ON AMENDMENTS TO A NUMBER OF ARTICLES
OF CIRCULARS TO REDUCE AND SIMPLIFY ADMINISTRATIVE PROCEDURES IN THE FIELDS OF
VEHICLE INSPECTION, CIVIL AVIATION AND INSPECTION UNDER THE MANAGEMENT OF THE
MINISTRY OF CONSTRUCTION
Pursuant to the Law on
Road Traffic Order and Safety No. 36/2024/QH15 dated June 27, 2024;
Pursuant to the Law on
Inspection No. 84/2025/QH15 dated June 25, 2025;
Pursuant to the Law on
Civil Aviation of Vietnam No. 66/2006/QH11 dated June 29, 2006; the Law on
amendments to the Law on Civil Aviation of Vietnam No. 61/2014/QH13 dated
November 21, 2014;
Pursuant to the Law on
Product and Goods Quality No. 05/2007/QH12 dated November 21, 2007; the Law on
amendments to the Law on Product and Goods Quality No. 35/2018/QH14 dated
November 20, 2018; the Law on amendments to the Law on Product and Goods Quality
No. 78/2025/QH15 dated June 18, 2025;
Pursuant to Decree No.
05/2021/ND-CP dated January 25, 2021 of the Government on management and
operation of airports and aerodromes; Decree No. 64/2022/ND-CP dated September
15, 2022 of the Government on amendments to a number of articles of Decrees on
business activities in the field of civil aviation; Decree No. 20/2024/ND-CP

Pursuant to Decree No.
33/2025/ND-CP dated February 25, 2025 of the Government on functions, duties,
powers and organizational structure of the Ministry of Construction;
At the proposal of the Director of the Vietnam
Register, the Director of the Legal Affairs Department and the Director of the
Civil Aviation Authority of Vietnam;
The Minister of
Construction promulgates this Circular on amendments to a number of articles of
Circulars to reduce and simplify administrative procedures in the fields of vehicle
inspection, civil aviation and inspection under the management of the Ministry
of Construction.
Chapter
I
AMENDMENTS
TO A NUMBER OF ARTICLES OF CIRCULAR NO. 19/2017/TT-BGTVT DATED JUNE 6, 2017 OF
THE MINISTER OF TRANSPORT ON MANAGEMENT AND PROVISION OF AIR NAVIGATION
SERVICES (AMENDED BY CIRCULAR NO. 32/2021/TT-BGTVT DATED DECEMBER 14, 2021,

explanations on relevant matters and issue the ANS facility operation license;
where the license is not issued, a written reply stating the reasons shall be
sent to the applicant organization.

Article
11. Amendments to Clause 4 Article 334 amended by Point c Clause 64 Article 1
of Circular No. 32/2021/TT-BGTVT dated December 14, 2021
“4. For cases of
reissuance specified at Points c and d Clause 1 of this Article: within 6 days from the date
of receipt of a complete application in accordance with regulations, the Civil
Aviation Authority of Vietnam shall appraise and conduct actual inspection;
request the applicant organization to provide additional explanations on
relevant matters and reissue the ANS facility operation license; where the
license is not issued, a written reply stating the reasons shall be sent to the
applicant organization.
Where the application is
incomplete, within 3 working days from the date of receipt of the application,
the Civil Aviation Authority of Vietnam shall guide the applicant organization
to complete the application in accordance with regulations.”.

12. Amendments to Clause 2 Article 337 amended by Clause 66 Article 1 of
Circular No. 32/2021/TT-BGTVT dated December 14, 2021
“2. Within 6 days from the
date of receipt of a complete application in accordance with regulations, the
Civil Aviation Authority of Vietnam shall appraise the application, conduct
actual inspection, request the applicant organization to provide additional
explanations on relevant matters and issue the license for operation of
technical systems and equipment for air navigation services; where the license
is refused, a written reply stating the reasons shall be sent to the applicant
organization.
Where the application is
incomplete, within 3 working days from the date of receipt of the application,
the Civil Aviation Authority of Vietnam shall guide the applicant organization
to complete the application in accordance with regulations.”.
Article
13. Amendments to Clause 4 Article 338 amended by Clause 67 Article 1 of
Circular No. 32/2021/TT-BGTVT dated December 14, 2021
“4. For cases of
reissuance specified at Points b, c and d Clause 1 of this Article: within 6 days from the date
of receipt of a complete application in accordance with regulations, the Civil
Aviation Authority of Vietnam shall appraise the application; request the
applicant organization to provide additional explanations on relevant matters
and reissue the license for technical systems and equipment for air navigation
services; where the license is refused, a written notice stating the reasons
shall be sent to the applicant.
Where the application is
incomplete, within 3 working days from the date of receipt of the application,
the Civil Aviation Authority of Vietnam shall guide the applicant organization
to complete the application in accordance with regulations.”.

