendations and rewards are reported after the
prescribed duration, these achievements of nominated teams or individuals must
be additionally provided.
3. As for the title of “Labor Hero": Heads of
participating units shall seek consent to the request for conferment of this
title from the SBV’s Governor (via Department of Emulation, Commendation and
Rewarding). Department of Emulation, Commendation and Rewarding shall consult
with the first Vice Chair of the Emulation, Commendation and Rewarding Board,
and then seek the SBV’s Governor’s consent in principle to establishment of
teams or individuals awarded the title of "Labor Hero". Based on
opinions from the SBV's Governor, the Department of Emulation, Commendation and
Rewarding shall send written notifications to these units. After receipt of
application documents for conferment of the title of “Labor Hero”, Department
of Emulation, Commendation and Rewarding shall check submitted documents,
verify achievements, and make synthesis reports for submission to the Board to
seek its decision; based on the consideration result obtained from the Board,
Department of Emulation, Commendation and Rewarding shall request the SBV's
Party Civil Affairs Committee to conduct review before proceeding to request
competent authorities to consider such application.
4. As for “Winner of Banking-Sector Honourable
Title” and “Winner of National Honourable Title”: After receipt of application
documents from units, Department of Emulation, Commendation and Rewarding shall
check legitimacy of submitted documents, verify their achievements, make
synthesis reports for submission to the Banking-sector Innovation Board and the
Banking-sector Emulation, Commendation and Rewarding Board for their review. Based
on review results from these Boards, Department of Emulation, Commendation and
Rewarding shall consult with the first Vice Chair of the Banking-sector
Emulation, Commendation and Rewarding Board before seeking the Governor’s
decision. Especially for the title of “Winner of National Honourable Title”,
application documents shall be submitted to the SBV’s Party Civil Affairs
Committee for review before being submitted to the SBV's Governor that then
requests competent authorities' review.
5. As for “SBV’s Honourable Flag” and “Government’s
Honourable Flag”: After receipt of application documents from participating
units, Clusters or Groups, Department of Emulation, Commendation and Rewarding
shall check legitimacy of submitted documents, verify their achievements, make
synthesis reports for submission to the Banking-sector Emulation, Commendation
and Rewarding Board for their consideration. Based on consideration results
from the Board, Department of Emulation, Commendation and Rewarding shall
consult with the first Vice Chair of the Banking-sector Emulation, Commendation
and Rewarding Board before seeking the Governor’s decision, or requesting
competent authorities for their consideration.
6. As for Orders and Medals of all kinds and ranks:
After receipt of application documents from units, Department of Emulation,
Commendation and Rewarding shall check submitted documents, verify
achievements, and make synthesis reports for submission to the Banking-sector
Innovation Board and the Banking-sector Emulation, Commendation and Rewarding
Board to convene a meeting on; based on the consideration result obtained from
the Board, Department of Emulation, Commendation and Rewarding shall request
the SBV's Party Civil Affairs Committee to conduct review before proceeding to
request competent authorities to consider such application.
7. As for “Prime Minister’s Certificate of Merit”,
after receipt of application documents from participating units, Department of
Emulation, Commendation and Rewarding shall check legitimacy of submitted
documents, verify their achievements, make synthesis reports for submission to
the Banking-sector Emulation, Commendation and Rewarding Board for their
review. Based on review results from the Board, Department of Emulation,
Commendation and Rewarding shall consult with the first Vice Chair of the
Banking-sector Emulation, Commendation and Rewarding Board before seeking the
Governor’s decision.
8. As for the title of “Excellent Labor Team” and
“Governor’s Certificate of Merit”, after receipt of submitted documents from
participating units, Department of Emulation, Commendation and Rewarding shall
check legitimacy of submitted documents, verifying their achievements and making
a synthesis report for submission to the first Vice Chair of the Banking-sector
Emulation, Commendation and Rewarding Board to consult with him/her before
seeking the Governor's decision.

