DECISION
PROMULGATING THE REGULATION ON THE MANAGEMENT AND USE OF GRANT
AID OUTSIDE OF OFFICIAL DEVELOPMENT ASSISTANCE (ODA) GIVEN TO VIETNAM BY
FOREIGN AGENCIES, ORGANIZATIONS, AND INDIVIDUALS UNDER MANAGEMENT OF THE
MINISTRY OF HEALTH
MINISTER OF HEALTH
Pursuant to Decree No.
95/2022/ND-CP dated November 15, 2022 of the Government on the functions,
tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to Decree No.
80/2020/ND-CP dated July 8, 2020 of the Government on the the management and
use of grant aid outside of official development assistance given to Vietnam by
foreign agencies, organizations, and individuals;
Pursuant to Circular
No. 19/2022/TT-BKHDT dated August 10, 2022 of the Ministry of Planning and
Investment on statistical reporting regulations concerning planning, investment
and statistics;
Pursuant to Circular
No. 23/2022/TT-BTC dated April 6, 2022 of the Ministry of Finance providing for
guidance on the state financial management of grant aid provided by foreign
countries and recorded as state budget revenue;

Article
1. Promulgated
together with this Decision is the Regulation on management and use of grant
aid outside of ODA given to Vietnam by foreign agencies, organizations, and
individuals under management of the Ministry of Health.
Article
2. This Decision comes into force from May 2, 2024.
Article
3. The Chief of the Ministry Office, Director of the Department
of Planning and Finance, Heads of units under and affiliated to the Ministry of
Health, and relevant organizations and individuals shall implement this
Decision./.

GENERAL
PROVISIONS
Article
1. Scope
This Regulation
prescribes the management and use of grant aid outside of ODA given to Vietnam
by foreign agencies, organizations, and individuals (hereinafter referred to as
"foreign aid"), managed by the Ministry of Health for protecting,
caring for, and improving the people's health, providing humanitarian
assistance, not for commercial or profit-making purposes.
Article
2. Regulated entities
1. Units assigned by the
Ministry of Health to manage foreign aid specified in Article 1 of this
Regulation and agencies, organizations, and individuals involved in or related
to the management of and directly using such foreign aid.
2. Aid donors in this
Regulation are foreign organizations and individuals specified in clause 2,
Article 2 of Decree No. 80/2020/ND-CP .

2. A
program/project/non-project document shall be prepared according to Forms
specified in Appendixes I, II, and III enclosed with Decree No. 80/2020/ND-CP .
3. An aid project
involved in public investment or construction investment must be formulated in
accordance with the law on management of public investment and work
construction investment.
4. The Department of
Planning and Finance shall receive aid documentation.
Article
4. Procedures for approval of program/project/non-project documents under the
Prime Minister's jurisdiction
1. The Prime Minister's
jurisdiction to approve a program/project/non-project document is prescribed in
clause 1, Article 7 of Decree No. 80/2020/ND-CP .
2. The Planning and Finance
Department shall assess the validity of the file on the basis of the provisions
of Article 8 of Decree No. 80/2020/ND-CP within 02 working days after receiving
such aid documentation. In case the file is ineligible, the Planning and
Finance Department will notify the aid owner in writing to submit additional
documents.
3. Seek opinions in
writing from relevant units of the Ministry of Health:
a) Depending on the
nature and scale of the program/project/non-project, the Department of Planning
and Finance will send the valid aid documentation for seeking opinions in
writing from the relevant units under the Ministry within 02 working days after
receipt; submit the aid documentation to the Ministry's leader in charge of the
unit proposing the program, project or non-project for direction on policies
and basic contents of the aid grant.
b) Relevant units shall,
based on their functions and tasks, send their written responses to the
Planning and Finance Department within 03 working days after receiving the
complete aid documentation. If the relevant units fail to give responses by
deadline or delay giving responses, it is considered that they agree with the
contents to be considered and shall take full responsibility before the law for
any matters related to their units.

