NGHỊ ĐỊNH

QUY ĐỊNH CHI TIẾT VÀ HƯỚNG DẪN THI HÀNH MỘT SỐ ĐIỀU CỦA LUẬT HÓA CHẤT

CHÍNH PHỦ

Căn cứ Luật Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;

Căn cứ Luật Hóa chất ngày 21 tháng 11 năm 2007;

Xét đề nghị của Bộ trưởng Bộ Công Thương,

NGHỊ ĐỊNH:

Chương I.

NHỮNG QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Nghị định này quy định chi tiết và hướng dẫn thi hành một số điều của Luật Hóa chất về:

1. Điều kiện sản xuất, kinh doanh và Danh mục hóa chất sản xuất, kinh doanh có điều kiện; Danh mục hóa chất hạn chế sản xuất, kinh doanh; Danh mục hóa chất cấm.

2. Danh mục hóa chất phải xây dựng kế hoạch phòng ngừa, ứng phó sự cố hóa chất; khoảng cách an toàn đối với cơ sở sản xuất, kinh doanh hóa chất nguy hiểm.

3. Danh mục hóa chất phải thực hiện khai báo.

4. Ngưỡng hàm lượng hóa chất nguy hiểm phải xây dựng phiếu an toàn hóa chất.

5. Thông tin về hóa chất.

6. Cơ sở dữ liệu hóa chất và Danh mục hóa chất quốc gia.

7. Trách nhiệm các Bộ, ngành và Ủy ban nhân dân các cấp trong quản lý hoạt động hóa chất.

Điều 2. Đối tượng áp dụng

Nghị định này áp dụng đối với tổ chức, cá nhân tham gia hoạt động hóa chất; tổ chức, cá nhân liên quan đến hoạt động hóa chất trên lãnh thổ nước Cộng hòa xã hội chủ nghĩa Việt Nam.

Điều 3. Giải thích từ ngữ

Trong Nghị định này, các từ ngữ sau đây được hiểu như sau:

1. GHS là tên viết tắt của Hệ thống hài hòa toàn cầu về phân loại và ghi nhãn hóa chất (Globally Harmonized System of Classification and Labelling of Chemicals).

2. Danh mục hóa chất quốc gia là danh mục các hóa chất đang sử dụng tại Việt Nam do Chính phủ ban hành.

3. Cơ sở dữ liệu hóa chất quốc gia là cơ sở dữ liệu thông tin về các loại hóa chất được sản xuất và nhập khẩu vào Việt Nam do Bộ Công Thương lưu trữ, cập nhật.

4. HACCP là tên viết tắt của Hệ thống kiểm soát các điểm tới hạn nhằm quản lý vệ sinh an toàn thực phẩm trong các cơ sở chế biến thực phẩm (Hazard Analysis and Critial Control Points).

Chương II.

DANH MỤC HÓA CHẤT

Điều 4. Danh mục hóa chất sản xuất, kinh doanh có điều kiện, hóa chất hạn chế sản xuất, kinh doanh và hóa chất cấm

1. Ban hành kèm theo Nghị định này các danh mục hóa chất theo quy định tại Điều 14, Điều 15 và Điều 19 của Luật Hóa chất, bao gồm:

a) Danh mục hóa chất sản xuất, kinh doanh có điều kiện (Phụ lục I);

b) Danh mục hóa chất hạn chế sản xuất, kinh doanh (Phụ lục II);

c) Danh mục hóa chất cấm (Phụ lục III).

2. Theo yêu cầu quản lý trong từng thời kỳ, Bộ Công Thương chủ trì, phối hợp các Bộ quản lý ngành, lĩnh vực xem xét, trình Chính phủ sửa đổi, bổ sung Danh mục hóa chất quy định tại khoản 1 Điều này.

3. Bộ trưởng các Bộ quản lý ngành, lĩnh vực có trách nhiệm hướng dẫn việc lập, thẩm định hồ sơ trình Thủ tướng Chính phủ cho phép sản xuất, nhập khẩu, sử dụng hóa chất cấm cho các mục đích đặc biệt phục vụ an ninh, quốc phòng, phòng, chống dịch bệnh và các trường hợp đặc biệt khác.

Điều 5. Danh mục hóa chất nguy hiểm phải xây dựng kế hoạch phòng ngừa, ứng phó sự cố hóa chất

1. Ban hành kèm theo Nghị định này danh mục hóa chất nguy hiểm mà tổ chức, cá nhân hoạt động hóa chất phải xây dựng kế hoạch phòng ngừa, ứng phó sự cố hóa chất theo quy định tại Điều 38 của Luật Hóa chất (Phụ lục IV).

2. Theo yêu cầu quản lý trong từng thời kỳ, Bộ Công Thương chủ trì, phối hợp các Bộ quản lý ngành, lĩnh vực xem xét, trình Chính phủ sửa đổi, bổ sung Danh mục hóa chất quy định tại khoản 1 Điều này.

Điều 6. Danh mục hóa chất phải khai báo

1. Ban hành kèm theo Nghị định này Danh mục hóa chất phải khai báo (Phụ lục V).

2. Theo yêu cầu quản lý trong từng thời kỳ, Bộ Công Thương chủ trì, phối hợp các Bộ quản lý ngành, lĩnh vực xem xét, trình Chính phủ sửa đổi, bổ sung Danh mục hóa chất quy định tại khoản 1 Điều này.

Chương III.

ĐIỀU KIỆN SẢN XUẤT, KINH DOANH HÓA CHẤT HẠN CHẾ SẢN XUẤT, KINH DOANH VÀ SẢN XUẤT KINH DOANH CÓ ĐIỀU KIỆN

Điều 7. Điều kiện sản xuất, kinh doanh hóa chất sản xuất, kinh doanh có điều kiện trong ngành công nghiệp

1. Giám đốc hoặc Phó Giám đốc kỹ thuật của cơ sở sản xuất, kinh doanh hóa chất sản xuất kinh doanh có điều kiện trong công nghiệp phải có bằng đại học các ngành hóa chất.

2. Có cán bộ chuyên trách quản lý an toàn hóa chất, lực lượng ứng phó tại chỗ và các trang thiết bị phòng ngừa, ứng phó sự cố hóa chất phù hợp với quy mô và đặc tính hóa chất; có Giấy chứng nhận đăng ký sử dụng hóa chất độc hại có yêu cầu đặc thù chuyên ngành công nghiệp theo quy định tại Quyết định số 136/2004/QĐ-BCN ngày 19 tháng 11 năm 2004 của Bộ Công nghiệp (nay là Bộ Công Thương).

