CIRCULAR
PRESCRIBING CREDIT RATING OF CREDIT
INSTITUTIONS AND FOREIGN BANK BRANCHES
Pursuant to
Law on State Bank of Vietnam No. 46/2010/QH12;
Pursuant to
the Law on Credit Institutions No. 32/2024/QH15;
Pursuant to
Decree No. 26/2025/ND-CP of the Government on the functions, tasks, powers and
organizational structure of the State Bank of Vietnam;
At the
request of Director General of Credit Institution Management and Supervision
Department;
The Governor
of the State Bank of Vietnam hereby issues the Circular prescribing the credit
rating of credit institutions and foreign bank branches.

Article
1. Scope
This Circular
provides for the credit rating of credit institutions and foreign bank branches
(FBBs).
Article
2. Regulated entities
1.
This Circular shall apply to the following entities:
a) Credit
institutions, including commercial banks (including partially State-owned
commercial banks, joint-stock commercial banks, joint venture banks, wholly
foreign-owned banks), cooperative banks, financial companies and financial
leasing companies;
b) FBBs;
c)
Organizations and individuals related to the credit rating of credit
institutions and FBBs.
2.
This Circular shall not be applied to credit institutions and FBBs
falling into one of the following cases:
a) Credit
institutions and FBBs that are placed under special control by the State Bank
of Vietnam (SBV);

c) Credit
institutions and FBBs that have operated for less than 24 months from the date
of commencement.
d) Credit
institutions and FBBs subject to early intervention in accordance with the Law
on Credit Institutions (excluding credit institutions and FBBs subject to early
intervention in accordance with Point b of Clause 1 of Article 156 of the Law
on Credit Institutions).
Article
3. Term interpretation
For the
purposes of this Circular, these terms are construed as follows:
1.
Capital adequacy ratio refers to an indicator that is calculated
in accordance with applicable regulations of the SBV on capital adequacy ratio,
prudential ratios and limits on operations of credit institutions and FBBs.
2.
Tier 1 capital adequacy ratio refers to an indicator calculated
according to the following regulations:
a) If a credit
institution or FBB applies the capital adequacy ratio defined according to
SBV’s regulations on prudential ratios and limits on operations of credit
institutions and FBBs (excluding the Circular No. 41/2016/TT-NHNN on capital
adequacy ratio for banks and FBBs (hereinafter referred to as Circular No.
41/2016/TT-NHNN), Circular No. 14/2025/TT-NHNN on capital adequacy ratio for
commercial banks and FBBs (hereinafter referred to as Circular No.
14/2025/TT-NHNN), its tier 1 capital adequacy ratio shall be calculated
adopting the following formula:

Total standalone risk-weighted assets
Standalone tier
1 capital and total standalone risk-weighted assets shall be calculated
according to SBV’s regulations on prudential ratios and limits on operations of
credit institutions and FBBs;
b) If a credit
institution or FBB applies the capital adequacy ratio defined according to the
Circular No. 41/2016/TT-NHNN, its tier 1 capital adequacy ratio shall be
calculated adopting the following formula:

KMR: Market risk capital requirements
Tier 1 capital,
RWA, KOR, KMR shall be calculated according to the
Circular No. 41/2016/TT-NHNN.
c) In case
commercial banks and FBBs implement the capital adequacy ratio as prescribed in
Circular No. 14/2025/TT-NHNN, the Tier 1 capital adequacy ratio shall
determined according to the formula prescribed in Circular No. 14/2025/TT-NHNN.
3.
Debt restructured as potentially bad debt refers to the balance
of a client's debt which is not yet written off as bad debt at a credit
institution or FBB as it is rescheduled or its interest is exempted or reduced
and classification group to which it belongs remains unchanged.
4.
Debts sold to VAMC as bad debts yet to be settled refers to bad
debts which have been purchased using special bonds by Vietnam Asset Management
Company (VAMC) and have yet to be disposed or recovered.
5.
Ratio of credit outstanding balances for Top 100 borrowers compared
to total credit outstanding balances of economic organizations and individuals
is determined by the total outstanding credit for top 100 borrowers (excluding
credit institutions and FBBs) to the total credit outstanding to all economic
organizations and individuals (excluding credit institutions and FBBs). In case
a credit institution or FBB has less than 100 customers (excluding credit
institutions or FBBs), the ratio of credit outstanding balances for Top 100
borrowers compared to total credit outstanding balances of economic
organizations and individuals shall be 100%.
6.
Operating expense refers to an operating expense entry posted on
an income statement as prescribed by laws on the financial reporting regime
applied to a credit institution and FBB.
7.
Gross operating income refers to an aggregate of net profit, net
profit/loss earned/incurred from services, net profit/loss earned/incurred from
foreign exchange business operations, net profit/loss earned/incurred from
trading securities transactions, net profit/loss earned/incurred from
investment securities transactions, net profit/loss earned/incurred from other
operations, and income generated from capital contributions or share purchases,
recorded on an income statement in accordance with laws on the financial
reporting regime applied to credit institutions and FBBs.
8.
Average equity refers to an entry of the owner’s equity that is presented
on a financial statement as provided by laws on the financial reporting regime
applied to credit institutions and FBBs and that is averaged over quarters of
an accounting year.

10.
Net interest margin (NIM) refers to an indicator for assessment
of the operational efficiency of a credit institution and FBB. This indicator
shows the difference between the average deposit interest rate and the average
loan interest rate of a credit institution and FBB. This indicator shall be
calculated as follows:

Average earning assets
Where:
-
Net interest income refers to an entry of net interest income presented
on an income statement as prescribed by laws on the financial reporting regime
applied to credit institutions and FBBs;
-
Average earning assets refer to all accounts and entries of deposits at
the SBV, deposits at other credit institutions and loans granted to other
credit institutions (except risk provisions), loans granted to customs
(excluding risk provisions), debt purchases (excluding risk provisions), and
investment securities (excluding risk provisions, price reduction provisions
and VAMC bonds), which are recorded on a financial statement in accordance with
laws on the financial reporting regime applied to credit institutions and FBBs
and averaged over quarters of an accounting year.
11.
Number of days it takes to collect interest refers to an
indicator for assessment for the operational efficiency of a credit institution
and FBB. This indicator shows the number of days required to collect interest
recognized as income of a credit institution or FBB. This indicator shall be
calculated as follows:

Where:

Interest and associated fees refer to an entry of interest and
associated fees presented on a financial statement as prescribed by laws on the
financial reporting regime applied to credit institutions and FBBs;
-
Interest and other similar income refers to an entry of interest and
other similar income presented in an income statement as prescribed by laws on
the financial reporting regime applied to credit institutions and FBBs;
-
n: n=4 if the number of days it takes to collect interest in a credit
rating year is calculated based on data about such interest obtained over
quarters of that year; n=2 if the number of days it takes to collect interest
in a credit rating year is calculated based on data about such interest
obtained over 6 months; n=4/3 if the number of days it takes to collect
interest in a credit rating year is calculated based on data about such
interest obtained over 9 months; n=1 if the number of days it takes to collect
interest in a credit rating year is calculated based on data about such
interest obtained over a year.
12.
Average liquid asset refers to an asset with high liquidity which
is determined under laws on the prudential ratios for operations of credit
institutions and FBBs (solvency ratio) and is averaged over ending business
days of quarters in a credit rating year.

14.
Ratio of total foreign currency positions to standalone average
equity shall be determined as follows:

Where:
-
k values range from 1 to 12, equaling to 12 months in a credit rating
year. If k=1, the standalone equity in the month (k-1) will be the standalone
equity determined at the end of December of the year preceding the credit
rating year;
-
Total positive foreign currency positions in the k month and total
negative foreign currency positions in the k month shall be determined
according to laws on foreign currency positions of credit institutions and FBBs
in the ending date of the k month;
-
Standalone equity shall be determined according to laws on the
prudential ratios for operations of credit institutions and FBBs (standalone
capital adequacy ratio).
15.
Ratio of the difference between interest sensitive assets and
interest sensitive liabilities to the equity shall be determined as
follows:

Where:

Interest sensitive assets refer to total on-balance sheet assets
sensitive to interest rates (except non-interest-bearing assets) which are
recorded in the explanatory notes on an income statement according to law on
the financial reporting regime applied to credit institutions and FBBs;
-
Interest sensitive liabilities refer to total on-balance sheet
liabilities sensitive to interest rates which are recorded in the explanatory
notes on an income statement according to laws on the financial reporting
regime applied to credit institutions and FBBs;
-
Equity refers to an entry of the owner’s equity that is presented on a financial
statement as provided by laws on the financial reporting regime applied to
credit institutions and FBBs.
16.
Minimum fine refers to the minimum level of the fine bracket imposed
on violations of organizations as prescribed in the Decree on administrative
penalties in the monetary and banking sector that is in effect on December 31
of the rating year (for periodic rating) or the last day of the quarter
immediately preceding the ranking time (for rating as prescribed in Clause 3 of
Article 22 of this Circular).
17.
Violations that have not been remedied refer to violations that
require remediation by competent state authorities but have not yet been
confirmed by competent state agencies to have been completed.
18. Average other assets refer to the item Other
assets reported under Item XII – Other assets on the financial statement, as
prescribed by the laws on financial reporting regimes applicable to credit
institutions and FBBs, are averaged over ending business days of quarters in a
credit rating year.
Article
4. Rules and approaches for credit rating of credit institutions and FBBs
1.
Credit rating must fully reflect the current business efficiency and
risks of credit institutions and FBBs, and must comply with laws.

a) Group 1:
Large-scale commercial banks (total average value of assets over quarters of
the credit rating year is greater than VND 300.000 billion);
b) Group 2:
Small-scale commercial banks (total average value of assets over quarters of
the credit rating year is equal to or less than VND 300.000 billion);
c) Group 3:
FBBs;
d) Group 4:
Financial companies (including: general finance companies, factoring finance
companies, consumer credit finance companies);
dd) Group 5:
Financial lease companies;
e) Group 6:
Cooperative banks.
3.
Credit institutions and FBBs shall be rated according to a set of
criteria. Each credit rating criterion must be subdivided into subgroups of
quantitative and qualitative indicators. The subgroup of quantitative
indicators is designed for measuring how healthy banking operations are, based
on data on operations of a credit institution and FBB. The subgroup of
qualitative indicators is designed for measuring the level of compliance with
laws of a credit institution and FBB.
4.
The weighting factor for both of these indicators and the weighting
factor for a single indicator in each equally-rated group shall be determined
on the basis of importance of each subgroup of indicators and a single
indicator for the level of healthiness of banking operations, inspection and
supervision requirements.
5.
Based on the score that a credit institution or FBB has achieved, it
shall be rated: Excellent (A), Good (B), Average (C), Fair (D) or Poor (E).

1.
Credit rating materials, data and information include:
a) Materials,
data and information that credit institutions and FBBs deliver to the SBV under
laws on the reporting and statistical regime;
b) Information
and data in the financial statements of credit institutions and FBBs that have
been independently audited in accordance with law;
b) Results of
supervision, inspection, assessment and audit (including information on
confirmation of completion of remediation of violations by credit institutions
and FBBs) of SBV, other competent state regulatory authorities, and independent
auditing companies related to the monetary and banking sector;
c) Other
materials, data and information that credit institutions and FBBs submit to the
SBV under laws and upon the request of the SBV.
2.
Figures used for calculation of credit rating
scores include:
a) Individual
figures of credit institutions and FBBs (except subsidiary companies and
associate companies);
b) Figures
released on December 31 each year by credit institutions and FBBs, except
figures of indicators which are calculated on average;
c) In case
where the credit rating is conducted in accordance with clause 3 of Article 22
hereof, the SBV's Governor shall make a decision on the scope of each material,
datum or information that may be used for credit rating of credit institutions
and FBBs.

