Thực hiện quy định tại Điều 56 của
Luật Điều ước quốc tế năm 2016 được sửa đổi, bổ sung một số điều bởi Luật số
137/2025/QH15, Bộ Ngoại giao trân trọng thông báo:
Hiệp định giữa Chính phủ nước Cộng hòa xã hội
chủ nghĩa Việt Nam và Chính phủ nước Cộng hòa I-ta-li-a về cùng trao đổi và bảo
vệ thông tin mật, ký
tại Rome ngày 26 tháng 06 năm 2025, có hiệu lực từ ngày 04 tháng 01 năm 2026.
Bộ Ngoại giao trân trọng gửi Quý Cơ quan bản
sao Hiệp định theo quy định tại Điều 59 của Luật nêu trên.

Chính phủ nước Cộng hòa xã hội chủ nghĩa Việt
Nam và Chính phủ nước Cộng hòa I-ta-li-a (sau đây gọi riêng là “Bên” và gọi
chung là “hai Bên”),
Nhất trí mở rộng, thắt chặt quan hệ hợp tác về
chính trị, quân sự, kinh tế và tổ chức đối thoại về các vấn đề liên quan đến
chính trị và an ninh,
Nhận thấy vai trò quan trọng của hợp tác song
phương vì Hòa Bình, ổn định, an ninh quốc gia và an ninh quốc tế,
Nhận thấy rằng hợp tác hiệu quả có thể đặt ra
yêu cầu trao đổi thông tin mật giữa hai Bên,
Trên cơ sở nguyên tắc tôn trọng độc lập, chủ
quyền, không can thiệp vào công việc nội bộ của nhau, bình đẳng và cùng có lợi,
tuân theo quy định và pháp luật quốc gia của mỗi Bên,
Mong muốn tạo ra các quy tắc về việc cùng trao
đổi và bảo vệ thông tin mật được áp dụng cho bất kỳ thỏa thuận hợp tác và hợp đồng
nào trong tương lai sẽ được thực hiện giữa hai Bên có chứa đựng hoặc liên quan
đến thông tin mật,
Đã thoả thuận như sau:
Điều
1
Phạm
vi và mục đích
1. Tuân theo quy định và pháp luật quốc gia của
mỗi Bên, Hiệp định này đề ra các quy tắc và thủ tục về việc cùng trao đổi và bảo
vệ thông tin mật giữa hai Bên, áp dụng đối với các cơ quan nhà nước, tổ chức,
cá nhân của mỗi Bên tham gia vào các hoạt động hợp tác giữa hai Bên hoặc thực
hiện các hợp đồng thuộc phạm vi điều chỉnh của Hiệp định này trong bất kỳ hoạt
động hợp tác có thông tin mật cần bảo vệ.
2. Mục đích của Hiệp định này là bảo vệ thông
tin mật đã được trao đổi giữa hai Bên và thực thể được ủy quyền trong quá trình
hợp tác.
Điều
2
Giải
thích từ ngữ
Trong Hiệp định này, các khái niệm sau đây được
hiểu như sau:
1. Thông tin mật là thông tin bất kể hình thức,
bản chất hoặc định dạng, được một trong hai Bên tạo ra, được phân loại cấp độ mật
theo quy định và pháp luật quốc gia để bảo đảm thông tin được bảo vệ, tránh việc
mất mát, chiếm đoạt, truy cập trái phép, làm lộ và tiêu hủy hoặc bất kỳ hình thức
tổn hại nào khác.
2. Tiếp cận thông tin mật trái phép là việc bất
kỳ cơ quan nhà nước, tổ chức hay cá nhân tiếp cận thông tin mật trái quy định
và pháp luật quốc gia của mỗi Bên và/hoặc quy định tại Hiệp định này.
3. Dấu mật là biện pháp đánh dấu hành chính được
chỉ định cho thông tin mật theo quy định và pháp luật quốc gia của một Bên, từ
đó tương ứng với các biện pháp an ninh bảo vệ thông tin đó.
4. Bên cung cấp là Bên chuyển giao thông tin mật.
5. Bên nhận là Bên thông tin mật được chuyển đến.
6. Thực thể được ủy quyền là cơ quan nhà nước,
tổ chức hoặc cá nhân, dưới sự giám sát của Cơ quan có thẩm quyền của các Bên,
được phép tiếp cận thông tin mật theo quy định và pháp luật quốc gia của mỗi
Bên, được bổ sung theo Hiệp định này và phải tham gia vào các hoạt động hợp tác
có liên quan hoặc thực hiện các Hợp đồng.
7. Cơ quan có thẩm quyền là cơ quan nhà nước
theo quy định và pháp luật quốc gia của mỗi Bên, thực hiện chính sách của nhà
nước về bảo vệ thông tin mật cũng như tiến hành giám sát việc triển khai thực
hiện Hiệp định này.
8. Hợp đồng là thỏa thuận bằng văn bản liên
quan đến việc cung cấp và chuyển giao thông tin mật giữa các thực thể được ủy
quyền.
9. Bên ký Hợp đồng là bất kỳ cơ quan nhà nước,
tổ chức hoặc cá nhân nào thuộc thẩm quyền của một Bên có năng lực pháp lý để ký
kết hợp đồng.
