PRESCRIBING FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF MINISTRY OF AGRICULTURE AND ENVIRONMENT OF VIET NAM

Pursuant to the Law on Government Organization No. 63/2025/QH15;

At the request of the Minister of Agriculture and Environment of Viet Nam;

The Government of Viet Nam promulgates a Decree prescribing the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Environment of Viet Nam.

Article 1. Position and functions

The Ministry of Agriculture and Environment of Viet Nam is a governmental agency that performs the function of state management in the following fields: agriculture; forestry; salt production; fisheries; irrigation; dike management and disaster preparedness and control; rural development; land; water resources; environment; hydrometeorology; climate change; survey and mapping; integrated management of resources and environmental protection of seas and islands; remote sensing; and state management of public services rendered in the fields under its management.

Article 2. Tasks and powers

1. Submit the following documents to the Government, including bills and draft resolutions of the National Assembly; draft ordinances and draft resolutions of the Standing Committee of the National Assembly; the Government’s draft decrees and resolutions formulated under the Ministry's approved annual law-making programs and plans, and other mechanisms, policies, projects, schemes and legislative documents under the Ministry’s state management as assigned by the Government or the Prime Minister. 

2. Submit to the Government and Prime Minister for approval, and organize the implementation of strategies, plannings, plans and programs, projects and works of national importance in the fields and sectors under its jurisdiction.

3. Submit to the Prime Minister draft decisions, directives and other documents to be promulgated by the Prime Minister.

4. Consider giving approval for development strategies, plannings and programs in the fields and sectors under its jurisdiction; investment projects as decentralized and authorized by the Government or the Prime Minister.

5. Promulgate circulars, decisions and other documents on state management of the fields and sectors under its management; direct, provide guidance on, organize, inspect and assess the implementation of strategies, policies, plannings, plans, programs, schemes, projects, tasks, legislative documents under its management after their approval and promulgation; develop national standards; formulate and promulgate national indicators, national technical regulations, technical regulations, statistical indicators and economic-technical norms in the fields and sectors under its state management; disseminate information on and raise public awareness of the law relating to the fields and sectors under its management.

6. Regarding crop production and plant protection

a) Direct and provide guidance on crop production activities; the development of growing areas and the production of safe agricultural products; plant protection; plant quarantine; crop production adapted to climate change; the addressing of technical barriers relating to plant quarantine in the import and export of crop products to facilitate market access; and the nationwide management of growing areas and packing facilities in accordance with law;

b) Direct and provide guidance on the use of state budget funds for programs for the prevention and control of plant disease outbreaks and the remediation of their consequences; direct the restoration of crop production in the event of natural disasters or disease outbreaks;

c) Direct the implementation of cropping patterns, cultivation practices, crop production techniques and harvesting practices; review and evaluate the implementation of annual crop production plans;

7. Regarding livestock production and animal health

a) Promulgate the list of livestock breeds subject to conservation and the list of livestock breeds banned from export; collect, conserve, exploit and develop animal genetic resources; establish criteria for and recognize disease-free livestock production areas; direct, provide guidance on and organize the implementation of measures for the prevention and treatment of animal diseases and the control of animal disease outbreaks; conduct animal and animal product quarantine; control the slaughter of animals and the preliminary processing and processing of animals and animal products; conduct veterinary hygiene inspections; manage veterinary drugs; and manage the practice of veterinary medicine;

b) Direct and provide guidance on the use of state budget-derived funding for national programs and plans for prevention, control and mitigation of consequences of animal disease outbreaks; 

c) Direct the implementation of regulations on livestock structure; breeding techniques; carry out final review and assessment of implementation of annual livestock production plans;

d) Direct scientific research into and application of microorganisms and chemicals for veterinary use; and conduct research into and production of vaccines and biological products for veterinary use;

dd) Direct, provide guidance on, and supervise the performance of state management of livestock breeds and products thereof, animal feeds, eligibility requirements to be satisfied by breeding farms, animal waste management; livestock breeding, breeding of other animals, and humane treatment of domestic animals.

8. Regarding forestry

a) Direct and provide guidance on the implementation of regulations on forest management. Promulgate lists of endangered, precious and rare forest plant and animal species, together with regimes for their management and protection. Provide guidance on the procedures for the exploitation, breeding and cultivation of forest plant and animal species and species listed in the Appendices to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), as well as on the rescue and release of forest animals back into the wild;

b) Manage systems of reserve forests, protective forests and production forests; protect forest ecosystems and forest organisms;

d) Direct and provide guidance on the conversion of forest types, the repurposing of forests, and the temporary use of forests in accordance with law; decide the conversion of forest types for forests under the Ministry’s management;

dd) Direct and provide guidance on forest ranger activities; provide unified professional and technical direction for forest rangers in accordance with law;

e) Perform state management of forest fire prevention and fighting;