3. Có đủ trang thiết bị kiểm tra chất lượng hoặc hợp đồng liên kết với đơn vị có đủ năng lực kiểm tra chất lượng được cơ quan có thẩm quyền thừa nhận để kiểm tra chất lượng hóa chất, sản phẩm hóa chất công nghiệp đảm bảo tiêu chuẩn được cơ quan có thẩm quyền quản lý ngành công nghiệp chấp nhận.

4. Có biện pháp quản lý, trang thiết bị an toàn, phòng, chống cháy nổ, phòng, chống rò rỉ phát tán hóa chất và các sự cố hóa chất khác theo quy định của Luật Phòng cháy chữa cháy, Luật Hóa chất và các quy chuẩn kỹ thuật cụ thể khác đối với từng loại hóa chất, thiết bị sử dụng trong cơ sở sản xuất, kinh doanh. Có trang thiết bị kiểm soát, thu gom và xử lý chất thải nguy hại theo quy định của pháp luật về bảo vệ môi trường và áp dụng hệ thống quản lý môi trường theo tiêu chuẩn ISO 14000 trước ngày 31 tháng 12 năm 2010.

5. Bộ Công Thương hướng dẫn thực hiện các quy định tại Điều này.

Điều 8. Điều kiện sản xuất, kinh doanh hóa chất sản xuất, kinh doanh có điều kiện trong ngành y tế

1. Giám đốc hoặc Phó giám đốc kỹ thuật của cơ sở sản xuất, kinh doanh hóa chất sản xuất, kinh doanh có điều kiện trong ngành y tế phải có trình độ chuyên môn và được cấp chứng chỉ hành nghề phù hợp với hình thức kinh doanh.

2. Cơ sở vật chất, kỹ thuật và nhân sự của cơ sở sản xuất phải đáp ứng các yêu cầu đạt tiêu chuẩn về Thực hành tốt sản xuất, kinh doanh thuốc theo lộ trình triển khai áp dụng các tiêu chuẩn thực hành tốt nêu tại Nghị định số 79/2006/NĐ-CP ngày 09 tháng 8 năm 2006 của Chính phủ quy định chi tiết thi hành một số điều của Luật Dược.

3. Cơ sở sản xuất hóa chất sản xuất, kinh doanh có điều kiện trong ngành y tế phải có đủ trang thiết bị kiểm tra chất lượng hoặc hợp đồng liên kết với đơn vị có đủ năng lực kiểm tra chất lượng để kiểm tra chất lượng hóa chất, sản phẩm hóa chất ngành y tế đảm bảo tiêu chuẩn dược điển và các tiêu chuẩn khác được cơ quan có thẩm quyền ngành y tế chấp nhận.

4. Có biện pháp quản lý, trang thiết bị an toàn, phòng, chống cháy nổ, phòng, chống rò rỉ phát tán hóa chất và các sự cố hóa chất khác theo quy định của Luật Phòng cháy chữa cháy, Luật Hóa chất và các quy chuẩn kỹ thuật cụ thể khác đối với từng loại hóa chất, thiết bị sử dụng trong cơ sở sản xuất, kinh doanh.

5. Cơ sở mua bán hóa chất và sản phẩm hóa chất hóa chất sản xuất, kinh doanh có điều kiện ngành y tế phải có đủ cơ sở vật chất và năng lực con người đáp ứng các quy định của pháp luật về dược.

6. Bộ Y tế hướng dẫn thực hiện các quy định tại Điều này.

Điều 9. Điều kiện sản xuất, kinh doanh hóa chất sản xuất, kinh doanh có điều kiện trong ngành thực phẩm

1. Giám đốc hoặc Phó Giám đốc kỹ thuật của cơ sở sản xuất, kinh doanh hóa chất sản xuất kinh doanh có điều kiện trong ngành thực phẩm phải có bằng đại học các ngành hóa thực phẩm, dược, y tế.

2. Cơ sở vật chất, kỹ thuật và nhân sự của cơ sở sản xuất, kinh doanh hóa chất, sản phẩm hóa chất trong ngành thực phẩm phải đạt tiêu chuẩn HACCP.

3. Có đủ trang thiết bị kiểm tra chất lượng hoặc hợp đồng liên kết với đơn vị có đủ năng lực kiểm tra chất lượng được cơ quan có thẩm quyền thừa nhận để kiểm tra chất lượng hóa chất, sản phẩm hóa chất ngành thực phẩm đảm bảo tiêu chuẩn được cơ quan có thẩm quyền ngành y tế chấp nhận đối với từng lô sản phẩm xuất xưởng.

4. Có biện pháp quản lý, trang thiết bị an toàn, phòng, chống cháy nổ, phòng, chống rò rỉ phát tán hóa chất và các sự cố hóa chất khác theo quy định của Luật Phòng cháy chữa cháy, Luật Hóa chất và các quy chuẩn kỹ thuật an toàn cụ thể khác đối với từng loại hóa chất nguy hiểm, thiết bị sử dụng trong cơ sở sản xuất, kinh doanh.

5. Bộ Y tế hướng dẫn thực hiện các quy định tại Điều này.

Điều 10. Điều kiện sản xuất, kinh doanh hóa chất sản xuất, kinh doanh có điều kiện trong ngành hóa chất bảo vệ thực vật

1. Giám đốc hoặc Phó Giám đốc kỹ thuật của cơ sở sản xuất (bao gồm cả sang chai, đóng gói) hóa chất sản xuất kinh doanh có điều kiện trong ngành bảo vệ thực vật phải có bằng đại học các ngành hóa chất, nông nghiệp và được cấp chứng chỉ hành nghề theo quy định tại Điều lệ quản lý thuốc bảo vệ thực vật ban hành kèm theo Nghị định số 58/2002/NĐ-CP ngày 03 tháng 6 năm 2002 của Chính phủ.

2. Cơ sở vật chất, kỹ thuật và nhân sự của cơ sở sản xuất hóa chất, sản phẩm hóa chất sản xuất, kinh doanh có điều kiện trong ngành bảo vệ thực vật phải đáp ứng các quy định tại Chương II Điều lệ quản lý thuốc bảo vệ thực vật ban hành kèm theo Nghị định số 58/2002/NĐ-CP ngày 03 tháng 6 năm 2002 của Chính phủ.