8. Asset quality
Quality of
assets of a credit institution or FBB shall be assessed and scored according to
the following subgroups of indicators:
1.
Subgroup of quantitative indicators:
a) Ratio of bad
debts, Debts sold to VAMC as bad debts yet to be settled and debts restructured
as potentially bad debts to total liabilities plus debts sold to VAMC as bad
debts yet to be settled;
b) Ratio of
class-2 debts to total liabilities;
c) Ratio of
credit outstanding balances for Top 100 borrowers compared to total credit
outstanding balances of economic organizations and individuals;
d) Ratio of
class 3 through class 5 off-balance sheet liabilities and commitments to class
1 through class 5 off-balance sheet commitments;
dd) Ratio of
provisions for risks in trading securities or investment securities (except
provisions for risks associated with special bonds used for selling debts to
VAMC) to total balance of trading securities or investment securities (except
the balance of special bonds used for selling debts to VAMC);
g) Ratio of
outstanding credit balances for real estate investment and business to total
outstanding balances (excluding outstanding credit balances owed to other
credit institutions and FBBs)

The management

Article 10. Business efficiency
The business
efficiency criterion of a credit institution or foreign bank branches shall be
assessed and scored according to the following subgroups of indicators:
1.
Subgroup of quantitative indicators:
a) Ratio of the
profit before tax to the average equity;
b) Ratio of the
profit before tax to average total assets;
c) Net interest
margin (NIM);
d) Number of
days it takes to collect interest.
2.
Subgroup of qualitative indicators: Compliance with laws on financial
regimes applied to credit institutions and foreign bank branches.

The liquidity
criterion of a credit institution or FBB shall be assessed and scored according
to the following subgroups of indicators:
1.
Subgroup of quantitative indicators:
a) Ratio of Average
liquid assets to average total assets;
b) Ratio of
short-term finances for mid-term and long-term loans;
c) Ratio of
outstanding loan balance to total deposits;
d) Ratio of
deposits of clients with large deposit balances to total deposits.
2.
Subgroup of qualitative indicators: Compliance with laws on the solvency
ratio, the maximum ratio of short-term capital used as mid-term and long-term
loans, and the ratio of outstanding loan balance to total deposits.
Article 12. Sensitivity to market risk
The criterion
for measuring the sensitivity to market risk of a credit institution or foreign
bank branch shall be assessed and scored according to the following subgroups
of indicators:

a) Ratio of

to limits to total foreign currency positions under laws;

with laws on market risk management.
Section 2. SCORING AND RATING
Article 13. Scoring of specific indicators and subgroups of
quantitative indicators
The score of
each quantitative indicator in 06 rating criteria may be 1, 2, 3, 4 or 5; the
score given to a subgroup of quantitative indicator ranges from 1 (equivalent
to Poor) to 5 (equivalent to Excellent). To be specific:
1.
The score of a quantitative indicator shall be determined based on the
value comparison between that indicator and the corresponding benchmark. The
benchmark for scoring of a quantitative indicator shall be determined based on
historical data of a credit institution or FBB. The score of each quantitative
indicator shall be determined according to the following specific regulations:

(i) The score
will stand at 5 if the value of the indicator is either greater than or equal
to the benchmark of 1;
(ii) The score
will stand at 4 if the value of the indicator is either greater than or equal
to the benchmark of 2, and is less than the benchmark of 1;
(iii) The score
will stand at 3 if the value of the indicator is either greater than or equal
to the benchmark of 3, and is less than the benchmark of 2;
(iv) The score
will stand at 2 if the value of the indicator is either greater than or equal
to the benchmark of 4, and is less than the benchmark of 3;
(v) The score
will stand at 1 if the value of the indicator is less than the benchmark of 4.
b) The higher
the value of a quantitative indicator, the higher the risk level:
(i) The score
will stand at 5 if the value of the indicator is either less than or equal to
the benchmark of 1;
(ii) The score
will stand at 4 if the value of the indicator is either less than or equal to
the benchmark of 2, and is greater than the benchmark of 1;
(iii) The score
will stand at 3 if the value of the indicator is either less than or equal to
the benchmark of 3, and is greater than the benchmark of 2;

