CIRCULAR
GUIDING
INSPECTION, APPRAISAL AND ACCEPTANCE OF GEODESY AND CARTOGRAPHY WORKS AND
PRODUCT
Pursuant to the
Government’s Decree No.91/2002/ND-CP, of November 11, 2002 defining the
functions, tasks, powers and organizational structure of the Ministry of
Natural Resources and Environment;
Pursuant to the
Government’s Decree No.12/2002/ND-CP, of January 22, 2002 on geodesic and
cartographic activities;
For strengthening
inspection, appraisal and acceptance of quality, volume, schedule of performing
geodesy and cartography works, products, the Ministry of Natural Resources and
Environment guides as follows:
I. GENERAL
PROVISIONS
1. Scope and subjects of
adjustment
1.1. This Circular prescribes content
and responsibility of management of inspection, appraisal and acceptance of quality,
volume, schedule of performing each item or entire geodesy and
cartography works, products (hereinafter referred to as inspection, appraisal
and acceptance of geodesy and cartography works, products).

2. Purpose of
inspection, appraisal and acceptance of geodesy and cartography works and
products
2.1. To inspect compliance of
standards, regulations, technical regulations, eco-technical norms and other
document relating to geodesy and cartography works, products.
2.2. To detect errors in the course of
production in order to timely remove products not assuring quality and find
handling measures to overcome errors aiming to assure quality of geodesy and
cartography works, products.
2.3. To certify quality, volume of
geodesy and cartography works, products have been finished.
3. Principles of
inspection, appraisal and acceptance of quality, volume, schedule of performing
geodesy and cartography works, products
3.1. Inspection, appraisal and
acceptance of quality, volume, schedule of performing geodesy and cartography
works, products must be implemented regularly in the course of production;
plans on inspection, appraisal and acceptance must be set on the basis of
progress of performing stages of works, products.
3.2. Unit performing works, products
must self-inspect, make acceptance for quality of all items of works, products
performed by itself.
3.3. Investor bases on work items of
works, products in order to inspect, appraise quality, volume, schedule of
performing for geodesy and cartography works, products in the course of
performance, to appraise and make acceptance of quality, volume, schedule of
performing for finished works, products.
4. Legal basis to
inspect, appraise and make acceptance of quality, volume, schedule of
performing for geodesy and cartography works, products

4.2. Projects, technical designs,
estimation approved by competent state agencies.
5. System of agencies
managing inspection, appraisal and acceptance of geodesy and cartography works
and products
5.1. State management on inspection,
appraisa; and acceptance of quality, volume, schedule of performing for geodesy
and cartography works, products is prescribed as follows:
a) The Ministry of Natural Resources
and Environment uniformly state manages on inspection, appraisal and acceptance
of quality, volume, schedule of performing for geodesy and cartography works,
products; promulgates documents providing on inspection, appraisal and
acceptance of quality, volume, schedule of performing for geodesy and
cartography works, products; directs and guides Ministries, Ministerial
agencies, Governmental agencies, People’s Committee of central-affiliated
cities and provinces to implement inspection, appraisal and acceptance of
quality, volume, schedule of performing for geodesy and cartography works,
products; decides on termination of performance, cancellation of partly or
entire works, products performed improperly comparing to approved technical
design – estimation or seriously violating standards, economic- technical
provisions;
The geodesy and cartography department
shall direct, guide investors of geodesy and cartography works, products to
implement inspection, appraisal and acceptance of quality, volume, schedule of
performing for geodesy and cartography works, products;
directly implement inspection,
appraisal and acceptance of quality, volume, schedule of performing for basic
and specialized geodesy and cartography works, products within management scope
of the Ministry of Natural Resources and Environment.
b) Ministries, ministerial agencies,
Governmental agencies shall implement inspection, appraisal and acceptance of
quality, volume, schedule of performing for specialized geodesy and cartography
works, products within their management sector.
c) People’s Committee of
central-affiliated cities and provinces (hereinafter referred to as
Provincial-level People’s Committee) shall implement state management on
inspection, appraisa; and acceptance of quality, volume, schedule of performing
for geodesy and cartography works, products in their localities.
5.2. Investor may use agencies
examining product quality, specialized agencies, establish Consulting Council,
hire organizations having function of geodesy and cartography advisory, hire
specialists in order to inspect, appraise quality of works, products and make
acceptance of such works, products.