10. As for the title of “People’s Teacher”,
“Teacher of Merit”, “Ho Chi Minh Prize” and "State Prize”, application
procedures and authority shall be subject to regulations laid down in the 2003
Law on Emulation, Commendation and Rewarding, the 2013 Law on Amendments and
Supplements thereto, the Decree No. 91/2017/ND-CP and other legislative
regulations.
11. As for emulative titles, commendations and
rewards specified in clause 3, 4, 5, 6, 7, 8, 9 and 10 of this Article, where
necessary, the Department of Emulation, Commendation and Rewarding may consult
with relevant units before making synthesis reports submitted to seek
commendation and rewarding decisions. Especially emulative titles such as
“Labor Hero”, “Winner of National Honourable Title” and other commendations or
rewards specified in clause 6 and 10 of this Article, the Department may
conduct polls to collect opinions from the public on nominated teams and
individuals via the State Bank’s portal before submitted requests for grant of
these titles or commendations or rewards.
12. On annual basis, the Department of Emulation,
Commendation and Rewarding in collaboration with the State Bank’s Office shall
prepare request documents including recommendations about emulative,
commendations or rewards conferred upon comrades holding office as SBV’s
leaders for submission to the Banking-sector Emulation, Commendation and
Rewarding Board for its consideration.
13. Commendation and rewarding attributed to
service period
a) With regard to the nominated officer who has
retired or has passed away:
i) If an SBV’s leader has retired or passed away,
the Department of Organization and Personnel shall be responsible for preparing
and submitted commendation or rewarding request documentation;
ii) In other cases, the Head of the unit where that
officer is supervised before his/her retirement or death shall be responsible
for preparing and submitted commendation or rewarding request documentation. If
the latest unit where the nominated officer is working has been subject to
dissolution, splitting, merger and acquisition processes, the Head of the unit
receiving duties transferred from the former shall be responsible for preparing
commendation and rewarding request documentation;
iii) Department of Emulation, Commendation and
Rewarding shall be responsible for verifying such documentation, synthesizing
and collecting confirmatory opinions from the Department of Organization and
Personnel (except when such request is submitted by the Department of
Organization and Personnel), and making a request to the Banking-sector
Emulation, Commendation and Rewarding Board for its review; based on the review
results received from the Board, the Department shall consult with the Party’s
Civil Affairs Committee before seeking the Governor's decision;
b) With regard to a nominated officer who is about
to retire:

ii) In other cases, the Head of the unit shall
prepare and submit requests for grant of commendations and rewards to qualified
officers in that unit. Department of Emulation, Commendation and Rewarding
shall be responsible for synthesizing such requests and collecting confirmatory
opinions from the Department of Organization and Personnel (except when such
request is made by the Department of Organization and Personnel), and making a
request to the Banking-sector Emulation, Commendation and Rewarding Board for
its review; and then consulting with the Party’s Civil Affairs Committee before
seeking the Governor's decision;
c) Department of Organization and Personnel shall
assume the following responsibilities: giving written confirmation about term
of service and sanctions, reasons and enforcement period (if any) and
equivalent designation of the nominee; cooperating with relevant units in
handling any complaints pertaining to conferment of commendations or rewards
upon officers that work in the banking sector for a long time.
14. With respect to commemorative medals
a) If an officer has been working in the banking
sector, the Head of the unit supervising that officer (even if that officer has
retired, died or transferred to other work) shall prepare a request, enclosing
documents of qualified and regulated officers, for submission to the Department
of Emulation, Commendation and Rewarding.
b) With regard to a non-banking officer,
commendations and rewards conferred upon comrades holding office as Leaders of
the Party, the State, National Assembly or Government shall be subject to the
requests made by the SBV's Office. Commendations and rewards granted to
individuals under the control of Ministries, central committees, sectors or
associations; foreigners that worked or are working in Vietnam, or Vietnamese
citizens working abroad, shall be subject to the requests of Heads of
Departments, Administrations, Authorities and SBV’s affiliates with which they
have direct work relationships. Commendations and rewards granted to Comrades
holding office as Leaders of the Party’s provincial or city committees,
People’s Councils and People's Committees of provinces and centrally-affiliated
cities, and other individuals working at localities, who prove their great
devotion to the banking sector, shall be requested by Directors of SBV branches
in cities or provinces. In some special cases, the Department of Emulation,
Commendation and Rewarding shall make recommendations about nominees for
commendations and rewards, and then requesting the Governor to issue his decision.
c) As for nominees specified in Point a and b of
this clause, the Department of Emulation, Commendation and Rewarding shall be
responsible for verifying submitted documents and submitting them to the first
Vice Chair of the Banking-sector Emulation, Commendation and Rewarding Board to
consult with them before seeking the Governor’s decision.
15. SBV’s branches in cities and provinces shall
consider rewarding or requesting the Governor to issue his decision on thematic
or sudden commendations or commemorative medals to teams and individuals under
the control of people's credit funds within their remit.
16. SBV’s branches in cities or provinces where
microfinance institution's head offices are located shall consider commending
or requesting competent authorities to commend or reward teams and individuals
under the control of microfinance institutions.
Article 27. Documentation principles

