HƯỚNG DẪN VIỆC KIỂM TRA AN TOÀN THỰC PHẨM HÀNG HÓA CÓ NGUỒN GỐC THỰC VẬT NHẬP KHẨU

Căn cứ Nghị định số 01/2008/NĐ-CP ngày 03 tháng 01 năm 2008 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn; Nghị định số 75/2009/NĐ-CP ngày 10/9/2009 của Chính phủ sửa đổi Điều 3 Nghị định số 01/2008/NĐ-CP ngày 03 tháng 01 năm 2008 của Chính phủ;
Căn cứ Luật an toàn thực phẩm số 55/2010/QH12 được Quốc hội thông qua ngày 17 tháng 6 năm 2010;
Căn cứ Nghị định số 79/2008/NĐ-CP ngày 18 tháng 7 năm 2008 của Chính phủ quy định hệ thống tổ chức quản lý‎, thanh tra và kiểm nghiệm về vệ sinh an toàn thực phẩm,
Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn việc kiểm tra an toàn thực phẩm hàng hóa có nguồn gốc thực vật nhập khẩu như sau:

Chương I

QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

1. Thông tư này qui định trình tự, thủ tục, nội dung kiểm tra an toàn thực phẩm (ATTP) đối với hàng hóa có nguồn gốc thực vật dùng làm thực phẩm (sau đây gọi tắt là hàng hóa) nhập khẩu vào Việt Nam thuộc phạm vi quản lý của Bộ Nông nghiệp và Phát triển nông thôn; trách nhiệm và quyền hạn của các bên có liên quan;

2. Danh mục hàng hóa thuộc phạm vi điều chỉnh của Thông tư này được quy định tại Phụ lục 1;

3. Thông tư này không điều chỉnh các nội dung, quy định liên quan đến hoạt động kiểm dịch thực vật;

Điều 2. Đối tượng áp dụng

Thông tư này áp dụng đối với các tổ chức, cá nhân trong nước và nước ngoài có hoạt động liên quan đến sản xuất kinh doanh hàng hóa nhập khẩu vào Việt Nam thuộc phạm vi quản lý của Bộ Nông nghiệp và Phát triển nông thôn.

Điều 3. Những hàng hóa nhập khẩu không thuộc diện phải kiểm tra ATTP:

1. Hàng hóa mang theo người để tiêu dùng cá nhân trong định mức được miễn thuế nhập khẩu;

2. Hàng hóa trong túi ngoại giao, túi lãnh sự;

3. Hàng hóa quá cảnh, chuyển khẩu;

4. Hàng hóa gửi kho ngoại quan;

5. Hàng hóa là mẫu thử nghiệm, nghiên cứu.

Điều 4. Giải thích từ ngữ

Trong Thông tư này, các từ ngữ dưới đây được hiểu như sau:

1. Lô hàng nhập khẩu: Là lượng hàng hóa nhập khẩu được đăng ký kiểm tra một lần;

2. Lô hàng kiểm tra: Là lượng hàng hóa cùng loại, của cùng một cơ sở sản xuất được đăng ký kiểm tra một lần;

3. Vi phạm nghiêm trọng qui định ATTP: Hàng hóa bị phát hiện có chứa tác nhân gây hại sức khỏe, tính mạng con người;

4. Tần suất lấy mẫu lô hàng: Là số lần thực hiện lấy mẫu kiểm nghiệm đối với các lô hàng kiểm tra nhập khẩu.

Điều 5. Yêu cầu đối với hàng hóa nhập khẩu

1. Hàng hóa nhập khẩu vào Việt Nam phải đáp ứng các yêu cầu sau:

a) Sản xuất tại quốc gia được cơ quan có thẩm quyền của Việt Nam công nhận đáp ứng đầy đủ các yêu cầu về bảo đảm ATTP hàng hóa theo quy định của Việt Nam;

b) Bao gói hoặc chứa đựng trong các phương tiện phù hợp; ghi nhãn, bao gồm các thông tin: tên hàng hóa, tên và địa chỉ cơ sở sản xuất; mã số (nếu có) và các thông tin khác (bằng tiếng Việt hoặc có nhãn phụ tiếng Việt) theo quy định;

c) Kiểm tra và chứng nhận ATTP theo quy định tại Chương III của Thông tư này.

2. Hàng hóa nhập khẩu có chứa thành phần biến đổi gen, hoặc được chiếu xạ, hoặc được sản xuất theo công nghệ mới:

a) Đáp ứng yêu cầu quy định tại khoản 1 Điều này;

b) Có giấy chứng nhận lưu hành tự do (CFS) do cơ quan có thẩm quyền của nước xuất khẩu cấp theo quy định tại Thông tư 63/2010/TT-BNNPTNT .

3. Hàng hóa (bao gồm cả hàng hóa quy định tại khoản 2, Điều này) đã qua chế biến bao gói sẵn nhập khẩu, trước khi lưu thông:

a) Đáp ứng yêu cầu quy định tại khoản 1, khoản 2 Điều này;

b) Đăng ký bản công bố hợp quy với cơ quan nhà nước có thẩm quyền của Việt Nam theo quy định hiện hành.

Điều 6. Hình thức và chỉ tiêu kiểm tra

1. Kiểm tra lô hàng: Các lô hàng nhập khẩu vào Việt Nam phải được kiểm tra thông tin về nguồn gốc xuất xứ, kiểm tra ngoại quan (bao gói, ghi nhãn). Trình tự, thủ tục kiểm tra ATTP lô hàng nhập khẩu được qui định tại Chương III của Thông tư này.

