1. Laborious, harmful
and dangerous occupations in the field of seafood production
Pursuant to the Labor
Code and procedures in Official Dispatch No. 2753/LDTBXH-BHLD dated August 01,
1995 of the Ministry of Labor, War Invalids and Social Affairs, hazardous jobs
are proposed by various ministries to the Ministry of Labor, War Invalids and
Social Affairs for inclusion in the list.

documents on labor, seafood production is not one of the laborious, harmful
and dangerous industries; only 38 jobs in the seafood production industry
are hazardous jobs (see the list enclosed herewith).

Clause 1 Article 162 of
the 2012’s Labor Code: “Employers may only employ minors to do jobs that are
suitable for their health and ensure development of their physical health,
and mental health and personality …”.
Clause 1 Article 163 of
the 2012’s Labor Code: “Do not employ minors to do hazardous jobs or jobs where
workplaces may affect their personality according to the list promulgated by
the Ministry of Labor, War Invalids and Social Affairs in cooperation with the
Ministry of Health.” Article 165 of the 2012’s Labor Code also prescribes
certain jobs and work places in which employment of minors is forbidden.

Thus, not every job on
the list mentioned in part 1 of this document is forbidden from employment of
minors. Only the jobs and workplaces specified in Points a, b, c, d, dd, e of
Clause 1, Points a, b, c, d of Clause 2 Article 165 of the 2012’s Labor Code
and Circular No. 10/2013/TT-BLDTBXH are forbidden from employment of minors.
This is uniformly applicable to every field and sector.
