NGHỊ ĐỊNH

CỦA CHÍNH PHỦ SỐ 100/2002/NĐ-CP NGÀY 06 THÁNG 12 NĂM 2002 QUY ĐỊNH CHỨC NĂNG, NHIỆM VỤ, QUYỀN HẠN VÀ CƠ CẤU TỔ CHỨC CỦA BẢO HIỂM XÃ HỘI VIỆT NAM

Căn cứ Luật Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;
Theo đề nghị của Bộ trưởng Bộ Nội vụ và Tổng Giám đốc Bảo hiểm xã hội Việt Nam,

NGHỊ ĐỊNH:

Điều 1. Vị trí và chức năng của Bảo hiểm xã hội Việt Nam

Bảo hiểm xã hội Việt Nam là cơ quan sự nghiệp thuộc Chính phủ, có chức năng thực hiện chính sách, chế độ bảo hiểm xã hội, bảo hiểm y tế (sau đây gọi chung là bảo hiểm xã hội) và quản lý Quỹ bảo hiểm xã hội theo quy định của pháp luật.

Điều 2. Nhiệm vụ và quyền hạn của Bảo hiểm xã hội Việt Nam

1. Xây dựng, trình Thủ tướng Chính phủ phê duyệt:

a) Chiến lược phát triển ngành Bảo hiểm xã hội Việt Nam và kế hoạch dài hạn, năm năm về thực hiện chính sách, chế độ bảo hiểm xã hội;

b) Đề án bảo tồn giá trị và tăng trưởng Quỹ bảo hiểm xã hội;

2. Chỉ đạo và tổ chức thực hiện chính sách, chế độ bảo hiểm xã hội; thu các khoản đóng bảo hiểm xã hội bắt buộc và tự nguyện; chi các khoản trợ cấp về bảo hiểm xã hội cho đối tượng tham gia bảo hiểm xã hội đầy đủ, thuận tiện, đúng thời hạn theo quy định của pháp luật;

3. Cấp các loại sổ, thẻ bảo hiểm xã hội;

4. Quản lý Quỹ bảo hiểm xã hội theo nguyên tắc tập trung thống nhất theo chế độ tài chính của Nhà nước, hạch toán độc lập và được Nhà nước bảo hộ;

5. Kiến nghị với Chính phủ, Thủ tướng Chính phủ và các cơ quan nhà nước có liên quan về việc sửa đổi, bổ sung chính sách, chế độ về bảo hiểm xã hội; cơ chế quản lý Quỹ, cơ chế quản lý tài chính (kể cả chi phí quản lý bộ máy của Bảo hiểm xã hội Việt Nam) và tổ chức thực hiện sau khi được phê duyệt;

6. Ban hành các văn bản hướng dẫn thực hiện việc giải quyết các chế độ bảo hiểm xã hội và nghiệp vụ thu, chi bảo hiểm xã hội theo thẩm quyền; quản lý nội bộ ngành Bảo hiểm xã hội Việt Nam;

7. Tổ chức hợp đồng với các cơ sở khám, chữa bệnh hợp pháp để phục vụ người có sổ, thẻ bảo hiểm theo quy định của pháp luật;

8. Kiểm tra việc ký hợp đồng và việc thu, chi bảo hiểm xã hội đối với cơ quan, đơn vị, tổ chức sử dụng lao động, cá nhân, cơ sở khám chữa bệnh; kiến nghị với cơ quan nhà nước có thẩm quyền và cơ quan cấp trên của đơn vị sử dụng lao động, cơ sở khám chữa bệnh để xử lý những hành vi vi phạm pháp luật về bảo hiểm xã hội;

9. Từ chối việc chi các chế độ bảo hiểm xã hội khi đối tượng tham gia bảo hiểm không đủ điều kiện hưởng bảo hiểm theo quy định của pháp luật hoặc khi có căn cứ pháp lý về các hành vi giả mạo, khai man hồ sơ để hưởng bảo hiểm;