1. Point e Clause 1 is amended as follows:
“e) Air traffic
controllers and aeronautical radio communication system operators must attend
and pass the assessment for issuance of licenses and ratings.
2. Point a Clause 2 is amended as follows:
“a) Air traffic
controllers, aeronautical radio communication system operators and air traffic
control instructors (applicable to the training of these two categories of
personnel) must possess English language proficiency at Level 4;”.
3. Point g Clause 4 is amended as follows:

Article 15. Amendments to

2. Licenses and ratings for air navigation personnel shall
apply to air traffic personnel with the following ratings:
a) Aerodrome control;
b) Approach control
without ATS surveillance;
c) Approach control with
ATS surveillance;
d) Area control without
ATS surveillance;

e) Aeronautical radio
communication system operator.”

“2. Within 11 days from
the date of receipt of a complete application, the Civil Aviation Authority of
Vietnam shall appraise the application, organize testing, and issue licenses
and ratings for air navigation personnel according to Form No. 03 specified in
Appendix IX enclosed with this Circular; in case of refusal to issue licenses
and ratings, it shall send a written reply to the applicant organization
clearly stating the reasons.
Where the application is
incomplete, within 5 working days from the date of receipt of the application,
the Civil Aviation Authority of Vietnam shall guide the applicant organization
to complete the application in accordance with regulations.”.

Clause 4 Article 342 amended by Clause 71 Article 1 of Circular No.
32/2021/TT-BGTVT dated December 14, 2021
“4. For reissuance of
licenses and ratings due to expiry of the validity period of licenses and
ratings: within
10 days from the date of receipt of the application, the Civil Aviation
Authority of Vietnam shall appraise the application, organize testing, and
reissue licenses and ratings for air navigation personnel; in case of refusal
to reissue, it shall send a written reply to the applicant organization clearly
stating the reasons.
Where the application is
incomplete, within 3 working days from the date of receipt of the application,
the Civil Aviation Authority of Vietnam shall guide the applicant enterprise to
complete the application in accordance with regulations.”.
Article
18. Replacement
of Form No. 05 in Appendix VIII enclosed with Circular No. 19/2017/TT-BGTVT
dated June 6, 2017 replaced by Article 2 of Circular No. 28/2023/TT-BGTVT dated
September 28, 2023 with the corresponding application form in Appendix I
enclosed with this Circular

Article 20. Amendments to
Clause 3 and Clause 4 Article 4
1. Clause 3 is amended as follows:
“3. The rating training
and on-the-job training program is a training program for aviation personnel
who have been granted professional certificates to attend the assessment for
issuance of ratings and perform duties at appropriate working positions in
accordance with specialized regulations.”.
2. Clause 4 is amended as follows:
“4. The recurrent training
program is a training program for review of previously learned knowledge and
supplementation and updating of new knowledge in aviation specialties so that
aviation personnel maintain the capability to work at their professional
positions.”
Article 21. Amendments to
Point c Clause 3 and annulment of Point d Clause 3 Article 8
1. Point c Clause 3 is amended as follows:
“c) Aviation personnel
specified in Clauses 14, 15 and 16 Article 6 of this Circular must possess
aviation professional certificates specified in Clause 1 Article 9 of this
Circular and must undergo recurrent and refresher training in accordance with
regulations.”.
2. Point d Clause 3 is annulled.