2. Kiểm tra tại nước xuất khẩu: Kiểm tra thực tế hệ thống kiểm soát an toàn thực phẩm và điều kiện bảo đảm ATTP trong quá trình sản xuất hàng hóa của nước xuất khẩu. Hình thức này được xem xét áp dụng trong trường hợp phát hiện nước xuất khẩu có nhiều cơ sở sản xuất có lô hàng vi phạm nghiêm trọng quy định về ATTP (từ 3 cơ sở sản xuất/năm trở lên).

3. Các chỉ tiêu về ATTP phải kiểm nghiệm căn cứ vào lịch sử tuân thủ quy định của nhà sản xuất, nhà nhập khẩu; tình hình thực tế về nguy cơ gây mất an toàn thực phẩm từ nơi sản xuất, nước sản xuất; tình hình thực tế lô hàng và hồ sơ kèm theo; đồng thời dựa trên Danh mục các chỉ tiêu ATTP và mức giới hạn tối đa cho phép theo qui định hiện hành của Việt Nam.

Điều 7. Căn cứ kiểm tra

1. Các quy định, tiêu chuẩn, quy chuẩn kỹ thuật của Việt Nam, quy định quốc tế về ATTP.

2. Trường hợp Việt Nam có ký kết Hiệp định, thỏa thuận song phương về ATTP với nước xuất khẩu thì tuân thủ theo các Điều ước quốc tế mà Việt Nam đã ký kết

Điều 8. Cơ quan kiểm tra, giám sát

1. Cơ quan kiểm tra tại cửa khẩu hoặc nơi tập kết: Các đơn vị thuộc Cục Bảo vệ thực vật hoặc được Cục Bảo vệ thực vật ủy quyền.

2. Cơ quan kiểm tra giám sát hàng hóa lưu thông trên thị trường: Các đơn vị thuộc Sở Nông nghiệp và Phát triển nông thôn được giao nhiệm vụ.

3. Cơ quan kiểm tra ATTP tại nước xuất khẩu: Cục Quản lý Chất lượng Nông Lâm sản và Thuỷ sản chủ trì, phối hợp với Cục Bảo vệ thực vật và các cơ quan có liên quan.

Điều 9. Phí, lệ phí và kinh phí triển khai kiểm tra, giám sát về ATTP.

1. Cơ quan kiểm tra thực hiện thu phí, lệ phí theo qui định hiện hành của Bộ Tài chính.

2. Kinh phí đi kiểm tra tại nước xuất khẩu do ngân sách nhà nước cấp. Cục Quản lý Chất lượng Nông Lâm sản và Thủy sản có trách nhiệm chủ trì, phối hợp với Cục Bảo vệ thực vật dự trù kinh phí đi kiểm tra tại nước xuất khẩu trình cấp có thẩm quyền phê duyệt.

3. Kinh phí kiểm tra giám sát sản phẩm hàng hóa lưu thông trên thị trường do ngân sách nhà nước cấp trong khuôn khổ chương trình giám sát được quy định tại Thông tư số 05/2010/TT-BNNPTNT ngày 22/01/2010 của Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn việc kiểm tra, giám sát vệ sinh an toàn thực phẩm nông sản trước khi đưa ra thị trường hoặc từ các nguồn kinh phí hợp pháp khác.

Chương II

ĐĂNG KÝ XUẤT KHẨU VÀ KIỂM TRA TẠI NƯỚC XUẤT KHẨU

Điều 10. Hồ sơ đăng ký của nước xuất khẩu

Cơ quan có thẩm quyền về ATTP đối với hàng hóa có nguồn gốc thực vật của nước xuất khẩu (sau đây gọi là Cơ quan thẩm quyền của nước xuất khẩu) gửi hồ sơ đăng ký về Cục Quản lý Chất lượng Nông Lâm sản và Thủy sản bao gồm:

1. Thông tin về hệ thống quản lý và năng lực của Cơ quan thẩm quyền của nước xuất khẩu về kiểm soát ATTP theo mẫu quy định tại Phụ lục 2 ban hành kèm theo Thông tư này;

2. Danh mục thuốc bảo vệ thực vật, chất điều hòa sinh trưởng, chất bảo quản sử dụng trong sản xuất, kinh doanh hàng hóa theo mẫu quy định tại Phụ lục 3 ban hành kèm theo Thông tư này;

3. Chương trình giám sát ATTP cập nhật hàng năm của nước xuất khẩu đối với hàng hóa trong quá trình sản xuất, kinh doanh trong nước và xuất khẩu.

Điều 11. Thẩm tra hồ sơ đăng ký

Trong thời hạn 30 ngày làm việc kể từ khi nhận được đầy đủ hồ sơ đăng ký nêu tại Điều 10, Cục Quản lý Chất lượng Nông Lâm sản và Thuỷ sản chủ trì, phối hợp với Cục Bảo vệ thực vật thực hiện thẩm tra và thông báo kết quả đến Cơ quan thẩm quyền của nước xuất khẩu kết quả thẩm tra.

Điều 12. Kiểm tra tại nước xuất khẩu

1. Cục Quản lý Chất lượng Nông Lâm sản và Thủy sản chủ trì, phối hợp với Cục Bảo vệ thực vật xây dựng kế hoạch kiểm tra; thông báo và phối hợp với Cơ quan thẩm quyền của nước xuất khẩu thực hiện kiểm tra hệ thống kiểm soát ATTP và điều kiện bảo đảm ATTP của cơ sở sản xuất hàng hóa xuất khẩu vào Việt Nam.

