QUYẾT ĐỊNH

CỦA BỘ TRƯỞNG BỘ TÀI CHÍNH SỐ 22/2000/QĐ-BTC NGÀY 21 THÁNG 2 NĂM 2000 BAN HÀNH MỨC THU PHÍ,LỆ PHÍ BẢO VỆ VÀ KIỂM DỊCH THỰC VẬT

Căn cứ Nghị định số 15/CP ngày 2/3/1993 của Chính phủ về nhiệm vụ, quyền hạn và trách nhiệm quản lý của Bộ, cơ quan ngang Bộ;
Căn cứ Nghị định số 178/CP ngày 28/10/1994 của Chính phủ về nhiệm vụ, quyền hạn và tổ chức bộ máy của Bộ Tài chính;
Căn cứ Nghị định số 04/1999/NĐ-CP ngày 30/1/1999 của Chính phủ về phí, lệ phí thuộc Ngân sách Nhà nước;
Căn cứ Điều 13, Điều 14 Quy định về hệ thống tổ chức, thanh tra chuyên ngành, giải quyết tranh chấp và lệ phí, phí tổn về công tác bảo vệ và kiểm dịch thực vật ban hành kèm theo Nghị định số 92/CP ngày 27/11/1993 của Chính phủ về hướng dẫn thi hành Pháp lệnh Bảo vệ và Kiểm dịch thực vật;
Sau khi thống nhất với Bộ Nông nghiệp và Phát triển nông thôn và theo đề nghị của Tổng cục trưởng Tổng cục Thuế,

QUYẾT ĐỊNH:

Điều 1.- Ban hành kèm theo Quyết định này Biểu mức thu phí, lệ phí bảo vệ và kiểm dịch thực vật.

Phí, lệ phí bảo vệ và kiểm dịch thực vật thu bằng tiền Việt Nam. Trường hợp mức thu quy định bằng Đô la Mỹ (USD) thì quy đổi từ USD ra tiền Việt Nam theo tỷ giá do Ngân hàng nhà nước Việt Nam công bố tại thời điểm thu tiền; Nếu tổ chức, cá nhân nước ngoài có nhu cầu nộp phí, lệ phí bằng ngoại tệ thì thu bằng USD theo mức thu quy định.

Điều 2.- Đối tượng nộp phí, lệ phí bảo vệ và kiểm dịch thực vật theo mức thu quy định tại Điều 1 Quyết định này là các tổ chức, cá nhân được cơ quan nhà nước có thẩm quyền thực hiện bảo vệ và kiểm dịch thực vật theo quy định của pháp luật, trừ các trường hợp không phải nộp phí, lệ phí sau đây:

1. Kiểm dịch sản phẩm thực vật xách tay sử dụng trong thời gian đi đường.

2. Kiểm dịch bó hoa, vòng hoa theo nghi thức ngoại giao khi xuất nhập cảnh.

3. Kiểm dịch lô giống cây trồng có khối lượng nhỏ dùng cho nghiên cứu, trao đổi khoa học kỹ thuật (không vì mục đích kinh doanh) theo quyết định của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn.

Riêng dịch vụ phòng trừ sinh vật gây hại tài nguyên thực vật tại Hợp tác xã theo Luật Hợp tác xã sẽ có quy định riêng.

Điều 3.- Cơ quan thu phí, lệ phí bảo vệ và kiểm dịch thực vật được trích tiền phí, lệ phí thu được trước khi nộp vào Ngân sách Nhà nước để phục vụ hoạt động bảo vệ, kiểm dịch thực vật và việc tổ chức thu phí, lệ phí theo dự toán được cấp có thẩm quyền phê duyệt sau khi có ý kiến thống nhất bằng văn bản của cơ quan tài chính cùng cấp, nhưng mức trích tối đa không quá 80% (tám mươi phần trăm) số tiền phí, lệ phí thu được; số tiền còn lại (tối thiểu 20%) phải nộp vào ngân sách nhà nước.