2. If a participating unit owing obligations to
make payment to the state budget and carrying out insurance policies for
employees wishes to request commendation or reward to a team or individual that
is the Head of a unit and the Director of a credit institution's branch,
request documentation for commendations and rewards must be certified in
writing by a competent authority. Especially emulative titles and other
commendation or reward falling within the Governor’s jurisdiction, the Head of
the unit responsible for certifying the aforesaid information in an achievement
report (written document stating tax and insurance obligation discharge
archived at this unit).
3. If a credit institution or enterprise under the
SBV’s control (legal person) wishes to request commendation, they must obtain
audit conclusion given during the commendation requesting period (with respect
to commendations or rewards falling within the Governor’s jurisdiction, audit
conclusions given during the corresponding time of consideration of emulative
titles, commendations or rewards; as for state-level commendations and rewards,
these audit conclusions must be given 5 years promptly before the commendation
date).
Article 28. Request documentation for emulative
titles
1. Emulative titles, commendations or rewards
falling within the remit of Heads of units or granted under the authority
delegated by SBV’s Governor shall be implemented by authorized Heads of
participating units under the provisions of the 2003 Law on Emulation,
Commendation and Rewarding (already amended or supplemented), the Decree No.
91/2017/ND-CP and this Circular.
2. Request documentation for consideration of
conferment of “Winner of Grassroots-level Honourable Title” shall include:
a) Written request form for recognition of the
title of “Winner of Grassroots-level Honourable Title";
b) Summary report on individual’s achievements;
c) Request form for recognition of innovations
(form No. 09 enclosed herewith) or decision on recognition of scientific
researches;
d) Minutes, enclosing results of the secret ballot
conducted by the unit’s Emulation, Commendation and Rewarding Board in which the
nominee has to win at least 70% of the vote cast by members of the Board (if
any member is absent, written opinions will be collected).

Board (if any member is absent, written opinions will be collected).

b) Report on achievements of teams and individuals
certified by the requesting unit. With respect to the request for conferment of

8. Request documentation for conferment of
commendation and rewarding attributed to service period shall comprise:
a) With regard to the nominated officer who has
retired or has passed away:
i) Request form made by the Head of the
participating unit (if the nominated officer is the SBV’s Leader, the
Department of Organization and Personnel shall be responsible for submitting
request documentation), enclosing the list of nominated individuals (using the
form No. 02 hereto attached);
ii) 04 copies of the report on achievements of
individuals certified by the requesting unit. If the dead officer meets
commendation and rewarding standards, the participating unit shall actively
collaborate with the Department of Organization and Personnel in making a
report on achievements for submission to request commendations and rewards
(using the form No. 16 hereto attached).
b) With regard to officers who are about to retire
i) Request form made by the Head of the
participating unit (if the nominated officer is the SBV’s Leader, the Department
of Organization and Personnel shall be responsible for submitting request
documentation), enclosing the list of nominated individuals (using the form No.
02 hereto attached);