3. Có đủ trang thiết bị kiểm tra chất lượng hoặc hợp đồng liên kết với đơn vị có đủ năng lực kiểm tra chất lượng được cơ quan có thẩm quyền thừa nhận để kiểm tra chất lượng hóa chất, sản phẩm hóa chất ngành thực phẩm đảm bảo tiêu chuẩn được cơ quan có thẩm quyền ngành nông nghiệp chấp nhận đối với mỗi lô sản phẩm xuất xưởng.

4. Có biện pháp quản lý, trang thiết bị an toàn, phòng, chống cháy nổ, phòng, chống rò rỉ phát tán hóa chất và các sự cố hóa chất khác theo quy định của Luật Phòng cháy chữa cháy, Luật Hóa chất và các quy chuẩn kỹ thuật an toàn cụ thể khác đối với từng loại hóa chất nguy hiểm, thiết bị sử dụng trong cơ sở sản xuất, kinh doanh. Có trang thiết bị kiểm soát, thu gom và xử lý chất thải nguy hại theo quy định của pháp luật về bảo vệ môi trường và áp dụng hệ thống quản lý môi trường theo tiêu chuẩn ISO 14000 trước ngày 31 tháng 12 năm 2010.

5. Tổ chức, cá nhân mua bán hóa chất sản xuất, kinh doanh có điều kiện trong ngành bảo vệ thực vật phải có Chứng chỉ hành nghề và các điều kiện cơ sở vật chất kỹ thuật theo quy định tại Nghị định số 58/2002/NĐ-CP ngày 03 tháng 6 năm 2002 của Chính phủ.

6. Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn thực hiện các quy định tại Điều này.

Điều 11. Điều kiện sản xuất, kinh doanh hóa chất sản xuất, kinh doanh có điều kiện ngành hóa chất thú y.

1. Giám đốc hoặc Phó Giám đốc kỹ thuật của cơ sở sản xuất hóa chất sản xuất kinh doanh có điều kiện trong ngành thú y phải có bằng đại học các ngành hóa chất, nông nghiệp, dược phẩm.

2. Có đăng ký kinh doanh thuốc thú y, chế phẩm sinh học, vi sinh vật, hóa chất dùng trong thú y.

3. Có địa điểm, cơ sở vật chất, kỹ thuật để sản xuất, bảo quản đạt tiêu chuẩn vệ sinh thú y theo quy định tại Nghị định số 33/2005/NĐ-CP ngày 15 tháng 3 năm 2005 quy định chi tiết một số điều của Pháp lệnh Thú y.

4. Có đủ trang thiết bị kiểm tra chất lượng hoặc hợp đồng liên kết với đơn vị có đủ năng lực kiểm tra chất lượng được cơ quan có thẩm quyền thừa nhận để kiểm tra chất lượng hóa chất, sản phẩm hóa chất ngành thú y đảm bảo tiêu chuẩn được cơ quan có thẩm quyền ngành nông nghiệp chấp nhận đối với mỗi lô sản phẩm xuất xưởng.

5. Có biện pháp quản lý, trang thiết bị an toàn, phòng, chống cháy nổ, phòng, chống rò rỉ phát tán hóa chất và các sự cố hóa chất khác theo quy định của Luật Phòng cháy chữa cháy, Luật Hóa chất và các quy chuẩn kỹ thuật cụ thể khác đối với từng loại hóa chất, thiết bị sử dụng trong cơ sở sản xuất, kinh doanh.

6. Tổ chức, cá nhân mua bán hóa chất sản xuất, kinh doanh có điều kiện trong ngành thú y phải có cơ sở vật chất kỹ thuật, đảm bảo tiêu chuẩn vệ sinh thú y theo quy định tại Pháp lệnh Thú y và Nghị định số 33/2005/NĐ-CP ngày 15 tháng 3 năm 2005 quy định chi tiết một số điều của Pháp lệnh Thú y.

7. Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn thực hiện các quy định tại Điều này.

Điều 12. Điều kiện sản xuất, kinh doanh hóa chất hạn chế sản xuất, kinh doanh

Tổ chức, cá nhân sản xuất, kinh doanh hóa chất, sản phẩm hóa chất hạn chế kinh doanh theo các ngành nghề tương ứng ngoài việc đảm bảo các điều kiện đã nêu từ Điều 7 đến Điều 11 Chương này còn phải đảm bảo các điều kiện về quy hoạch; điều kiện hạn chế kinh doanh; các điều kiện về an ninh, quốc phòng hay an toàn, trật tự xã hội khác quy định tại Luật Dược, Luật Phòng, chống ma túy và các văn bản quy phạm pháp luật liên quan.

Chương IV.

KHOẢNG CÁCH AN TOÀN

Điều 13. Trách nhiệm thực hiện thiết lập khoảng cách an toàn

1. Các dự án đầu tư sản xuất, kinh doanh hóa chất thuộc Danh mục quy định tại Phụ lục IV Nghị định này phải thiết lập khoảng cách an toàn từ khu vực sản xuất, cất giữ tới các điểm dân cư, công trình công cộng, di tích lịch sử, văn hóa, danh lam thắng cảnh, khu dự trữ thiên nhiên, vườn quốc gia, khu dự trữ sinh quyển, khu bảo tồn loài – sinh cảnh, khu bảo tồn biển, nguồn nước sinh hoạt.

2. Bộ Công Thương chủ trì, phối hợp với các Bộ quản lý ngành, Ủy ban nhân dân địa phương xử lý các cơ sở sản xuất hóa chất đang tồn tại có các điều kiện về khoảng cách an toàn chưa đảm bảo theo quy định của Nghị định này hoặc khoảng cách an toàn bị vi phạm phải thực hiện thiết lập khoảng cách an toàn trước ngày 31 tháng 12 năm 2010.

Điều 14. Xác định khoảng cách an toàn

1. Tổ chức, cá nhân có cơ sở sản xuất, cất giữ các loại hóa chất nguy hiểm quy định tại Phụ lục IV Nghị định này phải xác định khoảng cách an toàn sao cho tại địa điểm, vị trí cần bảo vệ theo quy định của pháp luật các yếu tố nguy hiểm nằm dưới ngưỡng định lượng.

a) Trường hợp hóa chất nguy hiểm thoát ra từ các sự cố ở dạng hơi, khí độc hoặc tạo thành hơi, khí độc, ngưỡng định lượng là nồng độ chất độc trong không khí (miligam/m^3) mà tại đó người tiếp xúc trong vòng 60 phút không bị ảnh hưởng khó hồi phục hoặc tổn thương đến mức phải sử dụng các phương tiện hoặc hành động bảo vệ tương ứng;

b) Trường hợp hóa chất nguy hiểm thoát ra từ các sự cố ở dạng hơi, khí dễ cháy, nổ hoặc tạo thành hơi, khí dễ cháy; nổ; ngưỡng định lượng là khối lượng chất dễ cháy, nổ trong không khí quy ra phần trăm (%) thể tích hoặc mg/l có giá trị thấp hơn giới hạn dưới của nồng độ cháy hoặc thấp hơn giới hạn nổ dưới;

c) Trường hợp sóng nổ lan truyền từ sự cố hóa chất nguy hiểm, ngưỡng định lượng là mức tăng áp suất không khí do lan truyền sóng nổ gây ra bằng 6,9 kPa.