(v) The score
will stand at 1 if the value of the indicator is greater than the benchmark of
4.
c) The nearer
to 0 the value of a quantitative indicator, the lower the risk level:
(i) The score
will stand at 5 if the absolute value of the indicator is either less than or
equal to the benchmark of 1;
(ii) The score
will stand at 4 if the absolute value of the indicator is either less than or
equal to the benchmark of 2, and is greater than the benchmark of 1;
(iii) The score
will stand at 3 if the absolute value of the indicator is either less than or
equal to the benchmark of 3, and is greater than the benchmark of 2;
(iv) The score
will stand at 2 if the absolute value of the indicator is either less than or
equal to the benchmark of 4, and is greater than the benchmark of 3;
(v) The score
will stand at 1 if the absolute value of the indicator is greater than the
benchmark of 4.
d) Benchmark of
1, 2, 3 and 4 of each quantitative indicator applied to each equally-ranked
group shall be subject to Article 14 hereof;
d) In the case
where commercial banks and FBBs apply the capital adequacy ratio according to
the standardized approach prescribed in Circular No. 14/2025/TT-NHNN or the internal
rating-based (IRB) approach prescribed in Circular No. 14/2025/TT-NHNN, the
benchmark used for scoring shall be the benchmark applied to the capital
adequacy ratio as stipulated in Circular No. 41/2016/TT-NHNN, as regulated in
Article 14 hereof;

2.
The score of a subgroup of quantitative indicators in each criterion
shall be determined by the sum of scores given to specific quantitative
indicators multiplied by the weighting factors for these indicators. The
weighting factors for quantitative indicators applied to specific equally rated
groups shall be regulated in Article 15 hereof.
3.
As for quantitative indicators prescribed in point a of clause 1 of
Article 7 hereof, if credit institutions and FBBs apply the capital adequacy
ratio according to the standardized method prescribed in Circular No.
14/2025/TT-NHNN before January 1, 2030 or the IRB approach prescribed in
Circular No. 14/2025/TT-NHNN, the score of a quantitative indicator prescribed
in point a of clause 1 of Article 7 hereof will be increased by 01 point after
being determined as provided in point a, d and dd of clause 1 of this Article
and ensuring that the score of this quantitative indicator is a maximum of 5..
Article 14. Scoring benchmarks for specific quantitative
indicators

Article 16. Scoring of subgroups of qualitative indicators
1.
The score given to a subgroup of qualitative indicators in each rating
criterion may be determined based on the assessment of the level of compliance
with laws and adherence to the directions and operations of the SBV by credit institutions
and FBBs in the monetary and banking sector, and will be 1, 2, 3, 4 or 5. Lower
score means less compliance with law.
2.
Violations committed by credit institutions and FBBs may be used for
scoring of subgroup of qualitative indicators in each rating criterion
specified in Articles 7, 8, 9, 10, 11, 12 hereof may be determined according to
the following 02 (two) criteria:
a) Time for
determination of violations:
(i) Violations
have been detected within 04 (four) years preceding the rating year but have
not been remedied before December 31 of the rating year; (ii) Violations have
been detected within the rating year;
b) Methods of
determination of violations:
(i) Decisions
on administrative penalties issued by competent persons;
(ii) Decisions
to enforce remedial measures issued by competent persons;

