PRESCRIBING AIR
TRANSPORT SERVICE BUSINESS AND GENERAL AVIATION SERVICE BUSINESS
The Government’s Decree No. 30/2013/ND-CP dated
April 08, 2013 prescribing air transport service business and general aviation
service business is amended by:
1. The Government’s Decree No. 92/2016/ND-CP dated
July 01, 2016 prescribing conditional business lines in civil aviation
industry, coming into force from July 01, 2016.
2. The Government’s Decree No. 89/2019/ND-CP dated
November 15, 2019 providing amendments to the Government’s Decree No.
92/2016/ND-CP dated July 01, 2016 prescribing conditional business lines in
civil aviation industry and the Government’s Decree No. 30/2013/ND-CP dated
April 08, 2013 prescribing air transport business and general aviation service
business, which comes into force from January 01, 2020.
3. The Government’s Decree No. 15/2024/ND-CP dated
February 16, 2024 providing amendments to the Government’s Decree No.
30/2013/ND-CP dated April 08, 2013 prescribing air transport service business
and general aviation service business and the Government’s Decree No.
92/2016/ND-CP dated July 01, 2016 prescribing conditional business lines in
civil aviation industry, which comes into force from February 16, 2024.

The Government promulgates a Decree prescribing
air transport service business and general aviation service business.[1]
Chapter I
GENERAL PROVISIONS
Article 1. Scope and regulated entities
1. This Decree deals with:
a) Eligibility requirements and procedures for
issuance of air transport service business license, license to provide
commercial general aviation services, and certificate of registration of
non-commercial general aviation activities;
b) Use of brand names and franchising by air
transport service providers and commercial general aviation service providers.
2. This Decree applies to any organizations and
individuals involved in issuance, re-issuance and invalidation of air transport
service business license, license to provide commercial general aviation
services, and certificate of registration of non-commercial general aviation
activities; provision of air transport services or general aviation services.
3. For the purposes of this Decree, air transport
service providers and commercial general aviation service providers are
hereinafter referred to as airlines.

1. Air transport service business includes air
transport, advertising, marketing and sale of air transport products on the
market for profitable purposes.
2. General aviation service business includes:
a) Commercial general aviation service business
means advertising, marketing, sale and provision of general aviation services
for profitable purposes;
b) Non-commercial general aviation service business
means general aviation activities performed to serve operation of organizations
or individuals not for profitable purposes.
Article 3. Authorities in charge of formulating
and promulgating development plannings, appraising and issuing
license/certificates
1. The Ministry of Transport of Vietnam shall play
the leading role and cooperate with relevant Ministries, regulatory authorities
and relevant organizations and individuals in formulating planning for
development of airlines of Vietnam, and submitting it to the Prime Minister for
approval.
2. The Minister of Transport of Vietnam shall
consider issuing and re-issuing air transport service business license, license
to provide commercial general aviation services, and investment certificate of
foreign-invested airlines after obtaining approval from the Prime Minister.
3. Civil Aviation Authority of Vietnam that is
affiliated to the Ministry of Transport of Vietnam shall process applications
for air transport service business license and license to provide commercial
general aviation services.
4. The Director of Civil Aviation Authority of
Vietnam shall consider issuing and re-issuing certificate of registration of
non-commercial general aviation activities (excluding activities performed by
unmanned aircraft systems or ultralight aircraft vehicles).

1. A foreign-invested airline shall have rights and
obligations as defined in laws on civil aviation, investment and enterprises.
2. The investment certificate issued to a
foreign-invested project shall also be the air transport service business
license or license to provide commercial general aviation services.

Chapter III
CERTIFICATE OF REGISTRATION OF GENERAL AVIATION
ACTIVITIES
Article 21. Eligibility requirements for
issuance of certificate of registration of non-commercial general aviation activities
1. A certificate of registration of non-commercial
general aviation activities shall be issued to an organization or individual
that performs non-commercial general aviation activities.
2. Eligibility requirements for issuance of a
certificate of registration of non-commercial general aviation activities:
a) Be an eligible applicant, including: a
Vietnamese juridical person; an organization that is established and operating
under the law of Vietnam, and is headquartered in Vietnam; a representative
office or branch of a foreign organization in Vietnam; a Vietnamese citizen who
is permanently residing in Vietnam; a foreign citizen who is permanently
residing in Vietnam;
b) Ensure availability of aircraft for operations;
c) Have an aircraft maintenance facility or have
entered into a service contract with an aircraft maintenance facility licensed
or recognized by the Ministry of Transport of Vietnam;
d) Use flight crew members who hold appropriate
license/certificate;