2. Trong thời hạn 30 ngày làm việc kể từ ngày kết thúc đợt kiểm tra tại nước xuất khẩu, Cục Quản lý Chất lượng Nông Lâm sản và Thuỷ sản chủ trì, phối hợp với Cục Bảo vệ thực vật xử lý kết quả kiểm tra và công bố báo cáo kết quả kiểm tra. Báo cáo nêu rõ lý do cụ thể những trường hợp chưa được phép xuất khẩu hàng hóa vào Việt Nam nếu kết quả kiểm tra chưa đáp ứng đầy đủ các yêu cầu theo quy định.

Chương III

TRÌNH TỰ, THỦ TỤC KIỂM TRA AN TOÀN THỰC PHẨM LÔ HÀNG NHẬP KHẨU

Điều 13. Nội dung kiểm tra

1. Kiểm tra hồ sơ;

2. Kiểm tra ngoại quan;

3. Kiểm nghiệm các chỉ tiêu về ATTP theo quy định tại Khoản 3 Điều 6 của Thông tư này.

Điều 14. Phương thức kiểm tra, lấy mẫu

Hàng hóa nhập khẩu phải được lấy mẫu tại địa điểm do cơ quan kiểm tra quyết định (tại cửa khẩu, nơi tập kết hoặc trong kho bảo quản). Phương thức kiểm tra, lấy mẫu được áp dụng như sau:

1. Kiểm tra thông thường: Thực hiện lấy mẫu kiểm nghiệm lô hàng kiểm tra theo tần suất tối đa đến 10% tùy theo mức độ rủi ro của hàng hóa. Tần suất này được áp dụng đối với từng địa điểm nhập khẩu. Việc lấy mẫu kiểm nghiệm được thực hiện bất kỳ trong số các lô hàng kiểm tra nhập khẩu. Lô hàng kiểm tra được phép làm thủ tục thông quan không phải chờ kết quả kiểm nghiệm chỉ tiêu ATTP.

2. Kiểm tra chặt: Thực hiện lấy mẫu kiểm nghiệm lô hàng kiểm tra theo tần suất 30% khi phát hiện 01 (một) lô hàng kiểm tra trước đó vi phạm nghiêm trọng quy định về ATTP; tần suất 100% khi phát hiện 02 (hai) lô hàng kiểm tra liên tiếp trước đó vi phạm nghiêm trọng quy định về ATTP. Trong các trường hợp này, chủ hàng phải tự bảo quản hàng hóa (tại cửa khẩu, nơi tập kết hoặc kho bảo quản) và chỉ được thông quan khi có chứng nhận về ATTP do cơ quan kiểm tra cấp hoặc được cơ quan kiểm tra cho phép.

Trường hợp kiểm nghiệm mẫu 02 (hai) lô hàng kiểm tra liên tiếp có kết quả đạt yêu cầu thì sẽ áp dụng phương thức kiểm tra thông thường.

Điều 15. Đăng ký kiểm tra

Chủ hàng thực hiện đăng ký kiểm tra về ATTP (theo mẫu qui định tại Phụ lục 4) với cơ quan kiểm tra tại cửa khẩu trong thời gian ít nhất 24 giờ trước khi hàng về đến cửa khẩu.

Điều 16. Quy trình kiểm tra

1. Kiểm tra hồ sơ: Cơ quan kiểm tra thực hiện xem xét hồ sơ đăng ký (nguồn gốc xuất xứ, lịch sử tuân thủ các qui định về ATTP của cơ sở sản xuất) và xác nhận đăng ký kiểm tra trong vòng 01 (một) ngày làm việc kể từ khi nhận được đầy đủ hồ sơ đăng ký;

2. Kiểm tra ngoại quan: Cơ quan kiểm tra thực hiện kiểm tra tình trạng lô hàng, bao gói, ghi nhãn khi hàng đến cửa khẩu;

3. Lấy mẫu kiểm nghiệm: Cơ quan kiểm tra thực hiện lấy mẫu kiểm nghiệm các chỉ tiêu ATTP tại địa điểm đã được đăng ký. Phương thức kiểm tra, lấy mẫu theo quy định tại Điều 14 của Thông tư này.

4. Lập biên bản kiểm tra và lấy mẫu (theo mẫu quy định tại Phụ lục 5).

Điều 17. Xử lý kết quả kiểm tra

1. Cấp chứng nhận kiểm tra ATTP (theo mẫu quy định tại phụ lục 6) đối với các trường hợp sau:

a) Lô hàng đang áp dụng phương thức kiểm tra thông thường hoặc lô hàng đang áp dụng phương thức kiểm tra chặt (trường hợp không lấy mẫu kiểm nghiệm), có kết quả kiểm tra hồ sơ và kiểm tra ngoại quan đạt yêu cầu trong thời gian không quá 01 (một) ngày làm việc kể từ khi hàng đến cửa khẩu;

b) Lô hàng đang áp dụng hình thức kiểm tra chặt (trường hợp có lấy mẫu kiểm nghiệm) và có kết quả kiểm tra hồ sơ, kiểm tra ngoại quan và kiểm nghiệm mẫu đạt yêu cầu theo quy định trong thời gian không quá 01 (một) ngày làm việc sau khi có kết quả phân tích đạt yêu cầu của phòng kiểm nghiệm được chỉ định.

2. Thông báo lô hàng không đạt yêu cầu ATTP (theo mẫu quy định tại Phụ lục 7) đối với trường hợp lô hàng có kết quả kiểm tra không đạt yêu cầu trong thời gian không quá 01 (một) ngày làm việc sau khi có kết quả kiểm tra.