g) Direct and provide guidance on integrated forestry, agricultural and fisheries production; the cultivation or planting, development and harvesting of medicinal plants in reserve forests, protective forests and production forests; and the harvesting of non-timber forest products in all forest types in accordance with law; organize the investigation, assessment, collection and preservation of endemic or valuable species of microorganisms and fungi threatened with extinction in all forest types for inclusion in the list of endangered, precious and rare species prioritized for protection;

h) Direct, and provide guidance on, the organization of ecotourism, resort and recreational activities in reserve forests, protective forests and production forests in accordance with regulations of law;

i) Direct, and provide guidance on, the implementation of policies on payment for forest environmental services and forest carbon sequestration and storage services in accordance with regulations of law; organize the management of Viet Nam Forest Protection and Development Fund; provide guidance on the organization, management and operation of provincial-level forest protection and development funds;

k) Direct the performance of state management tasks relating to forest management, protection, development and use; forest product harvesting; and forestry production associated with forest product processing and trade; provide guidance on the formulation, approval and implementation of sustainable forest management plans; establish criteria for sustainable forest management; provide guidance on the issuance of sustainable forest management certificates and forest valuation in accordance with law;

l) Direct and provide guidance on the development of forestry plant varieties; the formulation of a list of principal forestry tree species; procedures for the recognition of varieties and seed sources and for the export and import of forestry tree varieties; the development of a system of seed stands, seed orchards and national botanical gardens; the prevention and control of forest pests; and research, selection and breeding, trials, testing, quality management, production, trading, and import and export of forestry tree varieties;

m) Provide guidance on forest allocation, forest leasing, forest appropriation and replacement afforestation; forest surveys, forest inventories, forest change monitoring and the preparation of forest management records; the monitoring and assessment of forest resources; prescribe identification codes for planted forests; and establish and manage forest databases;

o) Decide the closure and reopening of natural forests nationwide or in multiple provinces and centrally-governed cities; submit to the Prime Minister for consideration and decision a proposal to provide support to forest owners implementing the Prime Minister’s decision to close natural forests;

p) Formulate regulations on dossiers for legal forest products; the order and procedures for managing the origin of forest products; and the issuance of licenses and certificates for forest products to be exported or imported; manage the export, import, temporary import for re-export, temporary export for re-import and transit of specimens of forest plant and animal species in accordance with Vietnamese law and treaties to which Viet Nam is a party; prescribe the order, procedures and documentation requirements for tracing the origin of and marking specimens of endangered, precious and rare forest plant and animal species and specimens of species listed in the CITES Appendices.

9. Regarding salt production

a) Direct, and provide guidance on, the implementation of technical procedures for salt production, harvesting, preliminary processing, processing and storage; review and assess the implementation of annual salt production plans;

c) Inspect the implementation of national technical regulations and procedures for production, processing and storage of salt and salt products (except those used in medical sector).

10. Regarding fisheries

a) Formulate planning for the protection and exploitation of aquatic resources and national planning for the system of fishing ports and storm-shelter anchorages for fishing vessels;

b) Direct and provide guidance on the implementation of regulations on co-management in the protection of aquatic resources; manage endangered, precious and rare aquatic species; marine protected areas; aquatic resource protection zones; areas where fishing is prohibited for fixed periods; prohibited fishing gear or gear types/categories; the restoration of aquatic resources and rehabilitation of aquatic species’ habitats; the surveys and assessment of aquatic resources; aquatic resources and aquatic ecosystems in reserve forests and protective forests; and aquatic resources in wetland conservation areas in accordance with law; organize the management of the Viet Nam Fund for Aquatic Resources Protection and Development; provide guidance on the organization, management and operation of provincial-level Funds for Aquatic Resources Protection and Development;

c) Provide guidance on the implementation of regulations of law on fishing ports and storm-shelter anchorages for fishing vessels; promulgate regulations on fishing vessel safety and the provision of disaster-prevention information to fishers and fishing vessels at sea; determine and allocate fishing license quotas and allowable catches by species in offshore waters to provinces and centrally-governed cities in accordance with regulations; develop, operate and manage the Fishing Vessel Monitoring System; and process fishing vessel tracking data for state management purposes;

dd) Direct and provide guidance on the performance of state management tasks relating to aquatic breeds, aquafeed and products for treating the aquaculture environment;

e) Direct and provide guidance on the performance of state management tasks relating to fisheries surveillance; patrol, inspection and control at sea; the investigation and handling of violations of law; and the application of measures to prevent violations of regulations on fishing activities and protection of aquatic resources in accordance with law.