2. Việc xác định khoảng cách an toàn phải căn cứ vào điều kiện cụ thể về khí tượng thủy văn, địa hình địa vật của nơi đặt cơ sở sản xuất, cất giữ hóa chất nguy hiểm và các điều kiện công nghệ của quá trình sản xuất, cất giữ hóa chất nguy hiểm.

3. Đối với hóa chất vừa có tính nguy hiểm cháy, nổ, vừa có tính độc, khoảng cách an toàn trong trường hợp sự cố được xác định riêng cho từng tính chất nguy hiểm và được lấy giá trị lớn nhất để áp dụng.

4. Trong cơ sở có nhiều loại hóa chất nguy hiểm, khoảng cách an toàn được xác định riêng cho từng loại hóa chất và lấy khoảng cách an toàn lớn nhất để áp dụng.

5. Trong cơ sở có nhiều thiết bị sản xuất, chứa đựng hóa chất nguy hiểm đặt tại các vị trí khác nhau, khoảng cách an toàn được xác định riêng cho từng thiết bị sản xuất, chứa đựng; khoảng cách an toàn áp dụng chung cho toàn bộ cụm thiết bị phải bao gồm khoảng cách an toàn riêng của từng thiết bị sản xuất, chứa đựng hóa chất nguy hiểm.

6. Bộ Công Thương có trách nhiệm xây dựng và ban hành quy chuẩn kỹ thuật về khoảng cách an toàn đối với cơ sở sản xuất kinh doanh hóa chất nguy hiểm quy định tại Phụ lục IV Nghị định này.

Điều 15. Thay đổi khoảng cách an toàn

Khoảng cách an toàn phải được thay đổi phù hợp trong trường hợp sau:

1. Cơ sở sản xuất, cất giữ hóa chất nguy hiểm có sự thay đổi về công nghệ, khối lượng sản xuất, cất giữ hoặc có sự thay đổi bất kỳ dẫn đến thay đổi về khoảng cách an toàn.

2. Số liệu thống kê về sự cố hóa chất nguy hiểm trong vòng 5 năm trở lại đây cho thấy khoảng cách an toàn dự đoán có sự khác biệt lớn so với thực tế.

3. Trường hợp khoảng cách an toàn từ nơi đặt thiết bị đến vị trí, địa điểm cần bảo vệ không đạt yêu cầu về ngưỡng định lượng cho phép, cơ sở sản xuất, cất giữ hóa chất nguy hiểm phải áp dụng các biện pháp để bảo đảm khoảng cách an toàn theo quy định, cụ thể:

a) Giảm khối lượng sản xuất, cất giữ hóa chất nguy hiểm;

b) Bổ sung các biện pháp che chắn hoặc sử dụng các phương tiện giảm nhẹ sự thoát ra của hóa chất nguy hiểm;

c) Thay đổi điều kiện công nghệ sản xuất, cất giữ hóa chất nguy hiểm để có kết quả theo hướng giảm khối lượng, áp suất, nhiệt độ sản xuất, cất giữ hóa chất.

Chương V.

NGƯỠNG HÀM LƯỢNG CHẤT NGUY HIỂM TRONG HỖN HỢP PHẢI XÂY DỰNG PHIẾU AN TOÀN HÓA CHẤT

Điều 16. Phân loại chi tiết hóa chất nguy hiểm theo Hệ thống hài hòa toàn cầu về phân loại và ghi nhãn hóa chất

Hóa chất nguy hiểm theo định nghĩa tại khoản 4 Điều 4 của Luật Hóa chất là các nhóm hóa chất nguy hiểm bao gồm các hóa chất với đặc tính chi tiết như sau:

1. Các chất nổ:

a) Các chất nỗ không bền;

b) Chất nổ loại 1;

c) Chất nổ loại 2;

d) Chất nổ loại 3;

đ) Chất nổ loại 4;

e) Chất nổ loại 5;

g) Chất nổ loại 6;

2. Các khí dễ cháy:

a) Khí dễ cháy loại 1;

b) Khí dễ cháy loại 2;

3. Các sol khí dễ cháy:

a) Sol khí dễ cháy loại 1;

b) Sol khí dễ cháy loại 2;

4. Khí ôxy hóa: khí ôxy hóa loại 1.

5. Các khí nén dưới áp suất:

a) Khí bị nén;

b) Khí hóa lỏng;

c) Khí hóa lỏng làm lạnh;

d) Khí hòa tan.

6. Các chất lỏng dễ cháy:

Điều 17. Ngưỡng hàm lượng chất nguy hiểm trong hỗn hợp chất phải xây dựng phiếu an toàn hóa chất

1. Các hỗn hợp chất có chứa các chất nguy hiểm với hàm lượng theo khối lượng sau đây phải xây dựng phiếu an toàn hóa chất:

2. Bộ Công Thương chủ trì, phối hợp với các Bộ, ngành liên quan hướng dẫn cụ thể việc thực hiện xây dựng phiếu an toàn hóa chất đối với hỗn hợp chất.

Chương VI.

THÔNG TIN HÓA CHẤT

Điều 18. Thủ tục khai báo hóa chất

1. Cơ quan tiếp nhận khai báo

Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương tiếp nhận hồ sơ khai báo đối với các tổ chức, cá nhân sản xuất hóa chất thuộc Danh mục hóa chất phải khai báo thuộc địa bàn quản lý.

Bộ Công Thương tiếp nhận hồ sơ khai báo của các tổ chức, cá nhân nhập khẩu các hóa chất thuộc Danh mục hóa chất phải khai báo.

2. Hồ sơ khai báo

Tổ chức, cá nhân khai báo lập (02) bộ hồ sơ gồm các tài liệu sau:

a) Bản khai báo hóa chất theo mẫu do Bộ Công Thương quy định;

b) Đối với hóa chất là hóa chất nguy hiểm, hồ sơ khai báo phải kèm theo Phiếu an toàn hóa chất Tiếng Việt và bản tiếng nguyên gốc hoặc tiếng Anh.