iii) Minutes of the meeting of the Emulation,
Commendation and Rewarding Board (except in case of grant of commendations or
rewards to the SBV’s Leadership).
9. Request documentation for conferring
commendation or reward upon non-banking teams or individuals shall include:
a) Request form for commendation or rewarding by
the Head of the participating unit having direct relationship with teams or
individuals, enclosing the list of nominated teams and individuals (using the
form No. 02 attached hereto);
b) Report on achievements of nominated teams and
individuals helpful to the banking sector with certification given by the
requesting unit (using the form No. 12 and 13 attached hereto).
10. Request documentation for conferring
commemorative medals upon nominees shall be comprised of the followings:
a) With regard to banking officers
i) Request form for commendation or rewarding by
the Head of the participating unit, enclosing the list of nominated individuals
(using the form No. 03 attached hereto);
ii) Work experience declaration form of each
individual. As Joint Stock Commercial Bank for Foreign Trade of Vietnam,
Vietnam Joint Stock Commercial Bank for Industry and Trade, Joint Stock
Commercial Bank for Investment and Development of Vietnam, Vietnam Bank for
Agriculture and Rural Development, Vietnam Bank for Social Policies,
Co-operative Bank of Viet Nam, Deposit Insurance of Vietnam and people's credit
funds shall not need to submit individual’s work experience declaration forms
to SBV, the requesting unit shall be responsible for storing and archiving
these forms (by using the form No. 04 attached hereto);
iii) Requesting unit’s list of nominees (using the
form No. 05 hereto attached).

Article 30. Application
deadline and duration
1. Yearly commendation and rewarding
a) The deadline for application for emulative
titles, commendations or rewards under the Governor’s authority shall be
earlier than February 28 each year. Teams and individuals involved in training
activities shall submit their application before August 15 each year; in
particular, the deadline for submission of application for the commemorative
medal of "For the prosperous career of Vietnamese Banks” shall be earlier
than February 28 each year.
b) Deadline and frequency of consideration of
conferment of emulative titles, commendations or rewards at the state level:
i) The deadline for submission of application for conferment
of the title of “Government’s Honourable Flag” shall be earlier than 28
February each year;
ii) The deadline for submission of application for
conferment of “Winner of National Honourable Title”, “Prime Minister’s
Certificate of Merit”, Honourable Orders and Medals of all kinds and ranks
shall be earlier than March 15 each year;
iii) The deadline for submission of application by
training team and individuals shall be earlier than August 15 each year;

v) The deadline or frequency of consideration of
conferment of “People’s Teacher”, “Teacher of Merit” or “Ho Chi Minh Prize”
shall be subject to regulations of competent authorities.
c) The deadline for application for emulative
titles, commendations or rewards under the authority of Heads of participating
units shall be regulated under the authority delegated to the Heads of
participating units.
2. Application for sudden commendations and rewards
shall be received promptly after nominated teams and individuals make sudden
praiseworthy achievements.
3. Application for thematic commendations and
rewards shall be received promptly after end of each program or task.
4. Application for commendation and rewarding
attributed to service period shall be submitted 6 months before a nominated
officer retires. In order to be commended or rewarded, a retired officer must
submit his/her application before March 15 each year.
5. Application for commendations or rewards
according to standards specified in point d of clause 1 of Article 18 herein
shall be submitted at least 6 months before the nominee’s retirement. In order
to be commended or rewarded, a retired officer must submit his/her application
before March 15 each year.
Article 31. “SBV’s
Honourable Flag” quantity
1. On an annual basis, SBV’s Governor shall confer
"SBV's Honourable Flag" upon Departments, Administrations,
Authorities, units at the SBV’s headquarter or enterprises under the SBV’s
control recognized as excellent units leading emulation campaigns in specific
emulative Clusters. Division into units belonging to specific emulative
Clusters shall be subject to the Governor’s decisions. Each year, the Governor
shall grant Honourable Flags to units under the control of Bank Supervision and
Inspection Agency that are recognized as excellent units leading emulation
campaigns.
2. On an annual basis, the Governor shall grant
Honourable Flags to SBV branches in cities and provinces that are recognized as
excellent units leading emulation campaigns in specific emulative Groups.
Division into units belonging to specific emulative Groups shall be subject to
the Governor’s decisions.