11. Regarding irrigation

a) Direct and provide guidance on basic surveys of irrigation, waterlogging prevention and drainage (excluding drainage and wastewater treatment in urban areas, concentrated rural residential areas, concentrated production, business and service areas, industrial clusters and industrial parks); investment in the construction, repair and upgrading of irrigation works and rural clean water supply works; and the operation of irrigation reservoirs and irrigation works in accordance with law;

b) Direct and provide guidance on the formulation, submission for approval, and implementation of irrigation plannings for agricultural purposes and multiple purposes associated with socio-economic sectors in accordance with regulations of law;

c) Direct and provide guidance on the formulation and implementation of technical procedures and policies on irrigation and drainage; the management of irrigation and drainage and the operation of irrigation works; and the management of irrigation infrastructure assets; provide guidance on the implementation of regulations on the discharge of wastewater into irrigation works;

d) Provide guidance on the inclusion of plans for the development of irrigation networks in provincial plannings in accordance with regulations of law;

dd) Direct and provide guidance on the implementation of measures to prevent and control drought, saltwater intrusion, waterlogging and desertification, and to mitigate their consequences; organize the monitoring, forecasting and warning of drought, saltwater intrusion and waterlogging, as well as the monitoring of water quantity and quality in irrigation systems, in accordance with regulations of law;

e) Direct and provide guidance on the formulation of plans for the protection of irrigation works and the demarcation of their protection zones;

h) Organize the formulation and review of planning for disaster preparedness and control and irrigation, and of irrigation planning, in accordance with regulations of law;

i) Direct and provide guidance on basic surveys and irrigation planning; organize inventories of water resources in irrigation works in conjunction with forecasts of drought, water scarcity, saltwater intrusion, desertification, floods, inundation and waterlogging; invest in and construct irrigation works for water storage, supply, irrigation, drainage and water conveyance to serve agricultural production, domestic use and other economic sectors; prevent and control water-related disasters and mitigate their adverse impacts, and prevent and control water pollution in irrigation systems under the Ministry’s management, in accordance with regulations of law;

k) Direct and provide guidance on matters relating to the safety of dams and reservoirs in accordance with regulations of law.

12. Regarding dike management and disaster preparedness and control

a) Direct and provide guidance on the implementation of regulations of law regarding mechanisms, human resources, supplies, vehicles, equipment, information systems, and essential goods for disaster preparedness and control;

b) Formulate the national disaster preparedness and control plan; provide guidance on the formulation and implementation of disaster preparedness and control plans at all local administrative levels;

c) Direct and provide guidance on post-disaster recovery, rehabilitation and reconstruction activities in accordance with regulations of law and international treaties to which Viet Nam is a party; compile, assess and tabulate disaster damage data and publish such data; monitor, analyze and assess damage caused by disasters that may affect Viet Nam, in accordance with regulations of law;

d) Direct and provide guidance on the establishment and enhancement of the operational effectiveness of commune-level disaster preparedness and control response forces and people’s dike management forces; organize training and professional development for personnel engaged in disaster preparedness and control;

dd) Direct and provide guidance on the formulation of dike planning and flood prevention and control planning for river sections protected by dikes, and plans for investment in the construction, repair, maintenance, upgrading, strengthening, protection and use of dikes, as well as dike protection operations, in accordance with regulations of law;

g) Compile and assess disaster damage and publish data on such damage; provide guidance on the compilation of statistics on and assessment of disaster damage nationwide;

h) Advise the National Civil Defense Steering Committee in directing disaster preparedness and control activities;

i) Organize the management of the Vietnam Disaster Management Fund (VNDMF).

13. Regarding rural development

a) Formulate rural development policies in the fields under the Ministry’s management; formulate, coordinate and organize the implementation of the National target programs on development of new-style rural areas, sustainable poverty reduction, and socio-economic development in ethnic minority and mountainous areas for each period, as assigned by the Government;

b) Consolidate and formulate overall plans and programs for rural development; strategies for the development of rural trades and craft villages associated with households, agricultural cooperatives and unions of agricultural cooperatives; promulgate policies to encourage the development of rural trades and the preservation and development of craft villages;

c) Direct and provide guidance on the development of agricultural electromechanical engineering; rural trades and craft villages associated with households, agricultural cooperatives and unions of agricultural cooperatives; direct the formulation and the implementation of programs, schemes and projects to support production organization and the development of craft villages and rural trades in accordance with regulations of law;

d) Provide guidance on the arrangement of residential areas and the relocation and resettlement of populations affected by irrigation and hydropower works; and on the arrangement and stabilization of residential areas in disaster-prone areas, extremely disadvantaged areas, border areas and islands, areas affected by sea level rise due to climate change, and areas experiencing spontaneous migration;

dd) Organize agricultural vocational training and vocational training for the development of rural trades for rural workers; support the development of start-up and innovation programs and models for rural agricultural workers; compile annual and periodic plans, training needs and funding requirements for agricultural vocational training for rural workers;