(iv) Reports on
results of surveillance, inspection, assessment and audit of competent
regulatory authorities under laws on monetary, banking (including SBV’s
regional branches and other affiliated units of the SBV, other state regulatory
authorities and independent audit firms);
(ii) Violations
are detected and reported by credit institutions and FBBs of their own accord,
and have not been remedied yet;
vi) In case a
single violation is recorded in more than one of the document forms specified
in points b(i), b(ii), b(iii), b(iv), b(v) Clause 2 of this Article, it is
determined as 01 violation.
3.
The score of subgroup of qualitative indicators shall be determined
based on the value comparison between the subgroup of qualitative indicators
prescribed in Clause 4 of this Article and the corresponding benchmark
prescribed in Article 17 of this Circular. To be specific:
a) The score
will be 5 if the value of the subgroup of qualitative indicators is lower than
or equal to benchmark of 1;
b) The score
will be 4 if the value of the subgroup of qualitative indicators is lower than
or equal to benchmark of 2 and higher than benchmark of 1;
c) The score
will be 3 if the value of the subgroup of qualitative indicators is lower than
or equal to benchmark of 3 and higher than benchmark of 2;
d) The score
will be 2 if the value of the subgroup of qualitative indicators is lower than
or equal to benchmark of 4 and higher than benchmark of 3;
dd) The score
will be 1 if the value of the subgroup of qualitative indicators is higher than
benchmark of 4.

Where:
-
Total fines mean total fines for violations against indicators included
in the subgroup of qualitative indicators in a rating criterion. Total fines shall
be the sum of the fines of the violations determined in Point b(i) of Clause 2
of this Article specified in decisions to impose administrative penalties of
competent persons and the minimum fines for violations determined in Point
b(ii), b(iii), b(iv), b(v) of Clause 2 of this Article as prescribed in the
Decree on administrative penalties in the monetary and banking sector. For
violations determined in Point b(iv), b(v) Clause 2 of this Article that are
not yet regulated in the Decree on administrative penalties in the monetary and
banking sector, the fine level to determine the total fine level is 0. With
regard to violations for which warnings are imposed, the fines constituting
total fines shall be 0;
-
Standalone equity shall be determined according to SBV’s regulations on
prudential ratios and limits on operations of credit institutions and FBBs.
5.
After determination of the score of subgroup of qualitative indicators
in each rating criterion according to the provisions of Clause 3 of this Article,
credit institutions and FBBs will be subject to the further score deduction on
conditions that the subtrahend point is not greater than 0,9 according to the
following principles:
a) If the
credit institution or FBB commits more than 02 (two) violations in the same
subgroup of qualitative indicators in each rating criterion, it will get 0,1
point deducted from total score given to that subgroup of qualitative
indicators as a penalty for each violation (applicable to the second or
subsequent violation), except the case specified in Point b of this Clause;

6.
If a credit institution or FBB fails to fully implement the remedial
plan, recommendations and cautions given by SBV in terms of organizational
structure, management and administration, unless such failure is a result of a
force majeure event, the score of the subgroup of qualitative indicators
specified in Clause 2 Article 9 of this Circular after it is determined
according to Clauses 3, 5 of this Article shall be subject to the further score
deduction according to the following principles:
a) If the score
of the subgroup of qualitative indicators is greater than 1, the credit
institution or FBB will get 1 point deducted from the score given to that
subgroup of qualitative indicators;
b) If the score
of the subgroup of qualitative indicators is lower than or equal to 1, the
score given to that subgroup of qualitative indicators of the credit
institution or FBB will be deducted and will be 0,1 point.
7.
In case where credit institutions or FBBs have yet to be or are not
subject to one or more indicators in the subgroup of qualitative indicators in
accordance with regulations of law on money and banking, scoring of such an
indicator or indicators will be delayed or cancelled.
Article 17. Benchmark for scoring of each subgroup of
qualitative indicators
The higher the
value of the benchmark 1, benchmark 2, benchmark 3 and benchmark 4 of each
subgroup of qualitative indicators is given, the lower the degree of compliance
with laws of the credit institution or FBB is assessed. These benchmarks are

Scores of
specific criteria prescribed in Article 7, 8, 9, 10, 11 and 12 hereof shall be