5. The aid owner will
incorporate the appraisal opinions, thereby complete the aid documentation, and
send 08 aid documentation sets to the Department of Planning and Finance under
the Ministry of Health.
6. Within 05 working days
after receiving the official aid documentation from the aid owner, the
Department of Planning and Finance shall submit a written request for the Prime
Minister’s approval of the program/project/non-project to the Ministry's leader
in charge of the Department for signing and sending it to the Ministry of
Planning and Investment.
In case the Minister
directly assigns a Deputy Minister to be in charge of the
program/project/non-project, the above-mentioned written request shall be
submitted to the Deputy Minister.
7. The procedures for
appraisal and approval of program/project/non-project documents under the Prime
Minister's jurisdiction, where the Ministry of Planning and Investment is the
leading agency, are prescribed in Article 10 of Decree No. 80/2020/ND-CP .
Article
5. Procedures for appraisal and approval of program/project/non-project
documents under the Ministry of Health's jurisdiction
1. The Ministry of
Health's jurisdiction to approve program/project/non-project documents is
prescribed in clause 2, Article 7 of Decree No. 80/2020/ND-CP .
2. The Planning and
Finance Department shall assess the validity of the appraisal dossier on the
basis of the provisions of Article 8 of Decree No. 80/2020/ND-CP within 02
working days after receiving such dossier. In case the dossier is ineligible,
the Planning and Finance Department will notify the project owner in writing to
submit additional documents.
3 . Seek opinions in
writing from relevant parties:
a) Seek opinions in
writing from relevant units under the Ministry of Health:

- Relevant units shall,
based on their functions and tasks, send their written responses to the
Planning and Finance Department within 03 working days after receiving the
valid dossier. If the relevant units fail to give responses by deadline or
delay giving responses, it is considered that they agree with the contents to
be considered and shall take full responsibility before the law for any matters
related to their units.
Seek opinions in writing
from relevant units under relevant Ministries and central authorities:
Within 02 working days
after receiving the valid dossier, the Department of Planning and Finance shall
submit a written request for giving opinions to the Ministry's leader in charge
of the Department for signing and sending it to the Ministry of Planning and
Investment, Ministry of Finance, Ministry of Public Security, Ministry of
Foreign Affairs, Vietnam Union of Friendship Organizations (in case the aid
donor is a foreign non-governmental organization) and relevant agencies. The
time limit for seeking opinions from Ministries, central authorities, and
relevant agencies shall be a maximum of seven (07) working days (except for
important and complex matters; in case these entities fail to give responses by
deadline or delay giving responses, the provisions of clause 3, Article 10 of
the Government’s Decree No. 39/2022/ND-CP shall apply).
In case the Minister
directly assigns a Deputy Minister to be in charge of the
program/project/non-project, the above-mentioned written request shall be
submitted to the Deputy Minister.
4. Depending on the
scale, nature, and content of the aid grant, the Department of Planning and
Finance shall, after the deadline for receiving written responses, incorporate
the direction of the Ministry’s leader in charge of the unit and take charge of
appraisal either by synthesizing opinions or holding an appraisal meeting to
clarify any discrepancies and unresolved issues.
The appraisal results
shall be made into a report on whether the program/project/non-project is
eligible to be approved.
5. The aid owner will
incorporate the appraisal opinions, thereby complete the aid documentation, and
send 08 aid documentation sets to the Department of Planning and Finance under
the Ministry of Health.
6. Within 05 working days
after receiving the official aid documentation from the aid owner, the
Department of Planning and Finance shall complete and submit an appraisal
report to the Ministry’s leader in charge of the Department for consideration
and approval of the program/project/non-project document.
In case the Minister
directly assigns a Deputy Minister to be in charge of the
program/project/non-project, the above-mentioned appraisal report shall be
submitted to the Deputy Minister.