14. Regarding quality management of agricultural, forestry and fishery products and goods, and salt

a) Direct, provide guidance on, and supervise compliance with quality assurance requirements to ensure food safety at the primary production stages of crop production, livestock farming, aquaculture, harvesting, fishing, extraction and slaughter;

b) Designate food testing laboratories serving the performance of state management tasks and reference testing laboratories; make final determinations in cases of discrepancies between test results issued by laboratories in the fields under the Ministry’s management, at the primary production stages of crop production, livestock farming, aquaculture, harvesting, fishing, extraction and slaughter;

c) Publish lists of countries and territories, and of production and business establishments, authorized to export to Viet Nam in the fields under the Ministry’s management;

d) Organize the implementation of traceability requirements for products and goods under the Ministry’s management;

dd) Perform state management of the quality of products and goods under the Ministry’s management during production and of goods exported, imported and placed on the market;

e) Promulgate lists of medium-risk and high-risk products and goods falling within the Ministry’s management;

g) Designate conformity assessment bodies and manage their activities in conducting testing, inspection, certification, verification and validation to meet state management requirements for the quality of high-risk products and goods falling within the Ministry’s management.

15. Regarding preservation, processing and transportation of agricultural, forestry and fishery products

b) Direct and provide guidance on the implementation of strategies, schemes, programs, mechanisms and policies for developing the processing sector in association with production and markets; support efforts to reduce post-harvest losses in product sectors falling within the Ministry’s management;

c) Provide guidance on, and supervise the satisfaction of compliance with regulations on eligibility conditions for establishments engaged in the preliminary processing, processing, preservation and transportation of agricultural, forestry and fishery products falling within the Ministry’s management;

d) Provide guidance on and support efforts to enhance processing capacity for agricultural, forestry and fishery products.

16. Regarding trade in agricultural, forestry and fishery products and salt

a) Conduct negotiations to promote market access for agricultural products; address technical barriers to the export and import of agricultural products; and develop cooperation and linkages in the production and marketing of agricultural products, as assigned by the Government or the Prime Minister;

b) Conduct market analysis and forecasting, trade promotion, and other activities related to branding programs for agricultural, forestry and fishery products and salt under the Ministry’s management;

c) Promulgate detailed lists of goods prohibited from import and goods prohibited from export, and lists of imports and exports subject to the Ministry’s specialized management, in accordance with regulations of law.

17. Regarding agricultural extension

a) Provide guidance on and inspect compliance with regulations governing agricultural extension activities;

c) Submit to competent authorities for promulgation, or promulgate within its competence, policies on the private sector involvement in agricultural extension activities and on cooperation with domestic and foreign organizations and individuals to mobilize funding and other resources for agricultural extension activities.

18. Regarding cooperatives and other forms of collective and private economic organization

a) Formulate mechanisms and policies to encourage and support the development of household businesses, farms, artels, cooperatives, cooperative unions, and production linkages along agricultural value chains;

b) Provide guidance on compliance with regulations on conditional business lines and service sectors specified in the list promulgated by the Government, and handle violations within its competence;

c) Direct and provide guidance on artels, cooperatives, cooperative unions and farms in fields and sectors under the Ministry’s state management.

19. Regarding land management

a) Provide guidance on land surveying, the updating of cadastral maps, and the preparation of cadastral maps, current land use maps, land use planning maps and other specialized maps for land management and use;

b) Provide guidance on land statistics and inventory; organize periodic land statistics and inventories, as well as thematic or ad hoc land statistics and inventories, in accordance with regulations of law;

c) Provide guidance on land surveys and assessments, and on land protection, improvement and restoration; organize periodic and thematic land surveys and assessments for regions and nationwide, and publish the results thereof; organize nationwide monitoring of land resources; organize the protection, improvement and restoration of land in inter-regional and inter-provincial areas of severe land degradation and in areas of extremely serious land pollution;

dd) Provide guidance on the land allocation, lease and appropriation, recognition of land use rights, land requisition and repurposing, auction of land use rights, bidding for selection of investors qualified to execute projects involving land use;

e) Provide guidance on the performance of compensation, support and residential resettlement tasks upon the State’s land appropriation or land requisition; development, management and exploitation of land funds;

g) Provide guidance on the land registration, preparation and management of cadastral records; issuance, modification, revocation and invalidation of certificates of land use rights and ownership of property on land; issuance and management of blank certificates of land use rights and ownership of property on land;

h) Provide guidance on the building, management, operation and exploitation of the National Land Information System;

i) Provide guidance on the exercise of the rights and responsibilities of the State and citizens with respect to land; the rights and obligations of land users; land use regimes; agreements on the receipt of land use rights; and the adjustment and extension of land use terms and the extension of land use schedules, in accordance with regulations of law.  Develop, manage, operate and exploit a system for monitoring and evaluating land management and use; organize the monitoring and evaluation of land management and use in provinces and centrally-governed cities, and use of land for projects of national importance, in accordance with regulations of law;

k) Perform state management of land in accordance with regulations of law.