4. On an annual basis, the Governor shall grant
Honourable Flags to training teams recognized as excellent units leading
emulation campaigns.
5. Teams qualified for receipt of Honourable Flags
shall include large teams specified in Article 3 herein; Departments,
Administrations, Authorities, Office of the Bank Supervision and Inspection
Agency; branches and subsidiaries of credit institutions; branches of Deposit
Insurance of Vietnam; campuses affiliated to training teams.
Chapter VI
EMULATION AND REWARDING FUNDS; RIGHTS AND OBLIGATIONS
OF HONOURED TEAMS AND INDIVIDUALS; STATE MANAGEMENT OF EMULATION AND REWARDING
ACTIVITIES
Section 1. EMULATION AND REWARDING FUNDS
Article 32. Emulation and
rewarding funds
Funding, set-aside amount and management and use of
the emulation and rewarding fund shall be subject to regulations laid down in
Article 65, 66 and 67 in the Decree No. 91/2017/ND-CP and other instructional
documents.
Article 33. Principles of
calculation of reward sums and responsibility for payment of reward sums
1. Principles of calculation of reward sums shall
be subject to regulations laid down in Article 68 in the Decree No.
91/2017/ND-CP.

a) With regard to teams and individuals rewarded by
the Prime Minister or the President:
i) SBV shall be responsible for paying reward sums
to teams and individuals under its control (except public service providers);
ii) Units controlling honoured teams or individuals
shall be responsible for paying reward sums to teams or individuals under the
control of credit institutions, foreign bank branches, Deposit Insurance of
Vietnam, public service providers, standing entities of associations and
enterprises under the SBV’s management;
b) With regard to teams and individuals rewarded by
SBV’s Governor:
i) Reward sums derived from the SBV’s emulation and
rewarding fund shall be paid to honoured teams or individuals under the SBV’s
control (except public service providers), and non-banking teams and
individuals;
ii) Reward sums paid to teams or individuals under
the control of credit institutions, foreign bank branches, Deposit Insurance of
Vietnam, public service providers, standing entities of associations and
enterprises under the SBV’s management shall be derived from emulation and
rewarding funds of respective units;
c) Reward sums paid to teams and individuals
honoured by Directors of SBV branches in cities and provinces shall be derived
from SBV’s emulation and rewarding funds of branches in cities or provinces
(except teams and individuals under the control of credit institutions);
d) Reward sums paid to teams or individuals under
the control of credit institutions, foreign bank branches, Deposit Insurance of
Vietnam, public service providers, standing entities of associations and enterprises
under the SBV’s management that are commended and rewarded by Heads of units
shall be derived from emulation and rewarding funds of these units.
3. Reward sums associated with emulative titles and
other commendations or rewards shall be subject to regulations laid down in
Article 69 through Article 74 in the Decree No. 91/2017/ND-CP and other
instructional documents.