10. Nguyên tắc “cần biết” là nguyên tắc theo đó
quyền tiếp cận thông tin mật chỉ có thể được cấp cho một cơ quan nhà nước, tổ
chức hoặc cá nhân liên quan đến các nhiệm vụ chính thức và để thực hiện nhiệm vụ
chính thức cụ thể.
11. Bên thứ ba là bất kỳ quốc gia, tổ chức quốc
tế hoặc bất kỳ thực thể nào không phải là một Bên ký kết Hiệp định này hoặc ký
kết Hợp đồng theo quy định của Hiệp định này.
12. Giải mật thông tin mật là việc xóa bỏ cấp độ
mật của thông tin đã được xác định.
13. Vi phạm an ninh là hành động hoặc không
hành động trái với luật pháp quốc gia của một trong hai Bên dẫn đến hoặc có thể
dẫn đến việc lộ lọt, mất, chiếm đoạt trái phép hoặc bất kỳ hình thức nào có thể
làm tổn hại đến thông tin mật.
Điều
3
Cấp
độ mật
1. Hai Bên đồng ý rằng các cấp độ mật sau là
tương ứng và phù hợp với các cấp độ mật theo quy định và pháp luật quốc gia mỗi
Bên.

2. Thông tin nhận được từ nước Cộng hòa
I-ta-li-a được xác định là RISERVATO sẽ được bảo vệ như thông tin ở cấp độ MẬT
tại nước Cộng hòa xã hội chủ nghĩa Việt Nam.
3. Mỗi Bên sẽ đánh dấu mật theo quy định và
pháp luật quốc gia của mỗi Bên và theo Hiệp định này.
4. Mỗi Bên được thay đổi cấp độ mật phù hợp với
quy định và pháp luật quốc gia của mình và phải thông báo cho Bên kia để thay đổi
biện pháp bảo vệ phù hợp đối với thông tin mật.
Điều
4
Cơ
quan có thẩm quyền
1. Cơ quan có thẩm quyền của hai Bên là:
Đối với nước Cộng hoà xã hội chủ nghĩa Việt
Nam: Bộ Công an - Cục An ninh chính trị nội bộ.
Đối với nước Cộng hòa I-ta-li-a: Chủ tịch Hội đồng
các Bộ trưởng - Cục An ninh tình báo - Văn phòng Cơ mật trung ương (DIS-UCSe);
2. Hai Bên phải thông báo cho nhau thông qua
kênh ngoại giao về những thay đổi đối với Cơ quan có thẩm quyền.
3. Cơ quan có thẩm quyền phải thông báo cho
nhau về quy định và pháp luật hiện hành của quốc gia mình quy định về bảo vệ
thông tin mật.
4. Nhằm bảo đảm hợp tác chặt chẽ trong việc thực
hiện Hiệp định này, Cơ quan có thẩm quyền có thể tổ chức tham vấn theo yêu cầu
của một trong hai Bên.
5. Nhằm đạt được và duy trì các tiêu chuẩn an
ninh tương ứng, các Cơ quan có thẩm quyền, theo yêu cầu, phải cung cấp cho nhau
thông tin về tiêu chuẩn an ninh, trình tự, thủ tục đối với việc bảo vệ thông
tin mật được áp dụng của mỗi Bên. Để đạt được mục đích này, các Cơ quan có thẩm
quyền có thể nhất trí về việc tổ chức thăm và làm việc với nhau.
6. Cơ quan có thẩm quyền của hai Bên có thể ký
các thoả thuận thực hiện liên quan đến Hiệp định này.
7. Cơ quan có thẩm quyền của hai Bên phải bảo đảm
việc tuân thủ nghiêm ngặt và ràng buộc Hiệp định này của các thực thể được ủy
quyền khi tham gia vào các hoạt động hợp tác của các Bên.
8. Cơ quan có thẩm quyền của hai Bên phải hợp
tác hỗ trợ nhau trong quá trình triển khai cũng như giám sát các thực thể được ủy
quyền thực hiện Hiệp định này.
Điều
5
Chuyển
thông tin mật
1. Thông tin mật chỉ được chuyển thông qua kênh
ngoại giao hoặc các kênh khác được hai Bên cùng đồng ý, phù hợp với quy định và
pháp luật quốc gia. Bên nhận sẽ khẳng định bằng văn bản khi nhận được thông tin
mật.
2. Thông tin được xác định là TUYỆT MẬT/SEGRETISSIMO/TOP
SECRET chỉ được chuyển thông qua kênh ngoại giao.
3. Trong trường hợp vận chuyển một bao kiện lớn
có chứa tài liệu và vật chứa thông tin mật liên quan, phù hợp với quy định và
pháp luật quốc gia, các Cơ quan có thẩm quyền hoặc các cơ quan liên quan phải
cùng thỏa thuận và duyệt kế hoạch vận chuyển, trong đó có thông tin về phương
tiện vận chuyển, tuyến đường và các biện pháp an ninh khác.