3. Thời gian từ khi lấy mẫu, gửi mẫu, kiểm nghiệm và trả lời kết quả tối đa không quá 10 ngày làm việc.

Điều 18. Nội dung kiểm tra giám sát hàng hoá nhập khẩu lưu thông trên thị trường

1. Kiểm tra thông tin truy xuất nguồn gốc lô hàng nhập khẩu;

2. Kiểm tra điều kiện bảo quản, bao bì, nhãn mác (nếu có) của hàng hóa lưu thông trên thị trường;

3. Lấy mẫu hàng hóa gửi cơ quan kiểm nghiệm được chỉ định phân tích chỉ tiêu ATTP khi phát hiện có dấu hiệu vi phạm hoặc khi có nghi ngờ về an toàn thực phẩm hoặc khi có yêu cầu của các Cơ quan nhà nước có thẩm quyền.

Chương IV

BIỆN PHÁP XỬ LÝ VI PHẠM QUY ĐỊNH VỀ AN TOÀN THỰC PHẨM

Điều 19. Đối với lô hàng nhập khẩu

1. Thông báo cho cơ quan thẩm quyền về ATTP của nước xuất khẩu đề nghị phối hợp điều tra nguyên nhân và đưa ra các biện pháp khắc phục.

2. Thông báo và phối hợp với các cơ quan chức năng trong nước có liên quan xử lý và giám sát quá trình xử lý lô hàng vi phạm theo quy định của pháp luật.

Điều 20. Đối với cơ sở sản xuất

1. Tạm thời đình chỉ việc nhập khẩu hàng hóa vào Việt Nam đối với các cơ sở sản xuất nếu vi phạm một trong các trường hợp sau:

a) Có từ 03 (ba) lô hàng kiểm tra trong vòng 6 tháng bị phát hiện vi phạm nghiêm trọng quy định về ATTP;

b) Kết quả kiểm tra theo quy định tại Điều 12 cho thấy cơ sở chưa đáp ứng đầy đủ các yêu cầu về ATTP theo quy định.

2. Cơ sở sản xuất được phép xuất khẩu trở lại vào Việt Nam nếu Cơ quan thẩm quyền nước xuất khẩu có công thư xác nhận Cơ sở đã áp dụng các biện pháp khắc phục sai lỗi phù hợp, đáp ứng điều kiện bảo đảm ATTP theo quy định.

Điều 21. Đối với nước xuất khẩu

1. Tạm thời đình chỉ nhập khẩu hàng hóa từ nước xuất khẩu trong trường hợp kết quả kiểm tra theo quy định tại Điều 12 cho thấy hệ thống kiểm soát ATTP của nước xuất khẩu chưa đáp ứng đầy đủ các yêu cầu theo quy định;

2. Chỉ được xuất khẩu trở lại hàng hóa vào Việt Nam khi kết quả kiểm tra giám sát sau đó cho thấy Cơ quan thẩm quyền của nước xuất khẩu đã đưa ra biện pháp kiểm soát ATTP đáp ứng đầy đủ yêu cầu theo quy định.

Chương V

TRÁCH NHIỆM VÀ QUYỀN HẠN

Điều 22. Trách nhiệm của cơ quan kiểm tra

1. Xác nhận đăng ký kiểm tra, thực hiện kiểm tra; cấp chứng nhận kiểm tra ATTP; hoặc Thông báo lô hàng không đạt yêu cầu ATTP đối với hàng hóa nhập khẩu theo quy định tại Chương III của Thông tư này;

2. Thông báo chính xác, khách quan và trung thực; tuân thủ chặt chẽ quy trình kiểm tra, lấy mẫu sản phẩm hàng hóa theo quy định để thẩm tra khi có yêu cầu;

3. Phối hợp với cơ quan Hải quan kiểm tra hàng hóa nhập khẩu, xử lý và giám sát quá trình xử lý các trường hợp vi phạm quy định về ATTP;

4. Thực hiện truy xuất nguồn gốc lô hàng nhập khẩu không bảo đảm ATTP;

5. Thu phí, lệ phí theo quy định.

Điều 23. Quyền hạn của cơ quan kiểm tra

1. Yêu cầu chủ hàng cung cấp tài liệu, hồ sơ liên quan để phục vụ công tác kiểm tra;

2. Tiến hành kiểm tra, lấy mẫu hàng hóa nhập khẩu theo phương thức và trình tự thủ tục được quy định tại Thông tư này;

3. Quyết định biện pháp xử lý và giám sát việc xử lý các lô hàng không đạt yêu cầu nhập khẩu.

Điều 24. Trách nhiệm của chủ hàng nhập khẩu

1. Thực hiện đăng ký kiểm tra về ATTP theo quy định tại Điều 15 của Thông tư này;

2. Tạo điều kiện để cán bộ của Cơ quan kiểm tra thực hiện nhiệm vụ kiểm tra, lấy mẫu kiểm nghiệm và giám sát hàng hóa theo qui định;

3. Cung cấp đầy đủ hồ sơ, mẫu vật liên quan để phục vụ công tác kiểm tra, truy xuất nguồn gốc;

4. Chấp hành quyết định xử lý vi phạm hành chính và chịu sự giám sát của Cơ quan có thẩm quyền;

5. Nộp phí và lệ phí kiểm tra, kiểm nghiệm theo qui định hiện hành của Bộ Tài chính và thanh toán các khoản chi phí thực tế trong việc xử lý lô hàng không đạt yêu cầu ATTP;

6. Tự chịu trách nhiệm về việc bảo quản hàng hóa đã được kiểm tra trong suốt thời gian chờ kết luận kiểm tra đối với phương thức kiểm tra chặt hoặc chờ quyết định xử lý của Cơ quan có thẩm quyền đối với trường hợp lô hàng đã có kết luận kiểm tra không đạt yêu cầu nhập khẩu.