10. Bồi thường mọi khoản thu, chi sai quy định của pháp luật về chế độ bảo hiểm xã hội cho đối tượng tham gia bảo hiểm xã hội;

11. Giải quyết khiếu nại, tố cáo của tổ chức và cá nhân về việc thực hiện chính sách, chế độ bảo hiểm xã hội theo quy định của pháp luật;

12. Lưu trữ hồ sơ của đối tượng tham gia và hưởng chế độ bảo hiểm xã hội theo quy định của pháp luật;

13. Tổ chức nghiên cứu, ứng dụng khoa học; ứng dụng công nghệ thông tin trong quản lý, điều hành hoạt động bảo hiểm xã hội;

14. Tổ chức đào tạo và bồi dưỡng chuyên môn nghiệp vụ bảo hiểm xã hội;

15. Tổ chức công tác thông tin, tuyên truyền, phổ biến chính sách, chế độ bảo hiểm xã hội;

16. Thực hiện hợp tác quốc tế về bảo hiểm xã hội theo quy định của pháp luật;

17. Chủ trì, phối hợp với các cơ quan nhà nước, các tổ chức chính trị - xã hội, tổ chức xã hội ở Trung ương và địa phương, với các bên tham gia bảo hiểm xã hội để giải quyết các vấn đề có liên quan đến việc thực hiện chính sách, chế độ bảo hiểm xã hội theo quy định của pháp luật;

18. Quản lý tổ chức, cán bộ, công chức, viên chức nhà nước; tài chính và tài sản của Bảo hiểm xã hội Việt Nam theo quy định của pháp luật;

19. Thực hiện chế độ báo cáo với Chính phủ, Thủ tướng Chính phủ và các cơ quan nhà nước có thẩm quyền theo quy định của pháp luật.

Điều 3. Hệ thống tổ chức của Bảo hiểm xã hội Việt Nam

Bảo hiểm xã hội Việt Nam được tổ chức và quản lý theo hệ thống dọc, tập trung, thống nhất từ Trung ương đến địa phương, gồm có:

1. Ở Trung ương là Bảo hiểm xã hội Việt Nam;

2. Ở tỉnh, thành phố trực thuộc Trung ương là Bảo hiểm xã hội tỉnh, thành phố trực thuộc Trung ương (sau đây gọi chung là Bảo hiểm xã hội tỉnh) trực thuộc Bảo hiểm xã hội Việt Nam;

3. Ở huyện, quận, thị xã, thành phố thuộc tỉnh là Bảo hiểm xã hội huyện, quận, thị xã, thành phố thuộc tỉnh (sau đây gọi chung là Bảo hiểm xã hội huyện) trực thuộc Bảo hiểm xã hội tỉnh.

Điều 4. Nhiệm vụ của Hội đồng quản lý Bảo hiểm xã hội Việt Nam

Hội đồng quản lý Bảo hiểm xã hội Việt Nam (sau đây gọi là Hội đồng quản lý) giúp Thủ tướng Chính phủ thực hiện các nhiệm vụ sau:

1. Chỉ đạo, giám sát, kiểm tra việc thu, chi, quản lý Quỹ bảo hiểm xã hội;

2. Thông qua dự toán và quyết toán hàng năm về thu, chi Quỹ bảo hiểm xã hội;

3. Thông qua chiến lược phát triển ngành Bảo hiểm xã hội Việt Nam, kế hoạch dài hạn, năm năm về thực hiện chính sách, chế độ bảo hiểm xã hội và các đề án bảo tồn giá trị và tăng trưởng quỹ bảo hiểm xã hội do Tổng Giám đốc Bảo hiểm xã hội Việt Nam (sau đây gọi là Tổng Giám đốc) xây dựng để Tổng Giám đốc trình Thủ tướng Chính phủ phê duyệt; giám sát, kiểm tra Tổng Giám đốc thực hiện chiến lược, kế hoạch, đề án sau khi được phê duyệt;

4. Đề nghị Thủ tướng Chính phủ bổ nhiệm, miễn nhiệm Tổng Giám đốc và các Phó Tổng Giám đốc Bảo hiểm xã hội Việt Nam.