OF THE MINISTER OF TRANSPORT PROMULGATING THE CIVIL AVIATION SAFETY REGULATIONS
ON AIRCRAFT AND AIRCRAFT OPERATIONS AND CIRCULARS ON AMENDMENTS TO CIRCULAR NO.
01/2011/TT-BGTVT DATED JANUARY 27, 2021 OF THE MINISTER OF TRANSPORT
Article 27. Amendments to Item
1 Point d Appendix 1 of Section 9.157 provided in Part 9 amended at Item 1
Appendix VI on amendments to a number of articles of Part 9 of the Civil
Aviation Safety Regulations on aircraft and aircraft operations enclosed with
Circular No. 56/2018/TT-BGTVT dated December 11, 2018
“(1) Where the application
is accepted, within the next 10 days, the CAAV shall consider, formulate a plan
and conduct inspection at the location of the flight simulation training
device.”.
Article 28. Amendments to
Points a and b of Section 21.071 provided in Part 21 amended at Item 4 Appendix
XII on amendments to a number of articles of Part 21 of the Civil Aviation
Safety Regulations on aircraft and aircraft operations enclosed with Circular

carry out the inspections and tests necessary for issuance of a Type Certificate
for aircraft, engines and propellers designed and manufactured in Vietnam,

completeness of the application for issuance of an AOC and notify the applicant
of the appraisal result. Where the application for issuance of an AOC is invalid or
incomplete, the applicant must supplement it and the AOC approval period shall
only be counted from the time the application has been supplemented as
required.”
2. Point d is amended as follows:
“d) Within 10 days from
the date of notification of the validity and completeness of the application
for issuance of an AOC, the CAAV shall examine the contents of the documents
and cooperate with the aircraft operator to formulate an actual inspection
plan.”.
3. Point e is amended as follows:
“e) Within 25 days from
the time of agreement on the actual inspection plan, the CAAV shall conduct the
inspection. If the inspection result shows that the applicant fully meets the
requirements of this Part, the CAAV shall issue the Air Operator Certificate. Where the requirements have
not yet been fully met, the CAAV shall notify the applicant of the result and
agree on the time limit for remedying the unmet requirements. The time necessary for
remedying the unmet requirements shall be added to the AOC approval period.”.

from receipt of the Operator’s application for renewal or amendment of an AOC, the
CAAV shall appraise the validity and completeness of the application and notify
the applicant of the appraisal result. Where the application is invalid or incomplete, the
applicant must supplement it and the period for renewal or amendment of the AOC
shall only be counted from the time the application has been supplemented as

2. Point h is amended as follows:
“(h) Within 3 working days
from receipt of the complete application, the CAAV shall examine the contents
of the documents and cooperate with the aircraft operator to formulate an
actual inspection plan for renewal or amendment of the AOC.”.
3. Point i is amended as follows:
“(i) Within 15 days from
the time of agreement on the actual inspection plan, the CAAV shall conduct the
inspection. If the inspection result shows that the applicant fully meets the
requirements of this Part, the CAAV shall grant renewal or amendment of the AOC. Where specific requirements
have not yet been met, the CAAV shall notify the applicant of the result and agree
on the time limit for remedying the unmet requirements. The time necessary for
remedying the unmet requirements shall be added to the period for renewal or
amendment of the AOC.”.
“(g) Within 6 days from
the time of receipt of the complete application, the Civil Aviation Authority
of Vietnam shall appraise the application, organize inspection and carry out
reissuance or renewal of the appropriate rating.”