Article
6. Modification and supplementation to program/project/non-project documents
during implementation
1. If any modification
and supplementation leads to changes in the Ministry of Health’s decision on
approval of a program/project/non-project document, the procedures for
appraisal and approval shall follow the provisions of Article 5 of this
Regulation.
2. An application for
modification and supplementation shall consist of:
a) A proposal of
approval for the adjusted aid, using the Form specified in Appendix 2
b) An agreement on the
provision of aid by the aid donor
c) Modified
program/project/non-project document;
d) Documents proving the
status of a juridical person (not applicable to aid donors being diplomatic
missions, governmental agencies, local governments of foreign countries).
dd) Copy of the competent
authority's decision on approval of the program/project/non-project document;
e) Copy of the aid
document already approved by the competent authority;

h) An aid agreement
concluded between the aid owner and the donor.
Chapter
III
MANAGEMENT
OF AID PROVISION
Article
7. Organization of management of programs or projects
The program or project
owner shall be decentralized power to decide the management of its program or
project in accordance with Article 12 of Decree No. 80/2020/ND-CP. The project
owner shall refer to Appendix 5.1 – Decision on the establishment of a program
or project managing unit and Appendix 5.2 – Regulation on the organizational
and operation of program or project managing units.
Article
8. Approval of annual implementation plan
1. The project owner
shall be decentralized power to approve the annual implementation plan by the
Ministry of Health, ensuring compliance with the decision on approval of the
program/project/non-project document already approved by the Ministry of
Health.
2. The project owner
shall appraise and approve the annual implementation plan.
3. An appraisal dossier
shall consist of:

b) The list of equipment,
supplies, and chemicals expected to be procured (if any);
c) Written responses from
relevant Departments (if any);
d) Donor's opinions on
the contents of the annual implementation plan (in foreign language and
Vietnamese translation) (if any);
dd) Copy of the competent
authority's decision on approval of the program/project/non-project document;
dd) Copy of the competent
authority's decision on approval of the program/project/non-project document;
g) Report on the
implementation results of the program/project/non-project, specifying (1)
Achieved results; (2) Comparison with the approved results and objectives; (3)
Disbursement results; (4) Advantages and difficulties; (5) Proposals and
recommendations;
h) Other documents (if
any): Donor’s expenditure limits; Medical device standards and norms approved
by the competent authority.
4. Appraisal contents:
a) Conformity with the
approved objectives, budget, locations, timelines, etc., compared to the
decision and the project document already approved by the Ministry of Health;

c) Budget estimates
allocated by the Ministry of Health, ensuring compliance with the provisions of
the Law on State Budget.
5. The appraisal result shall
be made into a report on whether the program/project/non-project is eligible to
be approved (Appendix 4 – Appraisal report on the annual implementation plan).
6. The project owner
shall send the approved annual implementation plan to the Ministry of Health
(Department of Planning and Finance) and the Ministry of Finance (Department of
Debt Management and External Finance) for monitoring and supervision.
Article
9. Reporting regime
1. The project owner
shall submit the following reports to the Department of Planning and Finance:
a) Reports on aid
receipt, 6-month and annual aid provision and disbursement, and aid completion
reports (within 06 months after completion of aid provision) as prescribed in
clause 4 Article 14 of Decree No. 80/2020/ND-CP and Circular No.
19/2022/TT-BKHDT;
b) Reports on financial
management as prescribed in clause 1 Article 12 and Article 20 of Circular No.
23/2022/TT-BTC– using Templates specified in Appendix 8 of this Regulation;
c) Ad-hoc reports at the
request of the managing agency.
2. The Department of
Planning and Finance shall, based on reports from the units, consolidate and
provide advice the Ministry of Health to send a report to the Ministry of
Planning and Investment, Ministry of Finance, and other relevant agencies in a
timely and lawful manner.