4. Trường hợp một trong hai Bên có căn cứ cho rằng,
trong quá trình thực hiện Hiệp định này, việc chuyển thông tin mật có thể gây tổn
hại đến chủ quyền và an ninh quốc gia hoặc trái với quy định và pháp luật quốc
gia của mỗi Bên và nghĩa vụ quốc tế thì có thể từ chối yêu cầu chuyển thông tin
mật và phải thông báo bằng văn bản lý do từ chối cho Bên đề nghị.
Điều
6
Biện
pháp bảo vệ thông tin mật
1. Phù hợp với quy định và pháp luật quốc gia
mình, hai Bên và thực thể được ủy quyền phải triển khai mọi biện pháp phù hợp để
bảo vệ thông tin mật theo Hiệp định này. Thông tin mật được cung cấp sẽ được bảo
vệ tương ứng với thông tin mật có cùng cấp độ mật được quy định tại Điều 3 của Hiệp định này.
2. Hai Bên phải thông báo cho nhau về bất kỳ
thay đổi nào về quy định và pháp luật quốc gia mình ảnh hưởng đến việc bảo vệ
thông tin mật. Trong trường hợp như vậy, hai Bên phải thông báo cho nhau, theo
quy định tại khoản 4 và khoản 5 Điều 4, nhằm trao đổi về khả
năng sửa đổi Hiệp định này. Trong thời gian đó, thông tin mật phải được bảo vệ
phù hợp với quy định của Hiệp định này, trừ khi có thỏa thuận khác bằng văn bản.
3. Chỉ thực thể được ủy quyền tham gia các nhiệm
vụ được giao, phù hợp với nguyên tắc “cần biết”, mới được quyền tiếp cận thông
tin mật. Việc tiếp cận thông tin mật phải thực hiện theo quy định và pháp luật
quốc gia của mỗi Bên và Hiệp định này.
4. Bên cung cấp thông tin mật phải:
a) Bảo đảm thông tin mật đã được đánh dấu bằng
dấu mật phù hợp với quy định và pháp luật quốc gia mình;
b) Thông báo cho Bên nhận về bất kỳ điều kiện tiết
lộ hoặc hạn chế đối với việc sử dụng thông tin mật đã cung cấp và về mọi thay đổi
tiếp theo trong phân loại cấp độ mật.
5. Bên nhận thông tin mật phải:
a) Bảo đảm thông tin mật đã được cung cấp được
đánh dấu bằng dấu mật tương ứng với dấu phân loại cấp độ mật do Bên cung cấp
quy định;
b) Không được cung cấp thông tin mật cho Bên thứ
ba mà không có sự đồng ý trước bằng văn bản của Bên cung cấp;
c) Không được sử dụng thông tin mật cho các mục
đích khác với mục đích mà thông tin mật đã được cung cấp;
d) Bảo đảm việc bảo vệ thông tin mật với thời hạn
theo quy định của Bên cung cấp và phù hợp theo Điều 3 của Hiệp định
này, trừ trường hợp có yêu cầu khác bằng văn bản của Bên cung cấp;
e) Bảo đảm rằng các thực thể được ủy quyền được
phép tiếp cận thông tin mật đã được cung cấp có khả năng bảo vệ thông tin mật
đó một cách đầy đủ;
f) Bảo đảm những người có quyền tiếp cận thông
tin mật đã được cung cấp được Cơ quan có thẩm quyền hoặc các cơ quan liên quan
phê duyệt và được thông báo đầy đủ về trách nhiệm và nghĩa vụ của họ trong việc
bảo vệ thông tin mật theo quy định và pháp luật có liên quan của Bên nhận.
Điều
7
Dịch,
sao, chụp và tiêu hủy thông tin mật
1. Tài liệu mật được đóng dấu TUYỆT MẬT/SEGRETISSIMO/TOP
SECRET chỉ được sao, chụp khi có sự đồng ý bằng văn bản của Bên cung cấp.
2. Việc dịch thuật thông tin mật phải được thực
hiện theo quy định và pháp luật quốc gia của mỗi Bên, cũng như theo Điều 3 Hiệp định này. Bản dịch thông tin mật phải được chú
thích phù hợp bằng ngôn ngữ của bản dịch chỉ rõ về việc bản dịch đó có chứa
thông tin mật của Bên cung cấp và cấp độ mật tương ứng.
3. Khi thông tin mật được sao, chụp hoặc trích
dẫn, tất cả dấu mật gốc phải được sao, chụp theo. Thông tin mật được sao, chụp
hay trích dẫn phải được kiểm soát như thông tin gốc, phù hợp theo Điều
3 Hiệp định này. Số lượng các bản sao phải được hạn chế theo yêu cầu của mục
đích chính thức.
4. Bên cung cấp có thể nêu rõ việc cấm sao, chụp
hoặc tiêu hủy thông tin mật bằng cách đánh dấu cụ thể vào thông tin mật hoặc
trên vật chứa thông tin mật liên quan hoặc gửi văn bản thông báo sau đó. Trong
trường hợp cấm tiêu hủy thông tin mật hoặc vật chứa thông tin mật thì chúng phải
được trả lại cho Bên cung cấp.
5. Thông tin TUYỆT MẬT/SEGRETISSIMO/TOP SECRET
không được phép tiêu hủy và phải được trả lại cho Bên cung cấp.
