HƯỚNG DẪN PHÂN LOẠI VÀ QUYẾT ĐỊNH DANH MỤC CƠ SỞ GÂY Ô NHIỄM MÔI TRƯỜNG CẦN PHẢI XỬ LÝ

Căn cứ Luật Bảo vệ môi trường ngày 29 tháng 11 năm 2005;
Căn cứ Nghị định số 80/2006/NĐ-CP ngày 09 tháng 8 năm 2006 của Chính phủ quy định chi tiết và hướng dẫn thi hành một số điều của Luật Bảo vệ môi trường;
Căn cứ Nghị định số 91/2002/NĐ-CP ngày 11 tháng 11 năm 2002 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Tài nguyên và Môi trường;
Căn cứ Quyết định số 64/2003/QĐ-TTg ngày 22 tháng 4 năm 2003 của Thủ tướng Chính phủ phê duyệt Kế hoạch xử lý triệt để các cơ sở gây ô nhiễm môi trường nghiêm trọng;
Bộ Tài nguyên và Môi trường hướng dẫn phân loại và quyết định danh mục cơ sở gây ô nhiễm môi trường cần phải xử lý như sau:

I. Căn cứ phân loại cơ sở gây ô nhiễm môi trường

1. Việc phân loại cơ sở gây ô nhiễm môi trường căn cứ vào mức độ vi phạm tiêu chuẩn Việt Nam về môi trường (trong Thông tư này cụm từ tiêu chuẩn môi trường được sử dụng theo quy định của Luật Bảo vệ môi trường và được hiểu như cụm từ quy chuẩn kỹ thuật về môi trường theo quy định của Luật Tiêu chuẩn và Quy chuẩn kỹ thuật) của các thông số ô nhiễm chính về nước thải, khí thải, tiếng ồn, độ rung.

2. Các thông số môi trường chính về nước thải, khí thải, tiếng ồn, độ rung của cơ sở bao gồm:

2.1. pH, nhiệt độ của nước thải;

2.2. Chất phóng xạ trong nước thải, khí thải;

2.3. Các thông số được quy định trong các tiêu chuẩn Việt Nam về môi trường tương ứng được cơ quan Nhà nước có thẩm quyền xác định dựa trên báo cáo đánh giá tác động môi trường hoặc bản đăng ký đạt tiêu chuẩn môi trường (được lập trước ngày 01 tháng 7 năm 2006) hoặc bản cam kết bảo vệ môi trường (được lập từ ngày 01 tháng 7 năm 2006) hoặc đề án bảo vệ môi trường (được lập từ ngày 01 tháng 7 năm 2006) đã được cơ quan Nhà nước có thẩm quyền phê duyệt, xác nhận hoặc theo quy định tại Phụ lục ban hành kèm theo Thông tư này.

3. Trường hợp cơ sở có các vi phạm quy định về quản lý chất thải rắn mà gây ô nhiễm môi trường xung quanh thì cơ quan Nhà nước có thẩm quyền xác định thêm các thông số môi trường chính về nước thải, khí thải do chất thải rắn gây ra theo hướng dẫn tại Khoản 2 mục này để làm căn cứ phân loại cơ sở gây ô nhiễm môi trường.

II. Tiêu chí phân loại cơ sở gây ô nhiễm môi trường

1. Cơ sở gây ô nhiễm môi trường nghiêm trọng là cơ sở thuộc một trong các trường hợp sau đây:

1.1. Có từ 02 (hai) thông số ô nhiễm thông thường vượt tiêu chuẩn Việt Nam về môi trường cho phép từ 5 (năm) lần trở lên;

1.2. Có từ 02 (hai) thông số ô nhiễm nguy hại vượt tiêu chuẩn Việt Nam về môi trường cho phép từ 3 (ba) lần trở lên;

1.3. Có 01 (một) thông số ô nhiễm thông thường vượt tiêu chuẩn Việt Nam về môi trường cho phép từ 05 (năm) lần trở lên và 01 (một) thông số ô nhiễm nguy hại vượt tiêu chuẩn Việt Nam về môi trường cho phép từ 03 (ba) lần trở lên;

1.4. Có giá trị trung bình của 02 (hai) thông số ô nhiễm vượt tiêu chuẩn Việt Nam về môi trường cao nhất từ 06 (sáu) lần trở lên;

1.5. Có từ 02 (hai) thông số ô nhiễm vượt tiêu chuẩn Việt Nam về môi trường trở lên và có ít nhất 01 (một) thông số ô nhiễm thông thường vượt tiêu chuẩn Việt Nam về môi trường từ 10 (mười) lần trở lên;