As for finance companies and financial leasing companies, the weighting
factor for the criterion of Sensitivity to market risk, the weighting factor
for the subgroup of quantitative indicators in the criterion of Sensitivity to
market risk and the weighting factor for the subgroup of qualitative indicators
in the criterion of Sensitivity to market risk shall be 5%, 5% and 0%,
respectively.
Article 19. Method for calculation of total rating score
1.
Total rating scores of credit institutions and FBBs shall be determined
by the sum of points of specific criteria multiplied by the corresponding
weighting factor of each criterion. The weighting factor for each criterion
shall be regulated in Article 19 hereof.
2.
Certain points shall be deducted from total scores of credit
institutions and FBBs if the score of the subgroup of qualitative indicators in
at least 4 criteria that they get is either less than or equal to 1. This
deduction may happen in the following cases:
a) If total
rating score is greater than 1, 1 point shall be deducted from such total
rating score of credit institutions or FBBs;
b) If total
rating score is either less than or equal to 1, 0,1 point shall be deducted
from such total rating score of credit institutions or FBBs.
3.
In case the audited financial statement of the rating year of a credit
institution or FBB are not fully accepted, the total score of the credit
institution or FBB after being determined according to the provisions in
Clauses 1 and 2 of this Article will continue to be deducted in the following
cases:
a) If total
rating score is greater than 0,5, 0,5 point shall be deducted from such total
rating score of credit institutions or FBBs;
b) If total
rating score is either less than or equal to 0,5, 0,1 point shall be deducted
from such total rating score of credit institutions or FBBs.

Credit
institutions and foreign bank branches shall be rated as follows:
1.
Credit institutions or foreign bank branches shall be ranked A
(Excellent) if their total score is either greater than or equal to 4,5.
2.
Credit institutions or foreign bank branches shall be ranked B (Good) if
their total score is less than 4,5 and greater than or equal to 3,5.
3.
Credit institutions or foreign bank branches shall be ranked C (Average)
if their total score is less than 3,5 and greater than or equal to 2,5.
4.
Credit institutions or foreign bank branches shall be ranked D (Fair) if
their total score is less than 2,5 and greater than or equal to 1,5.
5.
Credit institutions or foreign bank branches shall be ranked E (Poor) if
their total score is less than 1,5.
6.
Notwithstanding provisions laid down in clause 4 of Article 20 hereof,
credit institutions or FBBs shall be ranked D if they fall into cases specified
in point a and b of clause 1 of Article 156 of the Law on Credit Institutions.
7.
Aside from regulations in clause 5 of Article 20 hereof, credit
institutions or FBBs shall be ranked E if they fall into cases specified in
point a, b, c and dd of clause 1 of Article 162 of the Law on Credit
Institutions.
8.
Total rating score will be rounded to the nearest hundredth according to
the following principles:

(i) The second
decimal digit is increased by 1 if the third decimal digit is from 5 to 9;
(ii) The second

b) The
component scores of each criterion group shall be rounded to the third decimal
place according to the following principles:
(i) The third
decimal digit is increased by 1 if the fourth decimal digit is from 5 to 9;

Section 3. CREDIT RATING RESULTS
Article 21. Frequency, implementation deadlines and approval
of credit rating results
1.
By June 10 every year, Credit Institution Management and Supervision
Department shall act as the focal point to cooperate with SBV’s regional
branches in submitting the rating results of the immediately preceding year for
credit institutions and FBBs to the Governor of the SBV for approval.
2.
Before June 30th each year, the Governor of the SBV shall approve the
rating results of the immediately preceding year for credit institutions and
FBBs.

Article 22. Notification of credit rating results
1.
Within 15 days after SBV’s Governor approves credit rating results, Credit
Institution Management and Supervision Department and the SBV’s regional
branches shall notify the rating results to each credit institution and FBB
according to the micro-prudential supervision plan.
2.
The notification of rating results for each credit institution and FBB
shall include the rate, total score, and scores of each criterion group as
prescribed in Articles 7, 8, 9, 10, 11, and 12 hereof.
3.
The Credit Institution Management and Supervision Department shall take
charge of providing the rating results of credit institutions and FBBs to other
affiliated units of the SBV to serve state management requirements by functions
and tasks of those units, upon approval by the Governor of the SBV.
4. The
State Bank shall provide the rating results of credit institutions and FBBs to
other state regulatory entities or authorities in accordance with law.
5.
The notification of rating results of joint venture banks, wholly
foreign-owned banks, FBBs, and non-banking foreign credit institutions to
foreign central banks and foreign financial supervision authorities shall be
conducted in accordance with the Memorandum of Understanding signed between the
SBV, foreign central banks and foreign banking supervision authorities.
Article 24. Management of credit rating results
1.
Credit institutions and FBBs are not allowed to provide credit rating
results for any third party (except in cases where a FBB provides rating
results to the parent bank after the parent bank has made a written commitment
not to provide rating results to a third party) in any form.
2.
Credit Institution Management and Supervision Department, SBV’s regional
branches, other affiliates of the SBV and other state regulatory entities or
authorities having access to credit rating results of credit institutions and
FBBs as provided in clauses 3, 4, and 5 of Article 23 hereof shall store and
use them in accordance with laws on protection of state secrets in the banking
sector.