Article 34. Rights and
obligations of teams and individuals involved in commendation and rewarding
activities
1. Rights and obligations of teams and individuals
involved in commendation and rewarding activities
a) Have the right to participate in emulation
campaigns launched by the State, SBV, entities or units;
b) Have the right to request consideration of
conferment of emulative titles, commendations and other rewards prescribed in
laws;
c) Have the right to contribute opinions or request
competent authorities to consider granting emulative titles, commendations or
other rewards to teams and individuals making adequate achievements and meeting
standards prescribed in laws and vice versa;
d) Each year, honoured individuals may be given
opportunities to get their pay promotion before due dates or priority to be
sent to take domestic or overseas training and career development courses or
field trips; may have access to post planning, appointment and reappointment
benefits.
2. Obligations of teams and individuals involved in
commendation and rewarding activities
a) Strictly comply with regulations of the State,
SBV, entities or units when carrying out emulation, commendation and rewarding
activities;
b) Honoured teams and individuals shall be obliged
to take good care of rewarded items without lending them for the sake of
performing illegal acts.

d) Take responsibility for recommending individuals
with outstanding achievements, those acting as good examples with good
behavioral conducts or progressive examples who deserve commendations or
rewards, or reporting or accusing any team or individual performing fraudulent
acts or committing violations against laws on emulation, commendation and
rewarding.
Section 3. STATE MANAGEMENT OF EMULATION,
COMMENDATION AND REWARDING
Article 35. Communication
and dissemination of progressive examples
1. Department of Emulation, Commendation and
Rewarding shall counsel the Governor to plan and carry out communication and
education of patriotic emulation ideologies of President Ho Chi Minh,
guidelines and policies of the Party and laws of the State on emulation,
commendation and rewarding activities; praise, honour and diversify progressive
examples participating in emulation campaigns taking place within the entire
banking sector.
2. Banking-sector units shall plan and carry out
communication and multiplication of progressive examples, good examples with
good conduct and work, choose teams and individuals with outstanding
achievements made upon participation in emulation campaigns in order to praise,
honour, commend them or nominate them for awards.
Article 36. Training and
education
Department of Emulation, Commendation and Rewarding
shall set the schedule of training and educational courses in professional or
other skills for officers in charge of emulation, commendation and rewarding
activities of large teams referred to in Article 3 herein. Large teams shall
have the burden of planning and organizing training courses in emulation,
commendation and rewarding activities for small and basic teams under their
control, depending on specific requirements and conditions.
Article 37. Inspection of emulation,
commendation and rewarding activities
1. Department of Emulation, Commendation and
Rewarding shall be responsible for inspecting emulation, commendation and
rewarding activities performed by units in the entire banking sector.

2. Units shall be authorized to establish their own
emulation, commendation and rewarding boards, and innovation boards.

1. Chair: SBV’s Governor.
2. First Vice Chair: Deputy Governor in charge of emulation,
commendation and rewarding activities in the banking sector.
3. Standing Vice Chair: Director of the Emulation,

5. Secretary: Administrative officer of the

Article 40. Composition of
the Emulation, Commendation and Rewarding Boards at SBV-affiliated units
1. Chair: Head of a unit.

3. Members: Representative of the Party’s Committee
(Subcommittee), the Chair of Trade Union and other members who are key officers
of units under decisions issued by Heads of units according to the principles
under which total number of Board members (including Chair, Vice Chair and
other members) does not exceed 9 persons. As for Bank Supervision and
Inspection Agency, total number of Board members shall not be greater than 13
persons and the Chief of the Bank Supervision and Inspection Agency shall
decide establishment of Emulation, Commendation and Rewarding Boards at
Departments, Administrations, Authorities or affiliates.
4. Secretary: An officer in charge of emulation,
commendation and rewarding activities
Article 41. Composition of Emulation,
Commendation and Rewarding Boards at credit institutions, foreign bank
branches, Deposit Insurance of Vietnam and enterprises under the SBV’s control
1. Chair: President of Governing Board or Chair of
Board of Directors. In particular, with respect to Vietnam Bank for Social
Policies, the Board’s Chair is the Bank’s Director General; with respect to
foreign bank branches, the Board’s Chair is the Director General (Director) of
one of these branches.
2. Vice Chair: Director General (Director). In
particular, with respect to Vietnam Bank for Social Policies and foreign bank
branches, the Board’s Vice Chair is Deputy Director General (Deputy Director)
of one of these entities.