1.6. Có từ 02 (hai) thông số ô nhiễm vượt tiêu chuẩn Việt Nam về môi trường trở lên và có ít nhất 01 (một) thông số ô nhiễm nguy hại vượt tiêu chuẩn Việt Nam về môi trường từ 5 (năm) lần trở lên;

1.7. Có chứa chất phóng xạ gây ô nhiễm môi trường vượt mức cho phép;

1.8. Có pH nước thải bằng hoặc nhỏ hơn hai (≤ 2) hoặc lớn hơn mười hai phẩy năm (> 12,5);

1.9. Có nhiệt độ nước thải lớn hơn 450C.

2. Cơ sở gây ô nhiễm môi trường là cơ sở không thuộc một trong các trường hợp nêu tại Khoản 1 mục này mà có 01 (một) thông số môi trường trở lên về nước thải, khí thải, tiếng ồn, độ rung vượt tiêu chuẩn Việt Nam về môi trường.

III. Trình tự phân loại và quyết định danh mục cơ sở gây ô nhiễm môi trường cần phải xử lý

1. Trước ngày 31 tháng 3 hằng năm, dựa trên kết quả gần nhất về kiểm tra, thanh tra bảo vệ môi trường và căn cứ tiêu chí phân loại cơ sở gây ô nhiễm môi trường tại Mục II của Thông tư này, Sở Tài nguyên và Môi trường lập danh sách và đề xuất biện pháp xử lý các cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng trên địa bàn (trừ các cơ sở thuộc lĩnh vực quốc phòng, an ninh) theo Mẫu số 1 và Mẫu số 2 kèm theo Thông tư này, báo cáo của Ủy ban nhân dân cùng cấp, Bộ Tài nguyên và Môi trường; gửi danh sách cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng cho Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Tập đoàn kinh tế, Tổng công ty 91 (sau đây gọi chung là Bộ, ngành) có liên quan.

2. Trước ngày 30 tháng 4 hằng năm, trên cơ sở báo cáo của Sở Tài nguyên và Môi trường, Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương thực hiện các công việc sau:

2.1. Quyết định danh mục và việc xử lý các cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng trên địa bàn (trừ các cơ sở thuộc lĩnh vực quốc phòng, an ninh) theo quy định tại điểm b Khoản 3 Điều 49 của Luật Bảo vệ môi trường; đối với cơ sở thuộc thẩm quyền quản lý của Bộ, ngành thì phải tham khảo ý kiến của Bộ, ngành liên quan trước khi quyết định;

2.2. Báo cáo danh sách các cơ sở gây ô nhiễm môi trường nghiêm trọng trên địa bàn (trừ các cơ sở thuộc lĩnh vực quốc phòng, an ninh) có quy mô vượt thẩm quyền hoặc khả năng xử lý của mình hoặc của Bộ, ngành theo Mẫu số 3 kèm theo Thông tư này để Bộ Tài nguyên và Môi trường tổng hợp, trình Thủ tướng Chính phủ quyết định theo quy định tại điểm d Khoản 3 Điều 49 của Luật Bảo vệ môi trường;

3. Trước ngày 31 tháng 3 hằng năm, cơ quan chuyên môn về bảo vệ môi trường thuộc Bộ Quốc phòng, Bộ Công an dựa trên kết quả gần nhất về kiểm tra, thanh tra bảo vệ môi trường và căn cứ vào tiêu chí phân loại cơ sở gây ô nhiễm môi trường tại Mục II Thông tư này, chủ trì, phối hợp với Sở Tài nguyên và Môi trường có liên quan lập danh sách các cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng thuộc lĩnh vực quốc phòng, an ninh theo Mẫu số 4 và Mẫu số 5 kèm theo Thông tư này trình Bộ trưởng Bộ Quốc phòng, Bộ trưởng Bộ Công an và gửi Bộ Tài nguyên và Môi trường.

4. Trước ngày 30 tháng 4 hằng năm, trên cơ sở báo cáo của Cơ quan chuyên môn về bảo vệ môi trường, Bộ trưởng Bộ Quốc phòng, Bộ trưởng Bộ Công an thực hiện các công việc sau:

4.1. Quyết định danh mục và việc xử lý các cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng thuộc phạm vi quản lý;

4.2. Báo cáo danh sách các cơ sở gây ô nhiễm môi trường nghiêm trọng có quy mô vượt thẩm quyền hoặc khả năng xử lý của mình theo Mẫu số 6 kèm theo Thông tư này để Bộ Tài nguyên và Môi trường tổng hợp, trình Thủ tướng Chính phủ quyết định theo quy định tại điểm d Khoản 3 Điều 49 của Luật Bảo vệ môi trường.