Trường hợp hóa chất đã được khai báo trước đó, tổ chức, cá nhân hoạt động hóa chất nguy hiểm không phải nộp lại Phiếu an toàn hóa chất.

3. Thời gian khai báo

a) Đối với các tổ chức, cá nhân sản xuất hóa chất thuộc Danh mục hóa chất phải khai báo có trách nhiệm khai báo bằng văn bản đến Sở Công thương trước ngày 31 tháng 01 hàng năm;

b) Tổ chức, cá nhân nhập khẩu hóa chất có trách nhiệm khai báo bằng văn bản đến Bộ Công Thương trong thời gian 15 ngày làm việc, kể từ ngày thông quan hóa chất. Xác nhận đã khai báo hóa chất của Bộ Công Thương là một điều kiện để tổ chức, cá nhân được nhập khẩu hóa chất lần tiếp theo. Bộ Công Thương quy định mẫu phiếu xác nhận khai báo hóa chất nhập khẩu;

c) Sở Công thương lập sổ quản lý khai báo và tổng hợp tình hình, kết quả khai báo về hóa chất của địa phương, định kỳ tháng 3 hàng năm báo cáo Bộ Công Thương.

4. Các trường hợp miễn trừ khai báo

a) Hóa chất được sản xuất, nhập khẩu một lần phục vụ an ninh, quốc phòng, ứng phó các sự cố thiên tai, dịch bệnh khẩn cấp;

b) Hóa chất sản xuất, nhập khẩu dưới 100kg một năm không thuộc Danh mục hóa chất hạn chế sản xuất, kinh doanh và các Danh mục hóa chất được kiểm soát theo công ước quốc tế.

5. Bộ Công Thương chủ trì, phối hợp với các Bộ quản lý ngành xây dựng hệ thống quản lý tiếp nhận thông tin khai báo, báo cáo hóa chất qua mạng điện tử trước ngày 31 tháng 12 năm 2010.

Điều 19. Quy định về bảo mật thông tin

1. Tổ chức, cá nhân hoạt động hóa chất nếu có yêu cầu bảo mật các thông tin không quy định tại khoản 2 Điều 50 của Luật Hóa chất phải có đề nghị bằng văn bản đến cơ quan tiếp nhận khai báo hóa chất và báo cáo hoạt động hóa chất.

2. Những thông tin quan trọng nhằm bảo vệ sức khỏe cộng đồng và môi trường sẽ không được coi là các thông tin bảo mật, bao gồm:

a) Tên thương mại của hóa chất hoặc hỗn hợp hóa chất;

b) Tên của tổ chức, cá nhân sản xuất, nhập khẩu hóa chất; tổ chức, cá nhân báo cáo hoạt động hóa chất theo Điều 43, Điều 52 của Luật Hóa chất;

c) Thông tin trong Phiếu an toàn hóa chất;

d) Các thông tin phục vụ phòng ngừa và ứng phó sự cố hóa chất; ngăn chặn và hạn chế các ảnh hưởng xấu do độc tính của hóa chất; các thông tin cảnh báo khi sử dụng, tiếp xúc với hóa chất và cách xử lý sơ bộ trong trường hợp xảy ra sự cố;

đ) Phương pháp phân tích để xác định khả năng phơi nhiễm đối với con người và môi trường; tóm tắt kết quả thử nghiệm độc tính của hóa chất;

e) Độ tinh khiết của hỗn hợp chất và mức độ nguy hại các phụ gia, tạp chất.

3. Bộ Công Thương xây dựng hướng dẫn chi tiết về quy chế bảo mật thông tin khai báo hóa chất. Cơ quan tiếp nhận khai báo hóa chất, báo cáo hoạt động hóa chất có trách nhiệm bảo mật thông tin.

Điều 20. Xây dựng Danh mục hóa chất quốc gia và Cơ sở dữ liệu hóa chất quốc gia

1. Danh mục hóa chất quốc gia và Cơ sở dữ liệu hóa chất quốc gia nhằm mục đích quản lý an toàn hóa chất và cung cấp thông tin cho hệ thống giải đáp, cung cấp thông tin hóa chất nguy hiểm trong tình huống khẩn cấp.

2. Bộ Công Thương chủ trì, phối hợp các Bộ quản lý ngành, địa phương xây dựng Đề án Điều tra, khảo sát xây dựng Cơ sở dữ liệu hóa chất quốc gia, Danh mục hóa chất quốc gia trình Thủ tướng Chính phủ phê duyệt trước ngày 01 tháng 7 năm 2009.

Chương VII.

TỔ CHỨC THỰC HIỆN VÀ ĐIỀU KHOẢN THI HÀNH

Điều 21. Nhiệm vụ triển khai Luật Hóa chất của các Bộ, ngành

1. Các Bộ, ngành triển khai quản lý hoạt động hóa chất theo phân công tại Luật Hóa chất.

2. Bộ Công Thương chủ trì, phối hợp với các Bộ quản lý ngành, các Ủy ban nhân dân tỉnh, thành phố xây dựng trình Thủ tướng Chính phủ Đề án Cơ sở dữ liệu hóa chất quốc gia, Danh mục hóa chất quốc gia; Đề án Triển khai hoàn chỉnh hệ thống hài hòa toàn cầu về ghi nhãn hóa chất tại Việt Nam; xây dựng hệ thống phòng thí nghiệm đánh giá hóa chất mới tại Việt Nam.

3. Bộ Tài nguyên và Môi trường chủ trì, phối hợp với Bộ Quốc phòng, Bộ quản lý ngành, các Ủy ban nhân dân tỉnh, thành phố xây dựng trình Thủ tướng Chính phủ Đề án Điều tra, thu gom và xử lý hóa chất tồn dư do chiến tranh; Đề án Xây dựng phương án thu gom, xử lý các hóa chất độc tồn dư, hóa chất độc tịch thu hay hóa chất độc không rõ nguồn gốc.

4. Bộ Y tế, Bộ Nông nghiệp và Phát triển nông thôn rà soát, ban hành theo quy định các Danh mục hóa chất không được sử dụng, hạn chế sử dụng và được sử dụng trong các lĩnh vực y tế, hóa chất sử dụng trong chất diệt khuẩn, diệt côn trùng trong gia dụng và y tế, dược phẩm và phụ gia thực phẩm, bảo vệ thực vật, thú y và nuôi trồng thủy sản theo quy định của Luật Hóa chất.