AID-RELATED
FINANCIAL MANAGEMENT
Article
10. Aid-related financial management
1. Aid classified as
state budget revenues shall be estimated, controlled, accounted, and settled
according to the provisions of law on state budget and financial management in
accordance with the Law on State Budget, Decree No. 80/2020/ND-CP , Circular No.
23/2022/TT-BTC , and relevant guiding documents.
2. The annual aid-related
financial plan of programs/projects, or non-projects:
- The Ministry of Health
shall decentralize power to approve the annual aid-related financial plan to
the program/project/non-project owner on the basis of the Ministry's decision
on approval of the program/project/non-project documents, aid agreement, and
annual state budget estimate allocated by the Ministry of Health.
- The content of the
financial plan shall comply with clause 3, Article 8 of Circular No.
23/2022/TT-BTC (Appendix 7 enclosed herewith).
- The project owner shall
send the approved financial plan to the Ministry of Health (Department of
Planning and Finance) and the Ministry of Finance (Department of Debt
Management and External Finance) for monitoring and supervision.
3. The project owner
shall account, settle, and report all received and used capital sources and
properties; conduct acceptance, hand over, and settle the program/project
within 06 months from the project completion date.
4. The Department of
Planning and Finance shall act as the focal point to submit the project's
annual and final financial settlement reports to the Ministry’s leader in
charge of the Department for approval.

Chapter
V
IMPLEMENTATION
Article
11. Duties and powers of relevant entities
1. Duties and powers of
program/project/non-project owners are prescribed in Article 14 of Decree No.
80/2020/ND-CP and matters to which they are decentralized power are prescribed
in Articles 7, 8, and 10 of this Regulation.
2. Duties and powers of
Program/Project Management Boards are prescribed in Article 15 of Decree No.
80/2020/ND-CP .
3. The Department of
Planning and Finance shall serve as the focal agency for performing the state
management function over foreign aid. To be specific:
a) Take charge of
developing the guidance on the management of grant aid outside of ODA given to
the health sector and submit them to competent authorities for promulgation.
b) Serve as the focal
point for appraisal and provision of advice for the Ministry’s Leaders in
approving foreign aid programs/projects/non-projects under the Ministry’s
approval jurisdiction;
c) Take charge of synthesizing
the annual state budget revenue and expenditure estimates on the basis of
proposals by aid owners and submit thereby to the Ministry’s Leaders for
allocation of foreign aid and counterpart fund estimates to aid owners,
programs/projects/non-project owners in accordance with applicable laws;

e) Serve as the focal
point for cooperation with relevant entities in inspecting and supervising the
implementation of projects and compliance with regulations on management of
programs/projects, or non-projects managed by the Ministry of Health;
g) Send periodic reports
in accordance with Decree No. 80/2020/ND-CP , Circular No. 19/2022/TT-BKHDT, and
Circular No. 23/2022/TT-BTC .
4. The Department of
International Cooperation shall act as the focal point for aid mobilization
based on socio-economic development demands and orientations, and aid
absorption capacity. To be specific:
a) Take charge of and
cooperate with relevant entities in mobilizing aid for the health sector;
b) Take charge of
requesting competent authorities for granting a permission for the organization
of international conferences/seminars in Vietnam concerning industries and
sectors under the state management of the Ministry of Health in accordance with
laws;
c) Cooperate with the
Department of Planning and Finance in monitoring and supervising the
implementation of programs/projects/non-projects under its jurisdiction.
5. Departments and
relevant units under the Ministry of Health shall cooperate with the Department
of Planning and Finance in appraising aid grants in accordance with their
assigned functions and tasks, and in supervising program/project
implementation.
Article
12. Implementation provisions
1. The Department of
Planning and Finance shall provide guidance for the implementation of this
Regulation.

3. In the cases where any
of the documents referred to in this Regulation is amended or replaced, the
newest one shall apply.
4. Matters that are not
prescribed in this Regulation shall follow Decree No. 80/2020/ND-CP and other
relevant legislative documents.

owner affirms:
- The program/project/non-project
falls under the scope of Decree No. 80/2020/ND-CP , aims for socio-economic
development or provision of humanitarian assistance, and is not for commercial
or profit-making purposes;
- The aid recipient shall
hold the ownership of project results and intellectual property rights to the
project/aid results, and this is not a one-off contract;
- The schedule and
implementation contents of the program/project/non-project shall strictly
follow the concluded aid agreement;
- The project owner shall
take full responsibility before the law for the accuracy, reasonableness,
legitimacy, and completeness of the submitted aid documentation.