20. Regarding water resources

a) Direct and provide guidance on the management, protection, regulation, allocation, restoration, development, exploitation and use of water resources, and the management of river basins and water sources, in accordance with regulations of law;

b) Take the lead in implementing measures to ensure water security;

d) Take the lead in formulating and publishing water availability scenarios for inter-provincial river basins; formulate and organize the implementation of plans for regulating and allocating water resources in cases of drought or water scarcity, and submit such plans to the Prime Minister for consideration and decision, in accordance with regulations of law;

dd) Take the lead in formulating and adjusting inter-reservoir operation procedures for river basins, and submit them to the Prime Minister for approval; approve partial adjustments to inter-reservoir operation procedures within its competence;

e) Develop systems of decision-support tools for making decision on the regulation and allocation of water resources in river basins;

g) Formulate plans, programs and schemes for restoring degraded, depleted and polluted water sources;

h) Organize the implementation of solutions for protecting, regulating, distributing, developing and storing water; restoring water resources; preventing, controlling and repairing damage caused by water; and carrying out other activities in relation to water resources, with a view to ensuring water security;

i) Submit to the Government or Prime Minister measures for dealing with issues concerning transboundary water sources;

k) Provide guidance on declarations and registration relating to water resources, the issuance of permits for water resource exploration, exploitation and use, and the approval of fees payable for the right to exploit water resources, in accordance with regulations of law.

21. Regarding environment

a) Provide guidance on appraisal of environmental impact assessment reports and approval of results thereof; comment on strategic environmental assessment contents in accordance with regulations of law; organize appraisal of environmental impact assessment reports;

c) Organize the establishment and management of the national environmental monitoring network; approve and organize the implementation of the national environmental monitoring programs; provision of information and warning about environmental pollution in accordance with regulations of law;

d) Provide guidance on, and organize the preparation and announcement of, the national state of the environment report and thematic environmental reports; provide guidance on and organize the preparation of environmental protection reports in accordance with regulations of law;

dd) Provide guidance on the formulation of environmental protection contents in provincial plannings and plannings of special administrative-economic units; organize the formulation, submission for approval, announcement and implementation of environmental protection plannings, and the assessment of its implementation results, in accordance with regulations of law;

e) Provide guidance for ministries, central and local authorities on technical matters and key tasks relating to environmental protection; consolidate and propose the allocation of estimated state budget-derived funding for environmental protection activities of Ministries, ministerial-level agencies and provincial-level People’s Committees; provide guidance on the compilation of statistics on, monitoring of and publication of environmental protection expenditures;

g) Propose policies on environmental protection taxes and fees and other economic instruments in order to mobilize and use resources for environmental protection in accordance with regulations of law;

h) Provide guidance on the trial operation of waste treatment works; the import of scrap from abroad for use as production materials; the import of used seagoing ships for dismantling; the responsibilities of manufacturers and importers for recycling and treating products and packaging materials; the management of persistent pollutants; environmental self-audits; and environmental registration;

o) Organize performance of environmental protection tasks in the fields under the Ministry’s management in accordance with regulations of law;

k) Organize the management of Viet Nam Environment Protection Fund.

22. Regarding nature conservation and biodiversity

b) Direct and provide guidance on the establishment and management of natural heritage sites, wildlife sanctuaries, marine protected areas, biodiversity corridors, areas of high biodiversity, important wetlands, important ecological landscapes and biodiversity conservation facilities;

c) Play the leading role in organizing the formulation of projects for the establishment of natural heritage sites, wildlife sanctuaries, biodiversity corridors, areas of high biodiversity, important wetlands, important ecological landscapes and marine protected areas that extend across two or more provinces or centrally-governed cities, and submitting them for approval; and organize their management after approval, in accordance with regulations of law;

d) Submit to competent authorities for promulgation, or promulgate within its competence, lists of endangered, precious and rare species and species prioritized for protection, together with the regimes for their management and conservation; provide guidance on biosafety management for genetically modified organisms, gene-edited organisms and products of genetically modified organisms; prepare lists of invasive alien species and provide guidance on measures to prevent and control them; provide guidance on access to genetic resources and benefit-sharing from such resources, the collection and storage of genetic resources, and the conservation of gene pools, in accordance with regulations of law;

dd) Direct and provide guidance on the classification, management and protection of natural landscapes and natural ecosystems; the survey and assessment of important wetlands, the promulgation of lists of such wetlands, and the regimes for their conservation and sustainable use; payment for natural ecosystem services; and access to landscapes and the designation, management and protection of important natural landscapes, in accordance with regulations of law;

e) Provide guidance on and organize baseline surveys, monitoring, inventory, statistics and establishment of databases and reports on natural landscapes and biodiversity in accordance with regulations of law;

g) Provide guidance on the registration, recognition, issuance and revocation of licenses and certificates of nature conservation and biodiversity in accordance with regulations of law.