5. Bộ Nông nghiệp và Phát triển nông thôn xây dựng trình Thủ tướng Chính phủ Đề án Xây dựng phiếu an toàn hóa chất đối với toàn bộ thuốc bảo vệ thực vật tại Việt Nam.

6. Bộ Công an, Bộ Quốc phòng xây dựng, ban hành các văn bản quản lý, ban hành danh mục hóa chất không được sử dụng, hóa chất được sử dụng trong lĩnh vực đảm bảo an ninh, quốc phòng; phòng, chống bạo loạn và phòng cháy, chữa cháy.

7. Bộ Công an chủ trì, phối hợp với Bộ quản lý ngành xây dựng trình Thủ tướng Chính phủ Đề án Điều tra, khảo sát và tăng cường năng lực lực lượng phòng cháy, chữa cháy tại các vùng nhằm thực hiện nhiệm vụ phòng ngừa và ứng phó sự cố hóa chất trong các khu vực công nghiệp hóa chất tập trung.

8. Bộ Giao thông vận tải rà soát, bổ sung các văn bản quản lý liên quan đến vận chuyển hóa chất nguy hiểm bằng đường bộ, đường sắt, đường thủy và đường hàng không.

Điều 22. Hiệu lực thi hành

1. Nghị định này có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng Công báo.

2. Nghị định này thay thế các quy định tại Chương I, Chương II, Điều 12, Điều 13, Điều 20 Chương III và Chương IV Nghị định số 68/2005/NĐ-CP ngày 20 tháng 5 năm 2005 của Chính phủ về an toàn hóa chất. Bãi bỏ các quy định trước đây trái với Nghị định này.

Điều 23. Trách nhiệm thi hành

Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương và tổ chức, cá nhân liên quan chịu trách nhiệm thi hành Nghị định này.

1. GHS is an acronym for the Globally Harmonized System of Classification and Labeling of Chemicals.

2. National chemical list means a Government-promulgated list of chemicals presently in use in Vietnam.

3. National chemical database means a database of information on chemicals produced and imported into Vietnam, which is stored and updated by the Ministry of Industry and Trade.

4. HACCP is an acronym for the System of Hazard Analysis and Critical Control Points for management of food hygiene and safety in food processing establishments.

To meet management requirements in each period, the Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with line ministries in, studying and proposing amendments and supplements to the lists of chemicals specified in Clause 1 of this Article to the Government for decision.

3. Line ministers shall guide the compilation and evaluation of dossiers to be submitted to the

Prime Minister for permission for the production, import and use of banned chemicals for special purposes in security, defense, disease and epidemic prevention and control and in other special cases.

Article 5.-The list of hazardous chemicals for which chemical incident prevention and response plans are required

1. Promulgated together with this Decree is a list of hazardous chemicals for which organizations and individuals engaged in chemical activities are required to elaborate chemical incident prevention and response plans as specified in Article 38 of the Chemical Law (Appendix IV).

2. Chapter III

CONDITIONS ON PRODUCTION OR TRADING OF CHEMICALS RESTRICTED FROM PRODUCTION OR TRADING, AND CHEMICALS SUBJECT TO CONDITIONAL PRODUCTION OR TRADING

Article 7.- Conditions on production or trading of chemicals subject to conditional production or trading in the industrial sector

1. Directors or technical deputy directors of establishments producing or trading in chemicals subject to conditional production or trading in the industrial sector must possess university degrees in a chemical discipline.

2. These establishments must have personnel specializing in chemical safety management, chemical incident response forces and prevention and response equipment and facilities suitable to their sizes and characteristics of chemicals; possess registration certificates for use of hazardous chemicals with peculiar requirements in industries under Decision No. 136/2004/QD-BCN of November 19, 2004, of the Ministry of Industry (now the Ministry of Industry and Trade).

3. These establishments must have sufficient quality control equipment and devices or enter into quality control contracts with capable accredited units to inspect the quality of industrial chemicals and chemical products to ensure they are up to standards accepted by agencies competent to manage industries.

4. These establishments shall devise measures to manage and have safety equipment and devices to prevent and fight fire, explosion, chemical leakage and dispersal, and other chemical incidents under the Fire Prevention and Fighting Law, the Chemical Law and other specific technical regulations applicable to each kind of chemical and equipment used in their establishments. They must have equipment and devices to control, collect and dispose of hazardous waste under the law on environmental protection, and apply the environmental management system under ISO 14000 before December 31, 2010.

5. The Ministry of Industry and Trade shall guide the implementation of the provisions of this Article.

1. Directors or technical deputy directors of establishments producing or trading in chemicals subject to conditional production or trading in the healthcare sector must have professional qualifications and practice certificates suitable to business forms of these establishments.

2. Production establishments must have material and technical foundations and personnel satisfying requirements of good medicine manufacturing and trading practices under the roadmap of application of good practices standards specified in the Government's Decree No. 79/ 2006/ND-CP of August 9. 2006, detailing the implementation of a number of articles of the Pharmacy Law.

3. Establishments producing chemicals subject to conditional production or trading in the healthcare sector must have sufficient quality control equipment and devices or enter into quality control contracts with capable units to inspect the quality of medical chemicals and chemical products to ensure they are up to pharmacopoeial standards and other standards accepted by competent health agencies.

4. These establishments shall devise measures to manage and have safety equipment and devices to prevent and fight fire, explosion, chemical leakage and dispersal, and other chemical incidents under the Fire Prevention and Fighting Law, the Chemical Law and other specific technical regulations applicable to each kind of chemical and equipment used in their establishments.

5. Establishments trading in chemicals and chemical products subject to conditional production or trading in the healthcare sector must have sufficient material foundations and manpower as required by the pharmacy law.

6. The Ministry of Health shall guide the implementation of the provisions of this Article.

Article 9.- Conditions on production or trading of chemicals subject to conditional production or trading in the food industry

1. Directors or technical deputy directors of establishments producing or trading in chemicals subject to conditional production or trading in the food industry must possess university degrees in food chemistry, pharmacy or medicine.

1. These establishments must have material and technical foundations and personnel satisfying HACCP standards.

These establishments shall devise measures to manage and have safety equipment and devices to prevent and fight fire, explosion, chemical leakage and emission, and other chemical incidents under the Fire Prevention and Fighting Law, the Chemical Law and other specific technical safety regulations applicable to each kind of hazardous chemical and equipment used their establishments.