Cơ quan thu phí, lệ phí bảo vệ và kiểm dịch thực vật có trách nhiệm tổ chức thu, kê khai thu, nộp, quản lý sử dụng và quyết toán phí, lệ phí bảo vệ và kiểm dịch thực vật theo đúng quy định tại Thông tư số 54/1999/TT-BTC ngày 10/5/1999 của Bộ Tài chính hướng dẫn thực hiện Nghị định số 04/1999/NĐ-CP ngày 30/1/1999 của Chính phủ về phí, lệ phí thuộc Ngân sách Nhà nước.

Điều 4.- Quyết định này có hiệu lực thi hành sau 15 ngày kể từ ngày ký. Bãi bỏ các quy định về phí, lệ phí bảo vệ và kiểm dịch thực vật trái với Quyết định này.

Điều 5.- Tổ chức, cá nhân thuộc đối tượng nộp phí, lệ phí bảo vệ và kiểm dịch thực vật, đơn vị được giao nhiệm vụ tổ chức thu phí, lệ phí bảo vệ và kiểm dịch thực vật và các cơ quan liên quan chịu trách nhiệm thi hành Quyết định này.

2. Cấp giấy phép hành nghề khử trùng:

Giấy phép hành nghề khử trùng có thời hạn là 5 năm. Khi giấy phép hết hạn, cấp lại giấy mới thì thu bằng 50% mức thu lần đầu.

II. PHÍ KIỂM ĐỊNH THUỐC BẢO VỆ THỰC VẬT VÀ KIỂM DỊCH THỰC VẬT:

1. Kiểm định thuốc bảo vệ thực vật (BVTV):

Lô hàng giống dùng cho nghiên cứu khoa học kỹ thuật được miễn bao gồm những trường hợp sau: Ê 01 kg (hạt giống), Ê 10 cá thể (cành ghép, mắt ghép, hom giống, củ giống) đối với 1 chủng loại giống cho một lần nhập, xuất khẩu.

Đặc biệt đối với lô hàng có khối lượng nhỏ Ê 0,1 kg (hạt giống), Ê 10 cá thể (cành ghép, mắt ghép, hom giống, củ giống bao gồm nhiều chủng loại giống khác nhau được tính phí KDTV tương đương với phí KDTV của 1 lô hàng.

- Chi phí cho việc đi đến địa điểm lấy mẫu, kiểm tra vật thể thuộc diện KDTV thì phí kiểm dịch được cộng thêm theo thực chi hợp lý.

- Phân tích, giám định chỉ tiêu nào thì thu phí theo chỉ tiêu đó.

- Gieo trồng theo dõi, kiểm tra, kiểm dịch giống cây trồng nhập khẩu trong vườn ươm một loại giống theo thực chi.

c- Lô hàng có khối lượng trên 500 (tấn, m^3) được phân lô theo hầm tầu, kho để kiểm dịch và tính phí kiểm dịch, hoặc cộng thêm phí kiểm dịch phần còn lại (phí giấy tờ đối với cả lô hàng không đổi) với phí kiểm dịch của lô 500 (tấn, m^3).

d- Tổ chức, cá nhân nước ngoài và người Việt Nam định cư ở nước ngoài (trừ doanh nghiệp có vốn đầu tư nước ngoài tại Việt Nam) thu thêm 100% mức thu theo phụ lục này.

e- Phí giám sát việc kiểm tra xử lý khử trùng vật thể thuộc diện kiểm dịch thực vật được tính bằng 30% mức thu theo phụ lục này.

DECISION

ISSUING THE CHARGE AND FEE RATES FOR PLANT PROTECTION AND QUARANTINE

THE MINISTRY OF FINANCE

Pursuant to the Government’s Decree No. 15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and ministerial-level agencies;
Pursuant to the Government’s Decree No. 178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance;
Pursuant to the Government’s Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget;
Pursuant to Articles 13 and 14 of the Regulation on the organizational system, specialized inspectorate, dispute settlement and fees and costs for the plant protection and quarantine work, issued together with the Government’s Decree No. 92/CP of November 27, 1993 guiding the implementation of the Ordinance on the Plant Protection and Quarantine;
After consulting the Ministry of Agriculture and Rural Development and at the proposal of the General Director of Tax,

DECIDES:

Article 1.- To issue together with this Decision the Table of charge and fee rates for plant protection and quarantine.

