DECISION
ON ISSUANCE OF ALLOWANCES FOR TRADE
UNION OFFICIALS AT ALL LEVELS
PRESIDIUM OF THE VIETNAM
GENERAL CONFEDERATION OF LABOR
Pursuant to the Law on
Trade Unions; Charter of Vietnam Trade Unions;
Pursuant to Decision
No. 128-QD/TW dated December 14, 2004, on the salaries for cadres, civil
servants, and public employees of Communist Party of Vietnam (CPV), Front, and
mass organization agencies; Regulation No. 169-QD/TW dated June 24, 2008, of
the Central Secretariat of the CPV on the responsibility allowances for
members of Executive Committees of CPV Committees at all levels of the Central
Committee of the CPV; and Guidance No. 55-HD/BTCTW dated December 31, 2005, of
the Organization Commission of the CPV supplementing the implementation of
rearrangement of salaries and allowances for cadres, civil servants, and public
employees of CPV, Front, and mass organization agencies;
As requested by the
Department of Labor Relations and the Department of Trade Union Affairs of the
Vietnam General Confederation of Labor.
DECISION
Article
1. The
Regulations on allowances for trade union officials at all levels are issued
together with this Decision.

Article
3. The
departments and units affiliated to the Vietnam General Confederation of Labor;
federations of labor of provinces/cities (hereinafter referred to as
“provincial federations of labor”), central
sector-level trade unions, trade unions of business groups, trade unions of
corporation affiliated to the General Confederation of Labor, and trade unions
at all levels are responsible for implementing this Decision./.

1. Responsibility
allowance for trade union officials at all levels.
2. Multi-position
allowance for president and vice- president(s) of superior trade unions of
grassroots trade unions, specialized superior trade unions of grassroots trade
unions, and trade unions in the commune, ward, and special zone (hereinafter
referred to as “commune-level trade unions”) with full-time trade union
officials, who are also hold more than one positions, assigned according to the
regulations of the Vietnam General Confederation of Labor.
Article
2. Rules for implementation
1. Ensure that allowances
are provided to the correct recipients, meeting the standards and limits within
the allocated financial resources of the unit as prescribed by the Vietnam
General Confederation of Labor. The expenditures for paying allowance of the
unit must be included in the approved budget estimate and publicly and
transparently finalized with sufficient supporting documents as required.
2. Full-time trade union
officials participating in the executive committee and inspection committee of
multi-level trade unions are only entitled to the highest responsibility
allowance. Part-time trade union officials participating in the executive
committee and inspection committee of the Vietnam General Confederation of
Labor, superior grassroots trade unions, special grassroots trade unions, and
commune-level trade unions shall be entitled to the responsibility allowance of
trade union of the corresponding level. Within a trade union, officials holding
multiple positions are only entitled to the highest responsibility allowance.
3. The responsibility
allowance and multi-position allowance prescribed herein shall not be used as
grounds for calculating social insurance, health insurance, and unemployment
insurance premiums.
4. Individuals entitled to
allowances prescribed herein shall cease receiving allowances from the
following month upon ceasing to hold their assigned position or tasks.
5. The grassroots trade
union may use a maximum of 30% of the collected trade union funds and trade
union contributions (the portion the grassroots trade union is entitled to use)
to pay salaries and allowances for full-time trade union officials and
allowances for grassroots trade union officials. If this fund is not fully
used, it may be used to supplement the funds for visiting and supporting trade
union members. Grassroots trade unions that receive subsidies from the
specialized authority to pay allowances to trade union officials shall decide
the use of such subsidies.

Article
3. Responsibility allowance for grassroots trade union officials
1. Titles entitled to
responsibility allowances
a) President of the
grassroots trade union, member grassroots trade unions, and affiliated trade
union divisions (if any);
b) Vice-president of the
grassroots trade union, member grassroots trade unions, and affiliated trade
union divisions (if any);
c) Chairperson of the inspection
committee of the grassroots trade union, members of the executive committee of
the grassroots trade union, member grassroots trade union, and affiliated trade
union division (if any);
d) Leader and deputy
leader of the trade union group;
2. The responsibility
allowance for grassroots trade union officials shall be determined based on the
number of trade union members, the results of the collection of trade union
funds and trade union contributions in the previous year, and shall comply with
the framework of number of trade union members, as follows:
a. For presidents of
grassroots trade unions:

b. For the remaining
specified in Points b, c, and d of Clause 1 of this Article, the executive
committee of the grassroots trade union shall, based on the available funds, determine
the expenditures for paying allowances in the internal expenditure regulations
of the grassroots trade union, according to the framework of the number of
union members, eligible entities, priority order according to their
responsibilities from highest to lowest (president, vice-president, etc.) and
assess the performance of those receiving the allowance. Allowance payments may
be made monthly, quarterly, every six months, or annually.

2. The level of

7. Multi-position allowances of president and vice- presidents of superior trade union of grassroots trade
union
1. Titles entitled to
multi-position allowances
a) Leaders, managers of in
specialized agencies who are also president or vice-presidents of superior
trade unions of grassroots trade unions.
b) Trade union officials
at the superior who are also president or vice-presidents of subordinate trade
unions that are special grassroots trade unions; commune-level trade unions.
2. Level of multi-position
allowances
a) Other titleholders who
are also president of trade union shall be entitled to a monthly allowance
equal to 10% of their salary and allowances that are used as ground for social
insurance premium payment.
b) Other titleholders who
are also vice-president of trade union shall be entitled to a monthly allowance
equal to 7% of their salary and allowances that are used as grounds for social
insurance premium payment.

Article
8. Implementation upon issuance of new regulations by the CPV and the State
During the implementation
process, if the CPV and State issue new regulations related to allowances for
trade union officials, while awaiting amendments to these Regulations, the
Standing Committee of the Vietnam General Confederation of Labor shall review
each specific case to direct implementation in accordance with the new
regulations of the CPV and State and the practical condition of the trade union
organization.
Article
9. Responsibility for implementation
1. This regulation applies
from the grassroots trade union upwards.
2. The Labor Relations
Department, the Trade Union Affairs Department, and the Inspection Committee of
the Vietnam General Confederation of Labor are responsible for providing
guidance, inspecting, and supervising the implementation of this Regulation by
trade unions at all levels. Should any difficulties arise during
implementation, promptly report to the Standing Committee of the Vietnam
General Confederation of Labor for review and resolution./.
