CIRCULAR
PROMULGATING NATIONAL TECHNICAL REGULATION ON ELECTRIC
BICYCLES
Pursuant
to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant
to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 elaborating
some Articles of the Law on Standards and Technical Regulations;
Pursuant
to the Government's Decree No. 107/2012/ND-CP dated December 20, 2012 defining
the functions, tasks, powers and organizational structure of the Ministry of
Transport;
At the
request of the Director General of the Department of Science and Technology and
the Director General of Vietnam Register;
The
Minister of Transport hereby promulgates National technical regulation on
electric bicycles,

1. Promulgated together with this Circular
is the National technical regulation on electric bicycles.

39/2013/TT-BGTVT dated November 01, 2013 by the Minister of Transport.
NATIONAL TECHNICAL REGULATION ON ELECTRIC BICYCLES
1. GENERAL PROVISIONS
Scope
This
Regulation provides for requirements for technical quality and safety and
test methods for electric bicycles.
1.2.
Regulated entities
This
Regulation applies to agencies, organizations and individuals involved in
production, assembly, import, inspection, testing, management and certification
of technical quality and safety of electric bicycles.

Vehicle
that works using a direct current engine is hereinafter referred to as Electric
engine-powered vehicle.
Vehicle
that works using a pedal-assist system using a direct current engine is
hereinafter referred to as Electrically power assisted vehicle.
2. TECHNICAL REGULATIONS
2.1.
Technical requirements
2.1.1.
General requirements
2.1.1.1. Vehicle
and its parts must conform to technical documentation and requirements
specified in this Regulation.
2.1.1.2. Fixed
mechanism of the Vehicle must be securely inserted in designated positions. There
should be no collision or friction between the moving and fixed mechanisms.
2.1.1.3.
Parts of the Vehicle that may come into contact with the rider or bystanders
must not have any protrusions or sharp edges.
2.1.1.4.
The Vehicle must be equipped with a headlamp, rear reflector, audible warning
device, and power level display device.

2.1.1.6.
The saddle pillar (if fitted) shall be height-adjustable and contain a
permanent mark that clearly indicates the minimum insertion depth of the pillar
into the frame. The minimum insertion depth shall be not less than 2 times the
saddle pillar diameter from the point of insertion.
2.1.2. The
kerb weight (including the weight of batteries) of the Vehicle must conform to
technical documentation and not exceed 40 kg.
2.1.3.
Electric engine of Vehicle
The
electric engine power of the Vehicle must conform to technical documentation
and not be greater than 250 W.
2.1.4.
The maximum speed of the Vehicle must conform to technical documentation and
not be greater than 25 km/h.
2.1.5.
Operation by pedaling mechanism of the Vehicle
When
operated by pedaling mechanism, the Vehicle must be capable of traveling a
distance of 7 km in no more than 30 minutes.
2.1.6. Constant
distance traveled by the Vehicle (only applicable to Electric engine-powered
vehicle)
When
operated by electric engine, the Vehicle must travel a constant distance of at
least 45 km.

2.1.8.
Batteries of Vehicle
The total
nominal voltage of the batteries shall not exceed 48 V. The battery voltage
shall not be less than the nominal voltage and shall not exceed 15% of the
nominal voltage.
2.1.9. Power
system of Vehicle
2.1.9.1.
Power system components must be inserted in the designated position and with
the correct polarity. Electrical wiring must be insulated and securely mounted
and must not rub against other moving parts of the Vehicle. Electrical wire
connectors must be sealed.
2.1.9.2.
After the water resistance test, the Vehicle must operate normally.
2.1.9.3.
The frame, handlebar, battery box and engine housing must be insulated. The
insulation resistance of these parts shall not be less than 2 MW.
2.1.9.4.
Electric control unit of Vehicle
The
electric control unit must have the following features:
a) Cut
off power to the engine when applying the brakes (applicable only to Electric
engine-powered vehicle).

c)
Provide undervoltage or overcurrent protection.
2.1.10.
Braking system of Vehicle
2.1.10.1.
The Vehicle shall be equipped with two independent braking systems. One shall
operate on the front wheel and one on the rear wheel.
2.1.10.2.
The braking distance must not exceed 4 m.
2.1.11.
Operation on road
After
traveling a distance of 10 km under full load conditions, at the maximum possible
speed for an Electric engine-powered vehicle or at a speed of 25 km/h for an Electrically
power assisted vehicle, the Vehicle's electric control unit must control the
Vehicle's speed stably and reliably. Parts of the Vehicle must meet technical
specifications and be free of damage, cracks or breaks. No leakage of solution
of batteries or lubricating oil is permitted at the joints.
2.2.
Test methods
2.2.1. Testing of the general requirements specified in
2.1.1 of this Regulation shall be conducted by direct observation and
specialized equipment. Permissible
tolerances on dimensions: ± 30 mm in length and height, ± 20 mm in width.
2.2.2.
The kerb weight (including the weight of batteries) specified in 2.1.2 of this
Regulation shall be tested by scale. Permissible tolerance: ± 10 %.