23. Regarding hydrometeorology

a) Manage and organize hydrometeorological monitoring, investigation and survey activities; manage and provide guidance on hydrometeorological monitoring conducted at works required by law to carry out such monitoring and at other specialized hydrometeorological stations, in accordance with law; develop, manage, operate and utilize the national network of hydrometeorological monitoring stations; conduct lightning location monitoring and climate change monitoring;

b) Organize the protection of hydrometeorological works belonging to the national network of hydrometeorological stations;

d) Organize the collection and processing of information, identification and assessment of disaster risks, disaster risk zoning, disaster monitoring and surveillance;

dd) Receive feedback from ministries, central authorities, local authorities, organizations and individuals regarding the issuance schedule of hydrometeorological and disaster forecast and warning bulletins, the quality and reliability of such bulletins, and the use of disaster risk levels in disaster prevention, control and response activities and in socio-economic development; annually monitor, assess and compile information on the state management of hydrometeorology nationwide, in accordance with regulations of law;

e) Organize the appraisal of tsunami warning scenarios for Viet Nam in accordance with regulations of law;

g) Appraise hydrometeorological aspects of the planning and design of nationally important construction works and investment projects, as well as other construction works and investment projects, in accordance with regulations of law;

h) Manage the quality of hydrometeorological measuring instruments in accordance with regulations of law;

i) Manage, provide guidance on and organize hydrometeorological service activities in accordance with regulations of law;

k) Supervise the implementation of weather modification plans in accordance with regulations of law.

24. Regarding climate change

a) Direct and provide guidance on greenhouse gas (GHG) emission mitigation, ozone layer protection and climate change adaptation;

c) Organize climate change monitoring and national climate assessments; formulate, update and publish climate change scenarios, and provide guidance on their implementation; provide guidance on, and supervise, the assessment of climate change impacts, vulnerability, risks, losses and damage; and provide guidance on the integration of climate change considerations into strategies and plannings;

d) Organize the preparation of the national GHG inventory and GHG inventories for the fields under the Ministry’s management; provide guidance on GHG inventory preparation, GHG emission reduction, and the measurement, reporting and verification (MRV) of GHG emission reductions in the fields under the Ministry’s management;

dd) Provide guidance on the management, phase-out, collection, recycling, reuse and treatment of ozone-depleting substances and controlled greenhouse gases in accordance with international treaties on ozone layer protection to which the Socialist Republic of Viet Nam is a Party;

e) Provide guidance on the implementation of climate change adaptation activities; develop, update and implement the national monitoring and evaluation (M&E) system for climate change adaptation activities;

g) Provide guidance on the implementation of carbon credit trading and offsetting mechanisms; organize and operate the domestic carbon market and facilitate participation in the international carbon market; manage and organize the allocation of GHG emission allowances within the Ministry’s remit; manage carbon credits and issue written approvals for the registration of programmes and projects and for the international transfer of GHG emission reductions and carbon credits, in accordance with applicable law and international treaties to which the Socialist Republic of Viet Nam is a Party;

h) Organize the preparation and updating of the Nationally Determined Contribution (NDC), and monitor its implementation; prepare national reports on climate change and ozone layer protection in accordance with regulations of law and international treaties to which the Socialist Republic of Viet Nam is a Party.

25. Regarding surveying, mapping and geographic information

a) Develop, update, manage, operate and exploit the national geospatial data infrastructure in accordance with regulation of law; the national system of fundamental surveying data; the data systems of national surveying networks; basic surveying infrastructure facilities; and the Viet Nam Geospatial Information Portal; develop, operate and update the national fundamental geographic database; establish and update the national topographic map series; promulgate the list of geographical names to be shown on maps; and provide surveying and mapping products;

b) Provide guidance on, inspect and organize the verification, calibration, testing and inspection of measuring instruments used in surveying and mapping activities in accordance with regulations of laws on metrology and product and goods quality;

d) Inspect compliance with requirements governing surveying and mapping activities by licensed organizations and individuals; inspect the publication and distribution of maps; suspend the distribution of, and direct the recall of, map publications that contravene the law;

dd) Establish, update, publish and distribute mapping products in accordance with regulations of law;

e) Organize the surveying, revision and supplementation of administrative boundary maps to facilitate the establishment, dissolution, merger, division and adjustment of boundaries of provincial-level administrative divisions, and the settlement of disputes relating to provincial-level administrative boundaries, in accordance regulations of law;

g) Organize surveying and the establishment of topographic maps for the delimitation, demarcation and marking of the national boundary and for national border management; survey, establish and update the standard national border map series; provide guidance on the depiction of the national boundary and territorial sovereignty on surveying and mapping products and map publications.