6. Trong trường hợp bất khả kháng không thể bảo
vệ và trả lại thông tin mật đã được cung cấp theo Hiệp định này, thông tin mật
phải được tiêu hủy ngay lập tức. Bên nhận phải thông báo bằng văn bản cho Bẽn
cung cấp về việc tiêu hủy thông tin mật trong thời gian sớm nhất có thể.
Điều
8
Hợp
đồng
1. Khi có yêu cầu, Cơ quan có thẩm quyền hoặc
các cơ quan liên quan của hai Bên phải xác nhận cho đối tác của nhau về việc
Bên ký Hợp đồng đã được chấp thuận để tiếp nhận thông tin mật ở cấp độ phù hợp
theo luật pháp và quy định quốc gia. Sự chấp thuận đó phải được các Bên cùng
công nhận.
2. Mỗi Hợp đồng được ký kết theo các điều khoản
của Hiệp định này phải kèm theo một phụ lục bao gồm nhưng không giới hạn những
thông tin sau:
a) Hướng dẫn phân loại cấp độ mật và danh sách
thông tin mật;
b) Các thủ tục để thông báo bất kỳ thay đổi nào
về phân loại cấp độ mật của thông tin mật;
c) Thủ tục chuyển giao tin mật;
d) Tên của các cơ quan và tổ chức sẽ tiếp cận
thông tin mật, bao gồm thông tin về chức năng và trách nhiệm của các cơ quan này;
e) Thông tin cụ thể tham chiếu đến Hiệp định
này.
3. Trách nhiệm của Bên ký Hợp đồng trong bảo vệ
thông tin mật phải, trong mọi trường hợp, bao gồm nhưng không giới hạn các trường
hợp sau:
a) Chỉ cung cấp thông tin mật cho thực thể được
ủy quyền tham gia việc thực hiện Hợp đồng và phù hợp với nguyên tắc “cần biết”;
b) Bố trí phương tiện để chuyển giao thông tin
mật an toàn;
c) Bảo đảm phân loại cấp độ mật không bị thay đổi
trừ khi được Bên cung cấp cho phép bằng văn bản;
d) Thông báo về bất kỳ thay đổi có thể phát
sinh liên quan đến thông tin mật do những thay đổi về cấp độ mật hoặc giải mật
thông tin mật;
e) Thông báo về thủ tục phê duyệt các chuyến
thăm hoặc tiếp cận bởi nhân viên của Bên ký Hợp đồng đến các cơ sở của Bên ký Hợp
đồng còn lại trong quá trình thực hiện Hợp đồng;
f) Thông báo kịp thời cho Cơ quan có thẩm quyền
hoặc các cơ quan liên quan về bất kỳ sự tiếp cận trái phép, âm mưu tiếp cận hoặc
nghi ngờ có sự tiếp cận trái phép thông tin mật liên quan đến Hợp đồng;
g) Chỉ sử dụng thông tin mật được chuyển giao
trong Hợp đồng cho các mục đích liên quan tới Hợp đồng và trong giới hạn do Bên
cung cấp đưa ra.
4. Trong trường hợp được yêu cầu, bản sao Hợp đồng
và phụ lục kèm theo sẽ được nộp cho Cơ quan có thẩm quyền của Bên nhận vì mục
đích giám sát an ninh.
Điều
9
Vi
phạm an ninh
1. Trong trường hợp xảy ra vi phạm an ninh, Cơ
quan có thẩm quyền hoặc cơ quan liên quan của Bên có hành vi vi phạm an ninh xảy
ra phải thông báo sớm nhất có thể cho Cơ quan có thẩm quyền và cơ quan liên
quan của Bên kia và phải tiến hành điều tra thích hợp. Nếu được yêu cầu, Bên
kia phải hợp tác trong công tác điều tra có liên quan.
2. Trong trường hợp vi phạm an ninh xảy ra ở nước
thứ ba, Cơ quan có thẩm quyền của Bên gửi thông tin mật cho nước thứ ba phải thực
hiện các hành động theo quy định của khoản 1 Điều này khi có thể.
3. Trong bất kỳ trường hợp nào, Cơ quan có thẩm
quyền của Bên có vi phạm an ninh xảy ra phải thông báo cho Bên kia về kết quả điều
tra, nguyên nhân, mức độ thiệt hại xảy ra và biện pháp khắc phục và bồi thường
đã thực hiện.
4. Cơ quan có thẩm quyền của Bên có vi phạm an
ninh xảy ra sẽ thực hiện tất cả các biện pháp theo quy định và pháp luật của quốc
gia mình để hạn chế hậu quả của hành vi vi phạm và để ngăn ngừa các vi phạm sau
này.
Điều
10
Các
chuyến thăm
1. Chuyên gia về an ninh của hai Bên có thể tổ
chức gặp gỡ định kỳ nhằm trao đổi về các quy trình, thủ tục bảo vệ thông tin mật.
2. Các chuyến thăm của nhân sự của Bên cần tiếp
cận thông tin mật hoặc cần tiếp cận trụ sở lưu trữ thông tin mật của Bên kia phải
được sự cho phép trước bằng văn bản của Cơ quan có thẩm quyền hoặc cơ quan liên
quan của Bên đón tiếp.
3. Thủ tục cho chuyến thăm phải được thống nhất
giữa các Bên.