2.2.4. Maximum
speed of the Vehicle (only applicable to Electric engine-powered vehicle) specified
in 2.1.4 of this Regulation shall be tested as follows:
a) Test
conditions
- Rider’s
weight: 75 kg; if the rider’s weight is less than 75 kg, more load may be added
to reach the weight of 75 kg.
- Test
environment:
+ Ambient
temperature: ≤ 35 °C;
+ Wind
speed: ≤ 3 m/s;
- Test
road surface: flat and dry asphalt or cement concrete road surface with an
adhesion coefficient j not less than 0.6.
- Vehicle
preparation:
+ Tyres
are inflated to the manufacturer's recommended pressure;

b)
Procedure
- Mark a
measured distance of 100 m on the test road;
- The
Vehicle must be accelerated to the maximum possible speed from a standing start
over the measured distance and maintained at this maximum speed over the
measured distance;
- Measure
the time it takes the Vehicle to travel the measured distance;
- Operate
the Vehicle in the opposite direction and repeat the above sequence;
- Calculate
the maximum speed of the Vehicle according to the formula: V = 720/t
Where:
V: speed
of the Vehicle (km/h);
t: total
time for the Vehicle to travel the measured distance in both directions (s).

2.2.5.
Operation by pedaling mechanism of the Vehicle specified in 2.1.5 of this
Regulation shall be tested as follows:
a) Test
conditions: according to 2.2.4.a of this Regulation (except for the
requirements for charging batteries).
b)
Procedure: Measure and record the time it takes the Vehicle to travel a
distance of 7 km when operated solely by pedaling (without electric power
source).
2.2.6. Constant
distance traveled by the Vehicle specified in 2.1.6 of this Regulation shall be
tested as follows:
a) Test
conditions: according to 2.2.4.a of this Regulation.
b)
Procedure: Allow the Vehicle to run constantly at the highest possible speed. Stop
the Vehicle and the test will end when:
- The
Vehicle has travelled a distance of 45 km; or
- The
protection mechanism cuts off the power due to voltage drop when the vehicle
has not fully traveled a distance of 45 km, record the distance traveled.
2.2.7.
Electricity consumption of the Vehicle specified in 2.1.7 of this Regulation
shall be tested as follows:

- The
following formula shall be applied to calculate the electricity consumption in
100 km:

2.2.8. Battery
voltage of the Vehicle specified in 2.1.8 of this Regulation shall be tested as
follows: Fully charge the batteries according to the manufacturer's specifications,
let it be for 2 hours, and measure the battery voltage with a specialized
electrical measuring instrument.
2.2.9.
Testing of power system of Vehicle
2.2.9.1.
Inspect the insertion of power system components by observation.

2.2.9.3.
Isolation resistance specified in 2.1.9.3 of this Regulation shall be tested
using a megohmmeter. Parts to be tested include frame, handlebar, battery
box and engine housing.
2.2.9.4. The
feature “cut off power to the engine when applying brakes” (not applicable to
Electrically power assisted vehicle) specified in 2.1.9.4.an of this Regulation
shall be tested as follows:
Allow the
Vehicle's engine to operate, apply the brakes and use a multimeter to check
whether the power supply to the engine is disconnected.
2.2.9.5.
The feature “cut off power assistance of the Electrically power assisted
vehicle when pedaling stops or when the Vehicle reaches a speed of more than 25
km/h” specified in 2.1.9.4.b of this Regulation shall be tested as follows:
Use a
multimeter to check whether the power supply to the engine is disconnected when
pedaling stops or when the Vehicle reaches a speed of more than 25 km/h.

a)
Gradually reduce the voltage supplied to the Vehicle until the undervoltage protection
feature works. Record the value of protection voltage.
b)
Gradually increase the load on the electric engine until the overcurrent
protection feature works. Record the value of protection current.
2.2.10.
The breaking distance specified in 2.1.10.2 of this Regulation shall be tested
as follows:
a) Test
conditions: according to 2.2.4.a of this Regulation.
b)
Procedure:
+ Allow
the Vehicle to run at the maximum speed for an Electric engine-powered vehicle
or at a speed of 25 km/h for an Electrically power assisted vehicle, use a
speedometer to determine this speed;
+
Simultaneous apply a force to both front and rear brakes (at the same time,
stop pedaling in case of Electrically power assisted vehicle). Record the
braking distance from the moment the driver applies a force to the brake
mechanism until the Vehicle stops.
Carry out
3 consecutive tests. The test result is the mean value of the braking distance
after 3 tests.
2.2.11. Operation
on road specified in 2.1.11 of this Regulation shall be tested as follows:

+ Test
environment, test road surface, Vehicle preparation: according to 2.2.4.a of
this Regulation;
+ Full
load (gross weight) according to technical documentation.
b)
Procedure:
Allow the
Vehicle to completely run over the 10 km at the maximum possible speed for an
Electric engine-powered vehicle or at a speed of 25 km/h for an Electrically
power assisted vehicle.
3. MANAGEMENT REGULATIONS
3.1.
Inspection and testing methods
Electric
bicycles produced, assembled and newly imported must be inspected, tested and
certified according to Circular of the Minister of Transport providing for
inspection of technical quality and safety of electric bicycles.
3.2.

3.2.2.
Requirements for test samples
The
number of test samples necessary for conducting tests according to this
Regulation is 01 test Vehicle plus 01 battery pack to test the constant
distance traveled.
3.3.
Test report
The
testing facility must prepare a test report containing at least the details
specified in section 2 of this Regulation.
3.4.
Application of regulations
In cases
where any of the documents or materials referred to in this Regulation is
changed, supplemented, converted or replaced, the regulations in the newest one
shall apply.
4. ORGANIZING IMPLEMENTATION
4.1.
Road map for implementation
This
Regulation comes into force from January 01, 2014.

Vietnam
Register shall organize the implementation of this Regulation during inspection
of technical quality and safety of electric bicycles produced, assembled and
imported.
