CIRCULAR
AMENDMENTS
AND SUPPLEMENTS TO SOME ARTICLES OF CIRCULARS OF THE MINISTER OF EDUCATION AND
TRAINING ON DELEGATION, DEVOLUTION, AND DISTINCTION OF POWERS TO IMPLEMENT THE
STATE MANAGEMENT TASKS OF 02-LEVEL LOCAL GOVERNMENTS IN EDUCATION.
Pursuant to Resolution No. 190/2025/QH15 dated
February 19, 2025 of National Assembly of Vietnam on handling of certain issues
related to the reorganization of the state apparatus;
Pursuant to Government’s Decree No.
37/2025/ND-CP dated February 26, 2025 on functions, tasks, powers and organizational
structure of the Ministry of Education and Training of Vietnam;
Pursuant to Government’s Decree No.
142/2025/ND-CP dated June 12, 2025 on distinction of powers of two-tier local
government model in state management of the Ministry of Education and Training;
Pursuant to Government’s Decree No.
143/2025/ND-CP dated June 12, 2025 on delegation and devolution in state
management of the Ministry of Education and Training;
At the request of the Director of the Legal
Department;
The Minister of Education and Training issues a
Circular on amendments and supplements to some articles of circulars of the
Minister of Education and Training on delegation, devolution, and distinction
of powers to implement the state management tasks of 02-level local governments
in education.

AMENDMENTS AND
SUPPLEMENTS TO SOME ARTICLES OF CIRCULAR NO. 10/2025/TT-BGDDT DATED JUNE 12,
2025 ON DELEGATION, DEVOLUTION, AND DISTINCTION OF POWERS TO IMPLEMENT THE
STATE MANAGEMENT TASKS OF 02-LEVEL LOCAL GOVERNMENTS IN GENERAL EDUCATION
Article 1. Amendments to point
d, point dd of Clause 5, some points of Clause 10 of Article 10; supplements to
Clause 18 Article 18
1. Point d and point dd Clause 5 Article 18 are
amended as follows:
“d) The phrase “Chủ tịch Ủy ban nhân dân huyện, quận,
thị xã, thành phố trực thuộc tỉnh, thành phố trực thuộc Trung ương”
(“Chairperson of the People's Committee of the district, district-level town,
or city affiliated to province or centrally affiliated city”) is replaced with
the phrase “Chủ tịch Ủy ban nhân dân xã, phường, đặc khu” (“Chairperson of the
People's Committee of commune, ward, or special zone”) in Article 3 of Circular
No. 32/2020/TT-BGDDT;
The phrase “Ủy ban nhân dân cấp huyện”
("Chairperson of the People's Committee of the district") is replaced
with the phrase “Ủy ban nhân dân cấp xã” ("Chairperson of the People's
Committee of the commune") in Clause 1 of Article 6 and points dd, e of
Clause 1 of Article 10; the phrase “Sở Giáo dục và Đào tạo phối hợp với Ủy ban
nhân dân cấp huyện xây dựng nội dung phối hợp quản lý” ("Department of
Education and Training cooperates with the People's Committee of the district
to develop the content for cooperation”) is replaced with the phrase “Sở Giáo dục
và Đào tạo xây dựng nội dung quản lý” ("Department of Education develops
the content for cooperation”) in Clause 2 of Article 6; the phrase “dân tộc nội
trú cấp huyện” (“district-level boarding ethnic minority”) is replaced with the
phrase “dân tộc nội trú” (“boarding ethnic minority”) in points dd, e of Clause
1 of Article 10 of the Regulations on lower secondary schools, upper secondary
schools, and multi-level schools enclosed with Circular No. 32/2020/TT-BGDDT;
dd) Remove the phrase “Trưởng phòng Giáo dục và Đào
tạo” ("Director of the Sub-department of Education and Training") in
Article 3 of Circular No. 32/2020/TT-BGDDT.”
2. Clause 10 Article 18 is amended as follows:
a) Points a, b, and c of Clause 10 of Article 18
are amended as follows:
“a) Clause 1 Article 7 of Regulation on graduation
recognition in lower secondary education issued with Circular No.
31/2023/TT-BGDDT is amended as follows:

b) Clause 4 Article 8 of Regulation on graduation
recognition in lower secondary education issued with Circular No. 31/2023/TT-BGDDT
is amended as follows:
“4. The Council shall send request for graduation
recognition to the Chairperson of People's Committee of the commune for
approval.”.
c) Clause 5 Article 8 of Regulation on graduation
recognition in lower secondary education issued with Circular No.
31/2023/TT-BGDDT is amended as follows:
“5. The Chairperson of People's Committee of the
commune shall issue decision acknowledging graduation at request of education
institutions.”
b) Clause 5 (upon point e) and point e Clause 10
Article 18 are amended as follows:
“e) Clause 2 and Clause 7 Article 14 of Regulation
on graduation recognition in lower secondary education issued with Circular No.
31/2023/TT-BGDDT is amended as follows:
“2. Request the Chairperson of People's
Committee of the commune to promulgate decision on establishment of Council.”
“7. Request the Chairperson of People's
Committee of the commune to issue
decision on recognition for graduation and publish lists of students recognized
for graduation after decisions of the Chairperson of People's Committee of the
commune are issued; issue provisional certificate of graduation; transfer
certificate of graduation to students recognized for graduation.”
c) point g Clause 10 Article 18 is amended as
follows:

d) Point i is added after point h Clause 10 Article

“i) The phrase “Trưởng phòng Giáo dục và Đào tạo”
(“Directors of Sub-departments of Education and Training”) is replaced by the
phrase “Chủ tịch Ủy ban nhân dân cấp xã” (“Chairpersons of People's Committees
of communes”) in Article 3 of Circular No. 31/2023/TT-BGDDT.”
3. Clause 18 Article 18 is amended as follows:
“18. Amendments, supplements, and annulments of
certain contents in Appendix II, Appendix III, and Appendix IV issued with
Circular No. 15/2022/TT-BGDDT dated November 8, 2022 on upper secondary
education knowledge and teaching thereof in vocational education and training
institutions:
a) Amend to (3) of on the back of the Certificate
of completion of upper secondary school program - Appendix II “(3) Based on the
Birth Certificate, stating the province, centrally-affiliated city at the time
of issuance of the Certificate"
b) Remove the phrase “Huyện (Quận/Thị xã/TP thuộc tỉnh)”
(“District (District/District-level town/City affiliated to the province)”) on
the back of the Certificate of completion of upper secondary school program -
Appendix II;
b) Remove the phrases: “Huyện/ quận/ thị xã”
(District/District-level town) and “Huyện (quận, TX, TP thuộc tỉnh)” (“District
(District/District-level town/City affiliated to the province”) in the Book for
monitoring and evaluating students - Appendix III, Appendix IV;
d) Remove the phrases: “Bộ Lao động - Thương binh
và Xã hội” (“Ministry of Labor - Invalids and Social Affairs”), “Sở Lao động -
Thương binh và Xã hội” (“Department of Labor - Invalids and Social
Affairs"), and “Giám đốc Sở Lao động - Thương binh và Xã hội”

2. Clauses 5, 6, 7, 8, and 9 are supplemented as

commune”) in Clause 3, Article 15 of Circular No. 43/2021/TT-BGDĐT dated
December 30, 2021 of the Minister of Education and Training on evaluation of

levels.
7. Amendments and annulments of some contents of
Circular No. 04/2014/TT-BGDĐT dated February 28, 2014 of the Minister of
Education and Training introducing regulations on management of life skills
education and extracurricular activities (hereinafter referred to as “Circular
No. 04/2014/TT-BGDĐT”)
a) The phrase “Trưởng phòng giáo dục và đào tạo quận,
huyện” (“Head of the Department of Education and Training of the district”) is
replaced with the phrase “Chủ tịch Ủy ban nhân dân cấp xã” (“Chairperson of the
People's Committee of the commune”) in point b, clause 1, Article 8; the phrase
“Phòng giáo dục và đào tạo (“Department of Education and Training of the
district”) is replaced with the phrase “Ủy ban nhân dân cấp xã” (“People's
Committee of the commune”) and the phrase “Ủy ban nhân dân cấp huyện”
(“People's Committee of the district”) is replaced with the phrase “Ủy ban nhân
dân cấp tỉnh” (“People's Committee of the province”) in Article 13 of