Rewarding shall be responsible for managing application documentation or other
materials related to emulative titles, commendations and rewards under the
authority of the Governor or higher-level officeholders.
2. Units shall be responsible for managing and
safekeeping documentation relating emulation, commendation or rewarding
activities in accordance with regulations in force.
Article 47. Notification
of commendation and rewarding results
Each year, Department of Emulation, Commendation
and Rewarding shall be responsible for informing results of processing of
application documentation to requesting units.
Chapter IX
IMPLEMENTATION
PROVISIONS
Article 48. Reporting of
emulation, commendation and rewarding activities
1. By end of an operating year, units shall prepare
written review and assessment reports on emulation, commendation and rewarding
activities for submission to SBV (via Department of Emulation, Commendation and
Rewarding) by the deadline which falls on February 15 of the following year.
Banking Academy and Banking University of Ho Chi Minh city shall have to submit
these reports by August 15 each year. The full texts of these reports shall be
made by using the sample No. 29 hereto attached.
2. When launching an emulation campaign, a unit
must be responsible for announcing the launch of such campaign and sending
review reports after completion of such campaign to the SBV (via Department of
Emulation, Commendation and Rewarding) for supervisory purposes and for use as
a basis for consideration of commendations or rewards.

Article 49.
Responsibilities of units
1. Department of Emulation, Commendation and
Rewarding shall be responsible for recommending the Governor to issue decisions
on:
a) Maximum ratio of bad debts used as a basis for
considering grant of commendations and rewards to credit institutions, branches
of credit institutions, foreign bank branches, individuals holding posts as
managers or leaders of credit institutions, and Directors General (Directors)
of foreign bank branches;
b) Quantity of Honourable Flags specific to
emulative Clusters and Groups and units;
c) Ratio of "Excellent Labor Team” title
conferred upon units.
2. Bank Supervision and Inspection Agency shall be
responsible for providing information necessary for consideration of
commendation and rewarding by using the form No. 22 hereto attached for credit
institutions, foreign bank branches and individuals holding posts as managers
or leaders of credit institutions, Directors General (Directors) of foreign
bank branches that recommend nominees for commendations or rewards under the
authority of the Governor or state-level commendations or rewards.
3. SBV branches in cities or provinces shall be
responsible for providing information necessary for consideration of
commendation and rewarding by using the form No. 22 hereto attached for teams
of credit institutions and individuals holding posts as Directors or Vice
Directors of branches of credit institutions that recommend nominees for
commendations or rewards under the authority of the Governor or state-level
commendations or rewards.
4. Departments, Administrations, Authorities or
units concerned in the banking sector shall be responsible for providing
information necessary for consideration of commendations or rewards for teams
or individuals of SBV, Deposit Insurance of Vietnam, Training Teams and
Standing Entities of Associations and enterprises under the SBV’s authority.
5. Communications Department shall be responsible
for publicly posting information on the SBV’s portal about teams and
individuals nominated for Orders of all kinds, ranks, state-level honourable
titles and “Winner of National Honourable Title”.

7. Heads of units specified in point a of clauses
2, 3, 4 and 5 of Article 3 herein shall be responsible for providing
instructions about emulation, commendation and rewarding activities to ensure
that these activities are corresponding to business scale and conditions of
each unit.
Article 50. Entry into force
This Circular shall enter into force from December
16, 2019, replacing the Circular No. 08/2018/TT-NHNN dated March 30, 2018 of
the SBV’s Governor, providing instructions about emulation, commendation and
rewarding activities in the banking sector.
Article 51. Enforcement
Chief of the Office, Heads of SBV’s affiliates,
Presidents of Governing Boards, Chairs of Boards of Directors and Directors
General (Directors) of credit institutions, foreign bank branches, Deposit
Insurance of Vietnam, enterprises under the SBV’s authority, and Secretaries
General of associations under the SBV’s management, shall be responsible for
enforcing this Circular./.
