CIRCULAR

ON ROADMAP FOR APPLICATION OF BORDER CHECKPOINTS FOR IMPORT AND EXPORT IN CASE OF GOODS FOR TEMPORARY IMPORT FOR RE-EXPORT, TRANSIT OR STORAGE IN BONDED WAREHOUSES

Pursuant to Law on Foreign Trade Management dated June 12, 2017;

Pursuant to Decree No. 98/2017/ND-CP dated August 18, 2017 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 69/2018/ND-CP dated May 15, 2018 of Government on elaborating to a number of Articles of Law on Foreign Trade Management;

Pursuant to Decree 112/2014/ND-CP dated November 21, 2014 of Government on management of border checkpoint on land;

At the request of Director General of Export-Import Agency,

Minister of Industry and Trade promulgates Circular on roadmap for application of border checkpoints for import and export in case of goods for temporary import for re-export, transit or storage in bonded warehouses.

This Circular prescribes roadmap for application of border checkpoints for import and export in case of goods for temporary import for re-export, transit or storage in bonded warehouses.

Article 2. Regulated entities

1. Traders participating in temporary import for re-export, transit and storage in bonded warehouses.

2. Organizations and agencies managing temporary import for re-export, transit and storage in bonded warehouses.

3. Organizations and agencies related to temporary import for re-export, transit and storage in bonded warehouses.

Article 3. Regulations on border checkpoints for import and export

1. If goods for temporary import for re-export and transit are imported or re-exported out of Vietnam via terrestrial border, the import or re-export must be implemented at international border checkpoints or primary border checkpoints (bilateral border checkpoints) opened according to Decree No. 112/2014/ND-CP dated November 21, 2014 of Government on management of terrestrial border checkpoints.

2. Regulations under Clause 1 of this Article are applied to foreign goods temporarily imported for re-exported and sent to bonded warehouses if the goods are imported or re-exported out of Vietnam via terrestrial bonded warehouses.

3. Regulations under Clause 1 and Clause 2 of this Article shall be applicable from 12 p.m of January 1, 2021.

1. This Circular comes into force from June 30, 2020.

2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Industry and Trade for consideration./.