4. The Ministry of Health shall guide the implementation of the provisions of this Article.

Article 10.- Conditions on production or trading of chemicals subject to conditional production or trading in the chemical pesticide industry

1. Directors or technical deputy directors of establishments producing (including bottling and packaging) chemicals subject to conditional production or trading in the chemical pesticide industry must possess university degrees in chemistry or agriculture and practice licenses under the Regulation on management of plant protection drugs promulgated together with the Government's Decree No. 58/2002/ND-CP of June 3, 2002.

2. Establishments producing chemicals and chemical products subject to conditional production or trading in the chemical pesticide industry must have material and technical foundations and personnel meeting the requirements prescribed in Chapter II of the Regulation on management of plant protection drugs promulgated together with the Government's Decree No. 58/2002/ND-CP of June 3, 2002.

3. These establishments must have sufficient quality control equipment and devices or enter into quality control contracts with capable accredited units to inspect the quality of chemicals and chemical products in the chemical pesticide industry to ensure they are up to standards accepted by competent agricultural agencies for each production batch.

4. These establishments shall devise measures to manage and have safety equipment and devices to prevent and fight fire, explosion, chemical leakage and emission, and other chemical incidents under the Fire Prevention and Fighting Law, the Chemical Law and other specific technical safety regulations applicable to each kind of hazardous chemical and equipment used in their establishments. They must have equipment and devices to control, collect and dispose of hazardous waste under the environmental protection law, and apply the environmental management system under ISO 14000 before December 31. 2010.

5. Organizations and individuals trading in chemicals subject to conditional production or trading in the chemical pesticide industry must have practice certificates and material and technical foundations specified in the Government's Decree No. 58/2002/ND-CP of June 3, 2002.

6. The Ministry of Agriculture and Rural Development shall guide the implementation of the provisions of this Article.

2. These establishments must have business registrations for trading in veterinary medicines, bio-products and microorganisms and chemicals used in veterinary medicine.

3. These establishments must have locations and material and technical foundations for chemical production and preservation up to veterinary hygiene standards under the Government's Decree No. 33/2005/ND-CP of March 15, 2005. detailing a number of articles of the Veterinary Medicine Ordinance.

4. These establishments must have sufficient quality control equipment and devices or enter into quality control contracts with capable accredited units to inspect the quality of chemicals and chemical products for veterinary medicine to ensure they are up to standards accepted by competent agricultural agencies for each production batch.

5. These establishments shall devise measures to manage and have safety equipment and devices to prevent and fight fire, explosion, chemical leakage and emission, and other chemical incidents under the Fire Prevention and Fighting Law, the Chemical Law and other specific technical safety regulations applicable to each kind of hazardous chemical and equipment used in their establishments.

6. Organizations and individuals trading in chemicals subject to conditional production or trading in veterinary medicine must have material and technical foundations up to veterinary hygiene standards under the Government's Decree No. 33/ 2005/ND-CP of March 15, 2005, detailing a number of articles of the Veterinary Medicine Ordinance.

7. The Ministry of Agriculture and Rural Development shall guide the implem entation of the provisions of this Article.

Article 12.- Conditions on production or trading of chemicals restricted from production or trading

Organizations and individuals producing or trading in chemicals and chemical products restricted from production or trading in the above sectors or industries must, apart from satisfying the conditions specified in Articles 7 thru 11 of this Chapter, satisfy the conditions of planning, business restrictions, security, defense or social safety and order specified in the Pharmacy Law, the Drug Prevention and Fighting Law and relevant legal documents.

SAFETY DISTANCES

Article 13.- Responsibility to establish safety distances

1. Investment projects on the production of or trading in chemicals on the list specified in Appendix IV to this Decree shall establish safety distances between chemical-producing,or -storing facilities and residential areas, public works, historical or cultural relics, scenic places, beauty spots, natural reserves, national parks, biosphere reserves, species-habitat conservation areas, marine conservation areas and daily-life water sources.

2. The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with line ministries and local People's Committees in. handling existing chemical production establishments which fail to ensure safety distance conditions under this Decree or have their safety distances encroached upon and urging them to establish new safety distances before December 31, 2010.

Article 14.- Determination of safety distances

1. Organizations and individuals with establishments producing or storing hazardous chemicals specified in Appendix IV to this Decree shall determine safety distances to ensure that hazardous elements in places or positions protected by law are below quantitative limits.

a/ In ease a hazardous chemical leaked from an incident is a toxic vapor or gas or emits a toxic vapor or gas, the quantitative limit is the toxic chemical concentration in the air (miligram/m3) at which a person exposed to that vapor or gas for up to 60 minutes does not suffer from an irrecoverable effect or an injury of a degree requiring the use of protection devices or corresponding protection actions;

b/ In case a hazardous chemical leaked from an incident is a flammable or explosive vapor or gas or emits a flammable or explosive vapor or gas, the quantitative limit is the weight of that vapor or gas in the air expressed as percentage (%) of volume or in mg/l, which is below the lower limit of flammable concentration or the lower explosive limit;

c/ In case of blast wave spreading from a hazardous chemical explosion, the quantitative limit is the level of air pressure surge caused by the spreading blast wave and equal to 6.9 kPa.

3. For hazardous chemicals which are both flammable or explosive and toxic, safety distances in case of incident occurrence shall be determined separately tor each hazardous property and the maximum determined value will be applicable.

4. For an establishment with many kinds of hazardous chemicals, its safety distance shall be determined separately for each kind of chemical and the maximum safety distance will be applicable.

5. For an establishment with many equipment for hazardous chemical production or storage installed in different places, its safety distance shall be determined separately for each kind of equipment. The safety distance applicable to all of these equipment must cover the specific safety distance for each equipment.

6. The Ministry of Industry and Trade shall elaborate and promulgate technical regulations on safety distances applicable to establishments producing or trading in hazardous chemicals specified in Appendix IV to this Decree.

Article 15.- Change in safety distances

A safety distance must be changed as appropriate in the following cases:

1. A hazardous chemical -producing or -storing establishment makes a change in production or storing technology or volume or experiences any change leading to a change in the safety distance.

2. Statistics on hazardous chemical incidents for the last five years show that the estimated safety distance is greatly different from reality.

3. In case the safety distance from a place
where an equipment is installed to places or positions under protection does not satisfy the permissible quantitative limit, the hazardous chemical-producing or -storing establishment shall apply measures to assure the prescribed safety distance as specified below:

b/ Applying additional measures of sheltering and covering or using devices to reduce the leakage of hazardous chemicals;

c/ Changing the technology for producing or storing hazardous chemicals in order to reduce the production or storing volume, pressure or temperature of hazardous chemicals.