Điều 5. Cơ cấu của Hội đồng quản lý

1. Hội đồng quản lý gồm đại diện lãnh đạo của Bộ Tài chính, Bộ Lao động - Thương binh và Xã hội, Bộ Y tế, Tổng Liên đoàn Lao động Việt Nam và Tổng Giám đốc Bảo hiểm xã hội Việt Nam. Thành viên Hội đồng quản lý đại diện cho cơ quan mình tham gia vào công tác của Hội đồng quản lý, thảo luận, biểu quyết về các công việc của Hội đồng quản lý.

2. Hội đồng quản lý có Chủ tịch, 01 Phó Chủ tịch và các thành viên do Thủ tướng Chính phủ bổ nhiệm, miễn nhiệm theo đề nghị của Bộ trưởng Bộ Nội vụ.

Điều 6. Chế độ làm việc của Hội đồng quản lý

1. Hội đồng quản lý làm việc theo nguyên tắc tập thể; họp thường kỳ 03 tháng một lần để xem xét và quyết định những vấn đề thuộc nhiệm vụ, quyền hạn quy định tại Điều 4 của Nghị định này.

2. Hội đồng quản lý có thể họp bất thường để giải quyết những vấn đề cấp bách khi Chủ tịch Hội đồng quản lý hoặc Tổng Giám đốc hoặc trên 50% tổng số thành viên Hội đồng quản lý đề nghị.

3. Các cuộc họp của Hội đồng quản lý phải có ít nhất hai phần ba thành viên Hội đồng quản lý tham dự. Nghị quyết của Hội đồng quản lý phải được đa số thành viên Hội đồng quản lý dự họp biểu quyết tán thành. Những vấn đề chưa thống nhất ý kiến giữa các thành viên Hội đồng quản lý thì Chủ tịch Hội đồng quản lý báo cáo Thủ tướng Chính phủ quyết định.

4. Trong hoạt động, Hội đồng quản lý sử dụng bộ máy giúp việc, kinh phí và con dấu của Bảo hiểm xã hội Việt Nam.

5. Chủ tịch Hội đồng quản lý ban hành quy chế làm việc của Hội đồng quản lý và phân công nhiệm vụ đối với các thành viên Hội đồng quản lý.

Điều 7. Tổng Giám đốc Bảo hiểm xã hội Việt Nam

1. Tổng Giám đốc là đại diện pháp nhân của Bảo hiểm xã hội Việt Nam, do Thủ tướng Chính phủ bổ nhiệm theo đề nghị của Hội đồng quản lý. Tổng Giám đốc chịu trách nhiệm trước Thủ tướng Chính phủ và Hội đồng quản lý về thực hiện chính sách, chế độ bảo hiểm xã hội và quản lý Quỹ bảo hiểm xã hội theo quy định của pháp luật và thực hiện nhiệm vụ quy định tại Điều 2 của Nghị định này.

2. Giúp Tổng Giám đốc có các Phó Tổng Giám đốc; các Phó Tổng Giám đốc được Tổng Giám đốc phân công chỉ đạo một số mặt công tác và chịu trách nhiệm trước Tổng Giám đốc về nhiệm vụ được phân công. Khi Tổng Giám đốc vắng mặt, một Phó Tổng Giám đốc được Tổng Giám đốc ủy quyền lãnh đạo công tác của Bảo hiểm xã hội Việt Nam.

Các Phó Tổng Giám đốc do Thủ tướng Chính phủ bổ nhiệm, miễn nhiệm theo đề nghị của Hội đồng quản lý và Tổng Giám đốc.