the vehicle modification design dossier do not contain all contents required
under Appendix XIV enclosed with this Circular, or contain contents
inconsistent with technical regulations on technical safety and environmental
protection quality of motor vehicles, special-purpose motorized vehicles and
motor vehicle components, the inspection facility shall make a notice according
to the form specified in Appendix I enclosed with this Circular and send it to
the vehicle owner, clearly stating the contents to be supplemented or amended. Within 30 days from the
date of the notice, the vehicle owner shall supplement and complete the vehicle
modification design dossier; upon receipt of the supplemented or amended design
dossier, the inspection facility shall inspect and assess the vehicle modification
design dossier in accordance with Point a of this Clause; after the above time
limit, the certification procedures shall be carried out again from the
beginning.”.
2. Amendments to point a clause 3 as follows:
“a) For modified vehicles
for which a vehicle modification design dossier must be made: within 3 days from the date
of the notice of inspection and assessment of the actual vehicle, the
inspection facility shall conduct inspection and assessment of the modified
vehicle against the technical requirements specified in the National Technical
Regulation on inspection of motor vehicles and inspection of special-purpose
motorized vehicles; inspect and assess whether the modified items of the
vehicle meet the National Technical Regulation on technical safety and
environmental protection quality of motor vehicles and special-purpose
motorized vehicles, and the National Technical Regulation on permissible
tolerances and rounding of dimensions and mass; and make minutes of inspection
and assessment according to Form No. 02 specified in Appendix XV enclosed with
this Circular.”
“4. Procedures for
reissuance of the vehicle modification certificate
The inspection facility
shall reissue the vehicle modification certificate according to the form
specified in Appendix XVIII enclosed with this Circular within 1 working day
from the time of receipt of the application where the application is archived
at the inspection facility; or within 2 working days from the time of receipt
of the application where the application is archived at another inspection
facility, specifically as follows:
a) Reissuance in case the
vehicle modification certificate is lost or damaged: based on the archived data
on the vehicle modification management software and the archived modification
application for reissuance;
b) Reissuance in case the
vehicle modification certificate contains incorrect information: based on the archived data
on the vehicle modification management software and the archived modification
application, where there are sufficient grounds to determine that the issued
vehicle modification certificate contains incorrect information, the inspection
facility shall adjust the information and reissue the vehicle modification certificate.”.
“2. For motorcycles and
mopeds for which the period from the year of manufacture exceeds 5 years, the
vehicle owner must bring the vehicle to the inspection facility for emission
inspection.
In case of force majeure
as provided by law where vehicle registration data from the vehicle
registration authority cannot yet be shared, the vehicle owner shall present
one of the vehicle registration documents or the original appointment slip for
issuance of the vehicle registration certificate.
The inspection facility shall receive the
application, look up vehicle information of the motorcycle or moped on the
inspection management software and compare the vehicle registration certificate
with the actual motorcycle or moped: make a notice according to the form specified in Appendix I
enclosed with this Circular and send it to the vehicle owner; where the vehicle
does not fall into the case of refusal of inspection, it shall make the
inspection control sheet according to Form No. 3 Appendix IV enclosed with this
Circular.

for the imported component type in the case where all documents specified in

d) Issue the notice of
violation for imported components falling into one of the following cases: imported components falling
within the list of goods banned from import under Decree No. 69/2018/ND-CP;
documents in the application for inspection registration or imported components
containing images or contents incorrectly showing national sovereignty or
containing other contents adversely affecting the national security, politics,
economy, society or diplomatic relations of Vietnam; and other cases subject to
administrative handling in the form of confiscation of goods in accordance with

Within 2 working days from

receipt of the quality certificate, the importer must return the original
damaged quality certificate;
b) In case of refusal of
replacement, the certification authority shall send a written reply clearly
stating the reasons.”.