Điều 25. Quyền hạn của chủ hàng nhập khẩu

1. Được đề nghị cơ quan kiểm tra xem xét lại kết quả kiểm tra hoặc yêu cầu tái kiểm tra;

2. Được quyền khiếu nại, tố cáo và giải quyết khiếu nại, tố cáo theo quy định của pháp luật về khiếu nại, tố cáo.

Điều 26. Trách nhiệm của Đoàn kiểm tra tại nước xuất khẩu

1. Thực hiện việc kiểm tra ATTP tại nước xuất khẩu sau khi Bộ Nông nghiệp và Phát triển nông thôn ban hành quyết định thành lập đoàn kiểm tra;

2. Phối hợp với Cơ quan thẩm quyền của nước xuất khẩu triển khai các nội dung kiểm tra;

3. Báo cáo kết quả kiểm tra với Bộ Nông nghiệp và Phát triển nông thôn trong thời hạn 15 ngày kể từ ngày kết thúc đợt kiểm tra tại nước xuất khẩu;

4. Thông báo kết quả kiểm tra với Cơ quan thẩm quyền của nước xuất khẩu theo quy định tại Điều 12 của Thông tư này.

Chương VI

TỔ CHỨC THỰC HIỆN

Điều 27. Cục Quản lý Chất lượng Nông Lâm sản và Thủy sản

1. Tiếp nhận hồ sơ đăng ký xuất khẩu hàng hóa vào Việt Nam từ Cơ quan thẩm quyền của nước xuất khẩu; trao đổi thông tin, thông báo kế hoạch kiểm tra (khi cần thiết) với Cơ quan thẩm quyền nước xuất khẩu và trình Bộ ban hành quyết định thành lập đoàn kiểm tra của Việt Nam sang kiểm tra tại nước xuất khẩu;

2. Chủ trì, phối hợp với Cục Bảo vệ thực vật:

a) Thực hiện công bố Danh sách các quốc gia được phép xuất khẩu hàng hóa vào Việt Nam; các quốc gia tạm thời bị đình chỉ xuất khẩu vào Việt Nam; các cơ sở sản xuất tạm thời bị đình chỉ xuất khẩu hàng hóa vào Việt Nam; thông báo phương thức kiểm tra chặt đối với hàng hóa của quốc gia vi phạm nghiêm trọng các quy định về ATTP; thông báo cho Cơ quan thẩm quyền nước xuất khẩu về lô hàng không bảo đảm ATTP và đề nghị phối hợp điều tra nguyên nhân và đưa ra các biện pháp khắc phục;

b) Thực hiện kiểm tra đối với hệ thống kiểm soát ATTP và điều kiện bảo đảm ATTP của cơ sở sản xuất hàng hóa tại nước xuất khẩu;

c) Thực hiện truy xuất nguồn gốc lô hàng nhập khẩu không bảo đảm ATTP.

3. Hàng năm, hoặc đột xuất (khi có yêu cầu), báo cáo Bộ Nông nghiệp và Phát triển nông thôn về tình hình kiểm tra ATTP đối với hàng hóa nhập khẩu;

4. Hàng năm, xây dựng kế hoạch và dự trù kinh phí cho việc thực hiện kiểm tra ATTP đối với nước xuất khẩu trình Bộ Nông nghiệp và Phát triển nông thôn phê duyệt, cấp kinh phí.

Điều 28. Cục Bảo vệ thực vật

1. Chỉ đạo và giám sát các đơn vị trực thuộc hoặc ủy quyền:

a) Thực hiện kiểm tra và cấp chứng nhận kiểm tra ATTP, hoặc thông báo những trường hợp lô hàng nhập khẩu không đạt yêu cầu ATTP;

b) Thông báo phương thức kiểm tra chặt đối với các lô hàng từ cơ sở sản xuất vi phạm nghiêm trọng các quy định về ATTP;

c) Phối hợp với các cơ quan chức năng xử lý các lô hàng không bảo đảm ATTP và giám sát quá trình thực hiện.

2. Phối hợp với Cục Quản lý Chất lượng Nông Lâm sản và Thủy sản triển khai các hoạt động quy định tại khoản 2, Điều 27 của Thông tư này;

3. Hướng dẫn các đơn vị được Sở Nông nghiệp và Phát triển nông thôn giao thực hiện nhiệm vụ kiểm tra, giám sát ATTP hàng hóa nhập khẩu lưu thông trên thị trường;

4. Hàng năm, hoặc đột xuất (khi có yêu cầu), báo cáo tình hình kiểm tra ATTP hàng hóa nhập khẩu về Bộ Nông nghiệp và Phát triển nông thôn (qua Cục Quản lý Chất lượng Nông Lâm sản và Thủy sản);

5. Hàng năm, xây dựng kế hoạch và dự toán kinh phí cho việc thực hiện kiểm tra ATTP đối với hàng hóa nhập khẩu theo phân công đối với các nội dung không được thu phí, lệ phí trình Bộ Nông nghiệp và Phát triển nông thôn phê duyệt, cấp kinh phí.