IMPLEMENTATION
Article 25. Responsibilities of credit institutions and FBBs
1.
Credit institutions and FBBs shall be fully accountable for the accuracy
and authenticity of provided materials, data and information, and shall give
supplementary explanations and reports about issues related to credit rating
upon the request of the SBV.
2.
The management of credit rating results shall be subject to clause 1 of
Article 24 hereof and regulations of other laws.
Article 26. Responsibilities and authority of Credit
Institution Management and Supervision Department
1.
Take charge and cooperate with SBV’s regional branches and relevant
units in carrying out the credit rating of credit institutions and FBBs subject
to micro-prudential supervision of each unit.
2.
Act as a focal point to counsel and appeal to the SBV’s Governor to
grant the approval of credit rating results of credit institutions and FBBs.
3.
Apply controlling measures to credit institutions and FBBs subject to
micro-prudential supervision as per laws based on credit rating results which
have already been approved.
4.
Keep custody of, inform and provide credit rating results to credit
institutions and FBBs in accordance with this Circular and laws on protection
of state secrets in the banking sector.

4.

Article 28. Responsibilities and powers of other affiliates
of the SBV
1.
Before March 31st of the year immediately following the rating year, the
SBV Inspectorate shall provide the Credit Institution Management and
Supervision Department with: (i) documents, information, and data on violations
against regulations related to monetary and banking; (ii) results of the
implementation of conclusions, petitions, and handling decisions related to
inspections and audits (including detailed results of the implementation of
each petition and handling decision regarding inspections and audits, as well
as related information and data on actual financial status and operations (if
any)); (iii) other documents, information, and data as prescribed in Article 5
hereof, upon the request of the Credit Institution Management and Supervision
Department to serve as the basis for the rating process, and be accountable for
the accuracy and completeness of the provided documents, information, and data.
2.
Before March 31st of the year immediately following the rating year,
other relevant affiliates of the SBV (excluding the SBV Inspectorate) shall
provide the Credit Institution Management and Supervision Department and the SBV’s
Regional Branch with documents, information, and data as requested by the Credit
Institution Management and Supervision Department and the SBV’s Regional
Branch, in accordance with this Circular, to serve as the basis for the rating
process, and shall be accountable for the accuracy and completeness of the
provided documents, information, and data.
3.
Perform other tasks and exercise other powers as prescribed in this
Circular.

Circular No. 52/2018/TT-NHNN dated December 31, 2018, on the ranking of
credit institutions and foreign bank branches, and Circular No. 23/2021/TT-NHNN
dated December 31, 2021, amending Circular No. 52/2018/TT-NHNN of the Governor
of the State Bank of Vietnam on the credit rating of credit institutions and
foreign bank branches, shall cease to be effective from November 1, 2025,
except for the regulations specified in Clause 3 of this Article.
3.
The credit rating of credit institutions and foreign bank branches for
the 2025 rating year shall be conducted in accordance with Circular No.
52/2018/TT-NHNN and Circular No. 23/2021/TT-NHNN. The responsibilities of the
affiliates of the SBV in the implementation of the ranking of credit
institutions and FBBs for the 2025 rating year shall be carried out in
accordance with this Circular.
Article 30. Organization of implementation
Heads of units
affiliated to the SBV, credit institutions, and FBBs are responsible for the
implementation of this Circular./.