“4. The certification
authority shall grant the product type approval within 2 working days from the
date of obtaining satisfactory COP evaluation results and satisfactory
application examination results. The certificate of technical safety and environmental
protection quality of the product type (hereinafter referred to as the product
type approval certificate) shall be valid for 36 months from the date of
issuance. Grant
of the product type approval is provided as follows:
a) Certificate of
technical safety and environmental protection of vehicle type (vehicle type
approval certificate) according to the form specified in Appendix IX enclosed
with this Circular; blank form of the factory quality inspection sheet
according to the form specified in Appendix VII enclosed with this Circular;
b) Certificate of
technical safety and environmental protection of component type (component type
approval certificate) according to the form specified in Appendix X enclosed
with this Circular.”.
“d) The certification
authority shall issue the Certificate within 2 working days from the date of
obtaining satisfactory COP evaluation results and satisfactory application
examination results. The Certificate shall be issued according to the form
specified in Appendix IX or Appendix X enclosed with this Circular. The reissued Certificate
due to expiry shall be valid for 36 months from the date of issuance. The reissued Certificate
due to changes in the applicable national technical regulations shall be valid
for 36 months from the date of issuance if inspection and testing are carried
out against all applicable national technical regulations for the product type. The validity period of the
reissued Certificate in other reissuance cases shall be the same as the
validity period of the previously issued Certificate;”.
“d) The certification
authority shall issue the extension certificate within 2 working days from the
date of obtaining satisfactory COP evaluation results and satisfactory
application contents. The Certificate shall be issued according to the form
specified in Appendix IX or Appendix X enclosed with this Circular. The validity period of the
extension certificate shall be the same as the validity period of the
Certificate for the product type before the change;”.
“c) The certification
authority shall examine the COP evaluation results and the contents of the
application within 6 working days from the date the application is received and
the manufacturing establishment has fully paid all service charges and fees.
If the COP results and the
application examination results are satisfactory, the certification authority
shall record and supplement the changed contents relating to the certified
product type and notify the manufacturing establishment in writing or through
the online public service system.
If the application
contains non-conforming contents or the COP results are unsatisfactory, the
certification authority shall notify the manufacturing establishment for
supplementation and completion; where the COP results are unsatisfactory, the
manufacturing establishment shall agree on the time for the certification
authority to conduct the COP evaluation. The manufacturing establishment shall complete the notified
non-conforming contents of the application and resend them to the certification
authority. The
time limit for settlement shall be recalculated from the beginning after
receipt of the complete supplemented and completed application from the
manufacturing establishment.

1. Technical professional vehicles and equipment may only be
installed and used when there is a decision or an approved plan issued by the
competent person.
2. Based on the approved inspection and examination plan, the
unit managing and using technical professional vehicles and equipment shall
formulate an appropriate plan for use of the necessary technical vehicles and
equipment. The
plan must clearly indicate the following contents: time, location, purpose of
use; user; and name of the technical professional vehicle or equipment.
3. Procedures for and operations of use and preservation of
technical professional vehicles and equipment shall comply with the manufacturer’s
instructions and the technical regulations (if any).
4. Technical professional vehicles and equipment must be handed
over and received according to the working plan; such handover and receipt must
be recorded in the handover and receipt register for technical professional
vehicles and equipment.
5. The prescribed plan for use of technical professional
vehicles and equipment may be incorporated and approved in the inspection and
examination plan of the unit.”

Imported goods that are
not included in the list of products and goods specified in Appendix II and
Appendix III enclosed with this Circular but are included in the list of
products and goods specified in Appendix I and Appendix II enclosed with
Circular No. 62/2024/TT-BGTVT, and that have been granted a registration for
inspection of technical safety and environmental protection quality before the
effective date of this Circular, shall continue to complete the procedures for
certification of technical safety and environmental protection quality in
accordance with the regulations applicable at the time the above-mentioned
inspection registration was granted.

completion:
(1) : Sheet number means
the sequential number of the motor vehicle presented for inspection during the
day/the sequential number of the motor vehicle exempted from inspection during
the day/the motor vehicle submitting the application for reissuance of the
inspection certificate - inspection sticker during the day, according to the
following structure: “XXX/KD”, “XXX/CM”,
“XXX/CL”.
In which:
- “XXX” consists of 3 numeric characters according to the
sequence of the motor vehicle presented for inspection/the sequence of the
motor vehicle exempted from inspection during the day/the sequence of the motor
vehicle reissued with the certificate and inspection sticker during the day;
- “KD” is the symbol for applications of motor vehicles
presented for initial inspection, periodic inspection, inspection for issuance
of inspection certificate according to the validity period of the temporary
vehicle registration certificate. Example: 025/KD;
- “CM” is the symbol for applications of motor vehicles
exempted from initial inspection. Example: 009/CM;
- "CL" is the symbol for applications of motor
vehicles reissued with the inspection certificate - inspection sticker. Example: 001/CL.
(2): In case there are
no data on vehicle registration documents, the vehicle owner must present one
of the following documents: the original
vehicle registration certificate; a certified copy or an electronically
certified copy from the original vehicle registration certificate; the vehicle
registration certificate integrated into an electronic identification account
level 2 or higher; the original appointment slip for issuance of the vehicle
registration certificate.