5. Trước ngày 30 tháng 5 hằng năm, trên cơ sở báo cáo danh sách và đề xuất biện pháp xử lý các cơ sở gây ô nhiễm môi trường nghiêm trọng của Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương, Bộ Quốc phòng và Bộ Công an, Bộ Tài nguyên và Môi trường trình Thủ trướng Chính phủ quyết định danh mục và việc xử lý các cơ sở gây ô nhiễm môi trường nghiêm trọng.

6. Việc chỉ đạo tổ chức thực hiện xử lý các cơ sở gây ô nhiễm môi trường, các cơ sở gây ô nhiễm môi trường nghiêm trọng thực hiện theo quy định tại Khoản 4 Điều 49 của Luật Bảo vệ môi trường.

IV. Tổ chức thực hiện

1. Cơ quan chuyên môn về bảo vệ môi trường tại các Bộ, ngành và các Sở Tài nguyên và Môi trường phối hợp chặt chẽ trong quá trình phân loại, lập danh sách các cơ sở gây ô nhiễm môi trường, các cơ sở gây ô nhiễm môi trường nghiêm trọng.

2. Sở Tài nguyên và Môi trường thông báo quyết định xử lý đối với các cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng trên địa bàn địa phương cho Ủy ban nhân dân cấp huyện, cấp xã nơi có cơ sở gây ô nhiễm môi trường, cơ sở gây ô nhiễm môi trường nghiêm trọng và công khai cho nhân dân biết để cùng phối hợp kiểm tra, giám sát việc thực hiện.

3. Cục Bảo vệ môi trường tổng hợp, theo dõi, kiểm tra việc phân loại cơ sở gây ô nhiễm môi trường, cơ sở gây ô nhiễm môi trường nghiêm trọng theo Thông tư này; công bố trên các phương tiện thông tin đại chúng các cơ sở gây ô nhiễm môi trường nghiêm trọng theo quy định tại điểm d Khoản 1 Điều 104 của Luật Bảo vệ môi trường.

4. Trong quá trình triển khai thực hiện, nếu có vướng mắc phát sinh, các Bộ, ngành, Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương, các Sở Tài nguyên và Môi trường và các tổ chức, cá nhân có liên quan kịp thời phản ánh về Bộ Tài nguyên và Môi trường để xem xét, điều chỉnh.

CIRCULAR

GUIDING FOR CLASSIFICATION AND DECISION OF THE LIST OF ESTABLISHMENTS CAUSING ENVIRONMENTAL POLLUTION REQUIRED TO BE HANDLED

Pursuant to the Law on Environmental Protection dated November 29, 2005;

Pursuant to the Decree No.80/2006/ND-CP dated August 09, 2006 of the Government detailing and guiding the implementation of some Articles of the Law on Environmental Protection;

Pursuant to the Decree No.91/2002/ND-CP of November 11, 2002 of the Government regulating functions, duties, powers and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to the Decision No.64/2003/QD-TTg dated April 22, 2003 of the Prime Minister approving the plan on thorough handling of the establishments causing serious environmental pollution;

Ministry of Natural Resources and Environment guides the classification and decides on the list of establishments causing environmental pollution required to be handled as follows:

I. Bases for the classification of establishments causing environmental pollution

2. The main environmental parameters for waste water, waste gas, noise, vibration of the establishment include:

2.1. pH, temperature of wastewater;

2.2. Radioactive substances in wastewater, waste gas;

2.3. The parameters specified in the respective Vietnam standards on environment are determined by the competent State agencies based on the environmental impact assessment report or registration form for meeting environmental standards (to be established before July 01, 2006) or written commitment for environmental protection (to be established from July 01, 2006) or environmental protection schemes (to be established from July 01, 2006) which were approved, certified by the competent state agencies or as prescribed in Appendix issued together with this Circular.

3. Where the establishments commit acts of violation of regulations on management of solid wastes that pollute the surrounding environment, the competent State agencies shall identify additional main environmental parameters on waste water, waste gas caused by waste solids under the guidance in clause 2 of this Section for used as a basis for classification of the establishments causing environmental pollution.

