TECHNICAL SAFETY
INSPECTION FOR ELECTRICAL APPLIANCES AND TOOLS
Circular No. 33/2015/TT-BCT dated October 27,
2015 of the Minister of Industry and Trade on technical safety inspection for
electrical appliances and tools, effective on January 06, 2017, amended by:
Circular No. 28/2017/TT-BCT dated December 08,
2017 of the Minister of Industry and Trade on amendments and abrogation of
certain Circulars on petroleum trading, provision of conformity assessment
services, import and export under the state management of the Ministry of
Industry and Trade, effective from January 01, 2018.
Pursuant to Law on Electricity dated December
03, 2004 and the Law on Amendments to a number of articles of Law on
Electricity dated November 20, 2012;
Pursuant to the Law on Technical regulations
and standards dated June 29, 2006;
Pursuant to the Law on Product and goods
quality dated November 21, 2007;
Pursuant to the
Government’s Decree No. 14/2014/ND-CP dated February 26, 2014 elaborating
regulations on electrical safety of the Law on Electricity;

Director of the Industrial Safety Techniques and Environment Agency,
The Minister of Industry
and Trade promulgates the Circular on technical safety inspection for
electrical appliances and tools1:
Article 1. Scope
This Circular stipulates
technical safety inspection for electrical appliances and tools before and
during operation.
Article 2. Regulated
entities
This Circular applies to:
1. Organizations and
individuals using, operating electrical appliances and tools subject to
technical safety inspection.
2. Inspecting organization.
3. Other relevant organizations
and individuals.

For the purposes of this
Circular, the terms below are construed as follows:
1. "technical safety
inspection for electrical appliances and tools” (hereinafter referred to as
“inspection”) refers to the process-based inspection of safety of electrical
appliances and tools before and during operation according to respective
technical standards and regulations.
2.2 (Annulled).
3.”inspecting organization”
means an organization providing inspection services or the inspection
department of an organization using and operating electrical appliances and
tools.
Article 4. List of
electrical appliances and tools subject to inspection
1. The list of electrical
appliances and tools subject to inspection is provided in Annex I enclosed
herewith.
2. In consideration of
factual circumstances, the Ministry of Industry and Trade shall make amendments
and supplements to “The list of electrical appliances and tools subject to inspection”
to meet management requirements, technical and technological conditions of
electrical appliances and tools, and relevant regulations of law.
Article 5. Subject
matters of inspection
Subject matters of
inspection are stipulated in the inspection processes applicable to each type
of electrical appliances and tools, including one or several main points as
follows:

2. Measurement of insulation
resistance.
3. Measurement of resistance
in coils.
4. Inspection of dielectric
strength.
5. Measurement of contact
resistance.
6. Measurement of leakage
current.
7. Measurement of switching
parameters.
8. Inspection of operation
of safety mechanisms, protective components such as speed limiters, brakes.

Initial inspection shall be
conducted before electrical appliance or tool is put into operation.
2. Periodic inspection shall
be conducted during the use or operation of the electrical appliance or tool.
a) Any electrical appliance
which is an integral part of an operating line and cannot be separated for
inspection shall be inspected during the overhaul of the line overhaul, except
for the cases specified in Clause 3 of this Article;
b) 4 The inspection of electrical appliances other than
that regulated by Point a of this Clause shall be carried out periodically
according to the manufacturer's instructions but the maximum interval between
inspections of electrical tools and appliances in Section II and Section III
Appendix I enclosed with the Circular No. 33/2015/TT-BCT shall not exceed 36
months.
3. Irregular inspections
Irregular inspections shall
be conducted at the request of competent state agencies or after remedial work
is completed or at the request of users of such electrical appliances and
tools.
Article 7. Inspection of
electrical appliances and tools 5
1. Inspections of electrical
appliances and tools shall be carried out by inspecting organizations that meet
the requirements in Article 9 of the Government's Decree No. 107/2016/NĐ-CP
dated July 01, 2016 on eligibility for provision of conformity assessment
services and have been issued with the Certificate of Inspection Business
Registration by the Ministry of Industry and Trade.
Documentation and procedures
for grant of the Certificate of Inspection Business Registration are specified
in Article 10, Article 11 and Article 12 of the Decree No. 107/2016/NĐ-CP.

3. Upon completion of
inspection, the inspecting organization shall stick inspection stamps on
electrical tools and appliances that meet the requirements.
a) The template of the
inspection stamp is provided in Annex III enclosed with Circular No.
33/2015/TT-BCT. The stamp must not be covered, is noticeable and free from
adverse impacts of the environment;
b) If the electrical
equipment or appliance is located at a place or in an environment where the
inspection stamp cannot be stuck the inspecting organization shall, upon
completion of inspection, issue the Certificate of Inspection as replacement
for the stamp.

Article 10. Organization
of implementation
1. Industrial Safety
Techniques and Environment Agency shall:
a) Provide instructions and
organize the implementation of this Circular;
b)8 Receive and process applications
for registration of inspection business; publish the list of inspecting
organizations on the website of the Ministry of Industry and Trade;

2. The Departments of
Industry and Trade shall provide instructions and carry out inspection of
compliance with regulations on inspection by inspecting organizations,
organizations/individuals using, operating electrical appliances and tools in
their provinces.
3. Organizations/individuals
using, operating electrical appliances and tools shall:
a) Select an organization
qualified for inspection as prescribed herein;
b) Formulate a list of
electrical appliances and tools subject to inspection for management;
c) Formulate plans for
separation of electrical appliances from the equipment line for inspection in
accordance with the cycle of equipment line overhaul as prescribed in Article 6
of this Circular;
d) Put forward measures to
ensure safety for inspectors performing inspection and relevant electric
equipment system in operation during the inspection;
dd) Supervise the inspection
conducted by the inspecting organization according to the issued process;
e) Maintain and ensure
conformity of inspected electrical appliances and tools throughout their
operation according to Vietnam's technical regulations and standards,
international technical regulations and standards applicable in Vietnam.
4. Inspecting organizations
shall:

b) Carry out inspection
within the registered scope of inspection business;
c) Perform all inspection
items and contents in the inspection process; ensure quality and punctuality;
d) Ensure accuracy in
inspection performance capacity;
dd) Only employ inspectors
from another inspecting organization under a written cooperation agreement
between the two inspecting organizations;
e) Take legal responsibility
for the results given by its inspectors and the other inspecting organization’s
inspectors in case of a written agreement on cooperation in inspection;
g) Pay recompense for any
damage it causes as prescribed by law. Cancel inspection results upon discovery
of violations;
h)10 Provide training, issue inspector cards to
inspectors who carry out technical safety inspection for electrical appliances
and tools as prescribed by law. The training documents include those about
measurement and quality of products and goods as prescribed by law and
inspection contents prescribed in the Circular No. 33/2015/TT-BCT .
Article 11. Effect 11
1. This Circular comes into
force from January 06, 2017.

3. Difficulties that arise
during the implementation of this Circular should be reported to the Ministry
of Industry and Trade for consideration./.
