PROVIDING FOR LIST OF POTENTIALLY UNSAFE COMMODITIES UNDER
THE MANAGEMENT OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS
Pursuant to the Law on
Quality of Products and Goods dated November 21, 2007;
Pursuant to the Law on
Telecommunications dated November 23, 2009;
Pursuant to the Law on
Radio Frequencies dated November 23, 2009, Law dated November 09, 2022 on
Amendments to some Articles of the Law on Radio Frequencies;
Pursuant to the Law on
Information Technology dated June 29, 2006;
Pursuant to the
Government's Decree No. 132/2008/ND-CP dated December 31, 2008
elaborating the Law on Quality of Products and Goods, Government’s Decree
No. 74/2018/ND-CP dated May 15, 2018 on amendments to some Articles

At the request of
Director General of Department of Science and Technology,
The Minister of
Information and Communications hereby promulgates a Circular providing for list
of potentially unsafe commodities under the management of the Ministry of
Information and Communications.
Article 1. Scope
1. This Circular provides
for the list of potentially unsafe commodities under the management of the
Ministry of Information and Communications (hereinafter referred to as “the
List of category 2 commodities”) and rules for management of category 2
commodities.
2. This Circular only
applies to commodities whose HS codes and descriptions are provided in the List
of category 2 commodities.
Article 2. Regulated
entities
This Circular applies to:
1. Organizations and
individuals involved in production and sale of commodities on the List of
category 2 commodities in Vietnam.
2. Organizations and
individuals whose activities involve management of quality of commodities on
the List of category 2 commodities in Vietnam.

1. List of category 2
commodities and methods for management thereof:
a) “The list of
information technology and communications commodities subject to certification
and declaration of conformity” is provided in the Appendix I hereof.
b) “The list of
information technology and communications commodities subject to declaration of
conformity” is provided in the Appendix II hereof.
2. The Ministry of
Information and Communications shall review and modify the list of group 2
commodities from time to time to make it conformable with the State’s
management policy.
Article 4. Rules for
management of category 2 commodities
1. Quality of commodities
on the List of category 2 commodities shall be managed in accordance with
regulations of the Ministry of Information and Communications on certification
and declaration of conformity and inspection of quality of information
technology and communications commodities, and respective technical
regulations.
2. If part of a commodity
on the List of category 2 commodities is another commodity on the same List, it
is required to certify and declare its conformity with all technical
regulations applicable to such commodity.
3. Commodities on the
List of category 2 commodities are governed by two or more national technical
regulations, certification and declaration of their conformity shall be carried
out according to such technical regulations.
4. If provisions of a
technical regulation on conformity certification/declaration that is
promulgated before the effective date of this Circular are different from those
of this Circular, regulations of this Circular shall prevail.

Article 5.
Implementation clause
1. This Circular comes
into force from July 15, 2023.
2. The Circular
No. 02/2022/TT-BTTTT dated May 14, 2020 of the Minister of Information and
Communications shall cease to have effect from the effective date of this
Circular.
3. The certificate of
conformity or notification of receipt of declaration of conformity that is
issued before the effective date of this Circular and remains effective shall
continue to be used until the effective date of a new technical regulation
replacing the technical regulation or standard specified in such certificate of
conformity or notification of receipt of declaration of conformity.
Article 6. Implementary
organization
1. Chief of Office,
Director of Department of Science and Technology, heads of affiliates of the
Ministry of Information and Communications and relevant organizations and
individuals are responsible for the implementation of this Circular.
2. During the application
of technical regulations and measurement and testing, organizations and
individuals shall promptly report difficulties and follow the guidelines laid
down by the Department of Science and Technology (affiliated to the Ministry of
Information and Communications).
3. The Ministry of
Information and Communications shall cooperate with the General Department of
Vietnam Customs (affiliated to the Ministry of Finance) in resolving any issue
that arises from assigning HS codes to imports that are potentially unsafe
commodities within the scope of this Circular./.

explosion-proof communication equipment.
(b) Imported radar
equipment used on sea-going vessels is exempted from quality inspection as
prescribed in the Government’s Resolution No. 99/NQ-CP dated November
13, 2019, but it is still necessary to declare conformity before such equipment
is put into use.
(c) Short-range radio
transmitters and transceivers are short-range radio devices prescribed in the
Circular of the Minister of Information and Communications on the List of radio
equipment which is exempt from a radio frequency license, with technical and operational
conditions attached. Short-range transmitters and transceivers exclude
receive-only radio equipment; radio transceivers operating in the 2.4 GHz band
and using spread spectrum modulation techniques, and having an equivalent
isotropically radiated power of less than 60 mW; radio access equipment
operating in the 5 GHz band and having an equivalent isotropically radiated
power of less than 60 mW. It is only necessary to certify and declare
conformity if the equipment meets the prescribed frequency band, technical
conditions and operational conditions.