II. Criteria for classification of the establishments causing environmental pollution

1. Establishments causing serious environmental pollution are the establishments in one of the following circumstances:

1.1. There are from 02 (two) normal pollution parameters exceeding permissible Vietnam standards on environment for 5 (five) times or more;

1.2. There are from 02 (two) parameters of hazardous pollutants exceeding permissible Vietnam standards on environment for 3 (three) times or more;

1.4. There is an average value of 02 (two) pollution parameters exceeding the highest environmental standards of Vietnam for 06 (six) times or more;

1.5. There are 02 (two) pollution parameters exceeding Vietnam standards on environment or more and at least 01 (one) normal pollution parameter exceeding Vietnam standards on environment for 10 (ten) times or more;

1.6. There are 02 (two) pollution parameters exceeding Vietnam standards on environment or more and at least 01 (one) dangerous pollution parameter exceeding Vietnam standards on environment for 5 (five) times or more;

1.7. Containing radioactive substances causing environmental pollution exceeding the permitted level;

1.8. Having wastewater pH equal to or less than two (≤ 2) or more than twelve point five (> 12.5);

1.9. Having wastewater temperatures more than 450C.

2. Establishments causing environmental pollution are those not in one of the cases mentioned in clause 1 of this Section but having 01 (one) or more environmental parameter on waste water, waste gas, noise, vibration in excess of Vietnam standards on environment.

III. Order of classification and decision on the list of establishments causing environmental pollution required to be handled

1. Before March 31 each year, based on the closest results on examination, environmental protection inspection and based on criteria classifying the establishments causing environmental pollution in Section II of this Circular, the Department of Natural Resources and Environment makes a list and proposes the measures to deal with the establishments causing environmental pollution, causing serious environmental pollution in the area (except for the establishments in the field of defense and security) in Form No.1 and Form No.2 attached to this Circular, the report of the same level People's Committee, Ministry of Natural Resources and Environment; sends a list of establishments causing environmental pollution, causing serious environmental pollution to the ministries, ministrial-level agencies, governmental agencies, economic groups, corporations 91 (hereinafter referred to as ministries and branches) involved.

2.1. Make decision on the lists and the handling of establishments causing environmental pollution, causing serious environmental pollution in the area (except for the establishments in the field of defense and security) as prescribed in Point b, Clause 3 of Article 49 of the Environmental Protection Law, and for the establishments under branch’s, ministry’s management, it must be consulted by ministries and agencies before making a decision;

2.2. Report the list of establishments causing serious environmental pollution in the area (except for the establishments in the field of defense and security) with a scale beyond the competence or its own ability to handle or of ministries, branches in Form No.3 attached to this Circular to the Ministry of Natural Resources and Environment for synthesizing, submitting to the Prime Minister for making decision under the provisions at Point d, Clause 3 of Article 49 of the Law on Environmental Protection;

3. Before March 31 each year, professional agencies for environmental protection under the Ministry of Defence, Ministry of Public Security are based on the closest results on examination, environmental inspection and based on the criteria for classification of the establishments causing environmental pollution in Section II of this Circular, shall preside over and coordinate with the concerned Department of Natural Resources and Environment to make a list of establishments causing environmental pollution, causing serious environmental pollution in the field of defense and security in accordance with Form No.4 and Form No.5 attached to this Circular to submit to the Minister of National Defence, Minister of Public Security and Ministry of Natural Resources and Environment.

4. Before April 30 every year, based on reports of professional agencies of environmental protection, the Minister of National Defence, Minister of Public Security performs the following tasks:

4.1. Make decision on the list and the handling of establishments causing environmental pollution, causing serious environmental pollution under its management;

4.2. Report the list of establishments causing serious environmental pollution with a scale beyond the competence or its own ability to handle in Form No.6 attached to this Circular to the Ministry of Natural Resources and Environment for synthesizing, submitting to the Prime Minister for making decision under the provisions at Point d, Clause 3 of Article 49 of the Law on Environmental Protection.

5. Before May 30 each year, based on reports of list and proposal of measures for handling the establishments causing serious environmental pollution of the People's Committees of provinces and cities directly under the Central Government, Ministry of Defense and Ministry of Public Security, Ministry of Natural Resources and Environment submits to the Prime Minister for making decision on the lists and the handling of establishments causing serious environmental pollution.

6. The direction of the handling of establishments causing environmental pollution, the establishments causing serious environmental pollution shall comply with provisions in clause 4 of Article 49 of the Law on Environmental Protection.

IV. Organization of implementation

2. Departments of Natural Resources and Environment inform the decisions on handling for the establishments causing environmental pollution, causing serious environmental pollution in the areas to the commune-level and district-level People's Committees where the establishments causing environmental pollution, causing serious environmental pollution are situated and publicize for people to know to jointly inspect and supervise the implementation.

3. Department of Environmental Protection synthesizes, tracks, inspects the classification of the establishments causing environmental pollution, causing serious environmental pollution in this Circular; publicizes in the mass media the establishments causing serious environmental pollution as prescribed at Point d, Clause 1 of Article 104 of the Law on Environmental Protection.

4. In the process of implementation, if any problems arise, the ministries, branches and People's Committees of provinces and cities directly under the Central Government, the Departments of Natural Resources and Environment and other concerned organizations and individuals promptly report to the Ministry of Natural Resources and Environment for review and adjustment.