Chapter V

CONCENTRATION LIMITS FOR HAZARDOUS SUBSTANCES IN COMPOUNDS AT WHICH CHEMICAL SAFETY DATA SHEETS ARE REQUIRED TO BE COMPILED

Article 16.- Detailed classification of hazardous chemicals according to the Globally Harmonized System of Classification and Labeling of Chemicals

Chapter VI

INFORMATION ON CHEMICALS

Article 18.- Procedures for declaration of chemicals

1. Declaration-receiving agencies

Provincial/municipal Industry and Trade Services shall receive dossiers of declaration of organizations and individuals producing chemicals on the list of chemicals subject to compulsory declaration in localities under their management.

The Ministry of Industry and Trade shall receive dossiers of declaration from organizations and individuals importing chemicals on the list of chemicals subject to compulsory declaration.

2. Dossiers of declaration

A declaring organization or individual shall make two (2) dossier sets, each comprising:

a/ A written declaration of the chemical, made according to a form set by the Ministry of Industry and Trade;

In case chemicals have been previously declared, organizations and individuals engaged in hazardous chemical activities are not required to re-submit chemical safety data sheets.

3. Declaration deadline and time limit

a/ Organizations and individuals producing chemicals on the list of chemicals subject to compulsory declaration shall make written declarations to provincial/municipal Industry and Trade Services before January 31 every year;

b/ Organizations and individuals importing chemicals shall make written declarations to the Ministry of Industry and Trade within 15 working days after the customs clearance of these chemicals. The Industry and Trade Ministry's certification of chemical declarations constitutes a condition for these organizations and individuals to subsequently import chemicals. The Ministry of Industry and Trade shall set the form of certificate of declaration of imported chemicals;

c/ Provincial/municipal Industry and Trade Services shall keep books for declaration manage­ment, review the chemical declaration situation and results in their localities and report them to the Ministry of Industry and Trade in March every year.

4. Cases exempt from declaration

a/ Chemicals produced or imported only once for security, defense or response to natural disasters or emergency circumstances of diseases or epidemics;

b/ Chemicals produced or imported in a quantity of under 100 kg per year and not on the list of chemicals restricted from production or trading and lists of chemicals under control under international conventions.

5. The Ministry of Industry and Trade shall assume the prime responsibility for. and coordinate with line ministries in. formulating a system for computerized management and receipt of declared information and chemical reports before December 31, 2010.

1. Organizations and individuals engaged in chemical activities and wishing to keep confidential information not specified in Clause 2. Article 50 of the Chemical Law shall request in writing agencies receiving chemical declarations and reports on chemical activities.

2. Important information aiming to protect community health and environment is not regarded as confidential, including:

a/ Trade names of chemicals or mixtures of chemicals;

b/ Names of organizations and individuals producing or importing chemicals; organizations and individuals reporting on chemical activities under Articles 43 and 52 of the Chemical Law;

c/ Information in chemical safety data sheets:

d/ Information serving the prevention of and response to chemical incidents: prevention and mitigation of adverse impacts of chemical toxicity, warning information for persons using or exposed to chemicals, and methods to preliminarily remedy incidents;

e/ Methods of analysis to determine the possibility of human or environmental exposure to chemicals: summarized results of testing of chemical toxicity:

f/ Purity of mixtures of substances and hazards of additives and impurities.

3. The Ministry of Industry and Trade shall provide detailed guidance on the regulation on confidentiality of declared chemical information. Agencies receiving chemical declarations and reports on chemical activities shall keep confidential information therein.

The national chemical list and the national chemical database aim to serve the management of chemical safety and supply of information to the system for answering inquiries about and supplying information on hazardous chemicals in emergency circumstances.

The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with line ministries and localities in. formulating a scheme on investigation and survey for development of the national chemical database and elaboration of the national chemical list. and submitting it to the Prime Minister for approval before July 1, 2009.

Chapter VII

IMPLEMENTATION ORGANIZATION AND PROVISIONS

Article 21.- Tasks of ministries and branches to organize the implementation of the Chemical Law

1. Ministries and branches shall organize the management of chemical activities according to the Chemical Law.

2. The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with line ministries and provincial/ municipal People's Committees in, elaborating and submitting to the Prime Minister a scheme on the national chemical database and the national chemical list; a scheme on complete application of the Globally Harmonized System of Classification and Labeling of Chemicals in Vietnam; and a scheme on building of a system of laboratories to assess new chemicals in Vietnam.

3. The Ministry of Natural Resources and Environment shall assume the prime responsibility for. and coordinate with the Ministry of Defense, line ministries and provincial/ municipal People's Committees in, elaborating and submitting to the Prime Minister a scheme on survey, collection and treatment of residual chemicals left by wars; and a scheme on the elaboration of plans on collection and treatment of residual toxic chemicals, confiscated toxic chemicals or toxic chemicals of unidentified origins.

4. The Ministry of Health and the Ministry of Agriculture and Rural Development shall review and promulgate under regulations lists of banned chemicals, chemicals restricted from use. chemicals permitted for medical use.

5. The Ministry of Agriculture and Rural Development shall elaborate and submit to the Prime Minister a scheme on compilation of chemical safety data sheets for all plant protection drugs in Vietnam.

6. The Ministry of Public Security and the Ministry of Defense shall elaborate and promulgate management documents and lists of banned chemicals and chemicals permitted for use in security and defense assurance, riot and fire prevention and fighting.

7. The Ministry of Public Security shall assume the prime responsibility for, and coordinate with line ministries in, elaborating and submitting to the Prime Minister a scheme on investigation, survey and capacity building of local fire prevention and fighting forces in order to prevent and respond to chemical incidents in chemical industry zones.

8. The Ministry of Transport shall review and supplement management documents related to the carriage of hazardous chemicals by road, railway, waterway and airway.

Article 22.- Effect

1. This Decree takes effect 15 days after its publication in "CONG BAO."

2. This Decree replaces the provisions of Chapter I, Chapter II, Articles 12, 13 and 20 of Chapter III. and Chapter IV of the Government's Decree No. 68/2005/ND-CP of May 20, 2005. on chemical safety. To annul all previous regulations which re contrary to this Decree.

Article 23.- Implementation responsibility Ministers, heads of ministerial-level agencies

Heads of government-attached agencies, presidents of provincial/municipal People's Committees and concerned organizations and shall implement this Decree.