e) Fulfill national defense and security
requirements.
3. An applicant for certificate of registration of
non-commercial general aviation activities shall pay application fee as
prescribed by law.
Article 22. Application for issuance of a
certificate of registration of non-commercial general aviation activities [18]
1. The applicant shall submit 01 set of application
to the Civil Aviation Authority of Vietnam, whether directly or by post or in
another appropriate manner.
2. The application includes:
a) An application form, which is made using the
Form No. 06 or the Form No. 10 (in case of re-issuance of the certificate) in
the Appendix hereof;
b) Copies from the master register or copies
presented together with their originals for comparison or certified true copies
(if the application is submitted in person); certified true copies (if the
application is submitted by post) of the following documents: establishment
license or operation license or enterprise registration certificate (if the
applicant is an organization); ID card, Citizen identity card or passport (if
the applicant is an individual);
c) Copies from the master register or copies
presented together with their originals for comparison or certified true copies
(if the application is submitted in person); certified true copies (if the
application is submitted by post) of the following documents: Vietnam Permanent
Residence Card (for the foreign citizen permanently residing in Vietnam);
license for establishment of representative office or branch in Vietnam (for
the representative office or branch of a foreign organization);
d) Copies from the master register or copies
presented together with their originals for comparison or certified true copies
(if the application is submitted in person); certified true copies (if the
application is submitted by post) of the following documents: Certificate of
registration of Vietnamese nationality of aircraft and Certificate of
Airworthiness;

e) Copies from the master register or copies
presented together with their originals for comparison or certified true copies
(if the application is submitted in person); certified true copies (if the
application is submitted by post) of the following documents: Appropriate
licenses and certificates of flight crew members;
g) A copy from the master register or copy
presented together with its original for comparison or certified true copy (if
the application is submitted in person); certified true copy (if the
application is submitted by post) of the operation license of the aircraft
maintenance facility;
h) A copy from the master register or copy
presented together with its original for comparison or certified true copy (if
the application is submitted in person); certified true copy (if the
application is submitted by post) of the aircraft maintenance service lease
contract in the case of leasing of aircraft maintenance service.
Article 23. Application appraisal and issuance
of a certificate of registration of non-commercial general aviation activities
1.[19] Within 25 working days from the
receipt of the sufficient application prescribed in Article 22 hereof, the
Civil Aviation Authority of Vietnam shall appraise it and send a request for
opinions about the applicant, aircraft type or airfield to the Department of
Operations (affiliated to the Ministry of National Defense of Vietnam) or send
a notification of refusal to issue the certificate which must clearly indicate
the reasons for such refusal to the applicant.
2. The Department of Operations (affiliated to the
Ministry of National Defense of Vietnam) shall give a written response to the
Civil Aviation Authority of Vietnam within 10 working days from its receipt of
the written request. The Civil Aviation Authority of Vietnam shall issue a
certificate using Form No. 03 in the Appendix hereof after obtaining approval
from the Department of Operations (affiliated to the Ministry of National
Defense) or give a notification of refusal to issue the certificate which must
clearly indicate the reasons for such refusal to the applicant.
3. A certificate of registration of non-commercial
general aviation activities shall, inter alia, contain the following
information:
a) Name, business name and headquarters address of
the enterprise; legal representative of the organization;
b) Full name; date of birth; nationality; number,
issuing authority and issue date of ID card or passport, residence of the
individual;

d) Non-commercial general aviation activities to be
performed;
dd) Airport or aerodrome that will be the
aircraft’s home base;
e) Quantity, categories and registration
number of the aircraft to be put into operation.
Article 24. Invalidation and re-issuance of
certificate of registration of non-commercial general aviation activities
1. A certificate of registration of non-commercial
general aviation activities shall be invalidated in the following cases:
a) Fail to meet eligibility requirements for
issuance of the certificate;
b) Operate against the purpose or contents stated
in the certificate;
c) Seriously violate regulations of law on general
aviation;
d) Perform general aviation activities in a manner
that adversely affect national defense and security, public interests and social
order;

e) The organization holding the certificate no
longer exists; the individual holding the certificate died or is found
incapable of civil acts;
g) The invalidation is made at the request of the
certificate holder.
2. The certificate holder that wishes to change any
contents of the issued certificate shall prepare and submit 01 set of
application directly or by post to the Civil Aviation Authority of Vietnam. The
application includes:
a) The original application form which is made
using Form No. 10 in the Appendix hereof;
b) The documents concerning the change.
3. Procedures for appraising the application and
approving changes in contents of a certificate of registration of
non-commercial general aviation activities shall comply with provisions of
Article 23 of this Decree. If an application is approved, the Civil Aviation
Authority of Vietnam shall issue a new certificate containing additional
contents as requested or for replacing the old one.
4. If a certificate is invalidated, the Civil
Aviation Authority of Vietnam shall issue a document to invalidate the
certificate and the certificate holder shall immediately terminate general
aviation activities; the certificate holder shall liquidate relevant contracts
signed before the certificate is invalidated.
Chapter IV
BRAND AND FRANCHISING