Điều 29. Sở Nông nghiệp và Phát triển nông thôn các tỉnh, thành phố trực thuộc Trung ương

1. Chỉ đạo các đơn vị trực thuộc theo phân công thực hiện việc kiểm tra giám sát ATTP đối với hàng hóa nhập khẩu lưu thông trên địa bàn theo qui định và hướng dẫn của các Cục quản lý chuyên ngành;

2. Thông báo kịp thời với Cục Quản lý chất lượng Nông Lâm sản và Thủy sản, Cục Bảo vệ thực vật trường hợp hàng hóa nhập khẩu lưu thông trên địa bàn vi phạm qui định về ATTP;

3. Phối hợp với các cơ quan chức năng xử lý các lô hàng không bảo đảm ATTP và giám sát quá trình thực hiện;

4. Hàng năm, hoặc đột xuất (khi có yêu cầu), gửi báo cáo kết quả kiểm tra giám sát ATTP đối với hàng hóa nhập khẩu lưu thông trên địa bàn về Cục Bảo vệ thực vật để tổng hợp báo cáo Bộ;

5. Hàng năm, xây dựng kế hoạch và dự toán kinh phí cho việc thực hiện kiểm tra giám sát ATTP đối với hàng hóa nhập khẩu theo phân công trình cấp có thẩm quyền phê duyệt, cấp kinh phí.

Chương VII

ĐIỀU KHOẢN THI HÀNH

Điều 30. Hiệu lực thi hành

Thông tư này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2011.

Điều 31. Sửa đổi, bổ sung

Trong quá trình thực hiện, nếu có vướng mắc, các đơn vị báo cáo về Bộ Nông nghiệp và Phát triển nông thôn (qua Cục Quản lý chất lượng Nông Lâm sản và Thủy sản, Cục Bảo vệ thực vật) để xem xét, sửa đổi, bổ sung./.

CIRCULAR

GUIDING ON THE FOOD SAFETY CONTROL FOR IMPORTED FOODSTUFFS OF PLANT ORIGIN

Pursuant to the Decree No. 01/2008/ND-CP of January 3, 2008 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/ND-CP of September 10, 2009 amending Article 3 of the Decree No. 01/2008/ND-CP of January 3, 2008 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Food Safety No. 55/2010/QH12 approved by the National Assembly of Vietnam on June 17, 2010.
Pursuant to the Decree No. 79/2008/ND-CP of July 18, 2008 defining system of management, inspection and test of food hygiene and safety;
Hereafter is the guide by the Ministry of Agriculture and Rural Development to food safety control for imported foodstuffs of plant origin.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of application

1. This Circular guides food safety control procedures imported foodstuffs of plant origin (hereafter referred to as foodstuffs) under the management of the Ministry of Agriculture and Rural Development; responsibilities and jurisdictions of parties concerned.

2. The list of foodstuffs covered by this Circular shall be specified in Appendix 1.

Article 2. Objects of application

This Circular applies to native and foreign individuals and organizations operating business of imported foodstuffs under the management of the Ministry of Agriculture and Rural Development.

Article 3. Imported foodstuffs not subject to food safety inspection

1. Foodstuffs carried along for personal consumption within tax exemption

2. Foodstuffs in diplomatic bags, consular bags;

3. Foodstuffs in transit, transshipment;

4. Foodstuffs stored in bonded warehouses;

5. Foodstuffs as samples for experiment and research.

Article 4. Definition

...

1. Imported consignment means an amount of foodstuffs registered for one official inspection.

2. Inspected consignment means an amount of the same-type foodstuffs processed by the same establishment and registered for one official inspection.

3. Serious violation of food safety regulations means the foodstuffs are detected with risk to consumers’ health.

4. Sampling frequency means the number of test samples made for the inspected consignments during importation.

Article 5. Requirements for imported foodstuffs

1. Imported foodstuffs must meet the following requirements:

a) Being produced by countries recognized by Vietnamese Competent Authorities to meet Vietnamese food safety requirements;

b) Being packed or stored in proper means; labeled, including: name of foodstuffs, name and address of production establishment, approval number (if any) and other information (in Vietnamese or with sub-label in Vietnamese) in compliance with relevant regulations in force;

c) Being inspected and certified as described in Chapter III of the Circular.

a) Meet the requirements as prescribed in the Item 1 of this Article;

b) Be accompanied by a Certificate of Free Sale (CFS) issued by Competent Authority in charge of exporting country as prescribed in the Circular No. 63/2010/TT- BNNPTNT.

3. Imported processed and/or packed foodstuffs (including foodstuffs as described in the Item 2 of this Article) prior to being placed on the market must:

a) Meet the requirements as prescribed in the Items 1 and 2 of this Article;

b) Have declaration of conformity registered with Vietnamese Competent Authority in compliance with relevant regulations in force.

Article 6. Inspection forms and criteria

1. Consignment inspection: All consignments of foodstuffs imported into Vietnam shall undergo documentary, identity and physical checks. The import control procedures for food safety of imported consignments are laid down in Chapter III of this Circular.

2. On-site inspection in exporting countries: inspection of the food safety control system and hygiene conditions in production of exporting countries. This form shall be considered applicable in case the exporting country has a lot of establishments ( from three establishments per year) whose products have been detected with serious violation of Vietnamese regulations on food safety.

3. Food safety criteria to be tested shall be based on compliance profile of establishments and importers; potential food safety risks in production establishments or countries of origin; status of consignments and their accompanying documents; as well as list of food safety criteria and maximum levels thereof as prescribed.

1. Vietnam and international standards, legislations and technical regulations on food safety.

2. International treaties and bilateral arrangements on food safety with exporting countries that Vietnam has concluded or approved.

Article 8. Inspecting and supervising bodies

1. Inspecting bodies at border inspection posts or bonded warehouses: Units under or authorized by the Department of Plant Protection.

2. Inspecting and supervising bodies to products placed on the market: Units authorized by the Provincial Department of Agriculture and Rural Development.