Điều 8. Chế độ làm việc và trách nhiệm của Tổng Giám đốc

1. Tổng Giám đốc làm việc theo chế độ thủ trưởng, bảo đảm nguyên tắc tập trung dân chủ; ban hành quy chế làm việc của Bảo hiểm xã hội Việt Nam và chỉ đạo, kiểm tra việc thực hiện quy chế đó;

2. Tổng Giám đốc phân công hoặc ủy quyền cho Phó Tổng Giám đốc giải quyết các vấn đề thuộc thẩm quyền của Tổng Giám đốc. Tổng Giám đốc phải chịu trách nhiệm về quyết định của Phó Tổng Giám đốc được phân công hoặc ủy quyền giải quyết;

3. Tổng Giám đốc có trách nhiệm:

a) Chuẩn bị các nội dung quy định tại Điều 4 của Nghị định này để Hội đồng quản lý thông qua và tổ chức thực hiện các nghị quyết của Hội đồng quản lý;

b) Quyết định và chỉ đạo việc thực hiện chương trình cải cách hành chính của Bảo hiểm xã hội Việt Nam và việc thực hiện chính sách, chế độ bảo hiểm xã hội đối với các đối tượng tham gia bảo hiểm xã hội; bảo đảm chế độ thông tin, báo cáo của Bảo hiểm xã hội Việt Nam và các đơn vị trực thuộc;

c) Quyết định các công việc thuộc phạm vi quản lý của Bảo hiểm xã hội Việt Nam và chịu trách nhiệm về các quyết định đó; quyết định các biện pháp cụ thể để tăng cường kỷ luật, kỷ cương hành chính trong cán bộ, công chức, viên chức của Bảo hiểm xã hội Việt Nam; chống tham nhũng, lãng phí và mọi biểu hiện quan liêu, hách dịch, cửa quyền trong ngành;

d) Chịu kỷ luật khi có những khuyết điểm về quản lý để xảy ra tình trạng tham nhũng, tiêu cực gây thiệt hại nghiêm trọng trong cơ quan, đơn vị thuộc quyền quản lý của Bảo hiểm xã hội Việt Nam;

đ) Tổ chức thực hiện những quy định quản lý nhà nước về bảo hiểm xã hội. Khi trình Thủ tướng Chính phủ những vấn đề có liên quan đến chức năng quản lý nhà nước của bộ, cơ quan ngang bộ nào thì phải có ý kiến bằng văn bản của Bộ trưởng, Thủ trưởng cơ quan đó;

e) Phối hợp với Chủ tịch ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương tổ chức thực hiện chính sách, chế độ bảo hiểm xã hội tại địa phương theo quy định của pháp luật;

f) Phối hợp với người đứng đầu tổ chức công đoàn và các tổ chức xã hội khác ở Trung ương và ở tỉnh, thành phố trực thuộc Trung ương trong khi thực hiện nhiệm vụ của Bảo hiểm xã hội Việt Nam; tạo điều kiện để các tổ chức nêu trên hoạt động và tham gia quản lý.

Điều 9. Tổ chức Bảo hiểm xã hội tỉnh và Bảo hiểm xã hội huyện

1. Bảo hiểm xã hội tỉnh, Bảo hiểm xã hội huyện được tổ chức và hoạt động theo quy định của Tổng Giám đốc;

2. Bảo hiểm xã hội tỉnh, Bảo hiểm xã hội huyện có tư cách pháp nhân, có dấu, tài khoản và trụ sở riêng;

3. Tổng Giám đốc quy định chức năng, nhiệm vụ, cơ cấu tổ chức, biên chế, bổ nhiệm, miễn nhiệm, khen thưởng, kỷ luật cán bộ quản lý và quy định kinh phí hoạt động của Bảo hiểm xã hội tỉnh, Bảo hiểm xã hội huyện; quyết định thành lập, giải thể Bảo hiểm xã hội tỉnh, Bảo hiểm xã hội huyện trong trường hợp có quyết định sáp nhập, chia tách đơn vị hành chính cấp tỉnh, cấp huyện của cơ quan nhà nước có thẩm quyền.