6. Responsibilities for
management on inspection, appraisal and acceptance of quality, volume, schedule
of performance for geodesy and cartography works, products
6.1. Responsibilities of agency
deciding investment
a) To appraise dossier of acceptance;
certify quality, volume have finished; to appraise dossier of finalization and
approve finalization of geodesy and cartography works, products of investor;
b) To decide to solve arising
problems, technological difficulties which not have technical provisions on
such technology; solve problems on economic norm upon changing technological
solutions which cause increase of the estimation exceeding five percent (5%) compared
to approved volume; solve prolongation of schedule of performance of works,
products compared to approved schedule of performance.
c) To decide on
termination of performance, cancellation of partly or entire works,
products for works performing improperly comparing to approved technical design
– estimation or seriously violating standards, economic-technical provisions.
6.2. Responsibilities of investor
a) To assure quality, volume, progress
of performance for assigned geodesy and cartography works, products;
b) To decide to solve arising
problems, technological difficulties which had specific technical provisions; solve
problems on economic norm upon changing technological solutions which do not cause
increase of the estimation compared to approved volume; solve problems on
volume when the finished volume not exceed five per cent (5%) compared to
approved volume.
c) To supervise on quality, volume,
progress on course of works, product performance; to inspect, appraise and make
acceptance for assigned geodesy and cartography works, products;

6.3. Responsibilities of performance
unit
a) To organize a
system for inspection and acceptance of quality, volume, schedule of performing
of works, products in accordance to mechanism of inspection, appraisal and
acceptance of quality, volume, schedule of performing geodesy and cartography
works, products.
b) To properly implement the approved
technical design – estimation, comply with standard, economic and technical
provisions;
c) Under supervision, inspection,
appraisal and acceptance of investor, state management agencies on quality,
volume, schedule of performing works, products;
d) When having changes on
technological solutions, technical design, economic norm, work volume, progress
of performance compared to projects, approved technical design – estimation, it
must timely report to investor and may perform only after having answer in
writing of investor or agencies deciding on investment;
e) To assure quality, volume, schedule
of performing works, products of its unit; if works, products fail to meet
quality, it must compensate or re-perform with expenditure of itself.
7. Mechanism of report
during the course of perfoming geodesy and cartography works, products
7.1. Before 20th monthly,
performing unit must send report on performed quality, volume, progress to
investor.
7.2. Within five (05) working days
after finishing each stage of works, products and within ten (10) working days
after finishing entire works, products, investor must send report on performed
quality, volume, progress to agency deciding on investment.

8.1. Expenditure to implement suppervison,
inspection, appraisal and acceptance of quality, volume, progress of performing
geodesy and cartography works, products performed by investor is determined in
total estimation of works, products according to current provisions.
8.2. Expenditure to implement
inspection and acceptance of quality, volume, progress of performing geodesy
and cartography works, products performed by construction unit is calculated in
estimated price unit of works, products according to current provisions.
II. CONTENT,METHOD,
LEVEL OF INSPECTION, APPRAISAL AND ACCEPTANCE OF QUALITY, VOLUME OF GEODESY AND
CARTOGRAPHY WORKS, PRODUCTS
1. To make plan on
inspection, appraisal and acceptance of quality, volume, schedule of performing
works, products.
1.1. Construction unit shall make plan
on inspection and acceptance of quality, volume, schedule of performing works,
products; send report on such plan to investor before construction; organize to
implement according to made plan during the course of performance.
1.2. Investor makes plan on
inspection, appraisal and acceptance of quality, volume, schedule of performing
of works, products in accordance to approved schedule of performance and in
accordance to time of inspection, acceptance of construction unit; notifies
that plan to construction unit within ten (10) working days after receiving
plan on inspection and acception of construction unit; performs properly as
planned.
2. Content of
inspection, appraisal and acceptance of quality of geodesy and cartography
works and products
Content of inspection, appraisal and
acceptance of quality of geodesy and cartography works and products includes
items deteiled in Annex No.1 promulgated together with this Circular.
3. Method and extent of
inspection, appraisal of quality, volume, progress of performance of geodesy
and cartography works, products of the investor.