4. Bên đến thăm cần cung cấp bằng văn bản những
thông tin sau:
a) Họ tên, ngày sinh và nơi sinh, quốc tịch, số
hộ chiếu của người đến thăm;
b) Chức vụ của người đến thăm và tên cơ quan
người đó đại diện;
c) Phù hợp với quy định và pháp luật của mỗi
Bên, người đến thăm phải được Bên cử đi ủy quyền bằng văn bản để tiếp cận thông
tin mật, với thông tin cụ thể về phạm vi, nội dung của thông tin mật được phép
tiếp cận;
d) Mục đích, dự kiến chương trình làm việc và
thời gian của chuyến thăm;
e) Tên, địa chỉ, số điện thoại, email và đầu mối
liên lạc của tổ chức hoặc trụ sở đề nghị được đến thăm;
f) Thông tin mật mà người đến thăm muốn tiếp cận
và thời gian cần thiết cho việc tiếp cận đó, cũng như cấp độ mật cao nhất mong
muốn tiếp cận.
5. Yêu cầu cho chuyến thăm phải được chuyển tới
Cơ quan có thẩm quyền hoặc cơ quan liên quan của Bên đón tiếp ít nhất ba mươi
(30) ngày làm việc trước ngày diễn ra chuyến thăm.
6. Cơ quan có thẩm quyền của hai Bên có thể thỏa
thuận về danh sách những người được ủy quyền để thực hiện các chuyến thăm định
kỳ. Danh sách đó có giá trị trong mười hai (12) tháng. Khi danh sách đó đã được
hai Bên thông qua, những người được ủy quyền phải trao đổi trực tiếp với đơn vị
chức năng của cơ quan đón tiếp về những nội dung cụ thể liên quan đến chuyến
thăm, phù hợp với thời hạn và điều kiện đã được thống nhất.
7. Mỗi Bên phải bảo đảm công tác bảo vệ dữ liệu
cá nhân của người đến thăm theo quy định và pháp luật của mỗi quốc gia.
8. Mỗi Bên có quyền thay đổi danh sách người đến
thăm và thông báo những thay đổi đó cho Bên còn lại.
Điều
11
Chi
phí
Mỗi Bên phải tự chi trả các chi phí triển khai Hiệp
định này theo quy định và pháp luật quốc gia của mỗi Bên và không vượt quá khả
năng ngân sách thường xuyên của mình, cũng như không tạo ra các chi phí phát
sinh trong ngân sách quốc gia của nước Cộng hòa xã hội chủ nghĩa Việt Nam và nước
Cộng hòa I-ta-li-a.
Điều
12
Điều
khoản cuối cùng
1. Hiệp định này sẽ có hiệu lực vào ngày thứ ba
mươi (30) sau ngày nhận được thông báo bằng văn bản cuối cùng của hai Bên,
thông qua kênh ngoại giao, thông báo cho nhau về việc hoàn tất các thủ tục pháp
lý nội bộ cần thiết để Hiệp định có hiệu lực.
2. Hiệp định này có thể được sửa đổi trên cơ sở
có sự đồng ý bằng văn bản của cả hai Bên. Thoả thuận sửa đổi Hiệp định sẽ có hiệu
lực theo thủ tục quy định tại khoản 1 Điều này.
3. Hiệp định này có hiệu lực vô thời hạn.
4. Mỗi Bên có thể chấm dứt Hiệp định này vào bất
kỳ thời điểm nào bằng cách thông báo bằng văn bản cho Bên kia qua kênh ngoại
giao. Việc chấm dứt Hiệp định sẽ có hiệu lực sáu (6) tháng sau ngày nhận được
thông báo. Mặc dù chấm dứt Hiệp định này, mọi thông tin mật đã được cung cấp
theo Hiệp định này phải tiếp tục được bảo vệ theo quy định của các điều khoản của
Hiệp định.
5. Mọi bất đồng liên quan đến việc giải thích
hay áp dụng Hiệp định này phải được giải quyết một cách thân thiện thông qua
tham vấn giữa các Bên mà không nhờ đến sự can thiệp của Bên thứ ba.
6. Hiệp định này phải được thực hiện theo pháp
luật của Việt Nam và I-ta-li-a, cũng như phù hợp với luật pháp quốc tế và các điều
ước quốc tế và khu vực có liên quan mà hai Bên là thành viên.
ĐỂ LÀM BẰNG, các đại diện dưới đây được ủy quyền
đã ký Hiệp định này.
Làm tại Rome, ngày 26 tháng 6 năm 2025 được lập
thành hai bản gốc, mỗi bản bằng tiếng Việt, tiếng I-ta-li-a và tiếng Anh, các
văn bản đều có giá trị như nhau. Trong trường hợp có sự giải thích khác nhau,
văn bản tiếng Anh được dùng làm cơ sở.