26. Regarding integrated management of resources and environmental protection of sea and islands

a) Organize the preparation and formulation of plans for seas and islands; key programmes for baseline surveys of sea and island resources and environment; and programmes for integrated management of coastal resources;

b) Organize the survey, statistical compilation, classification and management of island resources; manage island resource records; prescribe in detail the contents of island resource records and provide guidance on the preparation and management of such records;

c) Provide guidance on and direct the establishment and protection of coastal protection corridors; the determination and adjustment of the mean lowest sea-water level line observed over a period of several years; and the determination of the outer limits of maritime zones in accordance with regulations of law;

d) Consolidate information on and assess Viet Nam’s sea-related socio-economic potential; compile statistics on, classify and assess the potential of Viet Nam’s sea areas and islands; assess changes in resources; and organize the analysis, assessment and forecasting of domestic and international developments relating to the management, exploitation and use of resources, scientific research, and international cooperation concerning Viet Nam’s seas and islands;

e) Organize the investigation and assessment of sources of waste arising from activities at sea and on islands within its competence; investigate and assess environmental pollution risks in the sea and islands, and prepare maps delineating environmental pollution risk zones; publish information on sea areas and islands that are no longer capable of receiving waste; organize the implementation of measures to prevent, detect, address and remedy sea and island environmental pollution and degradation, and to improve the sea and island environment; prepare the national report on the state of the sea and island environment and thematic reports on the state of the sea and island environment;

g) Organize the inspection and monitoring of activities involving the exploitation and use of resources and the protection of the environment in sea areas, coastal areas and islands; undertake activities to remedy and address the consequences of oil and chemical spills at sea; manage marine plastic litter in accordance with regulations of law;

h) Manage and provide guidance on the allocation of sea areas for the exploitation and use of marine resources; manage sea reclamation activities in accordance with regulations of law;

i) Monitor and consolidate information on the implementation of marine and oceanographic scientific research programmes and projects by ministries, central authorities and local authorities in accordance with regulations of law;

k) Provide guidance on and supervise activities involving the dumping of substances into the sea, and handle violations in accordance with regulations of law;

l) Coordinate the implementation of the Strategy for sustainable development of Viet Nam’s marine economy; the Strategy for sustainable exploitation and use of resources and protection of the environment of seas and islands; and the National marine spatial planning.

27. Regarding remote sensing

a) Manage and provide guidance on remote sensing data acquisition activities and the operation, maintenance and protection of remote sensing data acquisition infrastructure; develop, manage, exploit and operate remote sensing data acquisition infrastructure under the Ministry’s management;

b) Consolidate the remote sensing information and data requirements of ministries, ministerial-level agencies and provincial-level People’s Committees, as well as requirements arising from assigned ad hoc tasks, for the formulation of remote sensing data acquisition plans;

d) Manage, provide guidance on and organize the application of remote sensing to baseline surveys, monitoring and surveillance in support of agricultural production; the management and protection of natural resources and the environment; disaster prevention; socio-economic development; and national defense and security, in accordance with regulations of law;

dd) Organize periodic and ad hoc monitoring and surveillance using remote sensing technology in the fields of agriculture, rural development, natural resources, the environment, disasters and climate change;

e) Appraise matters relating to remote sensing data acquisition systems; the acquisition, storage, processing, provision, exploitation and use of remote sensing data; and the application and development of remote sensing technology in programmes, schemes, projects and tasks undertaken by ministries, ministerial-level agencies and local authorities;

g) Provide guidance on and inspect remote sensing activities performed by organizations and individuals according to regulations of law.

28. Regarding management of investment and construction investment

a) Direct, provide guidance on and supervise investment and construction investment activities, as well as construction activities, in accordance with regulations of law;

b) Direct and provide guidance on construction investment and the quality management of specialized construction works in the sectors and fields under the Ministry’s state management, in accordance with regulations of law;

c) Appraise the contents of pre-feasibility study reports and feasibility study reports for programmes, projects and schemes in the sectors and fields under the Ministry’s management;

d) Consider giving approval for investment policies; issue investment decisions; consider giving approval for designs, cost estimates and final accounts; and manage bidding for programmes and projects falling within the Ministry’s competence, in accordance with regulations of law;

e) Organize the overall monitoring and evaluation of investment, as well as the monitoring and evaluation of construction investment and specialized investment projects within the sectors and fields under the Ministry’s management, in accordance with regulations of law.

29. Regarding poverty reduction

a) Assist the Government in ensuring the consistent exercise of state management functions and the performance of state management tasks in the field of poverty reduction;

b) Formulate and submit to competent authorities for promulgation the national poverty standards applicable to each period, and provide guidance on their implementation;

c) Take the lead in formulating and submitting to competent authorities for promulgation, or proposing the formulation, promulgation, or amendment of, policies and legislative documents on poverty reduction (including policies aimed at ensuring minimum living standards and access to basic social services, such as employment, livelihoods, education, vocational education and training, healthcare, housing, the environment, credit, information, domestic water supply and legal aid), in line with the requirements of each period;

d) Take the lead in formulating, coordinating and organizing the implementation of poverty reduction programmes, schemes and projects;

dd) Organize the development of a poverty reduction database to support the formulation of social security policies and socio-economic development policies;

e) Take the lead in advising on and proposing participation in the activities of the Global Alliance against Hunger and Poverty and international cooperation activities on poverty reduction;

g) Organize the monitoring, consolidation and evaluation of the results of poverty reduction efforts by ministries, central authorities, and local authorities; report such results to competent authorities and publish them in accordance with applicable regulations;

30. Organize and carry out procedures for the registration, allocation, recognition, approval, issuance, replacement, renewal, amendment, reissuance, approval of the return of, temporary suspension, and revocation of licenses, certificates and decisions relating to matters within the scope of the Ministry’s state management, in accordance with regulations of law.