Article 4. Amendments and
supplements to Clause 1 and adding Clauses 1a, 1b after Clause 1 Article 11
1. Clause 1 Article 11 is amended as follows:
“1. The phrase “phòng Giáo dục và Đào tạo, sở Giáo
dục và Đào tạo” (“Sub-department of Education and Training, Department of
Education and Training”) is replaced with the phrase “cơ quan có thẩm quyền”
(“competent authority”) in point b, clause 3, Article 5; the phrases “Ủy ban

leadership position allowances in public educational institutions are replaced
as follows:
a) The phrase "Trường chuyên biệt tỉnh hưởng
như trường hạng I” (“provincial-level special schools are entitled to the same
benefits as Grade I schools") is replaced with the phrase “Trường chuyên
biệt tỉnh hưởng như trường hạng I, trừ các trường quy định tại cột ghi chú của
số thứ tự 6 trong bảng này” (“provincial-level special schools are entitled to
the same benefits as Grade I schools, except for the schools specified in the
Notes column of item 6 in this table") in the Notes column of item 5 in
the table of Leadership position allowance coefficients in Educational
Institutions;
b) The phrase “Trường chuyên biệt huyện hưởng như
trường hạng I” (“provincial-level special schools are entitled to the same
benefits as Grade I schools") is replaced with the phrase “Trường phổ
thông dân tộc bán trú tiểu học; trường phổ thông dân tộc bán trú trung học cơ sở;

This Circular provides guidance on the ranking and
implementation of leadership position allowances for continuing education
centers and vocational education - continuing education centers (hereinafter
referred to as “continuing education centers”).

and literacy eradication management information system and report the complete
data from the commune to the provincial level via the education
universalization and literacy eradication management information system;

commune-level authorities and the use of the province-level system shall be
carried out according to the User Guide provided on the education

“7. Amendments, supplements, and annulments of
certain phrases in Clause 2 Article 5 in Regulation on enrolment and training
in university preparatory programs (UPP) enclosed with Circular No.
44/2021/TT-BGDDT (hereinafter referred to as “Regulation enclosed with Circular
No. 44/2021/TT-BGDDT”) and Appendix enclosed with Circular No. 44/2021/TT-BGDDT
a) The phrase “Số định danh cá nhân/số Căn cước
công dân/số Chứng minh thư/số Căn cước” (“Personal Identification
Number/Citizen ID Number/Identity Card Number”) is added after " Họ và tên
thí sinh” (“Candidate's full name”) in the Form of application for
admission/enrollment into UPPs in the Appendix issued with Circular No.
44/2021/TT-BGDDT;
b) The phrases of "Copy of Birth Certificate"
and “Confirmation of permanent residence of the candidate and biological
parents/guardian” are annulled in Clause 2 Article 5 of the Regulations issued
together with Circular No. 44/2021/TT-BGDĐT.
8. The phrase: “Trưởng phòng Giáo dục và Đào tạo”
(“head of the Sub-department of Education and Training”) is annulled in
Appendix I and Appendix II issued with Decision No. 17/2008/QD-BGDĐT dated
April 17, 2008 of the Minister of Education and Training.”

IMPLEMENTATION CLAUSES
Article 9. Implementation

2. This Circular shall cease to have effect from
March 1, 2027, except for cases where Laws, resolutions of the National
Assembly; ordinances, resolutions of the Standing Committee of the National
Assembly; decrees, resolutions of the Government of Vietnam; decisions of the
Prime Minister; and Circulars of the Minister of Education and Training that
stipulate the authority, responsibilities of state management, procedures and
processes prescribed in this Circular are adopted or promulgated from the date
on which this Circular is adopted or promulgated from the date on which this
Circular comes into force and take effect before March 1, 2027; in such cases,
the corresponding provisions in this Circular shall cease to have effect.
3. During the effective period of regulations in
this Circular are effective, if regulations on powers,
responsibilities for state management and procedures in this Circular are
different from relevant legislative documents issued before the effective date
of this Circular, regulations of this Circular shall apply.
Article 10. Implementation
responsibilities
The Chief officers, the Director of the Legal
Department, Heads of relevant units affiliated to the Ministry of Education and
Training; Chairpersons of Provincial-level People's Committees; Directors of
Departments of Education and Training; Chairpersons of commune-level People's
Committees; relevant agencies, organizations, and individuals are responsible
for implementing this Circular./.