3.1. Method of inspection during the
course of perfoming works, products includes:
a) To apprase quality on the basis of
re-implementation for content of work items of works, products performed by
construction unit compared to standards, regulations, economic-technical
provisions, content of approved technical design-estimation;
b) To certify volume of fnished items
compared to the progress of performance which have been approved, assigned or
provided in Annexes of contract.
3.2. Method of appraisal of quality,
determination of volume for items or entire finished works, products
a) For works, products which are only
performed by a technological method, their quality shall be appraised on the
basis of re-implementation of items of works, products at the per cent rate (%)
provided proportional to each item specified in the Annex No.1 promulgated
together with this Circular;
b) For works, products which are
performed by various technological methods, their quality shall be appraised on the
basis of implementation of items of works, products by a technological method
different from the performed technological method at the per cent rate (%)
provided proportional to each item specified in the Annex No.1 promulgated
together with this Circular;
c) For works, products which are
performed appraisal of final product quality of works by synthetic method,
agency implementing inspection, acceptance shall make plan on quality appraisal
to submit to investor for approval; the approval is performed in according to
the process guided by Department of geodesy and cartography under the Ministry
of Natural Resources and Environment.
d) To appraise suitability of items of
products compared to standard, technical provisions on the basis of analizing
construction unit’s minutes of quality inspection, construction unit’s
technical summarizing reports, investor’s minutes on quality inspection during
the course of performance under method specified in point 3.1 of this clause,
result of quality appraisal of investor complies with method specified in
sub-item a and sub-item b of this point;
dd) To appraise on form of items of
products compared to current technical provisions;

4. Acceptance of geodesy
and cartography works and products
4.1. The investor implement acceptance
of works, products on the basis of determination of the following content:
a) Total volume which is performed and
satisfied technical quality compared to the volume approved in the technical
design – estimation;
b) Extent of difficulty for items of
works, products;
c) Norms, unit prices are applied to works,
products.
4.2. Cases have adjustment on
technological method, technical design, economic norms, unit price of products
and volume of work compared to project, technical design-estimation, the
investor shall consider to accept and handle as follows:
a) If having a written that agreeing
permission of adjustment of competent authorities, the investor shall implement
acceptance;
b) If having no written that agreeing
permission of adjustment of competent authorities, the investor must notify to
agency deciding investment for settlement.
5. Order of, procedures
for inspection, appraisal and acceptance of quality of geodesy and cartography
works and products

When ending inspection of each stage,
item, the investor must make Minute for inspection of finished quality, volume
on the basis of summarizing sheets recording inspection opinion in according to
Form No.2 enclosed with this Circular. The minute of inspection, acception of
finished quality, volume of investor for construction unit is made into three
(03) copies; one (01) copy kept in dosier of acception, one (01) copy sent to
contruction unit, one (01) copy kept in agency implement inspection.
5.2. When ending works, the investor
must implement acceptance of quality under method stated in point 3.2, clause 3
and make report on appraisal in according to Form No.3 enclosed with this
Circular.
5.3. When finishing works, products,
the construction unit must made dossier of acceptance of works, products. The dossier
of acceptance of construction unit shall be made into two (02) sets: One (01) set
sent to investor, one (01) set kept in construction unit. The dossier
comprises:
a) Official Dispatch proposing
acceptance of works and products;
b) Technical summarizing report made
in according to Form No.4 enclosed with this Circular;
c) Report on inspection and acceptance
of quality, volume, schedule of performance for works, products of the construction
unit made in according to Form No.5 enclosed with this Circular.
d) Report on arising problems,
technological difficulties; difficulties regarding economy - technique; volume
and other problems (if any) compared to the approved technical design -
estimation and written agreeing arising problems and solving them of competent
authorities.
5.4. After receiving the valid
acceptance dossier for works, products of construction unit, the investor shall
implement acceptance of works, products in according to content stated in
clause 4 of this section; time limit of acceptance not exceeding fifteen (15)
working days for each dossier; result of acceptance shall be made into the
minute of acceptance for finished works, products in according to Form No.6 enclosed
with this Circular.
5.5. After ending acceptance, the
investor must make dossier of acceptance for works, products; dossier of
acceptance of investor is made into three (03) sets: One (01) set
kept in investor, one (01) set is submitted enclosing products, one (01) set
sent to acengy deciding investment. The dossier comprises:

b) Technical summarizing report of
construction unit made in according to Form No.4 enclosed with this Circular;
c) Report on construction inspection
of quality, classification of difficulties, schedule of performance for works,
products of the investor made in according to Form No.7 enclosed with this
Circular.
d) Report on arising volume, solved
difficulties compared to the technical design - estimation and written agreeing
arising problems and solving them of competent authorities;
dd) Report of construction unit on
reparing errors at the request of investor and written certifying repariment of
products of investor (if any);
e) Report on quality appraisal of
investor for works, products made in according to Form No.3 enclosed with this
Circular;
g) The Minute of acceptance for
finished works or products is made according to Form No.6 enclosed with this
Circular.
5.6. After
receiving a valid dossier of acceptance for works, products of investor, agency
deciding investment or agency being ahthorized by it (hereinafter referred to
as agency deciding investment) shall implement inspection on adequacy,
rationality, exactness of acceptance dossier; time limit of inspection not
exceeding five (05) working days for each dossier; shall make the Certification
on finished quality, volume for works or products in according to Form No.8
enclosed with this Circular.
6. Submission of
products and finalization of works, products
6.1. List of
submitted products includes all products of geodesy and cartography items have
been approved in projects (if any), technical design – estimation have been
accepted, certified volume, quality.

6.3. After having written certifying
the finished quality, volume of agency
deciding investment, the investor shall make dossier of finalization for works,
products.
The
dossier of finalization comprises:
a) A Request for finalization of works
or products being made according to Form No.9 enclosed with this Circular.
b) Decision on approval of project (if
any), technical design-estimation of competent agency;
c) Economic contract or wrriten
assigning task of investor for construction unit;
d) The minute of acceptance of
finished works and products;
dd) The written certifying the
finished quality, volume of acengy deciding investment;
e) The minute of submission of
products or warehouse receipt for products;
g) For works constructed for many
years, a synthetic table of volume, finalization value of entire works,
products must be additionally made in according to Form No.10 enclosed with
this Circular.
The dossier of finalization of works,
products is made into three (03) sets; one (01) set kept in investor, one (01)
set sent to acengy deciding investment, one (01) set sent to construction unit.

1. Effect
This Circular takes effect after 15
days, since the day of publishing in the Official Gazette.
To annul the Decision No.657/QD-DC, of
November 04, 1997 of director general of Cadastral Directorate on promulgating
the Regulation on quality control of geodesic and cartographic works, prducts
and the Decision No.658/QD-DC, of November 04, 1997 of director general of
Cadastral Directorate on promulgating the Guidance on technical inspection,
acception for geodesic and cartographic works, prducts.
2. Organization of
implementation
The ministers, Heads of
ministerial-level agencies, Heads of Governmental agencies, chairpersons of
People’s Committee of central-affiliated cities and provinces shall direct
units, organizations operating in geodesy and cartography sector; other
relavant units, organizations under their management to implement this
Circular.
The geodesy and cartography Department
under the Ministry of Natural Resources and Environment shall guide and inspect
implementation of this Circular.
during the course of implementation if
any problem arising, it should be reported to the Department of geodesy and
cartography under the Ministry of Natural Resources and Environment for
coordination to consider and settle.