1. Each airline must develop its own brand,
including trade name and trademark.
2. Trademark is a collection of distinctive signs
of an airline, including business trademark, shape, colour, symbols, and signs
which are visible and used for identifying and distinguishing an airline and
its services from other airlines in the air transport service business and
commercial general aviation service business.
Article 26. Use of brands
1. The trade name or trademark or both the trade
name and trademark of an airline must be displayed on the airline’s signboard
and the outer side of its aircraft used in the air transport service business
or commercial general aviation service business.
2. An airline shall not:
a) use a brand that is confusingly similar to that
of another airline;
b) use the brand of another airline to provide its
air transport services or general aviation services, except the cases
prescribed in Clauses 3 and 4 of this Article;
c) use the brand of another airline before the
expiration of the prescribed 05-year period commencing on the date of
termination of the use of that brand.
3. A Vietnamese airline may use aircraft bearing
the brand of another airline during its provision of air transport services or
general aviation services in the following cases:

b) Shared-use of aircraft by a group of companies
in the form of parent company – subsidiary companies as defined in the Law on
enterprises.
4. A Vietnamese airline shall only be allowed to
use aircraft bearing the brand of the airline alliance of which it is a member,
provided that brand is not owned by any other airline.
5. The use of brand as prescribed in Point a Clause
3 of this Article shall require an approval from the Civil Aviation Authority
of Vietnam which is given according to procedures for giving approval for
aircraft lease as prescribed by laws.
6.[20] The use of brand specified in Point b
Clause 3 and Clause 4 of this Article shall be registered with the Civil
Aviation Authority of Vietnam. The airline shall submit 01 set of application
to the Civil Aviation Authority of Vietnam, whether directly, by post or in
another appropriate manner. Such an application includes:
a) The original application form which is made
using Form No. 08 in the Appendix hereof;
b) Copies from the master register or copies
presented together with their originals for comparison or certified true copies
(if the application is submitted in person); certified true copies (if the
application is submitted by post) of the documents proving the corresponding
regulations specified in Point b Clause 3 and Clause 4 of this Article;
c) A copy from the master register or copy
presented together with its original for comparison or certified true copy (if
the application is submitted in person); certified true copy (if the
application is submitted by post) of the written permission for use of the
brand granted by the brand owner.
7. Within 07 working days from the receipt of the
sufficient application as prescribed in clause 6 of this Article, the Civil
Aviation Authority of Vietnam shall appraise the received application and issue
a certificate of registration using Form No. 09 in the Appendix hereof or give
a notification of refusal to issue the certificate which must clearly indicate
the reasons for such refusal to the applicant. The Civil Aviation Authority of
Vietnam shall invalidate the issued certificate of registration in case the use
of a brand no longer meets the corresponding conditions in point c clause 3 and
clause 4 of this Article.
8. The airline shall pay registration fees as
prescribed by laws.

Airlines are not allowed to perform the franchising
of air transport services and commercial general aviation services in Vietnam
to other airlines.
Chapter V
IMPLEMENTATION
Article 28. Transition
Within 02 years from the effective date of this
Decree, airlines providing air transport services or commercial general
aviation services shall be required to meet aircraft fleet and legal capital
requirements set out in clause 3 Article 6 and Article 8 of this Decree.
Article 29. Effect [21]
This Decree comes into force from June 01, 2013 and
supersedes the Government’s Decree No. 76/2007/ND-CP dated May 09, 2007 prescribing
air transport service business and general aviation activities.
Article 30. Implementation organization
Ministers, heads of ministerial agencies, heads of
Governmental agencies and Chairpersons of provincial People’s Committees are
responsible for the implementation of this Decree./.

1. This Decree comes into force from July 01,
2016.
2. The following documents are abrogated:
a) Article 5 through Article 19 of the
Government’s Decree No. 30/2013/ND-CP dated April 08, 2013 on air transport
service business and general aviation service business;
b) Articles 36 and 37, Clause 1 Article 38,
Clauses 1 and 2 Article 39 of the Government’s Decree No. 102/2015/ND-CP dated
October 20, 2015 on management and operation of airports or airdromes.
3. Ministers, heads of ministerial agencies,
heads of Governmental agencies, Chairpersons of provincial People’s Committees
and relevant organizations and individuals shall implement this Decree./.”

industry, coming into force from July 01, 2016.