AGREEMENT
BETWEEN
THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIET NAM AND THE GOVERNMENT OF THE
ITALIAN REPUBLIC ON THE EXCHANGE AND MUTUAL PROTECTION OF CLASSIFIED
INFORMATION
The Government of the Socialist Republic of
Viet Nam and the Government of the Italian Republic (hereinafter referred to
individually as the “Party” and collectively as the “Parties”),
Having agreed to broaden and tighten their
political, military and economic co-operation, and to hold talks on political
and security-related issues,
Being aware of the important role of their
mutual co-operation for peace, stability, national and international security,
Realizing that effective co-operation may
require exchange of Classified Information between the Parties,
Based on the principles of mutual respect for
independence, sovereignty, and non-interference in the internal affairs of each
other, equality, mutual benefit in accordance with national laws and
regulations of each Party,
Desiring to create a set of rules regulating
the exchange and mutual protection of Classified Information, applicable to any
future co-operation agreements and contracts which will be implemented between
the Parties, containing or involving Classified Information,
Have agreed as follows:
ARTICLE
1
Scope
and Purpose
1. In accordance with the Parties’ national
laws and regulations, this Agreement sets out rules and procedures regulating
the exchange and mutual protection of Classified Information between the
Parties and applies to government agencies, organizations, individuals of each Party
participating in cooperation activities between such Parties or implementing
contracts under this Agreement within any cooperation activities where
Classified Information needs to be protected.
2. The purpose of this Agreement is to protect
Classified Information exchanged between the Parties or Authorized Entities in
the context of mutual cooperation.
ARTICLE
2
Definitions
In the context of this Agreement, the
expressions listed below shall have the following meanings:
1. “Classified Information” means information
of whatever form, nature or format, which is generated by one of the Parties,
to which a Security Classification Level has been attributed pursuant to
national laws and regulations in order to ensure its protection against loss,
misappropriation, unauthorized access, disclosure and destruction, or any other
form of damage.
2. “Unauthorized access to Classified
Information” means access by any government agency, organization or individual
to Classified Information, not in accordance with the national laws and
regulations of each Party and/or with this Agreement.
3. “Security Classification Marking” means an
administrative marking assigned to Classified Information in accordance with
national laws and regulations of one Party, to which corresponds a specific set
of security protection measures of such information.
4. “Providing Party” means the Party providing
Classified Information.
5. “Receiving Party” means the Party to which
Classified Information is provided.
6. “Authorized Entities” means a government
agency, organization or individual which, under the supervision of the Parties’
Competent Authorities, is allowed to access Classified Information in
accordance with the national laws and regulations of each Party, as
complemented by this Agreement, and which shall take part in relevant
cooperation activities or in the implementation of Contracts.
7. “Competent Authority” means the authority
which, in compliance with the national laws and regulations of the respective
Party, is in charge of implementing State policy on the protection of
Classified Information as well as monitoring the implementation of this
Agreement.
8. “Contract” means a written agreement which
involves providing or transferring of Classified Information between Authorized
Entities.
9. “Contractor” means any government agency,
organization or individual possessing the legal capacity to conclude contracts
under the jurisdiction of one the Parties.
10. “Need to know” means the principle
according to which access to Classified Information can be granted to a
government agency, organization or individual only in connection with official
duties or for the performance of an official task.
11. “Third Party” means any State,
International Organization or any other entity which is not a Party to this
Agreement nor a Party to a Contract pursuant to this Agreement.
12. “Declassification of Information” means the
removal of the Security Classification Level.
13. “Breach of Security” means an act or
omission contrary to the national legislations of one of the Parties which
results or may result in the unauthorized disclosure, loss, misappropriation,
or any other form of damage of Classified Information.
ARTICLE
3
Security
Classification Levels
1. The Parties agree that the following
Security Classification Levels are equivalent and correspond to the Security
Classification Levels specified in the national laws and regulations of the
respective Party.

2. Information received from the Italian
Republic classified as RISERVATO shall be protected as MẬT in the Socialist
Republic of Viet Nam.
3. The Parties shall mark Classified
Information in compliance with their national laws and regulations and this
Agreement.
4. Each Party can change Security
Classification Levels of its own Classified Information in compliance with its
national legislation and shall notify the other Party of such change in order
to adjust methods to appropriately protect Classified Information.
ARTICLE
4
Competent
Authorities
1. The Competent Authorities of the Parties
are:
For the Socialist Republic of Viet Nam: Ministry of Public
Security - Department of Internal Political Security.
For the Italian Republic: Presidency of the
Council of Ministers - Security Intelligence Department - Central Secrecy
Office (DIS-UCSe).
2. The Parties shall notify each other through
diplomatic channels of any subsequent changes of their Competent Authorities.
3. The Competent Authorities shall inform each
other about the national laws and regulations in force regulating the
protection of Classified Information.
4. In order to ensure close co-operation in the
implementation of this Agreement, the Competent Authorities may hold
consultations at the request made by one of them.
5. In order to achieve and maintain comparable
standards of security, the respective Competent Authorities shall, on request,
provide each other with information about the security standards, procedures,
and practices for protection of Classified Information applied by the
respective Party. To this end, Competent Authorities may agree to visit each
other.
6. The Competent Authorities of the Parties may
conclude implementing arrangements in relation to this Agreement.
7. The Competent Authorities of the Parties
shall ensure a strict and binding observance of this Agreement by Authorized
Entities participating in cooperation activities between such Parties.
8. The Competent Authorities of the Parties
shall mutually assist each other in the implementation as well as in the
monitoring of the implementation of this Agreement by Authorized Entities.