3. Inspecting bodies to exporting countries: The National Agro-Forestry-Fisheries Quality Assurance Department in co-ordination with the Department of Plant Protection and other relevant agencies.

Article 9. Charges, fees and budget

1. Inspecting bodies are allowed to collect charges and fees in compliance with regulations in force laid down by the Ministry of Finance.

2. Budget for inspections to exporting countries is covered by the State Budget. The National Agro-Forestry-Fisheries Quality Assurance Department in co-ordination with the Department of Plant Protection sets up and submits annual inspection plan to exporting countries and respective estimated expenses for approval.

Chapter II

REGISTRATION PROCEDURES AND ON-SITE INSPECTION TO EXPORTING COUNTRIES

Article 10. Registration documents

Exporting countries’ Competent Authorities on Food safety of foodstuffs of plant origin (hereafter referred to as Competent Authorities of exporting countries) provide the National Agro-Forestry-Fisheries Quality Assurance Department with the registration documents, including:

1. Information on food safety control system and capability of Competent Authorities of exporting countries by the form prescribed in enclosed Appendix 2.

2. List of pesticides, plant growth regulators, preservatives used in production, storage and trade of foodstuffs by the form prescribed in enclosed Appendix 3.

3. Annuall-updated Food safety monitoring program of exporting countries for foodstuffs during production, domestic circulation and export.

Article 11. Registration document verification

Within 30 working days after the receipt of completed registration documents as laid down in Article 10, the National Agro-Forestry-Fisheries Quality Assurance Department, together with the Department of Plant Protection verifies registration documents and notifies Competent Authorities of exporting countries of verification results.

1. The National Agro-Forestry-Fisheries Quality Assurance Department, together with the Department of Plant Protection shall sets up inspection plan; notify the plan to inspect and co-ordinates with Competent Authorities of exporting countries to conduct on-site inspections to assess food safety control system and food safety conditions of establishments registering to export foodstuffs to Vietnam.

2. Within 30 working days after on-site inspection missions in exporting countries, the National Agro-Forestry-Fisheries Quality Assurance Department, together with the Department of Plant Protection shall notify Competent Authorities of exporting countries of inspection results, which point out specific reasons for non-compliant cases.

Chapter III

FOOD SAFETY INSPECTION PROCEDURES TO IMPORTED FOODSTUFFS

Article 13. Inspection items

1. Documentary check;

2. Physical check;

3. Laboratory tests for food safety criteria as laid down in Item 3, Article 6 of this Circular.

Article 14. Inspection frequency

1. Regular inspection: To take samples for testing with the frequency of up to 10% based on risk level of the foodstuffs. This frequency shall be applied at each inspection post. Samples can be randomly taken from any inspected consignments. Inspected consignments are allowed to undergo the customs clearance procedures without testing results for food safety criteria.

2. Intensified inspection: To take samples for testing with the frequency of 30% if 01 (one) previously inspected consignment has been detected with serious violation of Vietnamese regulations on food safety; with the frequency of 100% if 02 (two) consecutive inspected consignments have been detected with serious violation of Vietnamese regulations on food safety. In these cases, consignees have to self-preserve their foodstuffs (at the border gates, bonded or storage warehouses) and their foodstuffs can not pass the customs clearance unless the Certificate of food safety or permit issued by inspecting bodies is available.

In case the testing results of 02 (two) consecutive inspected consignments are satisfactory, regular inspection regime shall be applied.

Article 15. Inspection registration

Registration for food safety inspection (by the form in the enclosed Appendix 4) must be submitted to inspecting bodies to border inspection posts at least 24 hours prior to the arrival of the consignment.

Article 16. Inspection procedures:

1. Documentary check: Inspecting bodies perform documentary check (country of origin, compliance profile of the establishment) and confirm the registration for inspection within 01 (one) working day of receipt of completed registration document;

2. Physical check: Inspecting bodies check status of consignments, packaging and labeling on arrival of consignment in border inspection posts;

3. Sampling: Inspecting bodies perform sampling to test for food safety criteria at designated place of inspection. Sampling frequency is as prescribed in Article 14 of this Circular.

Article 17. Follow-up actions:

1. A Certificate of food safety shall be issued (by the form in enclosed Appendix 6) for:

a) Consignments undergone the regular inspection or consignments undergone the intensified inspection (in case of no sampling for test) and with satisfactory results of documentary and physical checks within 01 (one) working day of arrival of the consignments at border inspection posts;

b) Consignments undergone the intensified inspection (in case of compulsory sampling for test) and with satisfactory testing results of documentary, physical checks and laboratory tests as prescribed within 01 (one) working day after receiving satisfactory testing results from designated laboratories.

2. A Notification of Non-compliance shall be granted (by the form in enclosed

Appendix 7) for consignments with fail inspection results within 01 (one) working day of receipt of the results.

3. Duration of taking and delivering samples, testing and delivering testing results should be no longer than 10 working days.

Article 18. Inspection items to imported foodstuffs placed on the market

1. Checks on traceability information;

3. Sampling for analysis at authorized laboratories when non-compliance is detected or suspected or on request of relevant competent authorities.

Chapter IV

ACTIONS TO NON-COMPLIANCE

Article 19. For non-compliant foodstuffs

1. Competent Authority of the exporting country shall be required to co-ordinate in the investigation of causes of non-compliance and apply corrective actions.

2. Non-compliance cases shall be notified to relevant national competent authorities for actions and supervision of handling process.