31. Manage national reserves of plant varieties, plant protection products, veterinary drugs and other goods, as assigned by the Government.

32. Perform the functions of focal point agency, national representative, national standing body or standing body of national steering committees in relation to activities, programmes and strategies, as well as international protocols, conventions, treaties, agreements, arrangements, commitments and forums concerning the fields under the Ministry’s management, as assigned by the Government or the Prime Minister.

33. Carry out digital transformation and application of information technology; develop, update, manage and operate information systems and databases in the fields falling within the scope of the Ministry’s state management; develop e-Government towards digital government, the digital economy and the digital society in the agriculture and environment sector; develop, manage and operate, and ensure the information security of, national digital infrastructure, digital platforms, data platforms and digital services in the field of agriculture and environment; and integrate, connect, analyze, process, publish, provide and share data and information in the fields falling within the scope of the Ministry’s management, in accordance with regulations of law.

34. Regarding science, technology and innovation

a) Formulate and promulgate, or submit to competent authorities for promulgation, and organize the implementation of, mechanisms, policies, strategies and plans on science, technology, technological innovation and technology transfer in the fields falling within the scope of the Ministry’s state management;

b) Formulate and manage, provide guidance on and organize the implementation of programmes, schemes and tasks relating to scientific research, development and application of high and advanced technologies, development and application of biotechnology, and improvement of productivity and quality in the sectors and fields under the Ministry’s management;

c) Manage, provide guidance on and organize innovation activities, as well as the application and transfer of new technologies, high technologies and strategic technologies in the fields falling within the scope of the Ministry’s state management.

35. Undertake international cooperation and international economic integration in the sectors and fields falling within the scope of the Ministry’s state management, in accordance with regulations of law; take the lead in proposing the negotiation, conclusion and implementation of international treaties and international initiatives; conclude and implement international agreements; and participate in international organizations as assigned by the Government.

37. Perform state management functions in respect of public services; provide public products and services in the fields falling within the scope of the Ministry’s state management, in accordance with regulations of law; and promote the private sector involvement in provision of public services in the fields under the Ministry’s state management.

38. Provide guidance on the functions, tasks and powers of specialized agencies responsible for agriculture and environment under the People’s Committees of provinces and centrally-governed cities, and under the People’s Committees of communes, wards and special zones within provinces and centrally-governed cities; manage the organizational structure, job positions, civil servant staffing quotas, the number of employees in public service units, and employees; and manage emulation and commendation, as well as other regimes and policies applicable to officials, civil servants, public employees and employees of the Ministry, in accordance with regulations of law.

39. Manage associations and non-governmental organizations operating in the fields falling within the scope of the Ministry’s state management in accordance with regulations of law.

40. Exercise the rights and perform the responsibilities of the State as owner of its capital in enterprises under the Ministry’s management, in accordance with regulations of law; coordinate with the Ministry of Finance in directing state-owned economic groups and state-owned corporations in which the Ministry of Finance acts as the State capital owner’s representative agency in carrying out political tasks, ad hoc and urgent tasks, and other important tasks in the relevant sectors and fields, as required by competent authorities, in a timely and effective manner and in accordance with the requirements set.

41. Manage assigned financial resources and assets, and manage and use allocated state budget-derived funds, in accordance with regulations of law.

42. Conduct inspections; organize the reception of citizens; resolve complaints and petitions submitted by organizations and citizens; resolve denunciations lodged by individuals; prevent and combat corruption and misconduct; and handle violations of law in the fields falling within the scope of the Ministry’s state management.

43. Organize the production of statistics on, the conduct of inventories, and the archiving of records and data relating to the fields falling within the scope of the Ministry’s management, in accordance with regulations of law.

44. Perform other tasks and exercise other powers as assigned by the Government or the Prime Minister, or as prescribed by law.

The Minister of Agriculture and Environment of Viet Nam shall define the functions, tasks, powers and organizational structure of its affiliated units; submit the decision on list of other public service providers affiliated to the Ministry of Agriculture and Environment to the Prime Minister for promulgation.

With respect to food safety management tasks, in addition to the tasks prescribed in clause 14 Article 2 of this Decree, the Ministry of Agriculture and Environment of Viet Nam shall continue to perform the tasks assigned to it under sector-specific legislative documents until superseded by other regulations issued by competent authorities.

Article 5. Effect

1. This Decree comes into force from September 15, 2026.

2. This Decree supersedes the Government’s Decree No. 35/2025/ND-CP dated February 25, 2025 prescribing the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Environment of Viet Nam.