ARTICLE
5
Transmission
of Classified Information
1. Classified Information shall be transmitted
by means of diplomatic channels or other channels mutually agreed by the
Parties in accordance with national laws and regulations. The Receiving Party
shall confirm in writing the receipt of Classified Information.
2. Classified Information at TUYỆT MẬT/
SEGRETISSIMO/ TOP SECRET level shall be transferred exclusively through
diplomatic channels.
3. In case of transmitting a large consignment
of documents and the relevant carrier containing Classified Information, the
Competent Authorities, or relevant authorities in accordance with national laws
and regulations, shall mutually agree on and approve a transportation plan,
which will include the means of transport, the route and the other security
measures.
4. In case one of the Parties has a ground
that, in implementing this Agreement, the Transmission of Classified
Information may cause a damage to national sovereignty and security or entail a
breach of its national laws and regulations as well as international
obligations, such Party can deny the request of Transmission of Classified
Information and shall notify the requesting Party in writing the reason of such
denial.
ARTICLE
6
Measures
for protection of Classified Information
1. In compliance with their national laws and
regulations, the Parties and Authorized Entities shall implement all
appropriate measures for the protection of Classified Information under this
Agreement. The provided Classified Information shall be protected with the corresponding
Security Classification Level, as set forth under Article 3 of
this Agreement.
2. The Parties shall inform each other about
any changes in their respective national laws and regulations affecting the
protection of Classified Information. In such cases, the Parties shall inform
each other, in compliance with Paragraphs 4 and 5 of Article 4,
in order to discuss possible amendments to this Agreement. Meanwhile, the
Classified Information shall be protected according to the provisions of this
Agreement, unless otherwise agreed in writing.
3. Only Authorized Entities engaged in assigned
duties in accordance with the “Need to know” principle have the right to access
to Classified Information, which shall be in accordance with the national laws
and regulations of the respective Party and this Agreement.
4. The Providing Party shall:
a) Ensure that Classified Information is marked
with an appropriate Security Classification Marking in accordance with its
national laws and regulations;
b) Inform the Receiving Party of any conditions
of release or restrictions on the use of the transmitted Classified Information
and of any subsequent changes in the security classification.
5. The Receiving Party shall:
a) Ensure that Classified Information which has
been provided is marked with an equivalent Security Classification Marking
regulated by the Providing Party;
b) Not disclose Classified Information to a
Third Party without the prior written consent of the Providing Party;
c) Not use Classified Information for other
purposes than those for which it was provided;
d) Ensure the protection of Classified
Information according to the terms of protection established by the regulations
of the Providing Party in accordance with Article 3 of this
Agreement, unless otherwise requested in writing by the Providing Party;
e) Ensure that Authorized Entities accessing
provided Classified Information have the capability to protect such Classified
Information adequately;
f) Ensure that individuals having access to
provided Classified Information have been duly approved by the Competent
Authority or relevant authorities and are fully informed of their
responsibilities and obligations to protect the Classified Information, in
accordance with the relevant laws and regulations of the Receiving Party.
ARTICLE
7
Translation,
reproduction, and destruction of Classified Information
1. Classified Information marked with a
Security Classification Level TUYỆT MẬT/ SEGRETISSIMO/ TOP SECRET shall only be
reproduced with the written permission of the Providing Party.
2. Classified Information translations shall be
in accordance with the national laws and regulations of each Party, as well as Article 3 of this Agreement. Translations of Classified
Information shall contain a suitable annotation in the language of the
translation indicating that they contain Classified Information of the
Providing Party and the level of such Classified Information.
3. When Classified Information is reproduced or
extracted, all original security markings thereon shall also be reproduced.
Such reproduced or extracted Classified Information shall be placed under the
same control as the original information in accordance with Article
3 of this Agreement. The number of copies shall be limited to that required
for official purposes.
4. The Providing Party may expressly prohibit
reproduction or destruction of Classified Information by placing a specific
indication on Classified Information or on the relevant container of Classified
Information or sending subsequent written notice. If destruction of Classified
Information or of the relevant container thereof is prohibited, it shall be
returned to the Providing Party.
5. Classified Information of TUYỆT MẬT/
SEGRETISSIMO/ TOP SECRET Security Classification Level shall not be destroyed
and shall be returned to the Providing Party.
6. In case of a force majeure situation, which
makes it impossible to protect and return Classified Information provided
according to this Agreement, Classified Information shall be destroyed
immediately. The Receiving Party shall notify the Providing Party in writing
about the destruction of the Classified Information as soon as possible.
ARTICLE
8
Contracts
1. Upon request, the Competent Authority or
relevant authorities of one Party shall confirm to those of the other Party
that a Contractor has been approved to receive Classified Information to the
appropriate level, in accordance with national laws and regulations. Such
approvals shall be mutually recognized by the Parties.
2. Each Contract signed under the provisions of
this Agreement shall need an annex containing, among others, the following
information:
a) Classification guidance and list of
Classified Information;
b) Procedure to inform of any changes of
Security Classification Levels of Classified Information;
c) Transmission Procedures;
d) Names of agencies and organizations, which
will access Classified Information, including their functions and
responsibilities;
e) A specific reference to this Agreement.