Điều 10. Cơ cấu tổ chức của Bảo hiểm xã hội Việt Nam

1. Ban Chế độ, chính sách bảo hiểm xã hội;

2. Ban Kế hoạch - Tài chính;

3. Ban Thu bảo hiểm xã hội;

4. Ban Chi bảo hiểm xã hội;

5. Ban Bảo hiểm xã hội tự nguyện;

6. Ban Giám định y tế;

7. Ban Tuyên truyền bảo hiểm xã hội;

8. Ban Hợp tác quốc tế;

9. Ban Tổ chức cán bộ;

10. Ban Kiểm tra;

11. Văn phòng;

12. Trung tâm nghiên cứu khoa học bảo hiểm xã hội;

13. Trung tâm Công nghệ thông tin;

14. Trung tâm Đào tạo và bồi dưỡng nghiệp vụ bảo hiểm xã hội;

15. Trung tâm Lưu trữ;

16. Báo Bảo hiểm xã hội;

17. Tạp chí Bảo hiểm xã hội.

Tổng Giám đốc quy định chức năng, nhiệm vụ, quyền hạn, cơ cấu tổ chức, biên chế; bổ nhiệm, miễn nhiệm, khen thưởng, kỷ luật cán bộ quản lý của các đơn vị quy định tại Điều này.

Tổng Giám đốc có trách nhiệm tổ chức lại bảo hiểm y tế tại một số ngành hiện có.

Điều 11. Hiệu lực thi hành

Nghị định này có hiệu lực sau 15 ngày, kể từ ngày ký.

Bãi bỏ Nghị định số 19/CP ngày 16 tháng 02 năm 1995 của Chính phủ về việc thành lập Bảo hiểm xã hội Việt Nam; Điều 5, Điều 25, khoản 2 Điều 26, và các Điều 27, 28, 29 của Điều lệ Bảo hiểm y tế ban hành kèm theo Nghị định số 58/1998/NĐ-CP ngày 13 tháng 8 năm 1998 của Chính phủ; Quyết định số 606/TTg ngày 26 tháng 9 năm 1995 của Thủ tướng Chính phủ về việc ban hành Quy chế tổ chức và hoạt động của Bảo hiểm xã hội Việt Nam và các quy định trước đây trái với Nghị định này.

Điều 12. Trách nhiệm thi hành

Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương, Chủ tịch Hội đồng quản lý và Tổng Giám đốc Bảo hiểm xã hội Việt Nam chịu trách nhiệm thi hành Nghị định này.

DECREE

PRESCRIBING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF VIETNAM SOCIAL INSURANCE

THE GOVERNMENT

Pursuant to the Law on Organization of the Government of December 25, 2001;
At the proposals of the Minister of the Interior and the general director of Vietnam Social Insurance,

DECREES:

Article 1.- Position and functions of Vietnam Social Insurance

Vietnam Social Insurance is a non-business agency attached to the Government and has the function of implementing the social insurance and medical insurance policies and regimes (hereinafter referred collectively to as the social insurance) and managing the social insurance fund according to the provisions of law.

Article 2.- Tasks and powers of Vietnam Social Insurance

a/ Strategy for development of Vietnams social insurance service and long-term and five-year plans on the implementation of social insurance policies and regimes.

b/ Scheme for preservation of value and development of the social insurance fund.