Charges and fees for plant protection and quarantine shall be collected in Vietnam currency. Where a charge or fee rate is prescribed in US dollar (USD), it shall be converted into Vietnam currency at the exchange rate announced by the State Bank of Vietnam at the time of collection; if a foreign organization or individual wishes to pay charge or fee in a foreign currency, it/she/he can pay in USD at the prescribed rate.

Article 2.- Payers of charges and fees for plant protection and quarantine at the rates prescribed in Article 1 of this Decision are organizations and individuals that are provided with plant protection and quarantine by competent State agencies according to the provisions of law, except for the following cases which are exempt from charge or fee payment:

2. Quarantine of flower bunches or wreaths according to diplomatic protocol upon entry or exit.

3. Quarantine of plant variety lots of small weight used for scientific and technical research or exchange (for non-business purposes) under decisions of the Minister of Agriculture and Rural Development.

Particularly the service for controlling organisms harmful to plant resources at cooperatives under the Cooperatives Law shall be subject to separate regulations.

Article 3.- The agencies collecting plant protection and quarantine charges and fees are allowed to deduct part of the collected charges and fees before remitting them into the State budget to fund the plant protection and quarantine activities as well as the organization of the charge and fee collection according to their estimates already approved by the competent authorities after having the written consent of the financial agency of the same level, given that the deducted amount must not exceed 80% (eighty per cent) of the collected charges and fees and the remainder (at least 20%) must be remitted into the State budget.

The agencies collecting plant protection and quarantine charges and fees shall have to organize the charge and fee collection, declare, remit, manage the use of, and settle the charges and fees collected in strict compliance with the provisions in the Finance Ministry’s Circular No. 54/1999/TT-BTC of May 10, 1999 guiding the implementation of the Government’s Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget.

Article 4.- This Decision takes effect 15 days after its signing. All regulations on plant protection and quarantine charges and fees contrary to this Decision are now annulled.

Article 5.- Organizations and individuals that have to pay plant protection and quarantine charges and fees, units assigned to organize the collection of plant protection and quarantine charges and fees and related agencies shall have to implement this Decision.

Permits for practicing sterilization have a term of 5 years. When a permit expires and a new permit is granted, a fee equal to 50% of the fee level for first-time granting shall be collected.

Lots of plant strains used for scientific and technical research, which are exempt from fees, include the following cases: ≤ 01 kg (seeds), ≤ 10 specimens (grafts, grafted stems, provines, root strains) for one kind of plant strain upon each import or export.

Particularly for lots weighing ≤ 0.1 kg (seeds), ≤10 specimens ( grafts, grafted stems, root strains) of different kinds of strains shall be subject to a plant quarantine charge equal to that for one whole lot.

- The quarantine charge may also include the actual reasonable expense for traveling to the place of taking samples and inspection of objects subject to plant quarantine.

- Expenses for growing, monitoring, examining and quarantine of imported plants in the nursery for a certain kind of plants are actually paid expenses.

c/ Lots weighing more than 500 (tons, m^3) shall be classified according to lots in ship holds or warehouses for quarantine and calculation of quarantine charge, or apart from the quarantine charge paid for the lot weighing 500 tons, m^3 an additional quarantine charge shall be collected for the amount in excess of 500 (tons, m^3) (the paper charge for the whole lot remains unchanged).

d/ Foreign organizations and individuals and overseas Vietnamese (excluding foreign-invested enterprises in Vietnam) shall have to pay a surcharge equal to 100% of the levels prescribed in this Appendix.

e/ The fee for supervision and inspection of the sterilization of objects subject to plant quarantine shall be equal to 30% of the charge level prescribed in this Appendix.