3. The Contractors’ responsibility to protect
the Classified Information shall, in all cases, include among others, the
following:
a) Disclose Classified Information only to
Authorized Entities engaged in the implementation of the Contract and in
accordance with the “Need to know” principle;
b) Arrange means to be used for the secure
transmission of the Classified Information;
c) Ensure that the Security Classification
Level is not changed unless authorized in writing by the Providing Party;
d) Notify any changes that may arise in
relation to Classified Information due to the changes of Security
Classification Levels or Declassification;
e) Notify the procedure for the approval of
visits or access by personnel of one Contractor to facilities of the other
Contractor in the execution of the Contract;
f) Notify in due time its Competent Authority
or relevant authorities any actual, attempted or suspected Breach of Security
related to the Contract;
g) Use the Classified Information exchanged
under the Contract only for the purposes related to such Contract and with the
limitations set by the Providing Party.
4. A copy of the Contract and its annexes is
submitted to the Competent Authority of the Receiving Party for security
monitoring, if required.
ARTICLE
9
Breach
of Security
1. In case of Breach of Security, the Competent
Authority or relevant authority of the Party where the Breach of Security
occurred, shall inform the Competent Authority and relevant authority of the
other Party as soon as possible and shall carry out the appropriate
investigation. The other Party, if requested, shall cooperate in the related
investigation.
2. In case a Breach of Security occurs in a
third country, the Competent Authority of the Party which has sent Classified
Information to the third country shall take the actions under Paragraph 1 of
this Article, when possible.
3. In all cases, the Competent Authority of the
Party where the Breach of Security occurs, shall inform the other Party of the
results of the investigation, the causes, the extent of damage, countermeasures
and remedies which have been adopted.
4. The Competent Authority of the Party where
the Breach of Security occurs, shall undertake all measures in accordance with
its national laws and regulations so as to limit the consequences of the breach
and to prevent further breaches.
ARTICLE
10
Visits
1. Security experts of the two Parties may hold
regular meetings to discuss the procedures for protection of Classified
Information.
2. Visits by the personnel of a Party requiring
access to Classified Information or to facilities of the other Party where
Classified Information is held shall be performed only with the prior written
consent of the Competent Authority or relevant authority of the host Party.
3. Visit procedures shall be agreed between the
Parties.
4. The sending Party shall provide in writing
the following information:
a) Name, date and place of birth, nationality,
passport number of the visitor;
b) Position, title of the individual and name
of the represented organization;
c) In accordance with national laws and
regulations of each Party, individuals shall be authorized in writing by the
sending Party to access Classified Information, with indication of the scope
and content of Classified Information authorized to access;
d) Purpose, proposed working program and
planned date of the visit;
e) Name, address, phone number, email and point
of contact of the organizations or facilities to be visited;
f) The Classified Information, to which the
individual needs to access and the duration of such access, as well as the
anticipated highest Security Classification Level to be accessed.
5. Requests for visits shall be submitted to
the Competent Authority 01- relevant authority of the host Party at least
thirty (30) working days before the date of the planned visit.
6. The Competent Authorities of the Parties may
agree to establish lists of authorized individuals to make recurring visits.
These lists are valid for a period of twelve (12) months. Once these lists are
approved by the Parties, the terms of the specific visits shall be arranged
directly with the appropriate authorities of the organizations to be visited by
those individuals, in accordance with the terms and conditions agreed upon.
7. Each Party shall guarantee protection of
personal data of the visitors, according to the respective national laws and
regulations.
8. Each Party shall have the right to change
the list of visitors notifying such change to the other Party.
ARTICLE
11
Expenses
Each Party shall bear its own expenses
regarding the implementation of this Agreement in accordance with its national
laws and regulations and without exceeding its ordinary budget availability,
without any additional cost for the State budgets of the Socialist Republic of
Viet Nam and of the Italian Republic.
ARTICLE
12
Final
provisions
1. This Agreement shall enter into force on the
30th day after the date of the receipt of the last of the two
written notifications by which the Parties have informed each other, through
diplomatic channels, about the completion of their internal legal procedures
required for the entry into force of this Agreement.
2. This Agreement may be amended at any time by
mutual written consent of the Parties. The amending agreement shall enter into
force following the same procedures stated in the Paragraph 1 of this Article.
3. This Agreement shall be in effect for an
indefinite period of time.
4. Each Party may terminate this Agreement at
any time by forwarding written notice to the other Party through diplomatic
channels. The termination shall enter into force six (6) months after the date
of receipt of the notification. Notwithstanding the termination of this
Agreement, all Classified Information provided pursuant to this Agreement shall
continue to be protected in accordance with the provisions set forth herein.
5. Any dispute regarding the interpretation or
application of this Agreement shall be resolved amicably by consultations and
negotiations between the Parties without interventions by a Third Party.
6. This Agreement shall be implemented in
accordance with the Vietnamese and the Italian legislations, as well as with
applicable international law and international and regional treaties to which
both Parties are members.
IN WITNESS WHEREOF the undersigned, being duly
authorized thereto, have signed this Agreement.
Done at Rome, on 26 June 2025, in two original
copies, each in the Vietnamese, Italian and English languages, all texts being
equally authentic. In case of any divergence of interpretation, the English
text shall prevail.