2. To direct and organize the implementation of social insurance policies and regimes; to collect compulsory and voluntary social insurance premiums; to pay social insurance subsidies to subjects participating in the social insurance in a full and convenient manner and within the prescribed time limits according to the provisions of law;

3. To issue assorted social insurance books and/or cards;

4. To manage the social insurance fund on the principle of centralism and uniformity under the States financial regime, independent accounting and protection by the State;

5. To propose to the Government, the Prime Minister and the relevant State agencies amendments and/or supplements to social insurance policies and regimes, as well as the fund management mechanism and financial management mechanism (including expenses for management of apparatus of Vietnam Social Insurance), and organize the implementation thereof after they are approved;

6. To promulgate documents guiding the application of the social insurance regimes and the social insurance revenue and expenditure operations according to its competence; to manage internal affairs of Vietnam Social Insurance service;

7. To sign contracts with lawful medical examination and treatment establishments to serve insurance book or card holders according to the provisions of law;

8. To inspect the signing of contracts and social insurance revenue and expenditure operations by agencies, units and organizations employing laborers, individuals and medical examination and treatment establishments; to request the competent State agencies and the superior bodies of the labor-employing units or medical examination and treatment establishments to handle acts of violating the social insurance legislation;

10. To pay compensations for all revenue and expenditure amounts made in contravention of law provisions on social insurance regimes to subjects participating in social insurance;

11. To settle complaints and denunciations of organizations and individuals about the implementation of social insurance policies and regimes according to the provisions of law;

12. To archive dossiers of subjects participating in social insurance and enjoying social insurance regimes according to the provisions of law;

13. To organize the scientific research and application; to apply information technology to the management and administration of social insurance activities;

14. To organize the training and fostering of social insurance professional skills;

15. To organize the work of information, propagation and dissemination of social insurance policies and regimes;

16. To undertake international cooperation on social insurance according to the provisions of law;

17. To assume the prime responsibility and coordinate with the State agencies, socio-political organizations and social organizations at the central and local levels, and the parties participating in social insurance in settling matters related to the implementation of social insurance policies and regimes according to the provisions of law;

18. To manage organization, personnel, public servants and State employees, finance and assets of Vietnam Social Insurance according to the provisions of law;

Article 3.- The organizational system of Vietnam Social Insurance

Vietnam Social Insurance is organized and managed according to professional insurance system in a centralized and unified manner from the central to local levels, and consists of:

1. Vietnam Social Insurance at the central level;

2. Social insurance agencies in the provinces and centrally-run cities (hereinafter referred collectively to as the provincial social insurance agencies) under Vietnam Social Insurance.

3. Social insurance agencies in rural districts, urban districts, provincial capitals and provincial cities (hereinafter referred collectively to as the district social insurance agencies) under provincial social insurance agencies.

Article 4.- Tasks of the Management Board of Vietnam Social Insurance

The Management Board of Vietnam Social Insurance (hereinafter referred to as the Management Board) assists the Prime Minister in performing the following tasks:

1. Directing, supervising and inspecting the revenues, expenditures and management of the social insurance fund;

2. Approving annual revenue and expenditure estimates and settlements of the social insurance fund;

4. Proposing the Prime Minister to appoint and dismiss the general director and deputy general directors of Vietnam Social Insurance.

Article 5.- Structure of the Management Board

1. The Management Board is composed of representatives of the leaderships of the Ministry of Finance, the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Health, the Vietnam Labor Confederation, and the general director of Vietnam Social Insurance. Members of the Management Board shall represent their own agencies to take part in the Management Boards works, discuss and vote on the Management Boards operations.

2. The Management Board has its chairman, one deputy chairman and members appointed and dismissed by the Prime Minister at the proposal of the Minister of the Interior.

Article 6.- Working regime of the Management Board

1. The Management Board shall work on a collective basis; meet once every three months to consider and decide on matters falling within its tasks and powers provided for in Article 4 of this Decree.

2. The Management Board may hold extraordinary meetings to solve urgent problems when so requested by its chairman or the general director or over a half of the total number of its members.

3. The Management Boards meetings must be attended by at least two thirds of its members. The Management Boards resolutions must be voted for by the majority of its members present at the meetings. Matters on which the opinions of the Management Boards members remain divergent shall be reported by its chairman to the Prime Minister for decision.

4. In its operation, the Management Board shall use the assisting apparatus, funding and seal of Vietnam Social Insurance.