Article 20. For non-compliant establishments

1. Import shall be suspended from establishments in one of the following cases:

a. Having at least 03 (three) inspected consignments detected with serious violation of food safety regulations within 6 months;

2. The import suspension shall be lifted when Competent Authorities of exporting countries submit reports on appropriate corrective actions taken by non-compliant establishments to meet relevant food safety requirements.

Article 21. For exporting countries

1. Import shall be suspended from exporting countries in case inspection results as prescribed in Article 12 show that the food safety control system of exporting countries has not yet fully met relevant food safety requirements.

2. The import suspension shall be lifted when follow-up inspection results show that Competent Authorities of exporting countries take food safety control measures in compliance with relevant food safety requirements.

Chapter V

RESPONSIBILITIES AND POWERS

Article 22. Responsibilities of the inspecting bodies

1. To confirm the receipt of registration documents and perform inspection to imported consignments; to issue Certificate of Food safety or Notification of Non- compliance for imported consignments as prescribed in Chapter III of this Circular;

2. To ensure the accuracy, honesty and objectivity of inspection results; strictly comply with sampling and inspection procedures as regulated (including sampling for re- testing on request);

4. To trace back non-compliant consignments;

5. To collect charges and fees as regulated.

Article 23. Powers of the inspecting bodies

1. To request consignees to provide with relevant documents of inspected consignments.

2. To take samples and perform inspection to imported consignments in compliance with the procedures laid down by this Circular.

3. To decide handling measures and supervise the handling to non-compliant consignments.

Article 24. Responsibilities of consignees

1. To register for food safety inspection as prescribed in Article 15 of this Circular;

2. To facilitate the inspection, sampling and supervision of foodstuffs in compliance with regulations in force.

4. To execute decisions on handling of administrative offences and be subject to supervision by competent authorities.

5. To pay inspection and testing fees and charges in compliance with regulations in force laid down by the Ministry of Finance and bear all expenses arising from application of handling measures against non-compliant consignments.

6. To self maintain inspected consignments while waiting for the inspection results in case of intensified inspection application or the decision by competent authorities on handling non-compliant consignments.

Article 25. Powers of consignees

1. To require inspecting bodies to review inspection results or perform the re- inspection.

2. To file a complaint and denouncement according to relevant regulations in force.

Article 26. Responsibilities of inspection team in exporting countries

1. To carry out food safety inspection in exporting countries after the Ministry of Agriculture and Rural Development issues the decision on setting up an inspection team overseas.

2. To co-ordinate with Competent Authorities of exporting countries to carry out on-site inspection.

4. To provide on-site inspection report to Competent Authorities of exporting countries as prescribed in Article 12 of this Circular.

Chapter VI

ORGANIZATION OF IMPLEMENTATION

Article 27. National Agro-Forestry-Fisheries Quality Assurance Department (NAFIQAD)

1. To be contact point to receive registration documents for export of foodstuffs to Vietnam from Competent Authorities of exporting countries; communicate with Competent Authorities of exporting countries about inspection plan (if necessary) and submit the Minister for setting up inspection mission to exporting countries;

2. To take responsibility, in coordination with the Department of Plant Protection:

a) To publish lists of countries approved to export their foodstuffs to Vietnam; countries and establishments suspended to export to Vietnam; notify of intensified inspection applied to foodstuffs from exporting countries detected with serious violation of food safety regulations; communicate with Competent Authorities of exporting countries about non-compliance cases and request to investigate non-compliance causes and take corrective actions.

b) To conduct on-site inspection for food safety control system and food safety conditions of exporting establishments;

c) To trace back, in collaboration with the Department of Plant Protection, non- compliance cases;

4. To set up and submit annual overseas inspection plan and respective estimated expenses to the Ministry of Agriculture and Rural Development for approval and allocation of budget.

Article 28. Department of Plant Protection (DPP)

1. To direct and supervise DPP subordinating or authorized units:

a) To perform food safety inspection and issuance of Certificates of food safety or Notification of non-compliance;

b) To notify of intensified inspection applied to consignments produced by establishments detected with serious violation of food safety regulations;

c) To co-ordinate with concerned competent authorities to handle non-compliant consignments and supervise the handling process.

2. To co-ordinate with the National Agro-Forestry-Fisheries Quality Assurance Department to perform activities as prescribed in Item 2, Article 27 of this Circular;

3. To instruct authorized units of Provincial Department of Agriculture and Rural Development to carry out inspection and supervision of imported foodstuffs placed on the local market.

4. To submit the annual or unexpected reports (on request) on food safety inspection of imported foodstuffs to the Ministry of Agriculture and Rural Development (via the National Agro-Forestry-Fisheries Quality Assurance Department);

Article 29. Departments of Agriculture and Rural Development in provinces/cities under the central government.

1. To direct subordinating units on assignment to carry out inspection and supervision of imported foodstuffs placed on the local market in compliance with guidance of concerned Departments.

2. To timely notify the Department of Plant Protection and the National Agro- Forestry-Fisheries Quality Assurance Department of non-compliance cases of imported foodstuffs placed on the local market.

3. To co-ordinate with concerned competent authorities to take handling measures to non-compliant consignments and supervise the handling process;

4. To submit the annual or unexpected reports (on request) on food safety inspection and supervision of imported foodstuffs to the Department of Plant Protection for comprehensive reports to the Minister;

5. To set up and submit for approval the annual inspection plan to imported foodstuffs on assignment and respective estimated expenses.

During enforcement, all involved units submit reports on difficulties to the Ministry of Agriculture and Rural Development (via National Agro-Forestry-Fisheries Quality Assurance Department and Department of Plant Protection) for consideration and appropriate amendment.
