CIRCULAR
PROMULGATING NATIONAL TECHNICAL REGULATIONS ON FOOD GRADE
SALT (SODIUM CHLORIDE) AND PURE SALT (SODIUM CHLORIDE)
Pursuant to the
Government’s Decree No. 15/2017/ND-CP dated February 17, 2017 defining the
functions, tasks, powers and organizational structure of the Ministry of
Agriculture and Rural Development;
Pursuant to the Law on
Standards and Technical Regulations 2006;
Pursuant to the Law on
Food Safety 2010;
Pursuant to the Law on
Quality of Products and Goods 2007;
Pursuant to the
Government’s Decree No. 74/2018/ND-CP dated May 15, 2018 on amendments to some
Articles of the Government's Decree No. 132/2008/ND-CP dated December 31, 2008
on elaboration of some Articles of the Law on Quality of Products and Goods;
Government’s Decree No. 154/2018/ND-CP dated November 09, 2018 amending,
supplementing and repealing certain regulations on investment and business
conditions in sectors under the management of the Ministry of Science and
Technology and certain regulations on specialized inspections;
Pursuant to the
Government’s Decree No. 15/2018/ND-CP dated February 02, 2018 on elaboration of

Pursuant to the
Government’s Decree No. 40/2017/ND-CP dated April 05, 2017 on management of
salt production and trading;
At the request of the
Director General of the Department of Science, Technology and Environment and
the Director General of the Department of Cooperatives and Rural Development,
the Minister of Agriculture and Rural Development hereby promulgates National
technical regulation on food grade salt (sodium chloride) and National technical
regulation on pure salt (sodium chloride).
Article 1. Promulgated
together with this Circular are the following National technical regulations:

Article 2. This Circular comes into force from August 04, 2022.
Article 3. Chief of the Ministry Office; Director General of
Department of Science, Technology and Environment; Director General of
Department of Cooperatives and Rural Development; heads of units affiliated to
Ministries; Directors of Departments of Agriculture and Rural Development of
provinces and central-affiliated cities and organizations and individuals
concerned are responsible for the implementation of this Circular.

I. GENERAL PROVISIONS
1. Scope
National technical
regulations on food grade salt (sodium chloride) (hereinafter referred to as
“food grade salt”) provides for technical requirements, test methods, sampling
and regulatory requirements for food grade salt.
2. Regulated entities
This Regulation applies
to:

processors, traders, exporters and importers of food grade salt within
Vietnam’s territory.

related organizations and individuals.

2. Technical
requirements for food additives and iodine added to salt
2.1. Food additives added
to food grade salt shall comply with the regulations laid down in the Circular
No. 24/2019/TT-BYT dated August 30, 2019 of the Ministry of Health.
2.2. Iodine added to salt
shall conform to technical requirements for potassium iodate (KIO3)
specified in QCVN 3-6:2011/BYT of the Ministry of Health on substances used for
iodine fortification in food.

Depending on the testing
facility’s capacity, other test methods with similar or higher accuracy
compared to the aforesaid test methods may be used.
3.2. Sampling
3.2.1. Sampling for
inspection and sample storage shall comply with regulations specified in point
a clause 3 Article 1 of the Circular No. 12/2017/TT-BKHCN dated September 28,
2017 of the Minister of Science and Technology.
3.2.2. Sampling for
inspection of imported food grade salt in case of applying the tightened
inspection method:
Random sampling method is
adopted. Each unit of product in the shipment of imported salt is selected
randomly and has an equal chance of being selected in the sample for
inspection. Single and random samples (gross samples) collected are divided
into two sampling units, one sampling unit is intended for testing and the
other is stored at the inspecting authority. Each sampling unit consisting of a
minimum of 200 and a maximum of 500 g is sufficient to carry out testing
according to regulations and contained in an air-tight plastic box or bottle
bearing the inspecting authority’s seal. The inspecting authority shall collect
samples of imported salt and make a sampling record in the witness of
representatives of the importer and border customs authority.

2. Food grade salt shall be declared by organizations and
individuals themselves using the testing result given by a designated testing laboratory
or a testing laboratory recognized to conform to ISO 17025; self-declaration
procedures are specified in Articles 4 and 5 of the Government’s Decree No.
15/2018/ND-CP dated February 02, 2018 and clause 1 Article 3 of the
Government’s Decree No. 155/2018/ND-CP dated November 12, 2018.
3. State inspection of food grade salt: Food grade salt shall
undergo state inspection of food safety as prescribed in the Government’s
Decree No. 15/2018/ND-CP dated February 02, 2018, Circular No.
39/2018/TT-BNNPTNT dated December 27, 2018 of the Ministry of Agriculture and
Rural Development and relevant legal documents.
IV. RESPONSIBILITIES
OF RELEVANT ORGANIZATIONS AND INDIVIDUALS
1. Providers of food
safety testing services
1.1. Testing laboratories
recognized by the Ministry of Science and Technology (Bureau of Accreditation)
as VILAS testing laboratories in chemistry sector,
including testing for sodium chloride and food safety indicators; designated
testing laboratories or testing laboratories recognized to conform to ISO 17025
shall carry out food safety testing in accordance with regulations of law,
technical requirements specified in this Regulation and relevant regulations of
law.
1.2. Annual or ad hoc
food safety testing reports shall be submitted to the Department of
Cooperatives and Rural Development (affiliated to the Ministry of Agriculture
and Rural Development) before December 15 every year.
2. Processors,
traders, exporters and importers of food grade salt
2.1. Take responsibility
for quality of products and make sure that they conform to the technical
requirements specified in this Regulation and relevant regulations of law.
2.2. Make product
self-declaration as prescribed in Articles 4 and 5 of the Government’s Decree
No. 15/2018/ND-CP dated February 02, 2018 and clause 1 Article 3 of the
Government’s Decree No. 155/2018/ND-CP dated November 12, 2018.

1. The Department of Cooperatives and Rural Development shall
provide guidance on, inspect and cooperate with competent authorities concerned
in organizing implementation of this Regulation; submit to the Ministry of
Agriculture and Rural Development the adjustments and amendments to this
Regulation.
2. In the cases where any of the legislative documents,
standards or regulations referred to in this Circular is amended or replaced,
the newest one shall prevail./.

Labeling of pure salt

43/2017/ND-CP dated April 14, 2017 and other relevant regulations of law.
2. Pure salt shall be declared by organizations and