Article 7.- The general director of Vietnam Social Insurance

1. The general director is the legal-person representative of Vietnam Social Insurance and appointed by the Prime Minister at the proposal of the Management Board. The general director shall be answerable to the Prime Minister and the Management Board for implementing the social insurance policies and regimes and managing the social insurance fund according to the provisions of law and performing the tasks prescribed in Article 2 of this Decree.

2. The general director is assisted by the deputy general directors; the deputy general directors are assigned by the general director to direct a number of working domains and answerable to the general director for their assigned tasks. When the general director is absent, a deputy general director authorized by the general director shall lead the operation of Vietnam Social Insurance.

The deputy general directors shall be appointed and dismissed by the Prime Minister at the proposals of the Management Board and the general director.

Article 8.- Working regime and responsibilities of the general director

1. The general director shall work according to the single-boss regime, ensuring the principle of democratic centralism; promulgate the working regulation of Vietnam Social Insurance, and direct and inspect the observance thereof.

2. The general director shall assign or authorize the deputy general directors to solve matters under his/her competence. The general director shall be responsible for decisions of the deputy general directors assigned or authorized to solve such matters.

3. The general director shall have the following responsibilities:

a/ To prepare contents prescribed in Article 4 of this Decree for approval by the Management Board, and organize the implementation of the Management Boards resolutions;

c/ To make decisions on works under Vietnam Social Insurances management and be responsible for such decisions; decide on specific measures to enhance the observance of discipline and administrative order by officials, public servants and employees of Vietnam Social Insurance; and to combat corruption, wastefulness and all manifestations of bureaucracy and authoritarianism in the service;

d/ To be disciplined for his/her managerial misconducts, which result in corruption and negative acts, causing serious damage to bodies and units under Vietnam Social Insurances management;

e/ To organize the enforcement of State management regulations on social insurance. Upon proposing to the Prime Minister matters related to State management functions of a ministry or ministerial-level agency, he/she must obtain written opinions of the minister or the head of such agency.

f/ To coordinate with the presidents of the People’s Committees of the provinces and centrally-run cities in organizing the implementation of social insurance policies and regimes in their respective localities according to the provisions of law;

g/ To coordinate with the heads of trade union organizations and other social organizations at the central level and in the provinces and centrally-run cities in performing the tasks of Vietnam Social Insurance; create conditions for the said organizations to operate and participate in the management.

Article 9.- Organization of provincial and district social insurance agencies

1. Provincial and district social insurance agencies are organized and operate according to the general directors regulations;

2. Provincial and district social insurance agencies have the legal person status, their own seals, accounts and offices;

3. The general director shall prescribe the functions, tasks, organizational structure, payrolls, appointment, dismissal, commendation and discipline of managerial officials and provide for operation funding of provincial and district social insurance agencies; decide on the establishment and dissolution of provincial and district social insurance agencies in cases where competent State agencies issue decisions on merger or division of provincial- or district-level administrative units.

The general director prescribes the functions, tasks, powers, organizational structure and payrolls; appoint, dismiss, commend and/or discipline managerial officials of the units defined in this Article.

The general director shall have to re-organize medical insurance in some branches where exists this form of insurance.

This Decree takes effect 15 days after its signing.

To annul the Governments Decree No. 19/CP of February 16, 1995 on the establishment of Vietnam Social Insurance; Articles 5 and 25, Clause 2 of Article 26, and Articles 27, 28 and 29 of the Medical Insurance Regulation promulgated together with the Governments Decree No. 58/1998/ND-CP of August 13, 1998; the Prime Ministers Decision No. 606/TTg of September 26, 1995 promulgating the Regulation on organization and operation of Vietnam Social Insurance and the previous stipulations which are contrary to this Decree.

Article 12.- Implementation responsibility

The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the presidents of the People’s Committees of the provinces and centrally-run cities, the chairman of the Management Board and the general director of Vietnam Social Insurance shall have to implement this Decree.
